Tom Lantos Pulmonary Hypertension Research and Education Act of 2008 - Expresses the sense of the Congress that: (1) the Secretary of Health and Human Services, acting through the Director of the National Institutes of Health (NIH) and the Director of the National Heart, Lung, and Blood Institute, should continue aggressive work on pulmonary hypertension; and (2) the Director of the Institute should continue research to expand the understanding of the causes of, and to find a cure for, pulmonary hypertension. Requires inclusion of information on the status of pulmonary hypertension research at NIH in biennial reports to Congress. Requires the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to carry out an educational campaign to increase public awareness of pulmonary hypertension. Requires the Secretary, acting through the Administrator of the Health Resources and Services Administration (HRSA) and the Director of CDC, to carry out an educational campaign to increase awareness of pulmonary hypertension among health care providers. Directs the Comptroller General to study and report to Congress on Medicare and Medicaid coverage standards that apply to patients with pulmonary hypertension, including standards for all therapies approved by the Food and Drug Administration (FDA) for the treatment of pulmonary hypertension.

New Alternative Transportation to Give Americans Solutions Act - Expresses the sense of Congress that 10% of new vehicles sold in the United States should be natural gas vehicles by December 31, 2018. Amends the Internal Revenue Code to: (1) increase the rate of the alternative fuel vehicle refueling property tax credit with respect to natural gas fuel; (2) allow new tax credits for investment in energy security bonds and natural gas vehicle production bonds; (3) allow a new tax credit for producing vehicles fueled by natural gas or liquified natural gas; (4) allow an increased alternative motor vehicle tax credit for the purchase of vehicles fueled by natural gas or liquified natural gas; and (5) extend through 2017 the tax credits for alternative fuel vehicle refueling property expenditures and for new qualified alternative fuel vehicles. Requires the General Services Administration (GSA) to study whether the federal fleet should increase the number of its natural gas vehicles. Requires each retail automotive fueling station owned by a major integrated oil company to have at least one pump dispensing natural gas for automotive purposes by January 1, 2018. Imposes a civil fine on oil companies that fail to comply with such requirement.

Sanctuary Enhancement Act of 2008

Sanctuary Enhancement Act of 2008 - Amends the National Marine Sanctuaries Act to require that the National Marine Sanctuary System consist of national marine sanctuaries authorized or established by an Act of Congress (in addition to sanctuaries currently designated by the Secretary of Commerce) and marine national monuments. Sets forth the System's mission. Requires the Secretary to prepare, maintain, and update an ecological classification of the nation's marine environment and an identification of maritime heritage resources as a national inventory of marine ecoregions and maritime heritage resources under U.S. jurisdiction. Requires the Secretary to strive to include in the System, by 2030, sites that will incorporate a full range of the nation's marine ecoregions and rare and unique marine habitats, and a full range of maritime heritage resource areas. Modifies various requirements regarding the designation and implementation of marine sanctuaries. Expands the list of prohibited activities. Amends provisions making a violation of a prohibited activity a criminal offense to: (1) exclude from those provisions foreign governments and their entities; and (2) add a requirement that a violation be knowing. Increases the maximum term of imprisonment and the maximum civil fine. Revises requirements regarding the preparation of fishing regulations applicable to a marine sanctuary. Requires that System research and monitoring conducted, supported, or permitted by the Secretary be made available to the public unless the Secretary determines that public disclosure may result in the destruction of, loss of, or injury to any System resource. Modifies requirements regarding special use permits.

