Derivative Trading Accountability and Disclosure Act - Establishes within the Department of the Treasury the Office of Derivatives Supervision (Office) to: (1) implement this Act and oversee the registration of derivatives traders; (2) coordinate with the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) in developing comprehensive, standardized regulations for derivatives transactions; and (3) facilitate information exchange among specified agencies regarding the development of derivatives regulations. Makes it unlawful for any unregistered derivatives trader to make use of the mails or any means or instrumentality of interstate commerce to effect any transactions in, or to induce or attempt to induce the purchase or sale of any type of derivative. Prescribes registration requirements for derivatives traders. Grants the SEC and CFTC authority to: (1) issue separate proposed regulations imposing specified requirements governing trading in the derivative instruments over which each Commission has jurisdiction; (2) impose civil penalties; (3) issue cease and desist orders; and (4) order an accounting and disgorgement. Requires the Office to invite representatives of the SEC, the CFTC, regulators of domestic and foreign boards of trade, and other experts, to participate in a working group of international regulators to review international standards in order to evaluate international regulations regarding harmonization of substantive commodities and securities regulation for economically equivalent instruments.

Veterans' Benefits Act of 2010

Veterans' Insurance and Health Care Improvements Act of 2009 - Makes permanent a current temporary extension of Servicemembers' Group Life Insurance (SGLI) coverage for totally disabled veterans. Allows veterans under age 60 to increase coverage under Veterans' Group Life Insurance (VGLI) in increments of up to $25,000 during each five-year period, to a maximum amount of $400,000. Eliminates a reduction by the Secretary of Veterans Affairs (VA) in the amount of an accelerated death benefit for terminally ill persons insured under SGLI and VGLI. Establishes, with respect to the provision of VA health care, a priority level for veterans awarded the Medal of Honor equal to the level of Purple Heart recipients. Provides permanent VA authority to provide hospital care, medical services, and nursing home care to Vietnam-era herbicide-exposed veterans and Persian Gulf War veterans who have insufficient medical evidence to establish a service-connected disability. Prohibits the Secretary from collecting copayments from catastrophically disabled veterans for the receipt of VA hospital care or medical services. Establishes within the Veterans Health Administration: (1) a Director of Physician Assistant Services; and (2) a Committee on Care of Veterans with Traumatic Brain Injury. Amends the Veterans' Mental Health and Other Care Improvements Act of 2008 to revise participant eligibility requirements under a pilot program of contract care for veterans residing in highly rural areas. Establishes in the Treasury the Qualified World War II Veterans Equity Compensation Fund to provide monthly payments of $1,000 to former active-duty World War II veterans who have not received benefits under the Servicemen's Readjustment Act of 1944.

21 Century FHA Housing Act of 2009 - Amends the National Housing Act to declare that the Secretary of Housing and Urban Affairs (HUD) is not subject to the National Environmental Policy Act of 1969 when insuring any mortgage for a one-family unit in a multifamily project that holds an undivided interest in the common areas and facilities which serve the project (condominium). Authorizes the Secretary to: (1) appoint and fix the compensation of HUD personnel; and (2) use certain funds to maintain an appropriate level of investment in information technology in order to upgrade HUD technology systems used in carrying out personnel-related functions. Requires the Secretary to: (1) establish a comprehensive training and education program to improve certain HUD services to users of Federal Housing Administration (FHA) mortgage insurance programs; and (2) conduct an ongoing review of delinquencies among recent single family housing mortgage originations. Amends the Helping Families Save Their Homes Act of 2009 to direct the Secretary to implement procedures that analyze mortgage performance during the mandatory random review of mortgagees of mortgages on one- to four-family residences who potentially present a high risk to the Mutual Mortgage Insurance Fund. Expresses the sense of the Congress that the Secretary of the Treasury, the Secretary of HUD, and the Director of the Federal Housing Finance Agency should use their authorities under the Emergency Economic Stabilization Act of 2008 (EESA), the Housing and Economic Recovery Act of 2008, and other statutory and regulatory authorities to provide financial support and assistance to facilitate increased warehouse credit capacity by qualified warehouse lenders. Urges that such financial support and assistance: (1) be used only to expand the amount of credit or lending capacity made available to qualified mortgage lenders by qualified warehouse lenders in order to fund residential mortgage loans; and (2) be provided in a form and manner which might include direct loans, guarantees, credit enhancement, and other incentives. Amends the National Housing Act to authorize the Secretary to implement alternative insured mortgage foreclosure avoidance demonstration programs, including methods involving short sales and deeds in lieu of foreclosure, and even partial or full payment of insurance benefits to the mortgagee.

