Clean Slate Act of 2023 This bill establishes a framework for sealing records related to certain federal criminal offenses. Courts must automatically seal records related to (1) a conviction for simple possession of a controlled substance or for any nonviolent offense involving marijuana, or (2) an arrest for an offense that does not result in a conviction. Additionally, an individual who meets certain criteria may petition to seal records related to a conviction for other nonviolent offenses.

Fresh Start Act of 2023 This bill allows grants under the National Criminal History Improvement Program (NCHIP) to be used to implement a state law that provides for the automatic expungement or sealing of certain criminal records. The NCHIP provides grants to state and tribal governments to enhance the quality, completeness, and accessibility of criminal history record information and ensure the implementation of effective background check systems.

Secure and Fair Enforcement Banking Act of 2023 or the SAFE Banking Act of 2023 This bill provides protections for federally regulated financial institutions that serve state-sanctioned marijuana businesses. Currently, many financial institutions do not provide services to state-sanctioned marijuana businesses due to the federal classification of marijuana as a Schedule I controlled substance. Under the bill, a federal banking regulator may not penalize a depository institution for providing banking services to a state-sanctioned marijuana business. For example, regulators may not terminate or limit the deposit or share insurance of a depository institution solely because the institution provides financial services to a state-sanctioned marijuana business. The bill also prohibits a federal banking regulator from requesting or ordering a depository institution to terminate a customer account unless (1) the regulator has determined that the depository institution is engaging in an unsafe or unsound practice or is violating a law or regulation, and (2) that determination is not based primarily on reputation risk. Additionally, proceeds from a transaction involving activities of a state-sanctioned marijuana business are no longer considered proceeds from unlawful activity. (Financial institutions that handle proceeds from unlawful activity are subject to anti-money laundering laws. Violators of these laws are subject to fines and imprisonment.) Furthermore, a financial institution, insurer, or federal agency may not be held liable or subject to asset forfeiture under federal law for providing a loan, mortgage, or other financial service to a state-sanctioned marijuana business.

Partner with Korea Act This bill creates an E-4 treaty trader visa category for up to 15,000 nationals of South Korea each fiscal year who are coming to the United States solely to perform specialty occupation services, subject to various requirements. The 15,000 limit shall only apply to principal recipients of such visas and not their accompanying spouses or children. (A specialty occupation is one that requires the theoretical and practical application of highly specialized knowledge and a bachelor's degree or higher.)

This joint resolution nullifies a Department of Labor final rule entitled Adverse Effect Wage Rate Methodology for the Temporary Employment of H-2A Nonimmigrants in Non-Range Occupations in the United States and published on February 28, 2023. This rule makes changes to the methodology used to set adverse effect wage rates for H-2A workers (temporary agricultural workers), including by using Bureau of Labor Statistics wage surveys in certain instances. (Generally, the minimum wage for an H-2A worker is the highest of the adverse effect wage rate, the applicable minimum wage, the prevailing wage for that occupation in that area, or any agreed-upon collective bargaining wage.)

Uyghur Policy Act of 2023 This bill addresses human rights issues concerning the Uyghurs and other minority groups residing primarily in the Xinjiang Uyghur Autonomous Region in China. The bill authorizes the establishment of a Special Coordinator for Uyghur Issues position within the Department of State. The State Department's Bureau of Educational and Cultural Affairs may, subject to appropriations, make certain funds available to human rights advocates working on behalf of Uyghurs and members of other persecuted minority groups in China. The funds, if made available, shall be used to facilitate the presence of such human rights advocates at public diplomacy forums to speak on issues related to the human rights and religious freedoms of persecuted minority groups in China. The State Department must ensure that Uyghur language training is available to Foreign Service officers. It must also ensure that a Uyghur-speaking member of the Foreign Service is assigned to U.S. diplomatic and consular missions in China.