Non-Foreign Area Retirement Equity Assurance Act of 2008 or the Non-Foreign AREA Act of 2008 - Revises federal employee locality-based comparability payments provisions to include U.S. territories and possessions, including the Commonwealth of Puerto Rico and the Commonwealth of the Northern Mariana Islands, within a pay locality. Revises the calculation of allowances based on living costs and conditions of environment for pay of employees stationed outside the continental United States or in Alaska to apply it only to areas designated as of December 31, 2008. Provides a formula for adjustment of such rate using a transition schedule for calendar years 2009-2011. Requires adjustment of special rates of pay in such areas in accordance with regulations prescribed by the Director of the Office of Personnel Management (OPM) or by the Department of Veterans Affairs (VA) for VA personnel. Allows a temporarily raised limitation on the amount of special rates during the transition period. Expresses the sense of Congress that application of this Act to an employee should not result in a decrease in take home pay. Defines as covered employees for purposes of this Act those who are or will be eligible for a cost-of-living allowance (COLA). Allows an employee subject to this Act's transition schedule and who retires from service during the period from January 1, 2009, through December 31, 2011, to elect to have the COLA paid during that period considered as basic pay for purposes of annuity computation. Provides procedures for employees to make an irrevocable election to be covered by this Act.

Climate Market, Auction, Trust & Trade Emissions Reduction System Act of 2008, or the Climate MATTERS Act of 2008 - Declares the purpose of this Act to establish a federal program to reduce US greenhouse gas (GHG) emissions substantially enough by 2050 to avert the catastrophic impacts of global climate change. Directs the Secretary of the Treasury to establish an international reserve GHG emission allowance program, whose allowance sales proceeds shall be used to mitigate the negative impacts of global climate change on disadvantaged communities in World Trade Organization (WTO) participant countries. Establishes the International Climate Change Commission to determine annually whether a WTO participant country has taken certain action to limit its GHG emissions. Amends the Internal Revenue Code to: (1) establish a system for issuing, auctioning, recording, and tracking GHG emission allowances; and (2) impose an excess emissions penalty on owners or operators of covered facilities that fail to submit one or more emission allowances to the Secretary for any year. Establishes a Carbon Market Efficiency Board to: (1) analyze information on the GHG emission allowance market; and (2) authorize the Secretary to carry out cost relief measures if the market poses a substantial harm to the U.S. economy. Provides for the distribution of emission allowances to owners and operators of fossil fuel-fired electric power generating facilities and of energy intensive manufacturing facilities. Establishes: (1) the Deficit Reduction Trust Fund; and (2) the Citizen Protection Trust Fund (CPTF). Directs the Secretary to administer a Climate Change Rebate Program. Provides for a healthy families fund. Sets forth allocations of specified CPTF account funds for: (1) investment in natural resource adaptation to impacts of climate change and ocean acidification; (2) owners and operators of covered facilities who take actions that result in verified GHG emission reductions; (3) states that comply with certain federal building energy standards; (4) states with GHG emission reduction programs exceeding federal GHG emission reduction targets; (5) reductions in GHG emissions from the agriculture and forestry sectors, including those from deforestation activities in foreign countries; and (6) states and load-serving entities that implement energy-efficiency programs. Requires distribution of certain funds for grants for fixed guideway transit and other specified alternative transportation projects. Requires the Administrator of the Environmental Protection Agency (EPA) to: (1) develop a federal greenhouse gas registry; (2) make certain GHG emission determinations for covered facilities; and (3) promulgate regulations that require that U.S. GHG emissions in uncovered sectors do not grow.

Nonnative Wildlife Invasion Prevention Act - Requires the Secretary of the Interior to promulgate regulations establishing a process for assessing the risk of all nonnative wildlife species proposed for importation into the United States, other than those included in a list of approved species issued under this Act. Sets forth factors that must be considered at minimum, including the identity of the organism to the species level, the geographic source, and the likelihood of spread and harm to groups of species or habitats. Provides procedures for issuance and expansion of the approved-for-importation list. Establishes prohibitions on: (1) importation of nonnative species or viable eggs; (2) permit violation; and (3) knowing possession, purchase, sale, barter, release, or breeding (including of prohibited species previously imported legally). Allows the imposition of fees to recover the costs of assessing risks of nonnative wildlife species. Establishes a Nonnative Wildlife Invasion Prevention Fund into which such fees will be deposited.

Amends the Commodity Exchange Act to make it unlawful for a person to enter into or execute an otherwise excluded swap transaction or exempt transaction involving crude oil, heating oil, gasoline, or diesel fuel (specified energy commodity), unless the person has been certified by the Commodities Future Trading Commission (CFTC) as having the capacity of accepting physical delivery of the commodity. Makes it unlawful, as well, for any person to hold a contract or agreement of sale of a specified energy commodity for future delivery, which is otherwise an excluded swap transaction or an exempt transaction, unless the CFTC has certified that the person has the capacity to produce or manufacture the commodity.