Employment Non-Discrimination Act of 2009 - Prohibits employment discrimination on the basis of actual or perceived sexual orientation or gender identity by covered entities (employers, employment agencies, labor organizations, or joint labor-management committees). Prohibits preferential treatment or quotas. Allows only disparate treatment claims. Prohibits related retaliation. Makes this Act inapplicable to: (1) religious organizations; and (2) the relationship between the United States and members of the Armed Forces. Declares that this Act does not repeal or modify any federal, state, territorial, or local law creating a special right or preference concerning employment for a veteran. Provides for the construction of this Act regarding: (1) enforcement by employers of rules and policies; (2) sexual harassment; (3) certain shared facilities such as showers or dressing facilities; (4) construction of new or additional facilities; (5) dress and grooming standards; and (6) provision of employee benefits to married vs. unmarried couples. Declares that, in this Act, "married" refers to a legal union between one man and one woman. Prohibits the Equal Employment Opportunity Commission (EEOC) from collecting statistics from covered entities on actual or perceived sexual orientation or gender identity or compelling the collection by covered entities of such statistics. Provides for enforcement, including giving the EEOC, the Librarian of Congress, the Attorney General, and U.S. courts the same enforcement powers as they have under specified provisions of the Civil Rights Act of 1964, the Government Employee Rights Act of 1991, and other specified laws. Allows actions and proceedings, subject to exception, against the United States and the states.

Automobile Dealer Economic Rights Restoration Act of 2009 - Prohibits an automobile manufacturer (manufacturer) in which the federal government has an ownership interest, or which receives loans from the federal government, from depriving an automobile dealer (dealer) of its economic rights. Requires the manufacturer to honor those rights as they existed for Chrysler LLC and General Motors Corporation dealers prior to the commencement of the bankruptcy cases of each corporation, including dealer rights to recourse under state law. Requires the appropriate manufacturer to restore the franchise agreement between the dealers and Chrysler LLC or General Motors that was in effect prior to the commencement of their respective bankruptcy cases, and to take assignment of such agreements. States that nothing in this Act is intended to make null and void the transfer of substantially all the assets of such corporations.

Veterans and Survivors Behavioral Health Awareness Act - Directs the Secretary of Veterans Affairs (VA) to provide scholarships to individuals pursuing education or training in behavioral health care specialties that are critical to the operations of Vet Centers (centers for readjustment counseling and related mental health services for veterans) in order to recruit and retain individuals with such specialties for service in Vet Centers. Conditions the scholarship on the recipient's agreeing to serve in such a capacity for whatever period the Secretary specifies in the agreement. Directs the Secretary, on receipt of a request for counseling from an individual who has been discharged or released from active service, to: (1) provide referrals to assist the individual in obtaining mental health care and services outside the VA; and (2) if pertinent, advise such individual of the individual's rights to apply for review of the discharge or release. Directs the Secretary to award grants to nonprofit organizations that provide emotional support services for survivors of deceased members of the Armed Forces and deceased veterans through the survivors' peers.

National Association of Registered Agents and Brokers Reform Act of 2009 - Amends the Gramm-Leach-Bliley Act to reestablish the National Association of Registered Agents and Brokers (NARAB) as a nonprofit corporation to prescribe, on a multi-state basis, licensing and insurance producer qualification requirements and conditions. Retains states' regulatory authority over: (1) licensing, supervision, disciplining, and setting of licensing fees for insurance producers; and (2) insurance-related consumer protection and unfair trade practices. Authorizes NARAB to: (1) establish membership criteria, including a mandatory criminal background check for state-licensed insurance producers; and (2) deny membership to a state-licensed insurance producer on the basis of the criminal history information obtained. Grants NARAB enforcement powers, including denial of membership to any state-licensed insurance producer for failure to meet membership criteria. States that NARAB membership authorizes an insurance producer to engage in the business of insurance in any state for any lines of insurance specified in the producer's home state license, including claims adjustments and settlement, risk management, and specified insurance-related consulting activities. Retains state regulatory jurisdiction regarding consumer protection and market conduct. Requires NARAB to establish an office of consumer complaints, including a toll-free telephone number. Authorizes NARAB to coordinate with state insurance regulators to: (1) establish a central clearinghouse; and (2) establish a national database for the collection of regulatory information concerning the activities of insurance producers.

