The rule establishes a new joint employer standard for determining whether two employers simultaneously employ a particular employee or employees. Under the rule, an entity may be considered a joint employer of another employer's employees if the two share or codetermine the employees' essential terms and conditions of employment. The rule is currently scheduled to take effect on February 26, 2024.

Covered veterans are those who received VA hospital care or medical services during the five-year period preceding the death of the veteran. The VA shall report on the results of the review and make such report publicly available.

Farm to Fly Act of 2023 This bill directs the Department of Agriculture (USDA) to integrate the advancement of sustainable aviation fuels into its programs. Specifically, this bill includes sustainable aviation fuel as an advanced biofuel for the purposes of several USDA bioenergy programs that primarily provide support and incentives for renewable energy projects. For purposes of these programs, the bill defines sustainable aviation fuel as liquid fuel, the portion of which is not kerosene, which (1) meets specific international standards, (2) is not derived from coprocessing specific materials (e.g., triglycerides) with a non-biomass feedstock, (3) is not derived from palm fatty acid distillates or petroleum, and (4) is certified as having a lifecycle greenhouse gas emissions reduction percentage of at least 50% compared with petroleum-based jet fuel (based on specific standards and agreements). In addition, the bill specifically includes fostering and advancing sustainable aviation fuels as part of the Biorefinery, Renewable Chemical, and Biobased Product Manufacturing Assistance Program. Further, USDA must carry out a comprehensive and integrated pursuit of all USDA mission areas for the advancement of sustainable aviation fuels, including through the identification of opportunities to maximize the development and commercialization of the fuels, supporting rural economic development through improved sustainability for aviation, and advancing public-private partnerships.

Israel Security Supplemental Appropriations Act, 2024 This bill provides FY2024 supplemental appropriations to the Department of Defense (DOD) and the Department of State for activities to respond to the attacks in Israel. The bill designates the funding as emergency spending, which is exempt from discretionary spending limits. The bill provides appropriations to DOD for Operation and Maintenance; Procurement; and Research, Development, Test and Evaluation. The funding is provided for purposes such as replacing defense articles that were provided to Israel, reimbursing DOD for defense services and training provided to Israel, procuring Israel's Iron Dome and David's Sling defense systems, and developing Israel's Iron Beam defense system. The bill provides appropriations to the State Department for Diplomatic Programs, including Worldwide Security Protection; Emergencies in the Diplomatic and Consular Service; and the Foreign Military Financing Program. In addition, the bill includes provisions that expand the authorities of the President to transfer defense articles and services from DOD to Israel. Finally, the bill rescinds specified unobligated funds that were provided for activities of the Internal Revenue Service.

Pay Our Troops Act This bill provides continuing appropriations for military pay for any period during which interim or full-year appropriations for FY2024 are not in effect (i.e., a government shutdown). Specifically, the bill provides FY2024 continuing appropriations for the pay and allowances of (1) members of the Armed Forces, including reserve components, who perform active service during the period; and (2) civilian employees and contractors of the Department of Defense (and the Department of Homeland Security in the case of the Coast Guard when the Coast Guard is not operating as a service in the Department of the Navy) who are providing support to such members of the Armed Forces. If a government shutdown occurs, the bill provides the continuing appropriations until the earlier of (1) the enactment into law of specified appropriations legislation, or (2) January 1, 2025.

Pell Plus Act of 2023

Pell Plus Act of 2023 This bill establishes the Pell Plus program to award an additional Federal Pell Grant (i.e., a Federal Pell Plus Grant), which shall be matched by the participating institution of enrollment, to eligible students. A student is eligible to receive a Federal Pell Plus Grant if the student (1) is enrolled in their first undergraduate course of study at a Pell Plus institution, (2) is maintaining progress toward completion of their course of study in no more than four academic years, and (3) has completed at least four semesters (or the equivalent) of such course of study. Further, the bill outlines the requirements for an institution to participate as a Pell Plus institution, including that the institution must notify students whether they are maintaining progress toward completion of their course of study. The bill directs the Department of Education (ED) to award a Federal Pell Plus Grant to an eligible student in an amount equal to the student's Federal Pell Grant award. If the student's combined Federal Pell Grant and Federal Pell Plus Grant exceed the cost of attendance, then ED must reduce the amount of the student's Federal Pell Plus Grant. The bill specifies that these Federal Pell Plus Grants must count toward current duration limits.

