BUFFER Act

Building Up Farmland Frontiers for Ecological Resilience Act or the BUFFER Act This bill provides that certain land (that is under state regulations) is eligible to participate under the Conservation Reserve Program (CRP). Under CRP, the Department of Agriculture provides annual payments to agricultural producers to take highly erodible and environmentally sensitive land out of production and install resource-conserving practices.   Specifically, land otherwise eligible under the program remains eligible for enrollment even if a tribal, state, or other local law, ordinance, or other regulation requires any resource-conserving or environmental protection measure or practice. The bill includes an exception that makes the land ineligible under the program if the implementation requirement has been imposed by an administrative order or a court order. Current regulations exclude from enrollment eligibility (with exceptions) land that is subject to tribal, state, or other local laws, ordinances, or other regulations that require any resource-conserving or environmental protection measures or practices.

Rural Community Hospital Demonstration Program Reauthorization This bill extends the Rural Community Hospital Demonstration Program for an additional five years. The program tests the feasibility of cost-based reimbursement under Medicare for small rural hospitals that are too large to qualify for special payment as critical access hospitals. The bill specifies that hospitals that participate in the program between December 30, 2024, and January 1, 2027, may continue to participate during the five-year extension period.

NO FAKES Act of 2026

Nurture Originals, Foster Art, and Keep Entertainment Safe Act of 2026 or the NO FAKES Act of 2026 This bill creates a federal intellectual property right to protect individuals from unauthorized digital replicas (e.g., digital content made using generative artificial intelligence) of their voice and visual likeness. Specifically, the bill gives each individual or right holder the right to authorize the use of the individual's voice or visual likeness (1) in a digital replica, or (2) for a product or service requiring authorization to avoid liability under the bill. This property right is not assignable during the individual’s lifetime but is licensable and does not expire upon the death of the individual. Generally, any individual or entity that engages in specified prohibited activities (e.g., distributing a digital replica without authorization) shall be liable in a civil action and subject to related penalties. The bill exempts specified uses from liability, such as categories of conduct likely to involve protected speech under the First Amendment (e.g., news reporting, sports broadcasts, and satire). The bill establishes (1) a notice-and-takedown process for unauthorized digital replicas; and (2) a counter-notification process, which allows an individual to contest the removal of a digital replica. The bill establishes penalties related to false or deceptive notice or counter-notice. The bill expressly preempts state laws related to digital replicas except for causes of action under state statutes or common law in existence as of January 2, 2025.

No War Appropriations through Reconciliation Act or the No WAR Act This bill establishes a budget point of order that prohibits considering reconciliation legislation that provides funding for unauthorized military force against Iran. (Reconciliation is an expedited method by which Congress may adopt changes in spending and revenue laws to achieve the budgetary goals reflected in a congressional budget resolution. Reconciliation bills are considered by Congress using expedited legislative procedures that prevent a filibuster and restrict amendments in the Senate.) Specifically, the point of order may be raised to prohibit the consideration of reconciliation legislation that provides budget authority for hostilities, including hostilities conducted by a proxy force, against Iran unless Congress has authorized such hostilities through a declaration of war or a specific authorization for use of military force. Under the bill, hostilities includes any offensive military operation, strike, covert action, or sustained engagement involving armed conflict against Iranian military forces, territory, or government institutions.  The point of order may be waived by a vote of at least three-fifths of all Senators duly chosen and sworn (60 votes if there are no vacancies).

Senior Hunger Prevention Act of 2026 This bill expands and modifies nutrition programs for older adults and adults with disabilities, including the Supplemental Nutrition Assistance Program (SNAP) and the Commodity Supplemental Food Program (CSFP). Under the bill, a household's eligibility for SNAP benefits may be certified for 36 months if all adult household members are elderly or disabled, an increase from 24 months. The bill also expands the SNAP medical expense deduction and increases the minimum allotment for households with one and two persons. The Department of Agriculture (USDA) must establish an elderly simplified application program that allows a state to implement a streamlined SNAP application and certification process for households where all adult household members are elderly or disabled and have no earned income. The bill also directs USDA to authorize public-private partnerships between USDA, retail food stores participating in SNAP, and community-based organizations to provide free or low-cost food delivery under SNAP, including through the use of private funds. Further, the bill reauthorizes CSFP, provides additional funding for the program, and expands eligibility to include low-income adults with disabilities. CSFP benefits may also be certified for 36 months. Currently, benefits may be certified for not less than one year, but not more than three years. The bill also expands eligibility for the Seniors Farmers Market Nutrition Program to include adults with disabilities, provide a 36-month certification period, and include minimum and maximum benefit amounts. Under the bill, USDA must also establish various related grant programs.