Tax Equity for Health Plan Beneficiaries Act of 2009 - Amends the Internal Revenue Code to: (1) exclude from an employee's gross income employer-provided accident and health plan benefits extended to a domestic partner or non-dependent, non-spouse beneficiary eligible to receive such benefits under an employer plan (i.e., "eligible beneficiary"); (2) exempt such benefits paid to eligible beneficiaries from applicable employment and unemployment taxes; (3) allow self-employed individuals a tax deduction for the health insurance costs of their eligible beneficiaries; (4) allow tax-exempt volutary employees' beneficiary associations to provide sick and accident benefits to the domestic partners and non-dependent, non-spouse beneficiaries of their members; and (5) allow reimbursement of the medical expenses of an eligible beneficiary from a health savings account (HSA). Directs the Secretary of the Treasury to provide guidance relating to reimbursements from a flexible spending arrangement and a health reimbursement arrangement attributable to an eligible beneficiary as defined by this Act.

Excludes members of the uniformed services from the definition of "employee." Sets forth requirements for filing: (1) an affidavit of eligibility as such a domestic partner, which shall include a certification that the employee and the domestic partner are each other's sole domestic partners and intend to remain so indefinitely; and (2) a statement upon dissolution of such a domestic partnership.

Gives the Director of the Federal Housing Finance Agency (FHFA) discretion to increase existing mortgage purchase limitations where an increase is warranted by higher median home prices in an area or sub-area and will have a significant impact on the cost or availability of mortgages for such homes. Amends the National Housing Act to raise limitations on the maximum principal obligation of mortgages that may be insured by the Secretary of Housing and Urban Development (HUD). Gives the Secretary discretion to increase mortgage insurance limitations where an increase is warranted by higher median home prices in an area or sub-area and will have a significant impact on the cost or availability of mortgages for such homes.

Credit Card Interchange Fees Act of 2009 - Amends the Truth in Lending Act to prohibit specified electronic payment system network practices, including the imposition of: (1) additional charges on merchants and consumers for premium payment cards; (2) certain restrictions on merchants, including chargebacks for transactions on point of sale terminals that exceed the allowable amount on such devices; (3) restrictions upon network routing; (4) any requirement to meet a minimum number of transactions in any period; or (5) fees or a related adverse action for failure of the merchant to meet such a minimum transactions requirement. Requires an electronic payment system network to disclose its contract terms to the merchant, including its complete operating rules, without restricting the merchant's use of such information. Directs the Federal Trade Commission (FTC) to prescribe regulations to: (1) ensure that the rules, terms, and conditions to which a merchant or consumer is subject under an agreement with an electronic payment system network are neither unfair nor deceptive to consumers and merchants, nor anticompetitive; (2) prohibit any unfair or deceptive act or practice or anticompetitive act or practice that may result from such rule, term, or condition; and (3) regularly review such rules, terms, and conditions. Directs the Board of Governors of the Federal Reserve System to collect and disseminate to the public: (1) complete information on fees charged by each electronic payment system network in connection with consumer-initiated transactions; and (2) the rules, terms, and conditions to which a merchant or a consumer is subject under an agreement with an electronic payment system network for transactions using payment cards.

Small Business Health Options Program Act of 2009 or the SHOP Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services to designate an office within the Department of Health and Human Services (HHS) to administer a health insurance program for small businesses and self-employed individuals to purchase health insurance coverage meeting certain requirements. Establishes a Small Business Health Board to monitor the implementation of the program and make recommendations for improvements. Requires the Administrator of the program to: (1) enter into contracts with health insurance issuers to provide health insurance coverage under this Act; and (2) enter into agreements with entities to serve as navigators to provide information about the program, provide referrals to applicable agencies for any grievance, complaint, or question, and assist in enrollment. Requires a participating employer to ensure that each eligible employee has an opportunity to enroll in a plan. Sets forth requirements for health plans offered under this Act. Requires the Administrator to contract with the National Association of Insurance Commissioners to study: (1) the rating requirements that apply to health insurance purchased in the small group markets in the states and to develop recommendations concerning rating requirements; and (2) the administrative procedures that apply to the program and to health insurance purchased in the small group markets in states. Sets forth premium-setting rules for plans under this Act. Allows a state to prohibit participation in this program if the state offers alternative health benefit plans. Amends the Internal Revenue Code to allow a tax credit for small employers for qualified employee health insurance expenses under this Act.

