Hezbollah International Financing Prevention Act of 2014

Hezbollah International Financing Prevention Act of 2014 - States that it shall be U.S. policy to: (1) prevent Hezbollah's global logistics and financial network from operating in order to curtail funding of its domestic and international activities; and (2) utilize diplomatic, legislative, and executive avenues to combat Hezbollah's criminal activities in order to block that organization's ability to fund its global terrorist activities. Directs the President to report to Congress: (1) a list of satellite, broadcast, or other providers that knowingly transmit the content of al-Manar TV; and (2) the identity of those providers that have or have not been sanctioned pursuant to Executive Order 13224. Directs the Secretary of the Treasury to prohibit or impose strict conditions on the opening or maintaining in the United States of a correspondent account or a payable-through account by a foreign financial institution that knowingly: (1) facilitates the activities of Hezbollah or its agents, instrumentalities, affiliates, or successors; (2) facilitates the activities of a person acting on behalf of or owned or controlled by an agent, instrumentality, affiliate, or successor; (3) engages in money laundering to carry out such an activity; (4) facilitates a significant transaction or provides significant financial services to carry out such an activity, including services that involve a transaction of gold, silver, platinum, or other precious metals; or (5) facilitates any of these activities, conspires to facilitate or participate in such an activity, or is owned or controlled by a foreign financial institution that knowingly engages in such an activity. Directs the Secretary of the Treasury to prescribe reporting, information sharing, and due diligence requirements for domestic financial institutions that maintain a correspondent account or payable-through account in the United States for a foreign financial institution. Authorizes the Secretary to waive such requirements if in the U.S. national security interests, and with congressional notification. Directs the Secretary of the Treasury to identify to Congress every 180 days each foreign central bank that carries out an activity prohibited under this Act. Sets forth penalty requirements for specified violations under this Act. Directs the President to designate Hezbollah as: (1) a significant foreign narcotics trafficker if Hezbollah meets meets the criteria set forth under the Foreign Narcotics Kingpin Designation Act, and (2) a significant transnational criminal organization if Hezbollah meets the criteria set forth under specified executive orders and statutes. Requires the President to report to Congress which of these criteria the President determines that Hezbollah has not met, if it does not. Directs the Secretary of State to report to Congress regarding Hezbollah's involvement in the trade in rough diamonds outside of the Kimberly Process Certification Scheme. Declares that nothing in this Act shall apply to authorized U.S. intelligence activities. States that any requirement of this Act shall cease to be in effect 30 days after the President certifies to Congress that Hezbollah: (1) is no longer designated as a foreign terrorist organization; (2) is no longer listed in the Annex to Executive Order 13224 (blocking property and prohibiting transactions with persons who commit or support terrorism); and (3) poses no significant threat to U.S. national security, interests, or allies.

Guam Military Training and Readiness Act of 2014 - Authorizes the Secretary of the Navy to establish a surface danger zone over the Guam National Wildlife Refuge if its establishment will support the operation by the Department of the Navy of a live-fire training range complex on Andersen Air Force Base, Northwest Field, to support training and operations. Deems the operation of such complex and the associated surface danger zone to be authorized uses of the Refuge. Authorizes the Secretary to close to public use any road or trail within, or any portion of, such Refuge if military operations, public safety, or national security require such closure. Directs the Secretary to: (1) limit such a closure to the minimum appropriate area and period, and (2) post and maintain appropriate warning notices and notify the public before and for the duration of such a closure.

Amends the Sikes Act (conservation programs on federal lands) to allow funds appropriated to the Department of Defense (DOD) that are obligated to cooperative agreements with states, local governments, Indian tribes, nongovernmental organizations, and individuals for maintenance and improvement of natural resources located off of military or state-owned National Guard installations (but that are related to current or anticipated military activities) to be: paid in a lump sum and include an amount intended to cover the future costs of the activities under the agreement; invested by the recipient in accordance with the recipient's own investment management guidelines, with any investment interest or income permitted to be applied for the same purposes as the principal; and used only for the direct costs of maintaining and improving the natural resources and for certain indirect and administrative costs that do not exceed 10% of the total cost of the project. Allows such cooperative agreements to be used to acquire property or services for the direct benefit or use of the U.S. government. Prohibits amounts available to DOD from being used under such Act to acquire fee title interest in real property for such natural resources projects that are not on a military installation. Requires the Inspector General of DOD to conduct an audit of the natural resources projects funded with amounts available to DOD under the Sikes Act that are not on a military installation.