Improving Care and Access to Nurses Act or the I CAN Act This bill allows other health care providers besides physicians (e.g., nurses) to provide certain services under Medicare and Medicaid. Among other changes, the bill (1) allows a nurse practitioner or physician assistant to fulfill documentation requirements for Medicare coverage of special shoes for diabetic individuals; (2) expedites the ability of physician assistants, nurse practitioners, and clinical nurse specialists to supervise Medicare cardiac, intensive cardiac, and pulmonary rehabilitation programs; and (3) allows nurse practitioners to certify the need for inpatient hospital services under Medicare and Medicaid.

Charlotte Woodward Organ Transplant Discrimination Prevention Act This bill expressly prohibits health care providers and other entities involved in matching donated organs with recipients from denying or restricting an individual's access to organ transplants solely on the basis of the individual's disability, except in limited circumstances. Specifically, these entities may consider an individual's disability when making decisions about transplants only if a physician finds, based on an individualized evaluation, that the individual's physical or mental disability is medically significant to the provision of the transplant. A disability shall not be considered medically significant if the individual has an adequate support system in place to comply with transplant-related medical requirements. These entities must also make reasonable changes to their policies to make transplants and related care more available to individuals with disabilities. Aggrieved individuals may bring claims of discrimination to the Office of Civil Rights of the Department of Health and Human Services or before a federal court. The bill provides for expedited resolutions of these claims. In addition, entities that receive federal contracts to manage all or part of the Organ Procurement and Transplantation Network may not issue policies that prohibit or hinder access to an organ transplant based solely on the individual's disability. This network is a public-private partnership linking professionals involved in the U.S. organ donation and transplantation system.

Encouraging the European Union to Determine that the European Union Should Sanction the Iranian Revolutionary Guard Corps Now As a Terrorist Entity Resolution or Encouraging the EU to DESIGNATE Resolution This resolution urges the European Union (EU) to expeditiously designate the Islamic Revolutionary Guard Corps (IRGC) as a terrorist organization under the EU Common Position 931 on terrorism. It also encourages the Biden Administration to make the EU designation of the IRGC as a terrorist organization a diplomatic priority in engagements with the EU.

National Human Trafficking Hotline Enhancement Act This bill requires an applicant for a grant to operate the National Human Trafficking Hotline to certify that the applicant will provide information received from the hotline to state and local law enforcement agencies, at their request.

Special Diabetes Program for Indians Reauthorization Act of 2023 This bill extends funding through FY2028 for the Special Diabetes Program for Indians. The program is administered by the Indian Health Service and provides funds to Indian health programs for diabetes prevention and treatment.

Public Safety Officer Concussion and Traumatic Brain Injury Health Act of 2023 This bill requires the Centers for Disease Control and Prevention (CDC) to collect and disseminate information about diagnosing, treating, and preventing concussions and traumatic brain injuries among public safety officers. The CDC must put the information it collects on its website. The CDC must also disseminate the information to medical and public health professionals, public safety employers and employee representatives, and other stakeholders. In implementing the bill, the CDC may support public and private efforts to identify and create guidelines, protocols, and evidence-based practices for treating concussions and traumatic brain injuries in public safety officers.

This joint resolution nullifies the final rule issued by the Consumer Financial Protection Bureau titled Small Business Lending under the Equal Credit Opportunity Act (Regulation B) and published on May 31, 2023. The rule requires financial institutions to collect and report to the bureau credit application data for small businesses. On July 31, 2023, the U.S. District Court for the Southern District of Texas ordered the bureau not to implement or enforce the rule until a related pending case is resolved.

Nancy Gardner Sewell Medicare Multi-Cancer Early Detection Screening Coverage Act This bill allows for Medicare coverage and payment for multi-cancer early detection screening tests that are approved by the Food and Drug Administration and that are used to screen for cancer across many cancer types, if the Centers for Medicare & Medicaid Services determines such coverage is appropriate.

