National Museum of Asian Pacific American History and Culture Act

National Museum of Asian Pacific American History and Culture Act This bill establishes a National Museum of Asian Pacific American History and Culture within the Smithsonian Institution to provide for the collection, study, and establishment of programs related to Asian Pacific American life, art, history, and culture. The bill also establishes a National Museum of Asian Pacific American History and Culture Council to: (1) make recommendations to the Board of Regents of the Smithsonian Institution concerning construction of the Museum, and (2) advise and assist the Board on all matters related to the Museum's administration and preservation. The Institute of Museum and Library Services shall establish: (1) a grant program for improving operations, care of collections, and development of professional management at Asian Pacific American museums; (2) a grant program that provides internship and fellowship opportunities at such museums; and (3) a scholarship program for assisting individuals who are pursuing careers or carrying out studies in the arts, humanities, and sciences in the study of Asian Pacific American life, art, history, and culture. The Board shall designate a site for the Museum within 12 months of this Act's enactment.

Nurse and Health Care Worker Protection Act of 2015 This bill requires the Department of Labor to establish a standard on safe patient handling, mobility, and injury prevention to prevent musculoskeletal disorders for health care workers. The standard must require the use of engineering and safety controls to handle patients. The standard must require health care employers to: (1) develop and implement a safe patient handling, mobility, and injury prevention program; (2) train their workers on safe patient handling, mobility, and injury prevention; and (3) post a notice that explains the standard, procedures to report patient handling-related injuries, and workers' rights under this Act. Labor must conduct unscheduled inspections to ensure compliance with the standard. This bill amends title XVIII (Medicare) of the Social Security Act to apply the standard to hospitals receiving Medicare funds.

A member shall not be entitled to transitional health care benefits through his or her department solely by reason of being given such examination.

Kari's Law Act of 2015 This bill amends the Communications Act of 1934 to require multi-line telephone systems to have a default configuration that allows users to directly initiate a call to 9-1-1 (without dialing any additional digit, code, prefix, or post-fix, including any trunk-access code such as the digit "9") from any station equipped with dialing facilities. Businesses installing such systems must configure the systems to provide a notification to a central location at the facility where the system is installed when a person at the facility initiates a call to 9-1-1 using the system, provided that the system is able to be so configured without an improvement to the hardware.

Territories Medicare Prescription Drug Assistance Equity Act of 2015 This bill amends titles XVIII (Medicare) and XIX (Medicaid) of the Social Security Act to make certain income-based subsidies available to Medicare prescription drug program beneficiaries who reside in Puerto Rico or another U.S. territory and are otherwise eligible. Current law makes such beneficiaries ineligible for premium and cost-sharing subsidies, but establishes a process for U.S. territories to apply for financial assistance with respect to the provision of Medicare prescription drugs. The bill retains a process for U.S. territories to apply for such assistance, but alters the formula by which the amount of assistance is calculated. Specifically, the bill phases in modifications to the formula that more closely align how assistance is calculated for U.S. territories with how it is calculated for the 50 states and the District of Columbia.

Child Protection Improvements Act of 2015 This bill amends the National Child Protection Act of 1993 to direct the Department of Justice to: (1) establish policies and procedures to streamline the process of obtaining national criminal history background checks on covered individuals, and (2) establish a criminal history review program to provide covered entities with reliable and accurate information on the criminal history of a covered individual. It defines "covered entity" as any business or organization that provides, or licenses, certifies, or coordinates individuals or organizations to provide care, care placement, supervision, treatment, education, training, instruction, or recreation to vulnerable populations including elderly persons, disabled persons, and children. It defines "covered individual" as an individual who: (1) has, seeks to have, or may have unsupervised access to vulnerable populations served by a covered entity; (2) is employed by or volunteers with, or seeks to be employed by or volunteer with, a covered entity; or (3) owns or operates, or seeks to own or operate, a covered entity.

Department of Veterans Affairs Veterans Education Relief and Restoration Act of 2015 This bill declares that, if a veteran is forced to discontinue a course as a result of a a permanent school closure and did not receive credit or lost training time toward completion of the education program, Department of Veterans Affairs (VA) educational assistance payments shall not, for a specified period of time, be: charged against the individual's entitlement to educational assistance, or counted against the aggregate period for which such assistance may be provided. The bill applies to courses and programs of education discontinued beginning with FY2015. The VA may continue to pay educational assistance and subsistence allowances to eligible veterans and eligible persons enrolled in specified courses for up to 4 weeks in any 12-month period when schools are temporarily closed under an established policy based on an executive order of the President or due to an emergency situation. The VA may also continue to pay a monthly housing stipend following a permanent school closure, but only until the earlier of: (1) the date of the end of the term, quarter, or semester during which the school closure occurred; and (2) the date that is four months after the school closure.

