Improving Medicaid Programs and Opportunities for Eligible Beneficiaries Act or the IMPROVE Act This bill establishes a state Medicaid option to provide for medical assistance with respect to coordinated care provided through a health home (i.e., a designated provider or team of health-care professionals) for children with medically complex conditions. States must determine payment methodologies in accordance with specified requirements; payments also temporarily qualify for an enhanced federal matching rate. The bill also makes a series of reductions relating to federal Medicaid expenditures. Among other changes, the bill reduces the federal matching rate for states that do not have required asset-verification programs for determining Medicaid eligibility. Further, drug manufacturers with Medicaid rebate agreements for covered outpatient drugs must disclose drug product information. Manufacturers are subject to civil penalties for knowingly misclassifying drugs. Manufacturers are also required to compensate for rebates that were initially underpaid as a result of misclassification (whether or not such misclassification was committed knowingly). Finally, the bill excludes specified wheelchairs and associated accessories from Medicare's competitive acquisition program (in which rates are set through a competitive bidding program rather than by an established fee schedule).

Threat Assessment, Prevention, and Safety Act of 2018 This bill directs the Department of Homeland Security (DHS) to establish within itself a Joint Threat Assessment and Management Task Force, which shall provide recommendations to Congress and DHS on the development and implementation of a national strategy for preventing targeted violence through threat assessment and management. The task force shall make recommendations relating to the most effective use of existing government infrastructure, workforce, and experience, unit support, training, and school violence prevention. The bill defines "threat assessment and management" as the systematic and evidence-based process of: (1) identifying individuals whose behavior indicates a capacity for committing acts of violence; (2) investigating and gathering information to assess whether such individuals pose a real threat; and (3) the subsequent management of such a threat. DHS shall develop and implement the national strategy and provide information and training services related to it. The bill directs DHS to award grants to governmental and educational entities and nongovernmental organizations to establish community based units for implementing the national strategy.

Inventor Protection Act This bill creates additional protections for patents wholly owned by their inventors, such as exempting such patents from administrative validity challenges and allowing inventors to sue for infringement in any district where the defendant is subject to that court's personal jurisdiction.

Application Privacy, Protection, and Security Act of 201 8 or the APPS Act of 201 8 This bill directs mobile device application developers, before the application collects personal data about the user, to notify the user and obtain the user's consent regarding the terms and conditions governing the collection, use, storage, and sharing of such personal data.

Strategic Petroleum Reserve Reform Act This bill amends the Energy Policy and Conservation Act to authorize the Department of Energy (DOE) to lease underutilized Strategic Petroleum Reserve storage facilities to private entities. Currently, DOE may only lease these storage facilities to foreign governments. DOE must conduct a pilot program to lease underutilized storage facilities. The program must make available capacity for storage of up to 200 million barrels of petroleum products.

Seniors Accessing Vouchers Equally Act or the SAVE Act This bill exempts the use of certain cost-sharing coupons by pharmacies or drug manufacturers under the Medicare prescription drug benefit from specified criminal penalties relating to illegal remunerations, so long as there is no generic version of the drug to which the coupon applies.

Integration of Baseball Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half-dollar clad coins in recognition and celebration of the 75th anniversary of the integration of the game of baseball. All sales of such coins shall include specified surcharges. All surcharges received by Treasury shall be distributed to the National Baseball Hall of Fame, with the understanding that the Hall of Fame shall work with the Jackie Robinson Foundation to develop and operate education programs about the integration of the game of baseball and to preserve artifacts related to the integration of the game.

Taxpayer Identity Protection Act This bill requires the Internal Revenue Service to submit to Congress a report regarding the Taxpayer Identification Number Perfection Program, including an explanation of the extent to which the information could be used to identify individuals receiving wages without work authorization.

Efficient Drug Disposal Act of 2018 This bill amends the Clean Air Act to exempt certain solid waste incinerators from performance standards, including emission requirements. Specifically, incinerators used by federal, state, and local law enforcement agencies to destroy contraband or household pharmaceuticals are exempt from these requirements.

History and Tradition Protection Act of 2018 This bill provides that, regarding a civil action for deprivation of rights under color of law, the remedies with respect to a claim shall be limited to injunctive and declaratory relief where the deprivation consists of a violation of a prohibition in the Constitution against the establishment of religion. No fees shall be awarded in proceedings in vindication of civil rights with respect to such a claim concerning the actions of states and localities. With regard to a claim brought against the United States or a federal official acting in his or her official capacity, the bill prohibits the award of reasonable fees and expenses of attorneys to the prevailing party.