North Dakota Trust Lands Completion Act of 2023 This bill authorizes the Department of the Interior to exchange, at the election of North Dakota, certain federal land for certain state land of substantially equal value. Specifically, subject to valid existing rights, if North Dakota elects to relinquish a parcel of state land located wholly or partially within the boundaries of any Indian reservation, the bill authorizes North Dakota to select one or more parcels of federal land of substantially equivalent value within that state. No later than 60 days after Interior approves North Dakota's selection of federal land, Interior shall initiate the actions necessary to convey the federal land to the state. As consideration for the conveyance of the federal land, North Dakota shall concurrently relinquish and convey the state land to Interior. Land conveyed to Interior that is within the boundaries of a reservation becomes part of the reservation on request of the tribe.

Reentry Act of 2023 This bill allows for Medicaid payment of medical services furnished to an incarcerated individual during the 30-day period preceding the individual's release. The Medicaid and Children's Health Insurance Program (CHIP) Payment and Access Commission must report on specified information relating to the accessibility and quality of health care for incarcerated individuals, including the impact of the bill's changes.

United States-Israel PTSD Collaborative Research Act This bill establishes a grant program for collaborative efforts between the United States and Israel to advance research on post-traumatic stress disorders. The Department of Defense, in coordination with the Department of Veterans Affairs and the Department of State, shall award grants to eligible academic institutions or nonprofit entities in the United States. Work shall be conducted by the eligible entity and an entity in Israel under a joint research agreement.

Small Lenders Exempt from New Data and Excessive Reporting Act or the Small LENDER Act This bill exempts certain financial institutions and transactions from the Consumer Financial Protection Bureau (CFPB) reporting requirements with respect to data about small business credit applications. Under the bill, the requirements apply only to financial institutions that originate at least 500 credit transactions to small businesses in each of the preceding two years. The bill further defines small businesses as those with annual revenue of $1 million or less. Currently, the CFPB has proposed a rule that the requirements apply only to financial institutions that originate at least 25 annual credit transactions to small businesses in each of the preceding two years. The rule further defines small businesses as those with annual revenue of $5 million or less.

United States-Israel Future of Warfare Act of 2023 This bill requires the Department of Defense to establish the United States-Israel Future of Warfare Research and Development Fund to conduct collaborative defense projects between the United States and Israel in areas of emerging technologies (e.g., artificial intelligence). The purpose of the fund is to enable the Armed Forces of the United States and Israel to meet emerging defense challenges.

Ensuring Patient Access to Critical Breakthrough Products Act of 2023 This bill provides for Medicare coverage of medical devices that are approved under the Food and Drug Administration (FDA) Breakthrough Devices Program. (Under the program, manufacturers work with the FDA to expedite the review and approval of certain medical devices that provide for more effective treatment or diagnosis of life-threatening or irreversibly debilitating human diseases or conditions.) The bill allows designated medical breakthrough devices to be temporarily covered under Medicare during a four-year transitional period. The Centers for Medicare & Medicaid Services (CMS) must assign payment codes for such devices within three months of FDA approval. The CMS must also establish a process to allow for continued coverage after the transitional period has expired, taking into account any additional evidence or data the CMS deems necessary. The CMS must also provide for temporary and, where appropriate, permanent Medicare coverage of breakthrough devices for which there is no existing benefit category (i.e., classification).

Prevent Interruptions in Physical Therapy Act of 2023 This bill allows a physical therapist to receive payment under Medicare for services provided to the physical therapist's patients by another physical therapist through a qualifying temporary arrangement, regardless of the geographic area or population served. Currently, physical therapists may only receive payment with respect to such arrangements for services provided in medically underserved, rural, or health professional shortage areas.

Gas Stove Protection and Freedom Act This bill prohibits the Consumer Product Safety Commission from using federal funds to (1) regulate gas stoves as a banned hazardous product, or (2) issue or enforce a product safety standard that prohibits the use or sale of gas stoves or substantially increases their price.