Veterans Freedom of Healthcare Act This bill amends the Veterans Access, Choice, and Accountability Act of 2014 to make the Department of Veterans Affairs (VA) Choice Program permanent. (The program allows the furnishing of hospital care and medical services to eligible veterans through agreements with non-VA entities.) Program eligibility requirements are revised. The VA shall ensure that veterans enrolled in the health care system, particularly those with service-connected disabilities rated 50% or greater, are able to receive: health care at VA medical facilities within certain wait-time goals; and the highest degree of care possible, with an emphasis on maintaining the highest degree of quality in treating ailments unique to or prevalent among the veteran population, including mental health services.

Student Loan Transfers Disclosure Act of 2015 This bill amends the Truth in Lending Act and the Higher Education Act of 1965 to establish requirements related to the transfer of servicing of postsecondary education loans. "Transfer of servicing" refers to the assignment, sale, or transfer of student loan servicing from one servicer to another. A postsecondary education lender must disclose to each loan applicant, at the time of application, whether there may be a transfer of servicing of the loan. Both the transferor servicer and the transferee servicer must provide specified notice of a transfer to the borrower within a certain timeframe. Loan payments improperly received by the transferor servicer instead of the transferee servicer (or vice versa) during the transfer period may not be treated as late. A transferee servicer shall make available a simple, online process through which the borrower may transfer any electronic fund transfer authority that the borrower had provided to the transferor servicer. The Consumer Financial Protection Bureau is authorized to establish regulations and grant reasonable exceptions in accordance with the bill. A lender shall not be liable to a borrower for failure to comply with the bill's disclosure and notice requirements with respect to events that occur before such regulations take effect. As a condition of eligibility for certain federal funding, an institution of higher education must ensure compliance with the bill's requirements.

Veterans Affairs Transfer of Information and Sharing of Disability Examination Procedures with DOD Doctors Act This bill declares that: if a member of the Armed Forces who is required to receive a physical examination as part of his or her separation from active duty has or is believed to have a medical condition that will or may make the member eligible for Department of Veterans Affairs (VA) disability compensation and benefits, the physical examination shall be performed by a VA-certified health care provider; and if such a condition is discovered during the physical examination and the examining health care provider is not VA-certified, the examination shall be completed by a VA-certified health care provider. An eligibility determination made as part of such physical examination shall be binding on the VA and be used as the basis for assigning the member's disability rating. The VA and the Department of Defense shall jointly establish a system to share data and maintain the medical and personnel records of members of the Armed Forces and veterans.

Security and Financial Empowerment Act of 2015 This bill amends the Violence Against Women Act to require the National Resource Center on Workplace Response provide information and assistance through domestic violence or sexual assault coalitions and survivor service organizations. These organizations and coalitions shall provide resource materials and assistance to employees, employers, and labor organizations to aid in efforts to develop adequate workplace responses to domestic and sexual violence. In addition, the bill requires employers to provide employees 30 days of leave per year, including 56 hours of earned paid leave, which can be used as a result of domestic violence, dating violence, sexual assault, or stalking of an employee or an employee's family member. States may provide nonrecurring short-term emergency benefits to employees using such leave. Survivors' Employment Sustainability Act The Survivors' Employment Sustainability Act prohibits employers, public benefit agencies, and insurers from discriminating against survivors of: domestic violence, dating or sexual violence, sexual assault, or stalking. Under the Internal Revenue Code, employers must give unemployment compensation to survivors who are separated from work due to conditions related to the individuals being survivors. The bill amends title IV part A (Temporary Assistance for Needy Families) (TANF) of the Social Security Act to require state agency personnel that administer TANF programs to be adequately trained to assist survivors seeking assistance. The Department of Health and Human Services (HHS) must study the barriers survivors encounter to maintain economic security. HHS may arrange financial literacy support for survivors. The Department of Labor must establish a public outreach campaign.

Water Advanced Technologies for Efficient Resource Use Act of 2015 This bill codifies the Environmental Protection Agency's (EPA) WaterSense program, which identifies, labels, and promotes water efficient products, buildings, landscapes, and services. This bill also establishes a program to provide financial incentives for consumers to purchase and install residential water efficient products and services labeled under the WaterSense program. In order to meet procurement requirements for a water consuming product or service, federal agencies must purchase a WaterSense product or service, or a Federal Energy Management Program designated product. Agencies do not have to procure those products or services if they are not cost-effective, or not reasonably available. The bill amends the Internal Revenue Code to exclude from the gross income of individual taxpayers any amount received under an incentive program for the purchase and installation of residential water efficient products and services.

Under current law, “clinical social worker services”: (1) include services performed for the diagnosis and treatment of mental illnesses, and (2) exclude services furnished to an inpatient of a skilled nursing facility as a condition of the facility's participation in the Medicare program. The bill repeals these provisions and instead specifies that such services include certain types of health behavior assessment and intervention.