Transportation Workforce Modernization Act This bill authorizes the Department of Transportation to make grants to institutions of higher education and other entities to establish curriculum for a transportation worker retraining program for workers displaced by the adoption of automated driving systems. The Government Accountability Office shall study and report on the impact of driverless vehicle adoption on specified sectors of the economy.

Do Not Track Kids Act of 2018 This bill addresses the collection and publication of children's personal and geolocation information by operators of websites, online services or applications, or mobile applications directed to children or minors. It also prohibits use of any such information to target marketing to children.

Vietnam Human Rights Act This bill urges the Department of State to prompt Vietnam to: (1) repeal laws and administrative decrees restricting freedom of expression (including the Internet), association, and peaceful assembly; and (2) release political and religious prisoners. The bill states that: (1) it is U.S. policy to prioritize religious freedom in bilateral relations with Vietnam, (2) Vietnam should be designated as a country of particular concern for religious freedom, and (3) Vietnamese officials guilty of gross violations of human rights should be investigated by the United States and sanctioned if warranted. The State Department may establish programs to: (1) monitor and halt bride and sex trafficking of girls and women in Vietnam and other Asian countries, including China; and (2) address Vietnam's growing sex-ratio disparity. The President may provide assistance to ethnic minority groups in Vietnam affected by severe human rights violations. The bill expresses the sense of Congress that: (1) military assistance to Vietnam should be conditioned upon human rights progress, and (2) trade and foreign assistance benefits will be contingent upon whether Vietnam has illegally expropriated properties of U.S. citizens.

This bill limits the authority of the Department of State with respect to international postal agreements that would require the U.S. Postal Service (USPS) to establish a classification, rate, or fee for any postal service. The Board of Governors of the USPS must establish reasonable and equitable classes of mail and reasonable and equitable rates of postage and fees for the transportation and delivery within the United States of documents and goods received from other countries. Such classifications, rates, and fees shall be regulated by the Postal Regulatory Commission in the same manner as comparable domestic classifications, rates, and fees, and shall be available to users of domestic postal services under the same terms and conditions as provided to foreign post offices and other entities tendering documents and goods from other countries to the USPS. The classifications, rates, and fees established by the USPS shall not discriminate between documents or goods received from other countries based on the country of origin, the nationality of the sender, or the ownership or governmental designation of the entity tendering the documents or goods to it. The State Department may not conclude a treaty, convention, or other intergovernmental agreement that requires the USPS to provide preferential classifications, rates, or fees for the transportation and delivery within the United States of documents and goods received from other countries unless specified conditions are met.

Poison Center Network Enhancement Act of 2018 This bill amends the Public Health Service Act to reauthorize for FY2020-FY2024 and revise the national toll-free phone number, public awareness campaign, and grant program relating to poison control centers. Among other changes, the bill: supports enhancements of the national toll-free phone number, such as texting capabilities and improved location accuracy; expands the public awareness campaign to include education about information that is available from poison control centers regarding drug misuse; and authorizes poison control centers and professional organizations to use grant funds for preventing and treating the misuse of opioids and other drugs.

Global Trade Accountability Act of 2018 This bill amends the Trade Act of 1974 to require congressional approval of unilateral trade actions. Such actions may take effect without congressional approval for one 90-day period if the President: determines that it is necessary because of a national emergency, because of an imminent threat to health or safety, for the enforcement of criminal laws, or for national security; and submits written notice of the determination to Congress.

Agricultural Certainty for Reporting Emissions Act This bill amends the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to exempt air emissions from animal waste at a farm from specified release notification requirements, recordkeeping requirements, and associated penalties.

Retirement Enhancement and Savings Act of 2018 This bill amends the Internal Revenue Code and the Employee Retirement Income Security Act of 1974 (ERISA) to modify requirements for tax-favored retirement savings accounts, employer-provided retirement plans, and retirement benefits for federal judges. With respect to employer-provided plans, the bill modifies requirements regarding: multiple employer plans, automatic enrollment and nonelective contributions, loans, terminating or transferring plans, reporting and disclosure rules, nondiscrimination rules, selecting lifetime income providers, and Pension Benefit Guaranty Corporation premiums. The bill also increases the tax credit for small employer pension plan startup costs and allows a tax credit for small employers that establish retirement plans that include automatic enrollment. With respect to Individual Retirement Accounts (IRAs), the bill: treats taxable non-tuition fellowship and stipend payments as compensation, repeals the maximum age for traditional IRA contributions, and permits any IRA to be a shareholder of any S corporation that is a bank. The bill makes several modifications to retirement benefits for magistrate judges of the U.S. Tax Court and other federal judges. The bill also modifies various tax provisions to: reinstate and increase the tax exclusion for benefits provided to volunteer firefighters and emergency medical responders, revise the required distribution rules for pension plans, increase penalties for failing to file tax or retirement plan returns, and require the Internal Revenue Service to share returns and return information with U.S. Customs Border Protection to administer the heavy vehicle use tax.