Save Our Gas Stoves Act This bill places limits on energy conservation standards for kitchen ranges or ovens under the Energy Policy and Conservation Act. The Department of the Energy (DOE) may not prescribe or amend energy conservation standards for kitchen ranges or ovens if they would result in the unavailability of a product on account of the type of fuel the range or oven uses. In addition, DOE may not finalize, implement, or enforce the proposed rule titled Energy Conservation Program: Energy Conservation Standards for Consumer Conventional Cooking Products issued on February 1, 2023, or any substantially similar rule. The proposed rule prescribes energy conservation standards for consumer conventional cooking tops, including electric cooking tops, gas cooking tops, electrical ovens, and gas ovens.

Hello Girls Congressional Gold Medal Act of 2023 This bill provides for the award of a single Congressional Gold Medal in honor of the female telephone operators of the Army Signal Corps, commonly known as the Hello Girls , in recognition of their military service, devotion to duty, and 60-year struggle for veterans' benefits and recognition as soldiers.

Lower Energy Costs Act This bill provides for the exploration, development, importation, and exportation of energy resources (e.g., oil, gas, and minerals). For example, it sets forth provisions to (1) expedite energy projects, (2) eliminate or reduce certain fees related to the development of federal energy resources, and (3) eliminate certain funds that provide incentives to decrease emissions of greenhouse gases. The bill expedites the development, importation, and exportation of energy resources, including by waiving environmental review requirements and other specified requirements under certain environmental laws, eliminating certain restrictions on the import and export of oil and natural gas, prohibiting the President from declaring a moratorium on the use of hydraulic fracturing (a type of process used to extract underground energy resources), directing the Department of the Interior to conduct sales for the leasing of oil and gas resources on federal lands and waters as specified by the bill, and limiting the authority of the President and executive agencies to restrict or delay the development of energy on federal land. In addition, the bill reduces royalties for oil and gas development on federal land and eliminates charges on methane emissions. It also eliminates a variety of funds, such as funds for energy efficiency improvements in buildings as well as the greenhouse gas reduction fund.

Fifth Amendment Integrity Restoration Act of 2023 or the FAIR Act of 2023 This bill revises federal laws governing civil asset forfeiture. Specifically, the bill makes various changes to the general rules governing civil forfeiture proceedings. Among the changes, the bill requires counsel for an indigent property owner whose primary residence is the subject of a civil forfeiture hearing regardless of whether the owner requests counsel, raises the evidentiary standard from preponderance of the evidence to clear and convincing evidence, and sets forth factors courts must consider in determining whether a forfeiture of property used to facilitate the commission of an offense is excessive. Additionally, the bill eliminates statutory authority for equitable sharing and directs forfeiture proceeds to be deposited into the general fund of the Treasury instead of the Department of Justice (DOJ) Assets Forfeiture Fund. The bill also makes changes with respect to the civil forfeiture of money involved in structuring offenses (i.e., structuring currency transactions to evade currency reporting requirements). Among the changes, the bill specifies an evidentiary standard of knowingly for structuring offenses, and requires a prompt probable cause hearing following the seizure of money involved in a structuring offense. Finally, the bill requires the annual report on deposits into the DOJ Asset Forfeiture Fund to specify deposits from each type of forfeiture and specify which funds were obtained from criminal forfeitures and which were obtained from civil forfeitures.

CBO Show Your Work Act This bill requires the Congressional Budget Office (CBO) to make available to Congress and the public each fiscal model, policy model, and data preparation routine that the CBO uses to estimate the costs and other fiscal, social, or economic effects of legislation. For each estimate of the costs and other fiscal effects of legislation, the CBO must also disclose, in a manner sufficient to permit replication by individuals not employed by the CBO, the data, programs, models, assumptions, and other details of the computations used to prepare the estimate. For data that may not be disclosed, the CBO must make available to Congress and the public a complete list of all data variables for the data; descriptive statistics for all data variables for the data, to the extent that the descriptive statistics do not violate the rule against disclosure; a reference to the statute requiring that the data not be disclosed; and contact information for the individual or entity who has unrestricted access to the data.