SGR Repeal and Medicare Provider Payment Modernization Act of 2014 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to: (1) end and remove sustainable growth rate (SGR) methodology from the determination of annual conversion factors in the formula for payment for physicians' services, (2) establish an update to the single conversion factor for 2014 through 2018 of 0.5%, (3) freeze the update to the single conversion factor at 0.00% for 2019 through 2023, and (4) establish an update of 1% for health professionals participating in alternative payment models (APMs) and an update of 0.5% for all other health professionals after 2023. Directs the Medicare Payment Advisory Commission (MEDPAC) to report to Congress on the relationship between: (1) physician and other health professional utilization and expenditures (and their rate of increase) of items and services for which Medicare payment is made; and (2) total utilization and expenditures (and their rate of increase) under Medicare parts A (Hospital Insurance), B (Supplementary Medical Insurance), and D (Voluntary Prescription Drug Benefit Program). Directs MEDPAC to report to Congress on: (1) the payment update for professional services applied under Medicare for 2014 through 2018; (2) the effect of such update on the efficiency, economy, and quality of care provided under such program; (3) the effect of such update on ensuring a sufficient number of providers to maintain access to care by Medicare beneficiaries; and (4) recommendations for any future payment updates for professional services under such program to ensure adequate access to care is maintained for Medicare beneficiaries Revises and consolidates components of the three specified existing performance incentive programs into a merit-based incentive payment system (MIPS) the Secretary of Health and Human Services (HHS) is directed to establish, under which MIPS-eligible professionals (excluding most Alternative Payment Model [APM] participants) receive annual payment increases or decreases based on their performance. Applies the MIPS program to payments for items and services furnished on or after January 1, 2018. Requires specified incentive payments to be made to eligible partial qualifying APM participants. Directs the Secretary to make available on the Physician Compare website of the Centers for Medicare & Medicaid Services (CMS) certain information, including information regarding the performance of MIPS-eligible professionals. Requires the Comptroller General (GAO) to evaluate the MIPS program. Requires GAO to submit to Congress a report that: (1) compares the similarities and differences in the use of quality measures under the original Medicare fee-for-service programs, the Medicare Advantage (MA) program under Medicare part C (Medicare+Choice), selected state Medicaid programs, and private payer arrangements; and (2) make recommendations on how to reduce the administrative burden involved in applying such quality measures. Directs GAO to report to Congress on: (1) whether entities that pool financial risk for physician services can play a role in supporting physician practices in assuming financial risk for treatment of patients; and (2) the transition to an APM of professionals in rural areas, health professional shortage areas, or medically underserved areas. Establishes the Payment Model Technical Advisory Committee to make recommendations to the Secretary on physician-focused payment models. Requires the Secretary to study: (1) the application of federal fraud prevention laws related to APMs; (2) the effect of individuals' socioeconomic status on quality and resource use outcome measures for individuals under Medicare; and (3) the impact of risk factors, race, health literacy, limited English proficiency (LEP), and patient activation, on quality and resource use outcome measures under Medicare. Directs the Secretary to: (1) post on the CMS Internet website a draft plan for the development of quality measures to assess professionals, (2) establish new Healthcare Common Procedure Coding System (HCPCS) codes for chronic care management services, and (3) conduct an education and outreach campaign to inform professionals who furnish items and services under Medicare part B and Medicare part B enrollees of the benefits of chronic care management services. Authorizes the Secretary to: (1) collect and use information on the resources directly or indirectly related to physicians' services in the determination of relative values under the Medicare physician fee schedule; and (2) establish or adjust practice expense relative values using cost, charge, or other data from suppliers or service providers. Revises and expands factors for identification of potentially misvalued codes. Sets an annual target for relative value adjustments for misvalued services. Phases-in of significant relative value unit (RVU) reductions. Directs GAO to study the processes used by the Relative Value Scale Update Committee (RUC) to make recommendations to the Secretary regarding relative values for specific services under the Medicare physician fee schedule. Makes Metropolitan Statistical Areas in California fee schedule areas for Medicare payments. Directs the Secretary to: (1) establish a program to promote the use of appropriate use criteria for certain imaging services furnished by ordering professionals and furnishing professionals, and (2) make publicly available on the CMS Physician Compare website specified information with respect to eligible professionals. Expands the kinds and uses of data available to qualified entities for quality improvement activities. Directs the Secretary to provide Medicare data to qualified clinical data registries to facilitate quality improvement or patient safety. Permits continuing automatic extensions of a Medicare physician and practitioner election to opt-out of the Medicare physician payment system into private contracts. Directs the Secretary to: (1) make publicly available through an appropriate publicly accessible website information on the number and characteristics of opt-out physicians and practitioners; and (2) report to Congress recommendations to amend existing fraud and abuse laws, through exceptions, safe harbors, or other narrowly targeted provisions, to permit gainsharing or similar arrangements between physicians and hospitals that improve care while reducing waste and increasing efficiency. Declares it a national objective to achieve widespread exchange of health information through interoperable certified electronic health record (EHR) technology nationwide by December 31, 2017, as a consequence of a significant federal investment in the implementation of health information technology through the Medicare and Medicaid EHR programs. Directs the Secretary to study the feasibility of establishing mechanisms that includes aggregated results of surveys of meaningful EHR users on the functionality of certified EHR products to enable such users to compare directly the functionality and other features of such products. Requires GAO studies on the use of telehealth under federal programs and on remote patient monitoring services.

