Mr. Nicolas Bonnet draws the attention of the Minister of Ecological Transition, Biodiversity and International Negotiations on Climate and Nature to the eco-organization Alcome, responsible for the REP Tobacco sector. The law of February 10, 2020 relating to the fight against waste and the circular economy (AGEC) provides for the establishment, from January 1, 2021, of a sector with extended producer responsibility for tobacco products equipped with filters, whether or not they contain plastic. In 2021, the eco-organization Alcome was approved by the Ministry of Ecological Transition to be the organization in charge of this REP sector. However, this approval today poses numerous difficulties which call into question its relevance. First, it contravenes Article 5.3 of the WHO Framework Convention on Tobacco Control, which limits exchanges between public decision-makers and tobacco manufacturers to what is strictly necessary and in a transparent manner. Indeed, Alcome is today made up of the main tobacco manufacturers. However, this approval by the Government, in addition to giving these manufacturers the possibility of establishing multiple contacts with decision-makers, whether local or national, maintains a form of confusion among the user, who cannot distinguish the general interest mission of the Ministry of response to the specific interests of these economic actors responsible for the sector. Secondly, multiple difficulties are observed in the execution by Alcome of the obligations listed in its specifications. In particular, Alcome has been sanctioned on several occasions for non-compliance with its obligations and also fails to respect its commitments in terms of territorial coverage. Several parliamentarians also reported difficulties encountered by certain communities in collecting the financial sums owed by the eco-organization. In this context, he asks how the Government plans to enforce the prerogatives imposed on this eco-organization, but also the financing deadlines for local authorities, despite the numerous constraints already pronounced. In view of all of these issues, he asks whether the Government intends to renew REP approval for the tobacco industry or whether it plans to grant governance of this sector to a more legitimate actor.

Mr. Nicolas Bonnet questions the Minister of Labor and Solidarity on the specific allowance for early termination of activity for employees and civil servants exposed to asbestos, as well as on related retirement rights. The asbestos early retirement scheme allows eligible employees and civil servants to cease their activity early and to receive the early cessation of activity allowance for workers. asbestos (Acaata) or the specific allowance for early cessation of activity (Ascaa) until their retirement. The amount of the allowance is calculated on the basis of reference remuneration over the last twelve months of activity. However, a situation of breakdown in equity between employees and civil servants exposed to asbestos appears. We can distinguish four scenarios, depending on the status of the person at the time of the request for the allowance (employee or civil servant) and according to the location of the activity which caused exposure (private sector or public sector). It appears that certain people, for example a person who was an employee in a classified asbestos company before becoming a civil servant, are, without valid reason, more disadvantaged than others, both in terms of the amount of the allowance and the calculation of retirement rights. This difference significant could be explained in particular by whether or not bonuses are taken into account in the reference remuneration used for the calculation. However, it must be remembered that the health risk linked to exposure to asbestos knows neither the status nor the place of exposure of the worker. Thus, he asks him what actions he plans to correct this breach of equity while this situation is urgent, to the extent that the amounts in gaming can represent a significant portion of the income of workers exposed to asbestos.
