Summary
Eelnõu muudatuste eesmärk on anda konkurentsiametile (KA) selged õiguslikud alused koostööks Euroopa Komisjoniga digiturgude määruse ja välisriigi subsiidiumide määruse rakendamisel. Kuigi mõlemad määrused Eestis juba kehtivad, täpsustab eelnõu konkurentsiameti volitusi ja loob nende rakendamiseks selgema riigisisese raamistiku. Mõlema määruse kohaselt on komisjonil ulatuslikud volitused, mille kohaldamisel võib komisjon paluda liikmesriigi abi. Eelnõuga sätestatakse, et KA võib osutuda komisjonile abi EL määrustes sätestatud juhtudel ettevõtjate suhtes kontrollide läbiviimisel ja neile teabenõude esitamisel. Samuti saab KA kaasata politsei ametiabi korras, kui määruse alusel viidava kontrolli raames on vaja kohaldada vahetut sundi. Digiturgude määruse puhul luuakse KA jaoks lisaks volitus toetada vajadusel Euroopa Komisjoni turu-uuringuid ja alustada määruses sätestatud pääsuvalitsejate kohustuste võimaliku täitmata jätmise suhtes Eestis konkurentsijärelevalvemenetlus, mille komisjon saab hiljem üle võtta. Mõlemad EL määrused puudutavad väga suuri ettevõtjaid. Digiturgude määrus puudutab eelkõige internetis nn pääsuvalitsejaid, kes osutavad platvormiteenuseid, näiteks Alphabet, Amazon, Booking; välisriigi subsiidiumide määrus puudutab suuri ettevõtjaid, kelle käive ulatub 500 miljoni euroni ja üle. Eeldatav mõju Eesti ettevõtluskeskkonnale on väike.
