Career-Ready Student Veterans Act

United States · United States Congress · 25 May 2017

Career-Ready Student Veterans Act This bill adds the following new criteria for state approval, with respect to the Department of Veterans Affairs (VA) educational assistance, of applications of educational institutions providing veterans with non-accredited courses: a program to prepare an individual for state licensure or certification must meet any state instructional curriculum licensure or certification requirements; or a program to prepare an individual for employment pursuant to standards developed by a state board or agency in an occupation requiring approval or licensure must be approved or licensed by that entity. The VA may waive either of these two requirements if: the educational institution is accredited by an agency or association recognized by the Department of Education; the program did not meet the requirements during the two-year period preceding the waiver date; the waiver furthers the purposes of the educational assistance programs or would further the education interests of individuals eligible for program assistance; and the educational institution does not provide any incentive payment based on securing enrollments or financial aid to any persons or entities engaged in student recruiting or admission activities or in making decisions regarding the award of student financial assistance, except for recruitment of foreign students residing in foreign countries who are ineligible for federal student assistance. The VA shall submit to Congress notice of, and justification for, a waiver within 30 days of issuance. The VA shall disapprove a course of education unless the educational institution providing it discloses publicly any conditions or additional requirements required to obtain the license, certification, or approval for which the course is designed to provide preparation. If after enrollment in a course subject to disapproval an individual pursues more courses of education at the same educational institution while remaining continuously enrolled, such courses shall not be subject to disapproval by reason of this bill.

Protecting Older Workers Against Discrimination Act

United States · United States Congress · 25 May 2017

Protecting Older Workers Against Discrimination Act This bill amends the Age Discrimination in Employment Act of 1967 to establish an unlawful employment practice when the complaining party demonstrates that age or participation in investigations, proceedings, or litigation under such Act was a motivating factor for any unlawful employment practice, even though other factors also motivated the practice (thereby allowing what are commonly known as "mixed motive" claims). The bill: (1) permits a complaining party to rely on any type or form of admissible evidence, which need only be sufficient for a reasonable trier of fact to find that an unlawful practice occurred; and (2) declares that a complaining party shall not be required to demonstrate that age or retaliation was the sole cause of the employment practice (thereby rejecting the Supreme Court's decision in Gross v. FBL Financial Services, Inc. , which requires a complainant to prove that age was the "but-for" cause for the employer's decision). The bill authorizes a court in a claim in which age discrimination is shown to grant declaratory and injunctive relief, but prohibits a court from awarding damages or issuing an order requiring any admission, reinstatement, hiring, promotion, or payment. The bill applies the same standard of proof to other employment discrimination and retaliation claims, including claims under the Civil Rights Act of 1964, the Americans With Disabilities Act of 1990, and the Rehabilitation Act of 1973.

Freedom from Discrimination in Credit Act of 2017

United States · United States Congress · 17 May 2017

Freedom from Discrimination in Credit Act of 2017 This bill amends the Equal Credit Opportunity Act (ECOA) to expand the categories of prohibited discrimination when extending credit to include discrimination on account of sexual orientation or gender identity. (Currently, such discrimination in credit is prohibited only on the basis of race, color, religion, national origin, sex or marital status, or age.) The bill defines: (1) "gender identity" as the gender-related identity, appearance, or mannerisms or other gender-related characteristics of an individual with or without regard to the individual's designated sex at birth; and (2) "sexual orientation" as homosexuality, heterosexuality, or bisexuality. The bill specifies that for purposes of the ECOA's protections against sex discrimination, the term "sex" includes: (1) a sex stereotype; (2) pregnancy, childbirth, or a related medical condition; and (3) sexual orientation or gender identity. The bill also extends ECOA's protections against discrimination to include: (1) an association with another person who is a member of a class protected against discrimination; and (2) a perception or belief, even if inaccurate, that the individual is a member of such a protected class. Under a current provision of the ECOA, a request for the signature of both parties to a marriage for the purpose of creating a valid lien, passing clear title, waiving inchoate rights to property, or assigning earnings does not constitute discrimination. The bill prohibits this provision from being construed to permit a creditor to take sexual orientation or gender identity into account in connection with the evaluation of creditworthiness of an applicant.
