Ms. Raquel Garrido alerts the Keeper of the Seals, Minister of Justice, to the untenable working conditions of agents of the judicial protection of young people (PJJ). PJJ 93 agents mobilized on Thursday April 25, 2024 to denounce the lack of resources necessary to carry out their most fundamental missions to the detriment of young people in care. Since the entry into force of the juvenile criminal justice code (CJPM) in 2021, the demand on staff has increased to the point that they can no longer carry out all their missions, particularly that of prevention. Their pace of work has become unsustainable, given the resources allocated far below the needs on the ground. Since 2021, educators have had to increase the number of hearings and submissions, which only leaves them time for legal follow-up. While Seine-Saint-Denis was already overworked, the increase in tasks induced by the CJPM no longer allows agents to properly take care of young people. Considering that there should be at least 1 educator for 20 young people and that in this case the ratio is much higher, an educator can only give one hour per month to each young person monitored. Seine-Saint-Denis is neglected and despised by the Government in all sectors and justice is not no exception. While the activity of the PJJ in Seine-Saint-Denis increased by 8% in 2023, the resources allocated to the services have not followed. Worse, on a national scale, the PJJ saw its budget reduced by 38 million euros by the drastic budget cut announced by the Government in February 2024. This austerity cure will directly affect the PJJ of Seine-Saint-Denis, taking into account the 30% increase in summons by judicial police officer with the SEAT since January 2024. It is clear that the Government does not understand the realities regularly denounced by PJJ agents. If the number of full-time equivalent positions (FTE) is constant, their breakdown does not meet the priorities of the territory. The unions are particularly asking for more positions on monitoring young people. Insufficient human and financial resources faced with the scale of the missions to be carried out also leads to mistreatment of staff and young people. The indefinite closure of the Saint-Ouen ASE, the relocation of the PJJ premises from Pierrefitte-sur-Seine to an industrial zone of Saint-Denis that is not easily accessible for the target public are all examples which reflect a lack of consideration for the agents and young people in care. The untenable pace of work of the agents promotes psychosocial risks and makes decent care of young people impossible. The agents also have a feeling of abandonment on the part of their administration which, in addition to stifling and disorganized management - as denounced by the unions - does not provide a concrete solution to compensate for the lack of resources. Under these conditions, how can agents achieve the objectives of reducing recidivism set by the ministry services? It's simply impossible. Seine-Saint-Denis requires more human and financial resources given the precarious population that agents must support. Thus, beyond judicial monitoring, educational mediation, prevention and support measures are fundamental for the integration of young people. They are more likely to have health problems due to lack of access to a healthcare pathway complete, need reinforced administrative monitoring that agents do not have the time to provide. However, these missions are inherent to the PJJ, in accordance with the spirit of the 1945 ordinance which highlighted the educational aspect over the repressive vector. The seriously degraded working conditions also lead to a loss of meaning - as recalled in the 2023 Senate report (opinion no. 134 (2023-2024)) - as well as to a decline in attractiveness of these social professions, at the expense of existing staff. The PJJ professions are like many so-called feminized professions - such as AESH, caregivers, midwives, nurses - which, despite multiple mobilizations to see their status upgraded, are not heard by the Government. Contempt for connection and social professions seems to be a constant for this Government. The conditions of work that is already difficult to maintain is likely to deteriorate significantly during the period of the Olympic and Paralympic Games. The administration aims to mobilize 70% of the PJJ 93 workforce over this period. This requirement is above ground and likely to put more pressure on agents, even though this attendance rate is already not achieved in certain services in normal times: for example at the UEHC in Puppet. Finally, the impossibility of taking leave during this period worries the unions. It is certain that the Prime Minister's recent speech on violence among minors is not likely to reassure agents when he has once again preferred repressive escalation instead of discussing the means allocated to the competent services to prevent this violence. The deputy asks Mr. the Keeper of the Seals, Minister of justice what he intends to put in place to respond to the demands of the PJJ 93 agents mobilized to obtain better working conditions and the guarantee of dignified care for the young people they support.

