Grégoire de Fournas attire l'attention de M. le ministre de l'agriculture et de la souveraineté alimentaire sur les dispositions de la loi n° 2021-1357 du 18 octobre 2021 visant à protéger la rémunération des agriculteurs, dite « Egalim 2 », relatives à la non-négociabilité de la matière première agricole. L'objectif de ces dispositions était de sanctuariser le prix de la matière première agricole en empêchant que la négociation commerciale porte sur celle-ci afin de permettre aux agriculteurs d'être plus justement rémunérés. L'article 4 de la loi prévoit ainsi de rendre obligatoire, dans le cadre des négociations commerciales entre fournisseurs et distributeurs, la transparence sur la part des matières premières agricoles dans le volume et le tarif des produits alimentaires. La négociation ne peut porter sur la part, dans le tarif du fournisseur, correspondant au prix des matières premières agricoles. Les acheteurs doivent ainsi faire figurer ces informations dans les conditions générales de vente (CGV) : soit en indiquant, pour chacun des produits transformés, le pourcentage de chaque matière première en volume et en pourcentage du tarif ; soit en indiquant ces mêmes informations de manière agrégée pour chaque produit transformé ; soit en faisant intervenir un tiers indépendant aux frais du fournisseur pour certifier que la négociation n'a pas porté sur la part de l'évolution du tarif du fournisseur résultant du prix des matières premières agricoles. Dans les deux premiers cas, l'acheteur peut, à ses frais, demander au fournisseur de mandater un tiers indépendant pour attester l'exactitude des éléments figurant dans les CGV. Si cet article 4 tente de protéger la rémunération des agriculteurs en sanctuarisant le prix de la matière première agricole, la question des contrôles menés afin d'en faire respecter les dispositions se pose. En effet, la crise connue par la filière agricole oblige à être particulièrement attentif à l'application de ces mesures afin de permettre aux producteurs d'être plus justement rémunérés dans un contexte où l'inflation et les difficultés liées à l'escalade des normes environnementales menacent notre agriculture tout entière. M. le député rappelle que, dans le rapport d'information déposé en application de l'article 145-7 alinéa 1 du Règlement de l'Assemblée nationale par la commission des affaires économiques sur l'application de la loi n° 2021-1357 du 18 octobre 2021 visant à protéger la rémunération des agriculteurs dont il a été rapporteur en juillet 2022, il avait déjà demandé que l'application de ces contrôles soit effective. Il lui demande de bien vouloir lui détailler les actions menées par la DGCCRF pour les années 2022 et 2023, ainsi que leur nombre, afin de faire respecter l'article 4 de la loi Egalim 2.

Grégoire de Fournas interroge M. le ministre de l'économie, des finances et de la souveraineté industrielle et numérique sur les dispositions contre les prix abusivement bas de la loi n° 2018-938 du 30 octobre 2018 pour l'équilibre des relations commerciales dans le secteur agricole et alimentaire et une alimentation saine, durable et accessible à tous, dite « Egalim ». En application de la loi « Egalim », l'ordonnance n° 2019-358 du 24 avril 2019 relative à « l'action en responsabilité pour prix abusivement bas » élargit l'interdiction de céder à un prix abusivement bas aux produits agricoles et aux denrées alimentaires. Le 11 janvier 2024, un viticulteur du Médoc a été le premier producteur à engager une action en justice sur le fondement de ces dispositions prévues par la loi « Egalim ». Il a ainsi assigné devant le tribunal de commerce de Bordeaux deux négociants qu'il accuse d'avoir acheté son vin à un tarif « abusivement bas ». L'ordonnance n° 2019-359 du 24 avril 2019 portant refonte du titre IV du livre IV du code de commerce relatif à la transparence, aux pratiques restrictives de concurrence et aux autres pratiques prohibées prise en application de la loi n° 2018-938 du 30 octobre 2018 pour l'équilibre des relations commerciales dans le secteur agricole et alimentaire et une alimentation saine, durable et accessible à tous, dite « Egalim », modifiée par l'article L. 442-4 du code du commerce, indique que l'action peut être « introduite devant la juridiction civile ou commerciale compétente par toute personne justifiant d'un intérêt, par le ministère public, par le ministre chargé de l'économie ou par le président de l'Autorité de la concurrence lorsque ce dernier constate, à l'occasion des affaires qui relèvent de sa compétence, une pratique mentionnée aux articles précités ». Par ailleurs, il est prévu que « le ministre chargé de l'économie ou le ministère public peuvent demander à la juridiction saisie d'ordonner la cessation des pratiques mentionnées aux articles L. 442-1, L. 442-2, L. 442-3, L. 442-7 et L. 442-8. Ils peuvent également, pour toutes ces pratiques, faire constater la nullité des clauses ou contrats illicites et demander la restitution des avantages indument obtenus, dès lors que les victimes de ces pratiques sont informées, par tous moyens, de l'introduction de cette action en justice » et « peuvent également demander le prononcé d'une amende civile ». Alors que la question des revenus des agriculteurs n'a jamais été aussi cruciale et que ce procès soulève pour la première fois le dispositif visant à lutter contre les prix abusivement bas prévus par la loi « Egalim », il lui demande les raisons de l'absence de son ministère devant le tribunal de commerce de Bordeaux le 11 janvier 2024.