Voting Rights Amendment Act of 2014 - Amends the Voting Rights Act of 1965 with respect to the requirement that a federal court retain jurisdiction for an appropriate period to prevent commencement of new devices to deny or abridge the right to vote. Expands the types of violations triggering the authority of a court to retain such jurisdiction to include certain violations of the Act as well as violations of any federal voting rights law that prohibits discrimination on the basis of race, color, or membership in a language minority group. Excludes from the list of violations triggering jurisdiction retention authority any voting qualification or prerequisite which results in a denial or abridgement of the right to vote that is based on the imposition of a requirement that an individual provide a photo identification as a condition of receiving a ballot for voting in a federal, state, or local election. Revises requirements for determining which states and political subdivisions are covered or not covered by criteria for declaratory judgments that they have not used devices to deny or abridge the right to vote. Subjects to the requirements for making such a determination any state (and all of its political subdivisions) during a calendar if 5 or more voting rights violations occurred in the state during the previous 15 years, at least one of which was committed by the state itself (as opposed to a political subdivision within it). Specifies application of such new coverage requirements to any specific political subdivision if: (1) 3 or more voting rights violations occurred in it during the previous 15 calendar years; or (2) 1 or more voting rights violations occurred in it during the previous 15 calendar years and the subdivision had persistent, extremely low minority turnout during that period. Provides that, if a state obtains a declaratory judgment that it has not used a device to deny or abridge the right to vote, the requirements for a new declaratory judgment generally will not apply, unless the new coverage requirements of this Act apply to the state solely on the basis of voting rights violations occurring after the declaratory judgment was issued. Prescribes transparency requirements, including reasonable public notice, regarding any changes to: (1) voting prerequisites, standards, or procedures; (2) polling place resources; or (3) demographics and electoral districts. Modifies authority to assign observers, including authorizing the assignment of observers to enforce bilingual election requirements. Revises requirements for injunctive relief, including its scope and the persons authorized to seek relief as well as the grounds for granting it.