Requires the Secretary to assess: (1) fees against licensee institutions to cover the cost of administering this Act; and (2) specified civil money penalties upon licensees or other persons for willful violation of this Act or related regulations. Cites safeguards required of licensees, including: (1) tax collection related to Internet gambling; (2) safeguards against fraud, money laundering, and terrorist finance; and (3) safeguards to combat compulsive Internet gambling. Requires the Secretary and any qualified state or tribal regulatory body to prescribe regulations for: (1) development of a Problem Gambling, Responsible Gambling, and Self-Exclusion Program; (2) a list of persons self-excluded from gambling activities at licensee sites; and (3) a program to alert the public to the existence, consequences, and availability of the self -exclusion list. Prohibits a person who is prohibited from gambling with a licensee from collecting any winnings, or recovering any losses that arise as a result of prohibited gambling activity. Shields a financial transaction provider from liability for engaging in financial activities and transactions on behalf of a licensee, or involving a licensee, if such activities are in compliance with federal and state laws. Permits states and Indian tribal authorities to opt-out of Internet gambling activities within their respective jurisdictions. Prohibits electronic cheating devices. Subjects violators of this Act to civil and criminal penalties.

Iran Refined Petroleum Sanctions Act of 2009 - Expresses the sense of Congress that: (1) diplomatic efforts to address Iran's illicit nuclear efforts, unconventional and ballistic missile development programs, and support for international terrorism are more likely to be effective if the President is empowered with explicit authority to impose additional sanctions on the government of Iran; (2) U.S. concerns regarding Iran are strictly the result of that government’s actions; and (3) the people of the United States have feelings of friendship for the people of Iran and regret that developments in recent decades have created impediments to that friendship. States that it should be U.S. policy to: (1) support international diplomatic efforts to end Iran's uranium enrichment program and its nuclear weapons program; (2) encourage foreign governments to direct state-owned and private entities to cease all investment in, and support of, Iran's energy sector and all exports of refined petroleum products to Iran; (3) impose sanctions on the Central Bank of Iran and any other Iranian financial institution engaged in proliferation activities or support of terrorist groups; and (4) work with allies to protect the international financial system from deceptive and illicit practices by Iranian financial institutions involved in proliferation activities or support of terrorist groups. Amends the Iran Sanctions Act of 1996 to direct the President to impose two or more current sanctions under such Act if a person has, with actual knowledge, made an investment of $20 million or more (or any combination of investments of at least $5 million which in the aggregate equals or exceeds $20 million in any 12-month period) that directly and significantly contributed to Iran's ability to develop its petroleum resources. (Under current law the sanction thresholds are $40 million, $10 million, and $40 million, respectively.) Directs the President to impose: (1) sanctions established under this Act (in addition to any current sanctions imposed under the Iran Sanctions Act of 1996) if a person has, with actual knowledge, sold, leased, or provided to Iran any goods, services, technology, information, or support that would allow Iran to maintain or expand its domestic production of refined petroleum resources, including any assistance in refinery construction, modernization, or repair; and (2) sanctions established under this Act if a person has, with actual knowledge, provided Iran with refined petroleum resources or engaged in any activity that could contribute to Iran's ability to import refined petroleum resources, including providing shipping, insurance, or financing services for such activity. Establishes additional sanctions prohibiting specified foreign exchange, banking, and property transactions. Includes references to refined petroleum resources in a presidential report to Congress requesting waiver of sanctions for purposes of national interest. Requires that the President immediately investigate a person upon receipt of credible information that such person is engaged in prohibited investment or other activity. Defines "credible information" as public or classified information or reporting supported by other substantiating evidence. Includes among the exceptions to the imposition of sanctions a situation in which the President determines in writing that the person to which the sanctions would otherwise be applied is: (1) a citizen or resident of a country that is a participant in the Proliferation Security Initiative; or (2) a foreign person organized under the laws of such country and is a subsidiary of a U.S. person. Directs the President to report to the appropriate congressional committees every six months regarding any person who has: (1) provided Iran with refined petroleum resources; (2) sold, leased, or provided to Iran any goods, services, or technology that would allow Iran to maintain or expand its domestic production of refined petroleum resources; or (3) engaged in any activity that could contribute to the enhancement of Iran's ability to import refined petroleum resources. States that the term "petroleum resources" includes petroleum, petroleum by-products, oil or liquefied natural gas, oil or liquefied natural gas tankers, and products used to construct or maintain pipelines used to transport oil or compressed or liquefied natural gas. (Under current law the definition of the term "petroleum resources" is limited to petroleum and natural gas resources.) Defines "petroleum by-products" as gasoline, kerosene, distillates, propane or butane gas, diesel fuel, residual fuel oil, and other goods classified in headings 2709 and 2710 of the Harmonized Tariff Schedule of the United States.