Grégoire de Fournas interroge M. le ministre de l'agriculture et de la souveraineté alimentaire sur la question des vignes abandonnées qui se multiplient dans les vignobles français en raison de la crise viticole. Ces vignes abandonnées deviennent souvent des foyers de maladies de la vigne et contaminent les vignes voisines correctement entretenues. Ces parcelles peuvent être abandonnées depuis plusieurs années et ne sont donc pas éligibles aux aides à l'arrachage récemment mises en place. Parmi les propriétaires de ces vignes abandonnées, beaucoup ont tout perdu du fait de la crise viticole et n'ont donc pas les moyens financiers d'arracher leurs vignes qu'ils n'exploitent plus. Il l'interroge donc sur les moyens qu'il compte mettre en place pour s'attaquer à ce problème, qu'il s'agisse à la fois des aides financières à l'arrachage des vignes abandonnées depuis plusieurs années, mais aussi de l'obligation d'arrachage, de dévitalisation ou de remise en état nécessaires pour éviter que se multiplient les foyers de contamination des maladies de la vigne.

Margin moderation agreements are provided for in article L. 611-4-1 of the rural and maritime fishing code. These agreements, renewed annually between the State and distribution companies that so wish, consist of reducing the company's margin by distribution and its stores on products in economic crisis, so that its gross margin rate on a fruit or vegetable concerned is less than or equal to its average gross margin rate for the last three years on the department. However, the margin charged by the distributor on a similar product is different depending on whether it is imported or produced on the national territory, without however being taken into account in the calculation of the rate of sale. margin. Furthermore, the “platform margin” linked to logistics costs is sometimes presented by distributors as a provision of logistics service and is not only borne by the first-to-market companies but also deducted from the distributor's margin. Grégoire de Fournas interroge M. le ministre de l'économie, des finances et de la souveraineté industrielle et numérique sur l'ordonnance n° 2019-359 du 24 avril 2019 contre les prix abusivement bas, prise dans le prolongement de la loi n° 2018-938 du 30 octobre 2018 pour l'équilibre des relations commerciales dans le secteur agricole et alimentaire et une alimentation saine, durable et accessible à tous, dite « EGALIM 1» et sur son application effective. L'objectif affiché de cette ordonnance était de permettre aux agriculteurs d'être plus justement rémunérés sur leurs produits et d'éviter que la grande distribution réclame des prix toujours plus bas auprès des fournisseurs de l'industrie agroalimentaire afin d'être plus compétitive que ses concurrents et ce au détriment des producteurs en bout de chaîne. Afin de caractériser un prix abusivement bas, il est tenu compte des indicateurs de coûts de production mentionnés aux articles L. 631-24, L. 631-24-1, L. 631-24-3 et L. 632-2-1 du code rural et de la pêche maritime. Si cette ordonnance encadre donc la fixation des prix et est supposée mettre un terme aux pratiques abusives de la grande distribution dans ce domaine, en engageant leur responsabilité et en les obligeant à réparer le préjudice si une telle pratique était avérée, la question de son application effective et des contrôles menés afin d'en faire respecter les dispositions se pose. En effet, les difficultés financières connues par la filière agricole dans son ensemble obligent à être particulièrement attentifs à l'application de ces mesures par la grande distribution, afin de permettre que les producteurs soient justement rémunérés dans un contexte où l'inflation et l'augmentation des prix de l'énergie ont eu un impact important sur les coûts de production, rendant plus importante la guerre des prix pratiquée par les enseignes de cette filière. Il lui demande donc de bien vouloir lui détailler les actions menées par la DGCCRF afin de faire respecter les mesures cette ordonnance.

Dans cet avis, longtemps attendu par le monde agricole, l'EFSA va dans le sens de la ré-autorisation en estimant que le glyphosate ne présente pas de « domaine critique de préoccupation » empêchant le renouvellement de son autorisation dans l'Union européenne. L'autorisation du glyphosate ayant déjà été prolongée jusqu'au 15 décembre 2023, la Commission européenne doit se servir de cet avis pour décider de proroger ou non, pour cinq ans, l'autorisation délivrée sur le marché européen. Alors que la France travaille à recouvrer sa souveraineté alimentaire, il est indispensable de donner aux agriculteurs les moyens de produire efficacement en préservant la compétitivité des exploitations agricoles. Pour un grand nombre de cultures, les alternatives au glyphosate sont trop coûteuses ou inexistantes. Il lui demande quelle sera la position de la France dans le cadre des discussions européennes sur cette autorisation. D'autre part, tandis que l'Assemblée nationale a adopté le 11 mai 2023 la résolution visant à « lutter contre les sur-transpositions en matière agricole », il lui demande comment il compte s'assurer qu'il n'y ait pas de sur-transposition française avec une réglementation plus contraignante que la réglementation européenne sur ce sujet.

