This bill provides $3 billion in appropriations to the Department of Energy for expenses related to the acquisition, transportation, and injection of domestic petroleum products for the Strategic Petroleum Reserve. The appropriations are available through FY2021 and are designated as emergency spending, which is exempt from discretionary spending limits.

This bill rescinds the appropriation to the John F. Kennedy Center for the Performing Arts provided for in the Coronavirus Aid, Relief, and Economic Security Act (CARES Act). The CARES Act appropriated $25 million to the center to prepare for and respond to COVID-19 (i.e., coronavirus disease 2019).

This bill provides funds with which the Federal Communications Commission shall reimburse small business broadband providers for costs incurred during the COVID-19 (i.e., coronavirus disease 2019) emergency period to voluntarily (1) provide free or discounted service to students in need of distance learning capacity, or (2) refrain from disconnecting low-income households that cannot afford to make a full payment.

This resolution condemns the Chinese government's response to the COVID-19 (i.e., coronavirus disease 2019) outbreak, including China's censorship of doctors and journalists during the early days of the outbreak and its refusal to accept assistance from the Centers for Disease Control and Prevention. The resolution also calls for (1) China to publicly state that there is no evidence that COVID-19 originated from outside China, and (2) the World Health Organization to retract misleading statements of support for China's response to COVID-19.

Immediate Relief for Rural Facilities and Providers Act of 2020 This bill establishes grant programs and other forms of financial assistance for health care providers in response to the national emergency relating to COVID-19 (i.e., coronavirus disease 2019). Specifically, the bill establishes (1) a grant program to provide emergency assistance to critical access hospitals, certain rural hospitals, and providers participating in Medicare; (2) a grant program to provide emergency assistance to health care practices and ambulatory surgery centers for staff salaries; and (3) a loan program to provide low-interest loans to health care practices and ambulatory surgery centers. The bill also temporarily increases reimbursements to rural hospitals under the Medicare swing-bed program. (The program allows rural hospitals to use beds, as needed, for either acute care or skilled nursing facility care.)

Securing and Enabling Commerce Using Remote and Electronic Notarization Act of 2020 This bill allows a notary public commissioned under state law to remotely notarize electronic records and requires recognition of notarizations performed under the laws of other states. Under the bill, a notary public may remotely notarize electronic records occurring in or affecting interstate commerce if (1) the individual and the notary public are able to electronically communicate by sight and sound simultaneously (i.e., by video chat); (2) the notary verifies the individual's identity and records the notarization; and (3) the notarization complies with other requirements, such as those relating to the attachment of a stamp or seal to the electronic record. Additionally, the bill allows a notary public to remotely notarize electronic records involving an individual located outside of the United States, subject to certain requirements. The bill also requires U.S. courts and states to recognize notarizations, including remote notarizations of electronic records, that occur in or affect interstate commerce and are performed by a notary public commissioned under the laws of other states.

Increasing Access and Multiple Use Act of 2020 This bill revises permit requirements under the Endangered Species Act of 1973 (ESA). It prohibits the Department of the Interior from requiring a permit holder, without the consent of the holder, to adopt any new minimization, mitigation, or other measure for any species adequately covered by the permit during its term, except to meet circumstances that have changed subsequent to the issuance of the permit. The bill provides that (1) a critical habitat designation or listing of a species under the ESA shall not result in a net loss of acreage, permits, or leases within grazing allotments or other multiple use activities; and (2) the presence of a critical habitat or a species listed under the ESA shall not result in the denial of any federal permit, lease, or expansion of multiple use activities based on the presence of the species or habitat. This bill requires federal public land management officials to facilitate the use of, and access to, federal public lands for fishing, sport hunting, and recreational shooting with specified exceptions. The bill prohibits Interior and the Department of Agriculture (USDA) from establishing policies or regulations that (1) restrict hunting or recreational fishing on lands within the National Forest System or Wildlife Refuge System that are otherwise open to those activities; or (2) restrict public access to public lands under certain conditions. Interior and USDA must make vacant grazing allotments available to a holder of a grazing permit or lease if it is determined that the land covered by such permit or lease are unusable because of a natural disaster, court-issued injunction, or a conflict with wildlife.

Danger Pay for U.S. Marshals Act This bill prohibits the Department of State from denying a request from the U.S. Marshals Service for danger pay. (Danger pay is a form of additional compensation for federal employees who are working in a foreign area and who are under threat of physical harm or imminent danger as a result of civil insurrection, civil war, terrorism, or wartime conditions.)

Endangered Species Transparency and Reasonableness Act of 2020 This bill requires the Department of the Interior or the Department of Commerce to publish online, subject to privacy or administrative limitations, the best scientific and commercial data available that are the bases for the determination of whether a species is an endangered species or a threatened species, including each proposed regulation for the listing of a species.