Mrs. Raquel Garrido alerts the Minister of National Education and Youth to the critical state in which public schools find themselves, particularly in the department of Seine-Saint-Denis, due to lack of resources allocated to carry out the missions entrusted to them. For too long, school has no longer been a priority for governments. Many of the successive reforms have the same objective in common: to make savings on the education of children. The rare revisions which do not concern the budgetary and financial aspect fuel the project of a two-tier school which sorts students and continues to increase educational inequalities. This is evidenced by Gabriel Attal’s recent announcements on the “clash of knowledge”. These announcements, largely rejected by national education personnel, do not in any way correspond to the demands of these professionals who demand the material resources necessary to carry out their jobs (recruitment, equipment, maintenance of premises) and an increase in their salaries. Today, private contract education is 73% financed by public funds. In the finance law for 2024, private education obtained an increase of 6.70% for a total of 9 billion euros in payment credits when the increase for education public school was much less with an increase of 4.58% for the 1st level and 5.40% for the 2nd level. Worse, the recent announcement of 10 billion euros in savings on state spending by Bruno Le Maire will worsen the already catastrophic situation in which public schools find themselves. The “School Education” mission is one of the most impacted by this cut with nearly 692 million euros in savings, including around 70% concerns personnel expenses. In concrete terms, in 2024 there will be fewer adults in schools to supervise students (teachers, CPE, AED, school doctors and nurses, psychologists, etc.). This decision is extremely serious even though staff are demanding a massive recruitment plan for public schools. In Seine-Saint-Denis, the situation is such that the education inter-union has presented a major emergency plan for the department with the main motto of reducing inequalities. This work carried out by the unions reveals that in Seine-Saint-Denis, there is a shortage of 2,200 positions supporting students with disabilities (AESH), 175 principal education advisors (CPE), 650 education assistants, 320 teaching assistants and that the emergency creation of 5,000 teaching positions for the start of the 2024 school year is primordial. Mobilized since February 26, 2024, the start of the school year, the next day, more than 700 staff and parents were present in front of the management of departmental national education services (DSDEN 93) in Bobigny. Since then, the mobilization has intensified: strike pickets, public meetings, “dead college” operations, town general assemblies. Depuis trop longtemps, l'école n'est plus une priorité des Gouvernements. Nombre des réformes successives ont en commun le même objectif : réaliser des économies sur l'éducation des enfants. Les rares révisions qui ne concernent pas l'aspect budgétaire et financier alimentent le projet d'une école à deux vitesses qui trie les élèves et continue d'accroître les inégalités scolaires. En témoignent les récentes annonces de Gabriel Attal sur le « choc des savoirs ». Ces annonces, largement rejetées par les personnels de l'éducation nationale, ne correspondent en rien aux revendications de ces professionnels qui demandent les moyens matériels nécessaires à l'exercice de leurs métiers (recrutements, équipements, entretien des locaux) et une revalorisation de leurs salaires. Aujourd'hui, l'enseignement privé sous contrat est financé à 73 % par des fonds publics. Dans le projet de loi de finances 2024, l'enseignement privé a obtenu une augmentation de 6,70 % pour un total de 9 milliards d'euros de crédits de paiement quand l'augmentation pour l'enseignement scolaire public a été bien moindre avec une augmentation de 4,58 % pour le 1er degré et de 5,40 % pour le 2nd degré. Pire, l'annonce récente de 10 milliards d'euros d'économies sur les dépenses de l'État par Bruno Le Maire va aggraver la situation déjà catastrophique dans laquelle se trouve l'école publique. La mission Enseignement scolaire est l'une des plus impactées par cette coupe sèche, avec près de 692 millions d'euros d'économies dont environ 70 % concernent des dépenses de personnels. Il y aura concrètement en 2024 moins d'adultes dans les établissements scolaires pour encadrer les élèves (enseignants, CPE, AED, médecins et infirmières scolaires, psychologues...). Cette décision est extrêmement grave, alors même que les personnels revendiquent un plan massif de recrutements pour l'école publique. En Seine-Saint-Denis, la situation est telle que l'intersyndicale éducation a présenté un grand plan d'urgence pour le département avec pour principal mot d'ordre la réduction des inégalités. Ce travail mené par les syndicats révèle qu'en Seine-Saint-Denis, il manque 2 200 postes d'AESH, 175 CPE, 650 assistants d'éducation, 320 assistants pédagogiques et que la création en urgence de 5 000 postes d'enseignants pour la rentrée 2024 est primordiale. Mobilisés depuis le 26 février 2024, jour de rentrée, les personnels et les parents d'élèves étaient le lendemain plus de 700 devant la DSDEN 93 à Bobigny. Depuis, la mobilisation s'est intensifiée : piquets de grèves, réunions publiques, opérations « collège mort », assemblées générales de ville. Hier, la journée de mobilisation à l'appel de l'intersyndicale a été très fortement suivie : 60 % de grévistes dans le département, plus de 4 500 personnes en manifestation à Paris, 450 personnes en assemblée générale départementale. Les personnels et parents d'élèves sont déterminés et ont prévu de poursuivre la mobilisation jusqu'à satisfaction de leurs revendications. Qu'attend Mme la ministre pour les recevoir ? Mme la députée a également réalisé un audit à destination des établissements publics du 1er et 2nd degré de sa circonscription avec l'aide des syndicats et des parents d'élèves. Au lycée Louise Michel à Bobigny, les absences ne sont pas remplacées. Certains élèves ont perdu plus d'un mois de cours car le remplacement d'un enseignant en congé paternité n'a pas été assuré. Il manque 18 heures d'accompagnement AESH sur l'établissement. Le nombre moyen d'élève par classe est de 29 avec des pics à 35, notamment dans la filière technologique (35 élèves en ST2S, en STMG) et en première générale (35 élèves). Le lycée a décidé de créer une classe supplémentaire sur sa marge dite d'autonomie mais les effectifs restent trop importants. Depuis plus d'un an, il n'y a pas d'infirmière dans cet établissement. Un demi-poste d'AED a également été supprimé sans diminution du nombre d'élèves dans l'établissement. Elle lui demande demande ce qu'elle compte faire pour répondre à l'urgence de la situation en Seine-Saint-Denis et plus spécifiquement pour le lycée Louise Michel de Bobigny.