Military Enlistment Opportunity Act of 2015 Amends citizenship and residency qualifications for enlistment in the armed forces to permit enlistment of additional persons who: (1) have resided continuously in a lawful status in the United States for at least two years, or (2) possess an employment authorization document issued by U.S. Citizenship and Immigration Services under requirements of the Department of Homeland Security (DHS) policy entitled Deferred Action for Childhood Arrivals. Requires authorized enlistees who are not citizens or other nationals of the United States or lawfully admitted for permanent residence to be adjusted to the status of an alien lawfully admitted for permanent residence under an exception to specified provisions of Immigration and Nationality Act. (Such enlistees need not establish that they entered the United States prior to January 1, 1972, or comply with other specified requirements.) Directs DHS to rescind such adjusted status if the person is separated from the armed forces under other than honorable conditions before the person served for a period or periods aggregating five years.

Medicare Premium Fairness Act of 2015 This bill amends title XVIII (Medicare) of the Social Security Act to: (1) prevent 2016 increases to Medicare Part B premiums and deductibles for enrollees, and (2) authorize federal funding to offset the corresponding reduction in aggregate monthly premiums. Under current law, the Centers for Medicare & Medicaid Services must annually determine the monthly actuarial rate upon which Part B premiums and deductibles are based. The bill temporarily freezes that rate at the 2015 level for enrollees, effectively preventing increases to premiums and deductibles for those enrollees in 2016. (Current law already protects Part B enrollees whose benefits are deducted from their Social Security benefits from premium increases that would result in a smaller Social Security check.)

Preserving Teacher Loan Forgiveness for Military Spouses Act of 2015 This bill amends title IV (Student Assistance) of the Higher Education Act of 1965 to modify the qualifying service requirement of the teacher loan forgiveness program for certain military spouses. Under current law, an otherwise qualified full-time teacher must complete five consecutive years of service to be eligible for the teacher loan forgiveness program. This bill permits a teacher who completes five full-time years of non-consecutive service to be eligible for loan forgiveness if the teacher was a qualified military spouse during any break in teaching service. A qualified military spouse is an individual who: (1) is a highly-qualified teacher at a high-need school, (2) is the spouse of a servicemember, (3) experienced a break in teaching service to relocate with servicemember spouse pursuant to military orders, and (4) resumed teaching the next academic year. The Department of Education must report to Congress on the number of individuals impacted by this modification.

Interim Consolidated Storage Act of 2015 This bill amends the Nuclear Waste Policy Act of 1982 to authorize the Department of Energy (DOE) to enter into new contracts (or modify existing contracts) with the licensee of an interim consolidated storage facility in order to take title to and store in it either high-level radioactive waste or spent nuclear fuel of domestic origin. The bill defines: "interim consolidated storage facility" as a facility licensed by the Nuclear Regulatory Commission for the storage of high-level radioactive waste or spent nuclear fuel received from DOE or from two or more persons that generate or hold title to such fuel generated at a civilian nuclear power reactor, and "high-level radioactive waste" as including Greater than Class C waste. The bill assigns priority to storage of such waste and spent fuel located on sites without an operating nuclear reactor. The bill makes appropriations targeted for the Nuclear Waste Fund available to pay for costs in connection with storage in an interim consolidated storage facility. Beginning in FY2016 DOE shall not expend, on fees for dry modes of storage of high-level radioactive waste or spent nuclear fuel, any amounts exceeding the cumulative amount of interest generated by the Fund each fiscal year.

The Agent Orange Act of 1991 is amended to extend for two years the authority of the VA to enter into an agreement with the National Academy of Sciences to evaluate the scientific evidence regarding associations between diseases and exposure to dioxin and other chemical compounds in herbicides, including the association between exposure to a herbicide used in U.S. and allied military operations in the Republic of Vietnam during the Vietnam era and each disease suspected to be associated with such exposure.