Directs the Secretary of Health and Human Services to provide for a competitive acquisition ombudsman within the Centers for Medicare & Medicaid Services to respond to complaints and inquiries by suppliers and individuals. Specifies topics for the Comptroller General's required study and report to Congress on the impact of competitive acquisition of DME on suppliers, manufacturers, and patients. Sets forth a special rule for the competitive acquisition program for diabetic testing strips.

Amends the Immigration and Nationality Act to extend the period for filing a naturalization application after completion of eligible military service. Eliminates conditional permanent resident status for certain alien spouses (and sons or daughters) who are members or veterans of the Armed Forces. Sets forth factors to be considered in initiating removal proceedings against active duty members of the Armed Forces or veterans. Prohibits removal of an alien who is a member or veteran of the Armed Forces based upon: (1) illegal reentry; (2) expedited removal for commission of certain crimes; or (3) inspection for admissions or asylum. Exempts from specified grounds of inadmissibility or deportation an alien who is a member or veteran of the Armed Forces or an alien who is the spouse, child, son, daughter, parent, or minor sibling of a member serving in the Armed Forces. Authorizes the Secretary of Homeland Security or the Attorney General to waive other grounds (with specified exceptions) for such removal. Sets forth waiver factors. Exempts from worldwide immigrant visa numerical limitations an alien who is eligible for a family-sponsored immigrant visa and is either the spouse or child of a permanent resident alien who is serving in the Armed Forces. Directs the Secretary to adjust to permanent resident status an alien who is a parent, spouse, child, son or daughter, or minor sibling of a citizen or person eligible for naturalization through military service who is serving or has served in the Armed Forces during specified periods of hostilities. Permits posthumous benefits under specified circumstances. Waives certain grounds of inadmissibility.

Gas Price Spike Act of 2008 - Amends the Internal Revenue Code to impose a windfall profit tax on crude oil, natural gas, or products of crude oil or natural gas. Defines "windfall profit" as so much of the profit on a sale of crude oil, natural gas, or related products as exceeds a reasonable profit. Establishes the Reasonable Profits Board to determine levels of reasonable profit from the sale of such products. Allows a tax credit for the purchase of certain fuel-efficient, American-made passenger vehicles. Authorizes the Secretary of Transportation to make grants to operators of mass transit systems, including bus and commuter rail systems, to reduce passenger fares on such systems.

American Steel First Act of 2008 - Prohibits heads of the Department of Homeland Security (DHS), the Department of Defense (DOD), and the Department of Transportation (DOT) from obligating or expending funds or providing financial assistance for projects for the construction, alteration, maintenance, or repair of a public building or public work unless all of the iron and steel used in such project is produced in the United States. Waives such prohibition in cases where: (1) the prohibition would be inconsistent with the public interest; (2) iron and steel are not produced in the United States in sufficient and reasonably available quantities of a satisfactory quality; or (3) inclusion of iron and steel produced in the United States will increase the cost of the overall project contract by more than 25%. Prohibits waivers by a department head for products produced in a foreign country that is determined by the U.S. Trade Representative to have violated the terms of an agreement with the United States by discriminating against products covered by the agreement that are produced in the United States. Prohibits such department heads from imposing financial assistance restrictions on: (1) states that impose more stringent requirements on the use of iron and steel in foreign countries in projects carried out with such assistance; or (2) recipients that comply with such state imposed requirements. Makes any person who intentionally labels or represents a product used in a project under this Act as "Made in America" when it is not ineligible for another department contract from for six years. Requires the Secretary of Transportation to: (1) publish a justification for a waiver of the prohibition against obligating funds to carry out the Surface Transportation Assistance Act of 1982, highway projects, public transportation projects, or aviation programs unless the steel, iron, and manufactured products used are produced in the United States; and (2) provide for public notice and comment for such waiver.