Deux demi-postes d'enseignants sont restés vacants pendant plusieurs mois. Une enseignante de lettres, dont l'absence était prévue de longue date, n'est pas remplacée. Des élèves, dont certains passent le baccalauréat de français cette année, n'ont plus cours de français depuis bientôt un mois. Il manque deux postes de CPE et plusieurs assistants d'éducation pour assurer le bon fonctionnement de la vie scolaire. Il y a seulement un poste équivalent temps plein de conseillère d'orientation psychologue et 1,8 poste d'infirmière sur l'établissement pourtant fréquenté par 2 400 élèves. Elle lui demande ce qu'elle compte faire pour répondre à l'urgence de la situation en Seine-Saint-Denis et plus spécifiquement pour le lycée Eugène Delacroix de Drancy.

Au collège République (REP +) à Bobigny, les absences courtes et longues, même prévues, ne sont jamais remplacées. Une enseignante de mathématiques absente depuis trois mois (dont l'absence était prévue) n'a pas été remplacée, laissant plusieurs classes sans cours de mathématiques durant cette période. Un poste de technologie est resté vacant jusqu'au mois de février 2024. Plusieurs élèves pâtissent du manque d'AESH affectés à l'établissement. Les parents d'élèves déplorent un nombre trop important d'élèves dans l'établissement ce qui entraîne des problèmes de sécurité. La suppression d'un poste de CPE n'arrange rien. Il manque également un assistant pédagogique et il n'y a qu'une seule assistante sociale qui intervient sur l'établissement alors qu'il y a 900 élèves. Le poste de psychologue scolaire, partagé avec d'autres établissements, permet une présence sur l'établissement un jour et demi par semaine seulement. A la rentrée 2023-2024, le collège accueillait 55 élèves de plus qu'à la rentrée 2022-2023 : il s'agit de la plus forte augmentation d'effectif dans le département alors que cet établissement est déjà le plus fréquenté de la Seine-Saint-Denis. Alors que la moyenne des établissements REP+ est de 590 élèves dans l'académie, le collège République accueille déjà 900 élèves et les premières estimations prévoient 50 élèves supplémentaires pour la rentrée 2024-2025. Elle lui demande ce qu'elle compte faire pour répondre à l'urgence de la situation en Seine-Saint-Denis et plus spécifiquement pour le collège République de Bobigny.