American Sovereignty and Species Protection Act This bill revises requirements governing the protection of endangered or threatened species. Specifically, the bill limits such protection to native species. In addition, the bill prohibits certain funding for endangered or threatened species from being used to purchase land in foreign countries.

Property Rights Protection Act of 2020 This bill specifies certain rights for private property owners or lessees. Specifically, the bill prohibits the Department of Agriculture and the Department of the Interior from conditioning the issuance, renewal, amendment, or extension of any land use or occupancy agreement on the transfer of any water right to the United States, or on any impairment of title or interest granted or otherwise recognized under state law, by federal or state judgment, or pursuant to any interstate water compact; or requiring any water user to apply for or acquire a water right in the name of the United States under state law as a condition for the issuance, renewal, or extension of any land use or occupancy agreement. Non-federally owned land and water may not be designated as critical habitat without the written consent of the property owners unless a threatened or endangered species is at risk of extinction without such a designation. The department concerned must pay an owner or lessee 150% of the fair market value of real property and is responsible for all related costs. Interior shall issue a final rule that requires the U.S. Fish and Wildlife Service to follow rules substantially similar to the requirements for the U.S. Geological Survey to obtain permission for certain access to private lands. Furthermore, it shall not be a violation of law to take any animal if it poses a recurring threat to life and property.

Ensuring Meaningful Petition Outreach While Enhancing Rights of States Act of 2020 or the EMPOWERS Act of 2020 This bill revises the petition process for listing, delisting, or reclassifying an endangered or threatened species, including by requiring petitioners to notify each county and state in which the species is located of the intent to submit a petition.

Critical Habitat Improvement Act This bill revises requirements governing the designation of critical habitat for an endangered or threatened species. Habitats outside of the geographical area occupied by the species must have at least one physical or biological feature that is essential to the conservation of the species in order to be considered as a potential critical habitat.

Weigh Habitats Offsetting Locational Effects Act of 2020 or the WHOLE Act of 2020 This bill revises the process by which the Department of the Interior or the Department of Commerce reviews an agency action to determine whether the action is likely to jeopardize the continued existence of an endangered or threatened species or result in the destruction or adverse modification of the critical habitat of the species. When making such determination, the appropriate department must consider the offsetting effects of protection or conservation measures that are already in place or proposed to be implemented as part of the action.

Listing Reform Act This bill modifies requirements concerning the review of petitions to add a species to the list of endangered or threatened species or to remove a species from the list. Specifically, the bill allows the Department of the Interior and the Department of Commerce to prioritize the consideration of petitions to list a species as endangered or threatened other than in the order in which the petitions are received. The appropriate department may not give general priority to petitions to add species to the list of endangered or threatened species over petitions to remove a species from the list. The deadline for the appropriate department to decide on whether or not a petition to list or remove a species should be granted is changed from within 12 months to as expeditiously as possible. The appropriate department is given the authority to preclude the listing of a species as threatened due to the likelihood of significant, cumulative economic effects that would result from such listing or from the likely resulting designation of critical habitat of the species. Once a petition is precluded due to those economic effects, the appropriate department may not reconsider that finding unless the department (1) determines there is endangerment of extinction of the species; or (2) receives a new petition to add the species to the list that includes an analyses concluding that alternative actions are possible other than those resulting in significant, cumulative economic effects.

Bring ESA Into the 21st Century Act This bill provides statutory authority for two rules relating to endangered or threatened species. The Fish and Wildlife Service (FWS) and the National Marine Fisheries Service (NMFS) published the rules on August 27, 2019. The first rule revises the interagency consultation process relating to such species and federal actions (i.e., activity authorized, funded, or carried out by federal agencies). Under current law, federal agencies must consult with the FWS and NMFS to review the effects of federal actions on such species or their critical habitats. Among other requirements, the rule establishes alternative consultation mechanisms as well as deadlines for FWS and NMFS to complete consultations. The second rule revises the processes for adding or removing a species to the list of endangered or threatened species and designating critical habitat for such species. Among other requirements, the rule outlines additional circumstances under which critical habitat does not need to be designated for endangered or threatened species.

Less Imprecision in Species Treatment Act of 2020 or the LIST Act of 2020 This bill revises the process for removing a species from the endangered or threatened species lists. A species must be removed from the endangered or threatened species lists if the Department of the Interior produces or receives substantial scientific or commercial information demonstrating that the species is recovered or that recovery goals set for the species have been met. The publication and notice of a proposed regulation to remove a species from the lists must consist solely of a notice of the removal. The bill establishes a process for removing species from the lists if they were erroneously or wrongfully listed. The bill prohibits a person from submitting a petition to list a species as a threatened or endangered species for 10 years if the person knowingly submitted a petition with information that was inaccurate beyond scientifically reasonable margins of error, fraudulent, or misrepresentative.