Mr. Grégoire de Fournas questions the Minister of Agriculture and Food Sovereignty on the ongoing revision of the INCO regulation, relating to the labeling of foodstuffs. For several years now, we have been witnessing a real change in purchasing criteria among French consumers. The latter are indeed attaching more and more importance to the quality of products as well as their origin. We see by example a growing dynamic towards “localism”, that is to say the fact of favoring the purchase of local products, a trend which reinforces the French ambition of food sovereignty. This growing consumer interest in local products requires that labeling provides the consumer with clear information on the origin of the products. The labeling of food products, in particular its origin, is currently framed by the so-called INCO regulation, relating to consumer information on foodstuffs. However, it is under the pretext of the INCO regulation that the ministry still refuses to issue the decrees implementing articles 12, 13 and 14 relating to the labeling of the Egalim 2 law passed more than a year and a half ago. On the other hand, article 13 of the INCO regulation sets the minimum size of characters for mandatory information, including the origin, at 1.2 mm, which is very insufficient especially since this mention is not necessarily on the upper side of the packaging. The obligation to print the flag of the producing country on the upper side of the packaging with a minimum size of 15 mm could, for example, guarantee good information to the consumer and allow them to make an informed choice. While this incomplete labeling is largely detrimental to French agriculture, he asks what France's position will be in the context of the revision of the INCO regulation.

Mr. Grégoire de Fournas questions the Minister of Agriculture and Food Sovereignty on the aspect relating to tomatoes of the trade agreement between the European Union and Morocco. Entered into force on October 1, 2012, the agreement between the EU and Morocco relating to reciprocal liberalization measures relating to agricultural products, processed agricultural products, fish and fishing products contains a set of provisions moving towards total liberalization. For its part, the tomato is included on a so-called “negative” list, which allows exceptions in trade agreements on “sensitive” products due to competition with Spanish tomatoes in particular. Moroccan tomato exports must respect a conventional “entry price” of 0.461 euros/kg from October 1 to May 31. This system is supposed to protect European agricultural sectors against low-priced imports. While it was previously left to the choice of the importer, the determination of the method of calculating this entry price must, since 2014, be done systematically on the basis of the flat-rate import value (VFI). However, Moroccan tomato producers have since turned away from round tomatoes, which constituted the majority of exports at the time, to produce “cherry” tomatoes. The new weighted average on this new basis is therefore increased, because it takes into account this growing share of “cherry” tomatoes with higher added value. Exports have in fact increased from 300 tonnes per year 15 years ago to more than 124,000 tonnes in 2021, out of a total of nearly 360,000 tonnes of tomatoes. With this calculation method, the average price passes always and well above the minimum entry price (46.1 euros/100kg) and limits the “additional specific duties” that Moroccan producers would have to pay. This calculation method therefore proved ineffective and ineffective for the surveillance and protection of the European market against Moroccan imports. Mr. Grégoire de Fournas questions the Minister of Agriculture and Food Sovereignty about the non-publication of decrees relating to articles 12, 13 and 14 of the Egalim 2 law. Promulgated on October 19, 2021, law no. 2021-1357 of October 18, 2021 aimed at protecting farmers' remuneration was supposed to provide better remuneration for French farmers. A year and a half later, the application of articles 12, 13 and 14, relating to labeling, was considerably delayed due to the non-publication of the decrees by the Ministry of Agriculture. Article 12, which modifies Article L. 121-4 of the Consumer Code, defines misleading commercial practices and introduces the ban on displaying a French flag, a map of France or any symbol representative of France on food packaging when the ingredients primary are not of French origin. The decree which was to determine the list of sectors concerned as well as the conditions of application of the article has still not been published, which makes the article inapplicable. Article 13, for its part, introduced labeling obligations for several foodstuffs. M. Grégoire de Fournas attire l'attention de M. le ministre de la transition écologique et de la cohésion des territoires sur la technologie de « dépollution de l'air » commercialisée par la société Ecopra. À l'inverse des dispositifs actuels sur le marché qui proposent uniquement des systèmes d'additifs pour les carburants, ce kit de dépollution permet d'agir en amont du filtre à air en modifiant directement le comburant, c'est-à-dire l'air, avant qu'il ne rentre dans l'admission d'air du moteur. Les effets positifs de ce comburant modifié seraient nombreux : outre la dépollution importante engendrée (baisse de l'opacité Co Co2 Hc Nox Np Mp), on noterait une baisse de la perte calorifique, un allègement de la charge propre du moteur (les huiles et les consommables sont moins chauds, la pression est moins haute et donc les pompes à eau et à huile sont déchargées), une baisse de régime moteur dans 98 % des installations réalisées, une conservation et une économie d'énergie, ce qui impliquerait par conséquent une économie financière, de temps ainsi qu'une augmentation de la durée d'autonomie du véhicule. Enfin, on observe une réduction de la nuisance sonore jusqu'à 5 décibels. Cette technologie de comburant formaté additivé semblerait répondre à la problématique environnementale et énergétique actuelle en permettant de diminuer de 15 à 30 % les émissions en CO2 et de réduire l'émission de particules des gaz d'échappement de 50 à 80 %. Elle représenterait également une piste intéressante face à la flambée des prix du carburant en permettant une économie de carburant de 15 à 30 % selon les véhicules. Par ailleurs, ce système s'adapte sur tous les véhicules thermiques de toutes générations et carburants, ce qui permettrait à ceux qui ne le peuvent de rentrer dans les zones à faibles émissions mobilités (ZFE-m). Cela représenterait une alternative intéressante dans le cadre des politiques de réduction des émissions de CO2. Il lui demande si les véhicules équipés de la technologie de dépollution de l'air Ecopra peuvent bénéficier d'un Crit'air mieux classé que celui attribué aux véhicules non équipés et qui leur permettent de pouvoir circuler dans ZFE-m dans la mesure où ceux-ci disposent d'un système qui modifie l'air en amont de la combustion.