Au collège Pierre Sémard à Drancy, 233 heures de français ont été perdues depuis le début de l'année scolaire faute de remplacement. Un poste en enseignement musical n'a été pourvu qu'à partir du mois de décembre 2023. 180 heures de musique ont été perdues pour les élèves de cet établissement. Certains élèves ont eu seulement 5 heures d'enseignement musical depuis le début de l'année. De manière générale, les absences courtes et longues ne sont pas remplacées. Il manque au moins 4 AESH sur l'établissement. Sur le poste et demi d'infirmière prévu, seul un demi-poste a été pourvu. Le poste de psychologue reste également vacant. Il manque au moins un poste de CPE et deux postes d'assistant d'éducation pour assurer le bon fonctionnement de la vie scolaire. Seul un demi-poste d'assistante sociale est pourvu sur l'établissement. La psychologue scolaire, qui intervient sur plusieurs établissements, ne peut être présente qu'une journée par semaine. Les trois quarts des élèves ne bénéficient pas d'un accompagnement AESH correspondant aux préconisations de la maison départementale des personnes handicapées (MDPH). Les personnels et les parents d'élèves déjà mobilisés à plusieurs reprises en 2023 déplorent également un sureffectif global dans l'établissement qui, combiné au manque d'encadrants, engendre des difficultés pédagogiques et des problèmes de sécurité. Il manque au moins un demi-poste de CPE et plusieurs assistants d'éducation pour permettre le bon fonctionnement de la vie scolaire. Le seul poste d'assistant social n'est pas suffisant. La suppression du poste de médiateur a également un impact sur le climat scolaire au sein de l'établissement. Un poste d'infirmière a été supprimé. De ce fait, il n'y a pas d'infirmière dans l'établissement les lundis, mardis et mercredis. Il manque plusieurs AESH pour plusieurs élèves qui devraient bénéficier d'un accompagnement. Mme Raquel Garrido alerte Mme la ministre de l'éducation nationale et de la jeunesse sur l'état critique dans lequel se trouve l'école publique, particulièrement dans le département de la Seine-Saint-Denis, faute de moyens alloués pour mener à bien les missions qui lui sont confiées. Depuis trop longtemps, l'école n'est plus une priorité des gouvernements. Nombre des réformes successives ont en commun le même objectif : réaliser des économies sur l'éducation des enfants. Les rares révisions qui ne concernent pas l'aspect budgétaire et financier alimentent le projet d'une école à deux vitesses qui trie les élèves et continue d'accroitre les inégalités scolaires. En témoignent les récentes annonces de Gabriel Attal sur le « choc des savoirs ». Ces annonces, largement rejetées par les personnels de l'éducation nationale ne correspondent en rien aux revendications de ces professionnels qui demandent les moyens matériels nécessaires à l'exercice de leurs métiers (recrutements, équipements, entretien des locaux) et une revalorisation de leurs salaires. Aujourd'hui, l'enseignement privé sous contrat est financé à 73 % par des fonds publics. Dans la loi de finances pour 2024, l'enseignement privé a obtenu une augmentation de 6,70 % pour un total de 9 milliards d'euros de crédits de paiement quand l'augmentation pour l'enseignement scolaire public a été bien moindre avec une augmentation de 4,58 % pour le 1er degré et de 5,40 % pour le 2nd degré. Pire, l'annonce récente de 10 milliards d'euros d'économies sur les dépenses de l'État par Bruno Le Maire va aggraver la situation déjà catastrophique dans laquelle se trouve l'école publique. La mission « Enseignement scolaire » est l'une des plus impactées par cette coupe sèche avec près de 692 millions d'euros d'économies dont environ 70 % concernent des dépenses de personnels. Il y aura concrètement en 2024 moins d'adultes dans les établissements scolaires pour encadrer les élèves (enseignants, CPE, AED, médecins et infirmières scolaires, psychologues...). Cette décision est extrêmement grave alors même que les personnels revendiquent un plan massif de recrutements pour l'école publique. En Seine-Saint-Denis, la situation est telle que l'intersyndicale éducation a présenté un grand plan d'urgence pour le département avec pour principal mot d'ordre la réduction des inégalités. Ce travail mené par les syndicats révèle qu'en Seine-Saint-Denis, il manque 2 200 postes d'accompagnant d'élèves en situation de handicap (AESH), 175 conseillers principaux d'éducation (CPE), 650 assistants d'éducation, 320 assistants pédagogiques et que la création en urgence de 5 000 postes d'enseignants pour la rentrée 2024 est primordiale. Mobilisés depuis le 26 février 2024, jour de rentrée, les personnels et les parents d'élèves étaient le lendemain plus de 700 devant la direction des services départementaux de l'éducation nationale (DSDEN 93) à Bobigny. Depuis, la mobilisation s'est intensifiée : piquets de grèves, réunions publiques, opérations « collège mort », assemblées générales de ville. Le jeudi 7 mars 2024, la journée de mobilisation à l'appel de l'intersyndicale a été très fortement suivie : 60 % de grévistes dans le département, plus de 4 500 personnes en manifestation à Paris, 450 personnes en assemblée générale départementale. Les personnels et parents d'élèves sont déterminés et ont prévu de poursuivre la mobilisation jusqu'à satisfaction de leurs revendications. Qu'attend Mme la ministre pour les recevoir ? Mme la députée a également réalisé un audit à destination des établissements publics du 1er et 2nd degré de sa circonscription avec l'aide des syndicats et des parents d'élèves. À l'école élémentaire Edouard Vaillant (REP) à Bobigny, il manque 18 heures de prise en charge AESH. De ce fait, 2 élèves ne bénéficient pas d'une prise en charge à la hauteur des préconisations de la maison départementale des personnes handicapées (MDPH). Elle lui demande ce qu'elle compte faire pour répondre à l'urgence de la situation en Seine-Saint-Denis et plus spécifiquement pour l'école élémentaire Edouard Vaillant de Bobigny.

