Ms. Joséphine Missoffe draws the attention of the Minister of State, Minister of National Education, Higher Education and Research, to the arrangements for exam accommodation planned for students with neurodevelopmental disorders (NDD) enrolled in private educational establishments under contract. During their schooling, many students with TND compensate for their disorders through educational adjustments made in place as part of a personalized support plan (PAP). Pursuant to Article D. 311-13 of the Education Code, for such a plan to be put in place, it is necessary to obtain a positive opinion from a national education doctor. The absence of national education doctors in private establishments under contract forces these establishments to resort to school doctors not attached to national education to validate these PAPs. According to article D. 351-28-1 of the education code, created by decree no. 2020-1523 of December 4, 2020, candidates who benefit from a PAP for a neurodevelopmental disorder benefit from a procedure for requesting exceptional accommodations for their exams, without having to request a new medical opinion. However, in certain academies, this procedure is refused to students enrolled in establishments private, due to the lack of validation of their PAP by a national education doctor. Candidates are thus obliged to make a complete request, subject to the opinion of a CDAPH doctor, on the basis of which the interacademic exams and competitions service (SIEC) makes a decision to accept or refuse accommodations for the exam. This situation creates a difference in treatment between private and secondary school students. public and generates many concerns and difficulties for these adolescents who find themselves taking their exams without the accommodations they have always benefited from in school. Thus, she asks him if a potential rewriting of article D. 311-13 of the education code, by opening the possibility of having the PAP validated by a school doctor or referent and not only by a national education doctor, is considered. If such a modification is not possible, she asks what would then be the procedure to follow so that all PAPs, even those signed in private establishments, can give access to the exceptional procedure provided for in article D. 351-28-1 of the education code.