Student Loan Borrowers' Bill of Rights Act of 2013

Student Loan Borrowers' Bill of Rights Act of 2013 - Removes educational loans from the list of debts that are non-dischargeable in bankruptcy. Amends title IV (Student Assistance) of the Higher Education Act of 1965 (HEA) to reinstate the six-year statute of limitations on the recovery by: institutions of higher education (IHEs) of refund amounts owed by students on grants made, or work assistance awarded, under title IV; guaranty agencies of amounts owed on loans made under the Federal Family Education Loan (FFEL) program; IHEs that have program participation agreements with the Secretary of Education of amounts owed under the William D. Ford Federal Direct Loan program or Federal Perkins Loans program; and the federal government of amounts owed by students on grants made under title IV or amounts owed by borrowers on loans made under title IV that have been assigned to the Secretary. Prohibits the collection of amounts individuals owe the Department of Education under title IV of the HEA through: (1) offsets of social security, railroad retirement, or black lung benefits; (2) offsets of tax refunds; or (3) wage garnishment. Amends the Internal Revenue Code to exclude discharged student loan debt from an individual's gross income. Excludes from gross income distributions from qualified tuition plans that are use to pay the interest or principal on student loans. Amends the HEA to make borrowers of PLUS loans made on behalf of dependent students under: the Direct Loan program eligible for income-contingent repayment plans, including plans based on the President's Pay As You Earn repayment initiative; the Direct Loan or FFEL programs eligible for income-based repayment plans that enable borrowers who have a partial financial hardship to make lower monthly payments; and the Direct Loan or FFEL programs eligible for loan forgiveness for service in areas of national need. Specifies the regulation to be used in determining whether individuals have an adverse credit history that disqualifies them from borrowing a Direct Plus loan (provided to graduate or professional students or the parents of dependent students). Prohibits evidence of an individual's default on a loan made, insured, or guaranteed under title IV of the HEA from being used in a federal or state proceeding involving the individual's professional or vocational license. Prohibits an IHE from blocking students' access to their student records at the IHE due to such students being in default on such loans. Directs the Secretary to cancel 50% of the balance of the interest and principal due on Direct loans that are not in default for borrowers who are employed in a public service job and make 60 monthly payments on such loans after October 1, 2013.

Viral Hepatitis Testing Act of 2013 - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS) to carry out surveillance, education, and testing programs with respect to hepatitis B (HBV) and hepatitis C (HCV) virus infections. Requires the Secretary to establish a national system with respect to HBV and HCV to: (1) determine the prevalence of such infections; (2) carry out testing programs to increase the number of individuals who are aware of their infection; (3) disseminate public information and education programs for the detection and control of such infections; (4) improve the training of health professionals in the detection, control, and treatment of such infections; and (5) provide referrals for counseling and medical treatment and ensure the provision of follow-up services. Directs the Secretary to determine the populations that are considered at high risk. Directs the Secretary to establish and support public-private partnerships that facilitate such HBV and HCV surveillance, education, screening, testing, and linkage to care programs. Requires the Director of the Agency for Healthcare Research and Quality (AHRQ) to convene the Preventive Services Task Force every three years to review its recommendation for HBV and HCV screening. Directs the Secretary of Veterans Affairs (VA) to establish and carry out a plan to provide veterans who were born between 1945 and 1965 with an HBC risk assessment and, if they are diagnosed with such virus, a thorough evaluation of, and information regarding, their need for treatment, vaccination, or other therapy. Requires the VA to use compliance with such plan as a key performance measure under the VA Handbook Performance Management System or its successor, including by giving the director of a VA medical facility that is not fully compliant a less than fully successful performance appraisal.

Know Before You Owe Private Student Loan Act of 2013 - Amends the Truth in Lending Act to require a lender, before issuing a private education loan for a student attending an institution of higher education (IHE), to obtain the IHE's certification of: (1) the student's enrollment status, (2) the student's cost of attendance, and (3) the difference between that cost and the student's estimated financial assistance. Eliminates the requirement that such lenders obtain a self-certification form from the private education loan applicant. Allows a lender to issue such loan without a certification if there is no response from the relevant IHE within 15 business days of the lender's request for the certification. Requires private educational lenders to: (1) send loan statements to borrowers at least once every three months a student is enrolled at an IHE; (2) notify the relevant IHE, in writing, of the loan amount and the student to whom it applies no later than the date funds are issued; and (3) submit an annual report to the Bureau of Consumer Financial Protection (CFPB) containing information the CFPB requires concerning private student loans. Amends title IV (Student Assistance) of the Higher Education Act of 1965 to require IHEs, before providing lenders with certifications, to determine whether students have exhausted their options for title IV assistance and notify borrowers of: (1) the availability of such assistance, (2) their ability to choose their own private educational lender, (3) the impact of the proposed private education loan on their eligibility for other financial assistance, and (4) their right to accept or reject a private education loan within 30 days of the lender's approval of their application and to cancel the loan within 3 business days of its consummation.