Mme Raquel Garrido alerte Mme la ministre de l'éducation nationale, de la jeunesse, des sports et des jeux Olympiques et Paralympiques sur le manque criant d'accompagnantes des élèves en situation de handicap (93 % des AESH sont des femmes selon la CGT- educ'action) dans les établissements scolaires français. Depuis plusieurs années, les AESH dénoncent l'absence de reconnaissance de leur travail. Elles se sont d'ailleurs une nouvelle fois mobilisées le jeudi 1er février 2024, aux côtés de l'ensemble des personnels de l'éducation nationale. Ces agentes contractuelles de l'État travaillent avec plusieurs enfants par classe, jusqu'à 10 élèves par personnel, parfois dans plusieurs établissements. Dans la circonscription de Mme la députée, une AESH lui a confié assurer le suivi de 7 élèves qui ont des profils et des handicaps variés (4 le matin et 3 l'après-midi). Comment assurer un accompagnement correct des élèves dans ces conditions ? Malgré leurs conditions de travail dégradées, les AESH sont totalement dévouées à leur tâche. Force est de constater que l'éducation nationale ne reconnaît pas ce dévouement. Pour 24 heures de travail par semaine, les AESH touchent en moyenne un salaire dérisoire de 800 euros par mois. Ainsi, beaucoup se retrouvent sous le seuil de pauvreté et n'ont d'autre choix que de cumuler deux emplois. La faible attractivité du métier d'AESH a d'ailleurs été mise en avant dans un rapport de 2022 de la Défenseure des droits : L'accompagnement humain des élèves en situation de handicap. Ce rapport indique que « L'argument principalement mis en avant par les académies pour justifier le non-respect des décisions des MDPH est leur difficulté à recruter des AESH ». Rien d'étonnant au regard du niveau de rémunération proposé et des conditions de travail décrites. D'après les chiffres du ministère de l'éducation nationale, en 2022, il y avait 132 200 AESH pour 430 000 élèves en situation de handicap scolarisés en milieu ordinaire. Le décalage est flagrant entre le nombre de professionnels et le nombre d'enfants dont l'accompagnement a été notifié par une MDPH. À titre d'exemple, dans la circonscription de Mme la députée, en Seine-Saint-Denis, de nombreux parents d'élèves l'alertent sur l'accompagnement seulement partiel de leur enfant ou sur l'absence totale de prise en charge. Au sein d'une école de Drancy, 59 heures dues à des élèves ne sont pas effectuées par manque d'AESH. Or les AESH ont un rôle essentiel dans l'inclusion des enfants et dans leur réussite scolaire. Aujourd'hui, des jeunes en situation de handicap se retrouvent sans accompagnement en classe. Certains parents doivent arrêter leur activité professionnelle pour s'occuper d'eux. On est dans une situation de maltraitance des élèves et des accompagnants qui sont épuisés par leur travail. Depuis plusieurs années, les AESH signalent leurs conditions de travail indignes et se mobilisent pour obtenir un véritable statut. Le 18 octobre 2023, les AESH et parents d'élèves de l'académie de Créteil se sont rendus une nouvelle fois devant le rectorat d'académie pour exposer leurs revendications à la nouvelle rectrice. Au-delà de la revendication d'un véritable statut accompagné de salaires décents et d'une formation de qualité, les AESH dénoncent la mise en place des pôles inclusifs d'accompagnements localisés et manifestent leur inquiétude face à la fusion des métiers d'AESH et des assistants d'éducation (AED). La mise en place des pôles inclusifs d'accompagnements localisés (PIAL) par Jean-Michel Blanquer en 2019 a en effet aggravé les conditions de travail des AESH : augmentation du nombre d'élèves à accompagner par personnel, emplois du temps changeants et mutations variables sans explication. Le PIAL ne répond donc pas à son objectif principal : des dizaines de milliers d'enfants sont toujours privés du droit fondamental à l'instruction. L'État français est donc hors la loi dans la mesure où il ne respecte pas les articles 23 et 28 de la Convention internationale des droits de l'enfant. Répondre à cette situation critique est pourtant assez simple : la création d'un véritable statut pour les AESH qui leur assure un niveau de rémunération à temps complet pour 35 heures travaillées par semaine comprenant 3 heures de formation et de concertation avec 8 heures de décharge. Elle lui demande si elle compte créer ce statut.