Electricity Reliability and Fuel Security Act This bill amends the Internal Revenue Code to allow a tax credit through 2022 for a portion of the expenses for the operation or maintenance of a coal-powered electric generation unit, excluding expenses for coal. The credit applies to taxpayers who own or lease an electric generation unit that uses coal to produce at least 75% of the electricity produced by the unit. Qualified public entities may transfer the credit to an eligible project partner. A "qualified public entity" is: (1) a federal, state, or local government entity or any political subdivision, agency, or instrumentality thereof; (2) a mutual or cooperative electric company; or (3) a not-for-profit electric utility which had or has received a loan or loan guarantee under the Rural Electrification Act of 1936. An "eligible project partner" is a person who: is responsible for operating, maintaining, or repairing the unit; participates in the provision, including transportation, of coal to the unit; provides financing for the construction or operation of the unit; or leases the unit.

Trickett Wendler, Frank Mongiello, Jordan McLinn, and Matthew Bellina Right to Try Act of 2018 This bill amends the Federal Food, Drug, and Cosmetic Act to exempt, from specified requirements and restrictions under that Act and other laws, the provision of certain unapproved, investigational drugs to a terminally ill patient who has exhausted approved treatment options and is unable to participate in a clinical trial involving the drugs. The manufacturer or sponsor of an eligible investigational drug must publish annual summaries on any use of the drug in accordance with these provisions. The bill limits the liability of a sponsor, manufacturer, licensed physician, clinical investigator, or hospital that provides, or declines to provide, an eligible investigational drug to an eligible patient in accordance with the bill.

Protecting Our Children's Future Act of 2018 This bill amends the Congressional Budget Act of 1974 and other budget laws to make several changes to the federal budget process. The changes to the budget process include: converting the existing annual budget and appropriations process to a biennial process; changing the calendar period for the federal fiscal year (currently October 1 through September 30) to January 1 through December 31 beginning in 2020; requiring mandatory spending to be subject to the appropriations process beginning in FY2020, with exceptions for Social Security, Medicare, programs administered by the Department of Veterans Affairs, and TRICARE; requiring the baseline budget of each department or agency to be assumed to be zero and each proposed expenditure to be justified as if it were a new expenditure; requiring Congress to consider appropriations bills using procedures similar to the existing budget reconciliation process, which includes expedited procedures that prevent a filibuster and restrict amendments in the Senate; withholding pay for Members of Congress if the House and Senate have not jointly agreed to a congressional budget resolution by June 30 of the first year of a Congress; and repealing the existing discretionary spending limits and the sequestration process used to enforce the limits.

Advancing Innovation and Reinvigorating Widespread Access to Viable Electromagnetic Spectrum Act or the AIRWAVES Act This bill requires the Federal Communications Commission (FCC) to complete auctions by December 31, 2020, that will grant priority access broadcast licenses for specified frequency spectrum bands. The FCC and the National Telecommunications and Information Administration are directed to identify frequencies in specified spectrum bands that may be utilized for non-federal unlicensed use and commercial licensed use. The FCC must allocate 10% of proceeds from each of the spectrum band auctions specified in the bill to expand wireless infrastructure in rural areas that are underserved or unserved. The FCC shall conduct a study on how unlicensed frequency spectrum bands can be utilized for: (1) the provision of healthcare in rural areas, (2) distance learning, and (3) facilitating innovations in agriculture.

Uniting and Securing America Act of 2018 or the USA Act of 2018 This bill provides conditional permanent resident status for an alien meeting specified requirements, including having entered the United States when younger than 18 years old and residing in the United States since December 31, 2013. An individual may apply to have such conditional basis removed after meeting specified eligibility requirements. The Department of Homeland Security (DHS) shall cancel the removal of, and adjust to the status of an alien lawfully admitted for permanent residence on a conditional basis, an individual who was granted Deferred Action for Childhood Arrivals (DACA) status, unless such individual has engaged in disqualifying conduct. The bill repeals provisions that deny an unlawful alien eligibility for higher education benefits on the basis of residence within a state unless a U.S. citizen or national is eligible for such benefits without regard to whether such citizen or national is such a resident. DHS shall: (1) deploy the most practical and effective technology available in order to achieve situational awareness and operational control along the U.S. border; (2) submit to Congress a comprehensive southern border strategy to achieve border control; and (3) begin eradicating the carrizo cane plant and salt cedar along the Rio Grande River. DHS may construct new ports of entry along the northern and southern borders. The bill establishes Operation Stonegarden in DHS to provide border security grants to law enforcement agencies in border or maritime border states that are involved in U.S. Customs and Border Protection operations DHS shall establish a two-year grant program to improve emergency communications in the southern border region for individuals who are at risk of violence and lack cellular and LTE network service. The number of immigration judges is increased. The President shall designate a senior official to coordinate federal and international efforts to strengthen citizen security, the rule of law, and economic prosperity in Central America.