In New Aquitaine, there are only two pelicandromas, one in Mérignac in Gironde and the other in Limoges in Haute-Vienne. In the context of the covid-19 health crisis, the ministerial instruction of July 29, 2021 no. 509040/ARM/DCSSA/ESSD relating to vaccination against covid-19 in the armies added vaccination against covid-19 to the vaccination schedule in the armed forces, in accordance with article D. 4122-13 of the Defense Code which provides that the compulsory vaccination schedule for military personnel is set by instruction from the Minister of the Armed Forces. However, since the start of the crisis, it has been proven that many soldiers who have not been vaccinated against covid-19 have consequently been sanctioned in different ways through decisions of temporary incapacity to serve, sanctions disciplinary sanctions, transfers-sanctions, inability to go on external operations, days of forced leave, delays in advancement and were even liable to criminal prosecution within the framework of the application of article L. 323-6 of the code of military justice. Grégoire de Fournas appelle l'attention de M. le ministre de l'intérieur et des outre-mer sur les conditions actuelles de détachement d'un policier national ou d'un gendarme vers la police municipale. L'État donne la possibilité aux policiers et aux gendarmes d'être détaché vers la police municipale. Pour cela, les agents désirant se faire détacher doivent renouveler les procédures relatives à l'armement et à l'assermentation. Ces démarches sont très longues et onéreuses pour les communes dont le coût est à leur charge. Dans le cas du suivi de l'assermentation, il est nécessaire de repasser devant le tribunal administratif, processus qui dure plusieurs mois. Le suivi de l'armement, quant à lui, coûterait 1 500 euros aux communes (nouvelles formations, visite médicale, échéances de tirs). Dans le contexte actuel de réduction des dépenses des collectivités, il paraît injustifié de faire recommencer ces procédures longues et coûteuses aux agents concernés alors qu'ils retrouveraient instantanément leur assermentation et leur arme en revenant dans leur précédente fonction. Il lui demande s'il compte modifier cette disposition pour mettre en place le suivi de l'assermentation et de l'armement dans le cadre des détachements des policiers nationaux et gendarmes vers la police municipale.

Directive (EU) 2015/413 of March 11, 2015 allows the cross-border exchange of information regarding road safety offenses between Member States for eight types of offenses (speeding, fire red, driving while drunk, not wearing a seat belt (or a helmet for two-wheelers)). Currently, 19 European countries have signed an information exchange agreement with France: Germany, Belgium, Spain, the Netherlands, Poland, Romania, Austria, Italy, Luxembourg, Hungary, Portugal, the Czech Republic, Slovakia, Estonia, Latvia and Lithuania, Ireland, Sweden, Denmark and Swiss. Massive fraud via vehicle registration in Bulgaria and Romania was identified by French law enforcement during road checks. To the extent that there are no agreements between France and these two countries, certain drivers, while living and working in France, register their vehicle in Bulgaria or Romania and are exempt from any fines. There are thus thousands of traffic tickets that are not paid and hundreds of thousands of euros in losses for the State.