Preserving Choice in Vehicle Purchases Act This bill modifies the waiver process under the Clean Air Act related to state emission control standards for new motor vehicles (or new motor vehicle engines). Under current law, states are preempted from adopting or enforcing emission control standards for new motor vehicles (or new motor vehicle engines) unless the Environmental Protection Agency (EPA) provides a waiver authorizing a state to adopt such standards if certain requirements are met. The bill provides that state standards that directly or indirectly limit the sale or use of new motor vehicles with internal combustion engines are not eligible for waivers. The bill also prohibits the EPA from determining that any state standards amended after the bill's enactment are within the scope of an existing waiver. Additionally, the bill requires the EPA to revoke waivers granted between January 1, 2022, and the date of enactment of this bill if the standards directly or indirectly limit the sale or use of new motor vehicles with internal combustion engines.

Sustainable Cardiopulmonary Rehabilitation Services in the Home Act This bill permanently allows services relating to cardiac rehabilitation programs, intensive cardiac rehabilitation programs, and pulmonary rehabilitation programs to be furnished via telehealth at a beneficiary's home under Medicare.

Sultana Steamboat Disaster Commemorative Coin Act of 2023 This bill directs the Department of the Treasury to mint and issue not more than 100,000 $5 gold coins, 500,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the Sultana steamboat explosion that occured on April 27, 1865, on the Mississippi River. All surcharges received by Treasury from the sale of such coins must be paid to the Sultana Historical Preservation Society for the purpose of establishing, operating, and maintaining a museum.

Military Spouse Hiring Act This bill expands the Work Opportunity Tax Credit (WOTC) to include the hiring of a qualified military spouse. (The WOTC permits employers who hire individuals who are members of a targeted group such as qualified veterans, ex-felons, or long-term unemployment recipients to claim a tax credit equal to a portion of the wages paid to those individuals.) A qualified military spouse is any individual who is certified by the designated local agency as being (as of the hiring date) a spouse of a member of the Armed Forces.

Fair and Open Competition Act or the FOCA Act This bill prohibits federal construction contracts or controlling documents for federally supported construction projects from requiring or prohibiting project labor agreements. Such documents also may not discriminate against or give preference to a bidder or contractor who signs or refuses to sign a project labor agreement. An agency may exempt a project from this prohibition to avert an imminent threat to public health or safety or to serve the national security.

Protecting American Energy Production Act This bill prohibits the President from declaring a moratorium on the use of hydraulic fracturing unless Congress authorizes the moratorium. The bill also expresses the sense of Congress that states should maintain primacy for the regulation of hydraulic fracturing for oil and natural gas production on state and private lands. Hydraulic fracturing, or fracking, is a process to extract underground resources such as oil or gas from a geologic formation by injecting water, a propping agent (e.g., sand), and chemical additives into a well under enough pressure to fracture the formation.

Whole Milk for Healthy Kids Act of 2023 This bill revises requirements for milk provided by the National School Lunch Program of the Department of Agriculture (USDA). Currently, schools participating in the program must provide milk that is consistent with the most recent Dietary Guidelines for Americans; USDA regulations require milk to be fat-free or low-fat and allow milk to be flavored or unflavored. The bill modifies these restrictions and instead permits schools to offer students whole, reduced-fat, low-fat, and fat-free flavored and unflavored milk. In addition, schools currently participating in the program must provide meals that meet certain nutrition requirements; USDA regulations require that the average saturated fat content of the meals offered must be less than 10% of the total calories. Under the bill, USDA must revise these requirements to increase the allowable average saturated fat content of a meal to account for milk fat included in whole milk.

Governing Unaccredited Representatives Defrauding VA Benefits Act or the GUARD VA Benefits Act This bill imposes fines on individuals for soliciting, contracting for, charging, or receiving any unauthorized fee or compensation with respect to the preparation, presentation, or prosecution of any claim for Department of Veterans Affairs benefits. The attempted commission of such offenses is also punishable by fine.