Securing America's Future Act of 2018 This bill amends the Immigration and Nationality Act to revise immigrant visa allocation provisions, including family-related visas. A nonimmigrant classification for parents of adult U.S. citizens is created. The diversity visa program is eliminated. Annual immigration levels are revised. The limit on the worldwide level of employment-based immigrants is increased. The H-2C visa temporary agricultural worker program is revised. A trust fund is established to provide incentives for such workers to return to their country of origin. DNA testing to establish family relationships is authorized. Employment eligibility verification provisions are revised. The Department of Homeland Security (DHS) shall establish an employment verification system. No federal, state, or local government entity or individual may prohibit or restrict a federal, state, or local government entity or official from complying with the immigration laws or assisting related federal law enforcement activities. The bill revises provisions regarding: (1) detention of aliens in removal proceedings; (2) illegal entry and reentry; (3) inadmissibility and deportability of criminal aliens, gang members, drunk drivers, and sex offenders; (4) repatriation; (5) asylum and asylum fraud; (6) unaccompanied alien children; (7) foreign students; and (8) visa fraud. The bill: (1) transfers authority for strengthening the southern border from the Department of Justice to DHS; (2) revises border security provisions; (3) provides for additional border security personnel; (4) authorizes new ports of entry along the northern border and southern borders; (5) authorizes National Guard border security activities; (6) provides contingent nonimmigrant status for certain aliens who entered the United States as minors; (7) authorizes appropriations for specified border barriers and infrastructure; and (8) establishes Operation Stonegarden to make border security grants to law enforcement agencies. DHS shall: (1) submit a southern border threat analysis, (2) establish the Integrated Border Enforcement Team program, (3) implement the Border Security Deployment Program, (4) review social media activities of visa applicants, and (5) establish a biometric exit data system.

340B Protecting Access for the Underserved and Safety-net Entities Act or the 340B PAUSE Act This bill amends the Public Health Service Act to suspend for two years the registration of certain hospitals in the 340B drug pricing program, which requires drug manufacturers to offer discounts on outpatient drugs to registered health care entities. The bill requires certain registered hospitals to report to the Department of Health and Human Services specified information, including the number of individuals receiving discounted drugs and associated costs.

Directs the Committee on House Administration to issue regulations requiring Members, officers, and employees of the House of Representatives to complete a training program on workplace rights and responsibilities, including anti-discrimination and anti-harassment training, during each congressional session. Requires Members, officers, or employees to certify completion of such training within 90 days after a congressional session begins or within 90 days after beginning service during a session. (Sets forth a special rule requiring such training to be completed within 180 days after the beginning of the second session of the 115th Congress.) Directs the committee to issue regulations requiring that each House employing office post in a prominent location in its office and in each Member's congressional district office a statement of rights and protections provided to House employees under the Congressional Accountability Act of 1995, including procedures for responding to and adjudicating allegations of violations of such rights and protections.

Indexing Narcotics, Fentanyl, and Opioids Act of 2017 or the INFO Act This bill requires the Secretary of Health and Human Services to appoint a federal coordinator within the Department of Health and Human Services to: coordinate programs related to opioid abuse reduction, liaise with state and local entities carrying out activities relating to opioid abuse reduction, and establish and operate a publicly available electronic database to facilitate data collection related to opioid abuse .

Hurricane Harvey Small Business Recovery Grants Act This bill establishes within the Small Business Administration (SBA) the Office of Hurricane Harvey Small Business Recovery Grants to compensate small businesses, located in a qualified disaster area, for substantial economic injury they suffered resulting from Hurricane Harvey beginning August 25, 2017, and ending August 25, 2018. This compensation (1) excludes interest on the amount of the payment before the settlement or payment of a claim or any punitive or noncompensatory damages; and (2) is limited to $100,000, except in cases where the SBA determines that a greater amount up to $250,000 is appropriate.