Threatened Species Protection Improvement Act of 2020 This bill provides statutory authority for the rule published on August 27, 2019, by the U.S. Fish and Wildlife Service relating to threatened species. The rule requires species listed as threatened after the issuance of the rule to be given protections tailored to the species' needs. Prior to the rule, threatened species were automatically provided with most of the protections that are provided to endangered species.

Land Ownership Collaboration Accelerates Life Act of 2019 or the LOCAL Act of 2019 This bill provides statutory authority for conservation agreements involving threatened or endangered species, including by providing for the legal treatment of species included in conservation agreements, setting forth the requirements of certain conservation agreements, and establishing safe harbor provisions for these agreements.

Critical Infrastructure Act of 2019 This bill (1) requires specified power administrations to disclose all estimated costs and factors affecting total power costs, such as costs for complying with environmental laws impacting the conservation of fish and wildlife, (2) prohibits the Department of the Interior from designating critical habitat in certain water infrastructure areas, and (3) provides exemptions from environmental review requirements for certain electrical power projects or construction projects that may affect prairie dogs. Specifically, the bill requires the Bonneville Power Administration, the Western Area Power Administration, the Southwestern Power Administration, and the Southeastern Power Administration to include in monthly billing statements sent to each customer estimates of all costs and factors affecting total power costs. The estimates must include the customer's share of such administration's costs for compliance with any relevant federal environmental laws impacting the conservation of fish and wildlife. Each administration must report each year on (1) all estimated costs and factors affecting total power costs, including estimates of its total compliance costs; and (2) sources of replacement power. The bill prohibits Interior from designating critical habitat for endangered or threatened species in certain water storage, diversion, or delivery facilities. In addition, the bill exempts projects to install or maintain electrical transmission poles or power lines from environmental review requirements. The bill also exempts from such review construction projects that include buffer areas if the projects would otherwise only require an environmental assessment because of the presence of prairie dogs in such buffer areas.

Lower Costs, More Cures Act of 2019 This bill establishes and modifies several requirements to address prescription drug prices under Medicare, Medicaid, and other programs. The bill generally limits payment amounts for drugs and biologics under Medicare medical services, reduces cost-sharing under the Medicare prescription drug benefit, modifies certain authorities and requirements under the Medicaid Drug Rebate Program, revises provisions relating to regulatory approval and commercial availability of generics and biosimilars, and establishes several reporting requirements for drug manufacturers with respect to drug prices.

Continuity for Operators with Necessary Training Required for ATC Contract Towers Act of 2019 or the CONTRACT Act of 2019 This bill exempts certain air traffic controllers from a required reduction in their retirement annuity payment on account of earnings from certain work performed while entitled to such annuity. Under current law, retired Federal Aviation Administration air traffic controllers receive an annuity payment during the period between the mandatory retirement age of 56 and the social security minimum age of 62. Such annuity payment is required to be reduced by a certain percentage of any excess earnings during this period. The bill exempts from such reduction in annuity payments an air traffic controller who participates in the Air Traffic Control Contract Program (a public-private partnership for air traffic control services) following mandatory retirement.

Justice for Juveniles Act This bill exempts juvenile prisoners (i.e., inmates who are under 22 years of age) from various requirements of the inmate grievance procedure, including the requirement to exhaust administrative remedies before filing a federal lawsuit regarding the condition of their confinement.

Survivors' Bill of Rights in the States Act of 2019 This bill directs the Department of Justice to make grants to states that provide certain legal rights to survivors of sexual assault. Among other things, grants may be used to implement such legal rights.

Creating Opportunities Now for Necessary and Effective Care Technologies for Health Act of 2019 or the CONNECT for Health Act of 2019 This bill expands coverage of telehealth services under Medicare. Among other things, the bill allows the Centers for Medicare & Medicaid Services (CMS) to waive certain restrictions, such as geographic restrictions, for services provided in high-need health professional shortage areas; excludes mental health and emergency medical services, as well as services provided at rural health clinics, federally qualified health centers, and Indian Health Service facilities, from such geographic restrictions; and allows the CMS to generally waive coverage restrictions during national emergencies. Additionally, the Medicare Payment Advisory Commission must report on information relating to the access of Medicare beneficiaries to telehealth services at home. The Center for Medicare and Medicaid Innovation may also test alternative payment models relating to expanded telehealth services.