Permits such an alien to travel abroad if the alien establishes to the satisfaction of the Secretary that emergency and extenuating circumstances beyond the alien's control require his or her departure for a brief, temporary trip abroad.

Homeowner Flood Insurance Affordability Act of 2013 - Prohibits the Administrator of the Federal Emergency Management Agency (FEMA) from: (1) increasing flood insurance risk premium rates to reflect the current risk of flood for certain property located in specified areas subject to a certain mandatory premium adjustment, or (2) reducing such subsidies for any property not insured by the flood insurance program as of July 6, 2012, or any policy that has lapsed in coverage as a result of the policyholder's deliberate choice (Pre-Flood Insurance Rate Map or pre-FIRM properties). Sets forth expiration dates for such prohibitions. Amends the National Flood Insurance Act of 1968 (NFIA) to prohibit the Administrator from providing flood insurance to prospective insureds at rates less than those estimated for any property purchased after the expiration of such six-month period (currently, any property purchased after July 6, 2012). Directs FEMA to: (1) restore during such six-month period specified estimated risk premium rate subsidies for flood insurance for pre-FIRM properties and properties purchased after such six-month period, and (2) submit to certain congressional committees a draft affordability framework addressing the affordability of flood insurance sold under the National Flood Insurance Program. Prescribes procedures for expedited congressional consideration of legislation on FEMA affordability authorities. Permits FEMA to enter into an agreement with another federal agency either to: (1) complete the affordability study, or (2) prepare the draft affordability framework. Directs FEMA submit to certain congressional committees the affordability study and report. Amends NFIA to authorize FEMA to reimburse homeowners for successful map appeals. Makes any community that has made adequate progress on the construction (as under current law) or reconstruction (new) of a flood protection system which will afford flood protection for the one-hundred year frequency flood eligible for flood insurance at premium rates not exceeding those which would apply if such flood protection system had been completed. Revises guidelines governing availability of flood insurance in communities restoring disaccredited flood protection systems to include riverine and coastal levees. Requires FEMA to: (1) rate a covered structure using the elevation difference between the floodproofed elevation of the covered structure and the adjusted base flood elevation of the covered structure; and (2) designate a Flood Insurance Advocate to advocate for the fair treatment of policy holders under the National Flood Insurance Program and property owners in the mapping of flood hazards, the identification of risks from flood, and the implementation of measures to minimize the risk of flood.

Fraudulent Overseas Recruitment and Trafficking Elimination Act of 2013 - Amends the Trafficking Victims Protection Act of 2000 to require the U.S. Agency for International Development (USAID) and the Department of State to incorporate anti-trafficking and anti-slavery priorities into other aspects of foreign assistance to ensure that assistance programs do not contribute to vulnerability to, or the prevalence of, human trafficking and slavery. Requires a foreign labor contractor to disclose in writing in English and in the primary language of the worker being recruited specified information, including the identity of the employer and the recruiter, worker protections, and a signed copy of the work contract. Prohibits a foreign labor contractor from providing related false or misleading information. Prohibits certain recruitment fees. Requires a foreign labor contractor to obtain from the Secretary of Labor a certificate of registration which shall be valid for two years. Provides for a registration fee. Exempts from such certificate requirement an employer who engages in foreign labor contracting solely to find workers for the employer's own use without the participation of any other foreign labor contractor. Directs the Secretary of Labor to: (1) maintain a list of all registered foreign labor contractors and a list of all such ontractors whose registration has been revoked; and (2) establish a process for receipt, investigation, and disposition of complaints. Amends the Immigration and Nationality Act to require a consular officer, before issuing specified work visas, to: (1) provide the alien with certain trafficking information, and (2) review and include in the alien's visa file the foreign labor recruiter's disclosures. Directs the Secretary of State to ensure that: (1) each U.S. diplomatic mission has a person responsible for receiving information from any worker who has been subject to violations of this Act, and (2) consulates maintain and make public any information regarding the identities of foreign labor contractors and the employers to whom those contractors supply workers. Sets forth administrative and civil action enforcement requirements.