National Infrastructure Development Bank Act of 2015 Establishes the National Infrastructure Development Bank as a wholly owned government corporation. Makes the Bank's Board of Directors responsible for monitoring and overseeing energy, environmental, telecommunications, and transportation infrastructure projects. Authorizes the Board to: (1) make senior and subordinated direct loans and loan guarantees to assist in the financing or refinancing of an infrastructure project, (2) issue public benefit bonds and provide financing to infrastructure projects, and (3) pay an interest subsidy to the issuer of American Infrastructure Bonds. Requires the Board to establish an Executive Committee to establish requirements and make recommendations for project proposals to be considered for financial assistance. Requires the Bank to establish a Risk Management Committee, which shall: (1) create financial, credit, and operational risk management guidelines for the Bank; (2) set guidelines to ensure diversification of lending activities by geographic region and infrastructure project type; (3) create conforming standards for all financial assistance provided by the Bank; (4) monitor financial, credit, and operational exposure of the Bank; (5) provide financial recommendations to the Board; and (6) ensure that the aggregate amount of interest subsidies provided for American Infrastructure Bonds in a given calendar year does not exceed 28% of interest payable under all such Bonds. Requires the Bank to establish an audit committee. Requires the Board to approve criteria established by the Executive Committee for determining project eligibility for financial assistance. Sets forth criteria to be considered by the Board for each type of infrastructure project. Requires the Executive Committee to conduct an analysis that considers the economic, environmental, and social benefits and costs of each project under consideration, prioritizing projects that contribute to economic growth, lead to job creation, and are of regional or national significance. Requires any financial assistance for an infrastructure project to be repayable from dedicated revenue sources that also secure the infrastructure project obligations. Limits the amount of assistance under this Act to 50% of reasonably anticipated project costs. Exempts all bonds issued by the Bank from state or local government taxation. Sets forth requirements regarding compliance of assisted projects with wage rate, domestic content, and buy American statutes. Requires the Board to establish an American Infrastructure Bond program. Establishes in the Treasury the National Infrastructure Development Bank Trust Fund into which an amount estimated to equal the tax receipts attributable to interest payable under such Bonds is to be appropriated.

America Votes Act of 2015 This bill amends the Help America Vote Act of 2002 to permit an individual required to present identification as a condition for voting in a federal election to meet the requirement by presenting the appropriate state or local election official with a sworn written statement, signed by the individual under penalty of perjury, attesting to the individual's identification and that he or she is registered to vote in the election. Allows an individual desiring to vote by mail to submit such a statement with the ballot. Requires any state subject to this identification requirement to: (1) prepare a pre-printed version of the statement which includes a blank space for an individual to provide a name and signature, (2) make copies of the pre-printed version available at polling places for election officials to distribute to individuals who desire to vote in person, and (3) include a copy of the pre-printed version with each blank absentee or other ballot transmitted to an individual who desires to vote by mail. Prohibits a state from requiring an individual who presents or submits such a sworn written statement to cast a provisional ballot in the election. Excepts first-time voters registering by mail from application of this Act. Requires states requiring an individual to present identification as a condition of receiving and casting a ballot in a federal election to include the use of a sworn written statement in voting information posted at polling places.

Prevent All Soring Tactics Act of 2015 or the PAST Act This bill amends the Horse Protection Act to establish a new system for inspecting horses for soring, revise penalties for violations of the Act, and modify enforcement procedures. The soring of horses is any of various actions taken on a horse's limb to produce a higher gait that may cause pain, distress, inflammation, or lameness. The Department of Agriculture (USDA) must establish requirements to license, train, assign, and oversee persons hired by the management of horse shows, exhibitions, sales, or auctions to detect and diagnose sore horses. A license may not be issued to a person with conflicts of interest, and USDA must give preference to veterinarians. USDA may revoke a license for unsatisfactory performance. USDA must assign licensed inspectors after receiving notice that management intends to hire the inspectors. An inspector must issue a citation for violations and notify USDA of violations. USDA must publish information on violations of this bill and disqualify a horse that is sore. The bill prohibits a person in any horse show, exhibition, sale, or auction from causing or directing a horse to become sore for the purpose of showing, exhibiting, selling, or auctioning the horse. The bill prohibits the use of specified devices on a Tennessee Walking, a Racking, or a Spotted Saddle horse at a show, exhibition, sale, or auction. The bill increases the maximum criminal and civil liability penalties for certain violations. USDA may disqualify violators from specified activities related to horse shows, exhibitions, sales, and auctions.

Veterans Emergency Treatment Act or the VET Act This bill declares that, if a veteran who is enrolled in the Department of Veterans Affairs (VA) health care program requests a medical examination or treatment at an emergency department of a VA medical facility, the veteran shall be provided with: a medical screening examination to determine whether an emergency medical condition exists; and if an emergency condition exists, stabilizing medical treatment or transfer to another VA or non-VA medical facility. If a non-stabilized emergency medical condition exists the VA hospital may not transfer the veteran unless the veteran, after being made aware of the risks, makes a written transfer request, or a physician (or a qualified medical person if a physician is not present) certifies that the medical benefits of a transfer outweigh the risks. The VA may not take adverse action against a VA employee because the employee refuses to authorize the transfer of an enrolled veteran with a non-stabilized emergency medical condition or because the employee reports a violation of a requirement of this Act. A VA or non-VA medical facility may not delay provision of an appropriate medical screening examination or further medical examination and treatment required in order to inquire about the payment method or insurance status of an enrolled veteran.