Air Ambulance Quality and Accountability Act This bill amends title XVIII (Medicare) of the Social Security Act to modify standards and payment for air-ambulance services under the Medicare Program. The Department of Health and Human Services (HHS) shall establish minimum standards that must be met by air-ambulance suppliers and providers as a condition of their participation in Medicare. These standards must address: (1) scope of practice, training, and clinical capability; (2) medical equipment and vehicle attributes; (3) documentation; (4) medical direction and oversight; (5) reporting of specified events; (6) patient safety and infection control; (7) clinical quality-management and performance-improvement programs; and (8) particular populations. An air-ambulance provider or supplier that is accredited by an HHS-approved organization shall be deemed to be in compliance with these standards. HHS must establish an air-ambulance quality-reporting and performance program under which Medicare payment is determined according to a specified performance-based formula. Performance measures shall address patient safety, clinical quality, and over-triage. An air-ambulance provider or supplier must, subject to suspension of payment under Medicare, annually submit specified cost data to HHS. The Medicare Payment Advisory Commission shall report to Congress on whether changes should be made with regard to reimbursement of air-ambulance providers and suppliers under Medicare.

Carbon Capture Act This bill amends the Internal Revenue Code to extend and modify the tax credit for carbon dioxide (CO2) sequestration. The bill modifies the credit to: allow certain new industrial or direct air capture facilities to qualify for the credit if construction begins before 2024; allow qualified projects to claim the credit for 15 years, beginning on the date the equipment was originally placed in service; increase the credit amounts for certain projects placed in service upon or after the enactment of this bill; expand the purposes for which captured CO2 may be used; modify the requirements for the amount of CO2 that must be captured; specify that the 75 million metric ton cap on the CO2 that may qualify for the credit applies only to projects placed in service before the enactment of this bill; allow the credit to be transferred from the entity that owns and uses the capture equipment to the entity that disposes of or uses the CO2; and allow certain facilities that were placed in service after 2015 and have not previously claimed the credit to be treated as placed in service on the date of the enactment of this bill.

Border Security for America Act of 2017 This bill directs the Department of Homeland Security (DHS) to: (1) construct and operate infrastructure and technology to deter and detect illegal border activity in high traffic areas, (2) deploy the most practical and effective technology to achieve situational awareness and operational control of the border, (3) deploy additional capabilities to specified border sectors or regions, (4) submit a plan for evaluating and using independent verification and validation resources for border security technology, (5) establish a National Border Security Advisory Committee, (6) submit a southern border threat analysis, (7) implement the Border Security Deployment Program, (8) establish a biometric exit data system, and (9) begin eradicating the carrizo cane plant and any salt cedar along the Rio Grande River. The bill provides for: (1) U.S. Border Patrol personnel increases and infrastructure improvements, including forward base upgrades along the southern border; and (2) National Guard and Department of Defense border assistance. The bill: (1) prohibits federal agency restrictions on U.S. Customs and Border Protection activities on federal land within 100 miles of the border, (2) requires increases in immigration and law enforcement personnel and agricultural specialists, (3) authorizes appropriations for specified immigration purposes, and (4) requires electronic passport screening and biometric matching at airports of entry. The Anti-Border Corruption Act of 2010 is amended to provide for hiring flexibility. Operation Stonegarden is established as a DHS program to provide border security grants. This bill authorizes DHS to construct new ports of entry along the northern and southern borders.

Dream Act of 2017 This bill directs the Department of Homeland Security (DHS) to cancel removal and grant lawful permanent resident status on a conditional basis to an alien who is inadmissible or deportable or is in temporary protected status who: (1) has been continuously physically present in the United States for four years preceding this bill's enactment; (2) was younger than 18 years of age on the initial date of U.S. entry; (3) is not inadmissible on criminal, security, terrorism, or other grounds; (4) has not participated in persecution; (5) has not been convicted of specified federal or state offenses; and (6) has fulfilled specified educational requirements. DHS shall cancel the removal of, and adjust to the status of an alien lawfully admitted for permanent residence on a conditional basis, an alien who was granted Deferred Action for Childhood Arrivals (DACA) status unless the alien has engaged in conduct that would make the alien ineligible for DACA. DHS may not: (1) grant conditional permanent resident status without the submission of biometric and background data, and completion of background and medical checks; and (2) disclose or use information provided in applications filed under this bill or in DACA requests for immigration enforcement purposes. The bill prescribes the conditions under which DHS: (1) may terminate a person's conditional permanent resident status, and (2) shall adjust a person's conditional status to permanent resident status. The bill: (1) sets forth documentation requirements for establishing DACA eligibility, and (2) repeals the denial of an unlawful alien's eligibility for higher education benefits based on state residence.