Directs the Secretary to make grants to establish or improve training programs for health care professionals to: (1) improve the quality of immediate and long-term follow-up care for survivors of childhood cancers and their families; and (2) ensure that such care is linguistically and culturally competent. Requires the Director of NIH to make grants to establish pilot programs to develop, study, or evaluate model systems for monitoring and caring for childhood cancer survivors. Requires the Secretary to make grants to: (1) establish and operate a clinic for comprehensive long-term follow-up services for childhood cancer survivors; and (2) improve physical and psychosocial care for childhood cancer survivors.

Amends the Congressional Budget and Impoundment Control Act of 1974 to address issues of emergency spending by requiring: (1) Committee on the Budget guidelines; (2) a separate House vote on an emergency designation; and (3) detailed reserve funds for emergencies in the President's budget request to Congress. Prescribes a procedure for adjustments in committee allocations resulting from such spending in joint budget resolutions. Amends the Congressional Budget Act of 1974 (CBA) to prohibit floor amendments to amendments reported by the Committee on the Budget (or from the consideration of which the Committee has been discharged) with respect to legislation for emergency reserve funds for certain military operations. Prohibits consideration of an amendment to a joint budget resolution which changes the amount of budget authority and outlays set forth in the CBA for the emergency reserve fund. Requires reports on legislation which provide new budget, spending, or credit authority, or otherwise provide an increase or decrease in revenues or tax expenditures, to include a CBO projection of the cost of debt servicing (interest). Amends the CBA concerning: (1) CBO cost analysis (scoring) for conference reports; (2) legislation which evades specified budget enforcement mechanisms; and (3) legislation which is unreported by committee (for purposes of budget point of order rules). Amends the Rules of the House of Representatives concerning: (1) budget compliance statements (permitting inclusion of budgetary implications); (2) requirements for budget act waivers (inclusion mandatory for bill consideration); and (3) a separate vote to waive a major budget act point of order.

Requires coastal recreation water quality monitoring and notification programs to include monitoring consistent with such criteria, public notification, source tracking, sanitary surveys, and prevention efforts to address identified sources of contamination by pathogens and pathogen indicators in such waters that are used by the public. Authorizes appropriations: (1) for grants to states and local governments for developing and implementing monitoring and notification programs for FY2007-FY2013; and (2) to implement the Beaches Environmental Assessment and Coastal Health Act of 2000 through FY2013. Revises requirements applicable to state recipients of monitoring and notification program grants, including to require such recipients to identify: (1) the use of a rapid testing method to detect levels of pathogens or pathogen indicators that are harmful to human health; (2) measures for communicating any exceeding of applicable water quality standards for pathogens and pathogen indicators to specified officials within two hours of the receipt of the results of a water sample; (3) measures to ensure that closures or advisories are made within two hours after the receipt of a water quality sample that exceeds such standards; and (4) measures that inform the public of identified sources of pathogenic contamination. . Requires the EPA to: (1) prepare an annual assessment of the compliance of state and local governments with program requirements; (2) commence a study of the formula for the distribution of program grants; (3) update within 12 months after this Act's enactment and biennially thereafter (currently, periodically) the list indicating which coastal recreation waters adjacent to beaches used by the public are, and which of such waters are not, subject to a monitoring and notification program; and (4) study and report to Congress on the long-term impact of climate change on pollution of coastal recreation waters.
