Après l’alinéa 1, insérer les trois alinéas suivants : « 1° A Le sixième alinéa de l’article 131‑21 est ainsi modifié : « a) Les mots : « porte également sur les » sont remplacés par les mots : « est obligatoire s’agissant des » ; « b) Sont ajoutées deux phrases ainsi rédigées : « Cette confiscation est motivée. Toutefois, la juridiction peut, par une décision spécialement motivée, décider de ne pas prononcer cette peine, en considération des circonstances de l’infraction et de la personnalité de son auteur. »