250th Anniversary of the United States Marine Corps Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the 250th anniversary of the United States Marine Corps. All surcharges received by Treasury from the sale of such coins must be paid to the Marine Corps Heritage Foundation and shall only be used for the purposes of supporting the mission of the Marine Corps Heritage Center.

Promoting Cross-b order Energy Infrastructure Act This bill establishes a new process for approving the construction and operation of energy infrastructure across an international border of the United States and replaces the existing process established under specified executive orders. Specifically, this bill requires a person to obtain a certificate of crossing before constructing, connecting, operating, or maintaining a border-crossing facility for the import or export of oil, natural gas, or electricity across a U.S. border between Canada or Mexico. A certificate must be obtained from the Federal Energy Regulatory Commission (FERC) for a facility consisting of oil or natural gas pipelines or the Department of Energy (DOE) for an electric transmission facility. As a condition of issuing a certificate, DOE must require that an electric transmission facility be constructed, connected, operated, or maintained consistent with specified policies and standards. FERC and DOE must meet a deadline for issuing a certificate as set forth by this bill. The bill also requires FERC to meet a deadline for approving applications to import or export natural gas to or from Canada or Mexico.

This bill makes certain irrigation districts in North Dakota eligible to receive pumping power (i.e., hydropower) from the Pick-Sloan Missouri Basin Program, subject to the terms and rates established by the Bureau of Reclamation. Under this bill, an irrigation district must enter into a contract with Reclamation to receive such pumping power.

American Energy Act This bill sets forth requirements to extend terms for energy drilling permits and to limit the effect of civil actions concerning such permits. Specifically, the bill extends the terms for permits to drill issued under Section 17 of the Mineral Leasing Act from two years to four years. The bill also requires the Department of the Interior to process an application for an oil or gas drilling permit or other authorizations under a valid existing lease regardless of any pending civil actions affecting the application or related lease. It also addresses litigation concerning the environmental review of certain oil and gas lease sales held under the Mineral Leasing Act or the Outer Continental Shelf Lands Act. A court may not vacate a lease sale nor otherwise limit, delay, or enjoin related lease activities unless the court concludes that (1) the lease will pose a risk of an imminent and substantial environmental harm, and (2) there is no other equitable remedy available. In addition, no court may enjoin or issue any order preventing the award of leases to a bidder in a lease sale if Interior has previously opened bids for such leases or disclosed the high bidder for any tract that was included in such lease sale.

Securing and Enabling Commerce Using Remote and Electronic Notarization Act of 2023 or the SECURE Notarization Act of 2023 This bill allows a notary public commissioned under state law to remotely notarize electronic records and perform notarizations for remotely located individuals. The bill provides technical requirements for the notarizations, including the creation and retention of video and audio recordings and the use of communication technologies (i.e., video chat). Additionally, the bill requires U.S. courts and states to recognize notarizations—including remote notarizations of electronic records and notarizations of remotely-located individuals—that occur in or affect interstate commerce and are performed by a notary public commissioned under the laws of other states. The bill also allows a notary public to remotely notarize electronic records involving an individual located outside of the United States, subject to certain requirements.

Eliminating a Quantifiably Unjust Application of the Law Act or the EQUAL Act This bill eliminates the federal sentencing disparity between drug offenses involving crack cocaine and powder cocaine. Currently, different threshold quantities of crack cocaine and powder cocaine (e.g., 28 grams of crack cocaine and 500 grams of powder cocaine) trigger the same statutory criminal penalties. This bill eliminates the lower quantity thresholds for crack cocaine offenses. Under the bill, the same threshold quantities of crack cocaine and powder cocaine trigger the same statutory criminal penalties. The change applies to future cases and cases pending on the date of enactment. With respect to past cases, the bill authorizes resentencing of a defendant who was convicted or sentenced for a crack cocaine offense before the date of enactment.