AACE Act

Accelerating Appraisals and Conservation Efforts Act or AACE Act This bill relaxes requirements for the Department of the Interior in appraising and valuing real property for transactions over which Interior has jurisdiction. Specifically, a private real property appraiser needs only to be licensed or certified in one state to perform appraisal or valuation services for real property over which Interior has jurisdiction. Currently, if a private assessor is used for a real property transaction within Interior's jurisdiction, that assessor must be licensed or certified in the state where that transaction occurs.  When using private appraisers, Interior shall, to the maximum extent practicable, use private appraisers who are certified general real property appraisers licensed in the state where the transaction occurs. Additionally, Interior may use a private appraiser who is licensed outside the state in which the transaction occurs only if private appraisers licensed in that state are unavailable, not assignment qualified, or not cost competitive.

Stillbirth Health Improvement and Education for Autumn Act of 2023 or the SHINE for Autumn Act of 2023 This bill authorizes grants and establishes other programs to improve data collection on stillbirths. Specifically, the Department of Health and Human Services (HHS) may award grants for surveillance and data collection on stillbirths, and HHS must issue guidelines for health departments and vital statistics units concerning the collection of stillbirth data. HHS must also develop educational awareness materials about stillbirths and make them publicly available. Furthermore, HHS must implement a fellowship program to provide training in perinatal autopsy pathology and otherwise support research on stillbirths and fetal autopsies. The bill also requires HHS to issue a report with educational guidelines on stillbirths and stillbirth risk factors.

Tech to Save Moms Act

Tech to Save Moms Act This bill supports the use of technology to improve, and address disparities in, maternal health outcomes. Specifically, the Center for Medicare and Medicaid Innovation may test telehealth models to screen and treat common pregnancy-related complications for Medicaid enrollees. In addition, the Department of Health and Human Services (HHS) must award grants to evaluate and expand the use of technology-enabled collaborative learning models by entities that provide services to pregnant and postpartum individuals in medically underserved areas or from certain populations, and reduce racial and ethnic disparities in maternal health outcomes by increasing access to digital tools. HHS must also contract with the National Academies of Sciences, Engineering, and Medicine to study the use of technology in maternal health care.

If the training is scheduled outside of working hours, food service personnel must be informed about the necessity of scheduling the program and compensated for attending the program. Personnel may not be penalized for failing to attend a program outside of working hours.

Delivering for Rural Seniors Act of 2023

Delivering for Rural Seniors Act of 2023 This bill directs the Food and Nutrition Service (FNS) to award competitive grants to state agencies under a home delivery pilot program for participants in the Commodity Supplemental Food Program (CSFP). (The CSFP works to improve the health of low-income persons at least 60 years of age by supplementing their diets with nutritious Department of Agriculture foods.)  Under the pilot program, a state agency must distribute grant funds to an eligible entity (i.e., a local agency or subdistributing agency) to operate projects that facilitate home delivery of commodities to CSFP participants. Grant funds may be used for costs associated with transportation and distribution of commodities to CSFP participants, staffing required to operate home delivery services, and home delivery outreach to CSFP participants or potential participants. A state agency must prioritize eligible entities that serve CSFP participants who reside in rural areas. A state agency must also submit an annual report to FNS about the project, including best practices regarding the use of home delivery to improve the effectiveness of the CSFP.

Bring Animals Relief and Kibble Act of 2023 or the BARK Act of 2023 This bill provides civil and criminal liability protections for the donation of pet food and pet supplies under the Bill Emerson Good Samaritan Food Donation Act. (The act shields persons that donate and distribute food to nonprofit organizations from liability for injuries caused by those donated products, with exceptions.)  Specifically, the bill limits liability for persons or gleaners arising from the nature, age, packaging, or condition of food or pet supplies that are donated in good faith by the person or gleaner to a nonprofit organization, state, or local government for direct distribution to pets, service animals, or emotional support animals. Gleaner means a person who harvests for free distribution to the needy, or for donation to a nonprofit organization, an agricultural crop that has been donated by the owner. Further, the bill limits liability for a nonprofit organization, state, or local government arising from donated items received from a person or gleaner in good faith for direct distribution to pets, service animals, or emotional support animals.  The bill also specifies that the existing exception that permits a person, gleaner, or nonprofit organization to be held liable for acts or omissions that constitute gross negligence or intentional misconduct applies to the liability protections established by this bill.