Real Marketing Edible Artificials Truthfully Act of 2019 or the Real MEAT Act of 2019 This bill prohibits the sale of any imitation meat food product unless its label includes (1) the word imitation , and (2) a statement that clearly indicates the product is not derived from or does not contain meat.

Livestock Risk Management and Education Act This bill directs the Department of Agriculture (USDA) to provide competitive grants to improve the farm management knowledge and skills of livestock producers. USDA must give priority to applicants that (1) demonstrate an ability to work directly with livestock producers, (2) collaborate with farm management educational programs and associations, and (3) include in their application a description of the curriculum the applicant is seeking to carry out to educate livestock producers on risk management through futures market participation and hedging strategies.

Countering Turkish Aggression Act of 2019 This bill directs the President to impose sanctions related to Turkey. The President shall impose property- and visa-blocking sanctions on (1) specified officials of Turkey's government, such as the president and vice president of Turkey; (2) any foreign person that knowingly sells to, provides support to, or conducts a transaction with Turkey's armed forces; and (3) any foreign person that supplies goods or services that support petroleum production for use by Turkey's armed forces. The President may temporarily stop the application of such sanctions upon certifying to Congress that Turkey (1) is not operating in certain parts of Syria without U.S. support, and (2) has withdrawn its troops and Turkey-supported rebel groups from occupied areas. The President shall impose additional sanctions on Turkey based on Turkey's purchase of a surface-to-air defense system from Russia. No funds may be obligated or expended to transfer to Turkey's armed forces any U.S. defense articles, services, or technology.

Localizing Authority of Management Plans Act of 2019 or the LAMP Act of 2019 This bill revises requirements governing the management of endangered or threatened species, establishes exemptions from environmental review requirements, and permits the delegation of authority for species management to states under certain circumstances. Specifically, this bill revises requirements governing cooperative management agreements to manage areas established for the conservation of endangered or threatened species. Under current law, the agreements are between states and the Department of the Interior or the Department of Commerce. This bill allows the departments to enter into (1) agreements with local governments, Indian tribes, or nonfederal persons; and (2) agreements to manage areas established for the conservation of species that are candidates for listing. The bill exempts the actions of preparing, approving, and entering into an agreement from environmental review requirements. The departments may (1) delegate the authority to manage species to states that establish and maintain an adequate program for the conservation of endangered or threatened species that reside in the state, and (2) provide financial assistance to a state that has entered into an agreement with the department or to a state with delegated authority.

Puppies Assisting Wounded Servicemembers for Veterans Therapy Act or the PAWS for Veterans Therapy Act This bill requires the Department of Veterans Affairs to implement a pilot program to assess the effectiveness of addressing post-deployment mental health and post-traumatic stress disorder through a method where veterans train service dogs for veterans with disabilities.

American Energy First Act This bill addresses offshore and onshore oil and gas resources, and the use of renewable energy resources on the Outer Continental Shelf (OCS) and other federal lands. Among other things, the bill allows states with an established permitting and regulatory program to manage certain federal permitting and regulatory responsibilities for oil and gas development on federal lands within their borders; limits the President's authority to prohibit oil and gas leasing on the OCS; establishes a revenue sharing framework to distribute revenues collected from oil and gas leasing on the OCS to certain states (Virginia, North Carolina, South Carolina, Georgia, and Alaska); provides a mechanism for states to receive their entitled percentage of sales, bonuses, royalties, and rentals for all public land or deposits located in the state; requires the Department of the Interior to establish certain federal land as geothermal and wind energy leasing priority areas; and limits the authority of Interior to declare a moratorium on the leasing of federal lands for oil and gas activities unless such moratorium is authorized by Congress.

Border Officers Utilization for National Defense Act of 2019 or the BOUND Act This bill sets a minimum number of U.S. Customs and Border Protection officers that must be deployed along the border between the United States and Canada. The minimum number of officers is the maximum number of officers that were deployed along that border at any time between January 1, 2016, and the enactment of this bill.

State Veterans Home Inspection Simplification Act This bill alters certain requirements relating to inspection and certification of Medicare skilled nursing facilities that are also state veterans homes. Specifically, the bill requires the Centers for Medicare & Medicaid Services (CMS) to treat state veterans homes that are inspected and determined to meet applicable standards set by the Department of Veterans Affairs (VA) as also meeting applicable standards for skilled nursing facilities under Medicare. The CMS must also use VA inspection reports for such facilities in lieu of state inspection reports for purposes of the Nursing Home Compare website.

This bill modifies the eligibility criteria for an elderly offender to qualify for early release from prison and placement in home detention. Specifically, it reduces the amount of a prison term an elderly offender must serve by the amount of good time credits earned by the offender.
