Requires that allotments to states that do not qualify under this Act be ratably reduced if necessary to ensure the allotments to qualifying states. Defines a "qualifying winter season" as one occurring after enactment of this Act for which the projected average price of heating oil is greater than the average price for the winter of 2011-2012.

Smart Energy Act

Smart Energy Act - Amends the National Energy Conservation Policy Act (NECPA) to direct each federal agency to implement requirements for the use of energy and water efficiency measures in federal buildings through private financing instead of appropriations, unless: (1) to do so conflicts with the primary mission of the agency or facility, or (2) if greater cost savings can be generated under a different program Requires a federal agency, in carrying out energy management requirements, to participate in demand response programs offered by electric utilities, Independent System Operators, Regional Transmission Organizations, and demand response aggregators, where such programs are available, in order to support electric grid reliability and security and reduce energy bills for the agency or facility. Directs the Director of the Office of Management and Budget (OMB) to direct the Federal Chief Information Officer to require: (1) agencies, when updating their federal data center inventories in the third quarter of each fiscal year, to state what actions have been taken to verify the inventories; (2) the agencies to complete the missing elements in their respective federal data center consolidation plans and submit them; and (3) the Data Center Consolidation Task Force to assess such plans to ensure they are complete and to monitor their implementation as well. Directs the Secretary of Energy (DOE) to issue guidelines for federal agencies to employ advanced tools allowing energy savings through the use of computer hardware, energy efficiency software, and power management tools. Amends NECPA to require federal agencies to create an implementation plan for achieving requirements for advanced metering of energy use in federal facilities, buildings, and equipment. Requires the energy manager, for each facility meeting certain criteria, to use the web-based tracking system to publish energy and water consumption data on an individual facility basis. Amends the Energy Policy Act of 2005 to establish a loan program for energy efficiency upgrades to existing buildings. Directs the Secretary to establish collaborative research and development partnerships with other programs within the Office of Energy Efficiency and Renewable Energy, the Office of Electricity Delivery and Energy Reliability, and the Office of Science that: (1) leverage the research and development expertise of those programs to promote early stage energy efficiency technology development; (2) support the use of innovative manufacturing processes and applied research for development, demonstration, and commercialization of new technologies and processes to improve efficiency, reduce emissions, reduce industrial waste, and improve industrial cost-competitiveness; and (3) apply the knowledge and expertise of the Advanced Manufacturing Office to help achieve the program goals of the other programs. States that it is the goal of the United States to achieve by the end of 2020 a doubling of the production of electricity from combined heat and power and waste heat recovery in the United States from the current level of approximately 85 to at least 170 gigawatts. Directs the Secretary to transmit to Congress, make available to the public, and update biennially a strategic plan to achieve this national goal.

Immigration and Naturalization Investment Ventures for Engineering, Science, and Technology in America Act of 2011 or INVEST in America Act - Amends the Immigration and Nationality Act to provide conditional permanent resident status for an alien entrepreneur (and spouse and children) who: (1) is in the process of completing, or has completed, a graduate level degree in science, technology, engineering, math or a related academic discipline from an accredited U.S. institute of higher education; (2) establishes a new commercial enterprise related to such study that meets specified employment and wage requirements; and (3) is admissible as an immigrant. Directs the Secretary of Homeland Security (DHS) to terminate such alien's status for fraud or failure to meet status requirements during the 60-month period after obtaining such status. Directs the Secretary of Homeland Security, the Secretary of Commerce, and the Secretary of Education to submit a recruitment, retainment, and investment strategic plan to Congress to attract skilled and talented foreign nationals to immigrate to the United States to create jobs and grow the economy.

School Access to Emergency Epinephrine Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS), in awarding grants to states under the children's asthma treatment grants program, to favor states that require their public elementary and secondary schools to: (1) permit authorized personnel to administer epinephrine to any student believed to be having an anaphylactic reaction, and (2) maintain a supply of epinephrine that is prescribed by a licensed physician and is stored in a secure and easily accessible location. (States given this preference are also required by current law to require those schools to authorize students, under certain conditions, to self-administer medication to treat their asthma or anaphylaxis.) Requires such states to also have a Good Samaritan law protecting school employees and agents from liability related to the administration of epinephrine to students believed, in good faith, to be having an anaphylactic reaction.

Defines "generic substitution rate" as the share of all drug units for which Medicaid payment is made to a state for the 20 most widely prescribed multiple source drugs under the state program that have a specific National Drug Code. Directs the Secretary to provide for payments to eligible states for implementation of programs to achieve reductions in expenditures under Medicaid or under SSA title XVIII (Medicare) (innovative health care savings program).

Federal Communications Commission Consolidated Reporting Act of 2011 - Amends the Communications Act of 1934 to require the Federal Communications Commission (FCC) to publish on its website and submit to Congress a biennial report on the state of the communications marketplace assessing: (1) competition, including intermodal, facilities-based, and new and emergent services competition and addressing the provision of content and communications using the Internet; (2) deployment of communications capabilities, including whether advanced telecommunications capability is being deployed to all Americans in a reasonable and timely fashion; and (3) whether laws, regulations, or regulatory practices pose a barrier to competitive entry or expansion of existing providers of communications services. Requires the FCC to compile a list of geographic areas that are not served by any provider of advanced telecommunications capability. Repeals and consolidates various FCC reports including reports on satellite competition, international broadband, video programming, cable industry prices, small business entry barriers, commercial mobile radio, and several other existing reports under such Act.

Federal Communications Commission Process Reform Act of 2011 - Amends the Communications Act of 1934 to establish procedural requirements for the Federal Communications Commission (FCC) concerning: (1) the issuance of proposed rulemaking notices, including the time periods for comments and replies and any necessary findings, background information, or performance measures that must be contained in such notices; (2) the circumstances under which the FCC is authorized to adopt or amend a rule; and (3) the disclosure of closed meetings held by a bipartisan majority of FCC Commissioners. Requires the FCC, before adopting or amending a rule that may have an economically significant impact, to: (1) analyze the specified market failure, actual consumer harm, burden of existing regulation, or failure of public institutions that warrants the rule or amendment; and (2) determine that the benefits justify its costs. Directs the FCC to establish rules for: (1) Commissioners' deliberations including procedures for initiating agenda items and approving orders; and (2) the publication of the status of open rulemakings and all proposed orders, decisions, reports, or actions on circulation for review. Prohibits the FCC, without providing an opportunity for public review, from relying on unpublished reports to Congress or ex parte FCC communications or filings under specified circumstances. Directs the FCC to publish on its website and in other required formats: (1) each order, decision, report, or action within seven days of its adoption; and (2) an anticipated release schedule for all statistical reports and reports to Congress. Sets forth standards that restrict the FCC's authority to conditionally approve line and license transfers and other transactions. Prohibits the FCC from considering a voluntary commitment of a party to such transfer or transaction unless the FCC could adopt that commitment as a condition under such standards.

Local Flexibility for Transit Assistance Act - Authorizes the Secretary of Transportation (DOT) to make urbanized area formula grants for the operating costs of equipment and facilities for use in public transportation in an urbanized area with a population over 200,000 to a designated recipient, direct recipient, or subrecipient that provides public transportation in the area operating less than 100 buses in fixed-route service in the area during peak service hours. Authorizes a designated recipient or direct recipient that operates at least 100 buses in fixed-route service during peak service hours in an urbanized area with a population of more than 200,000 to use grant funds for the operating costs of public transportation equipment and facilities in such projects if: (1) the recipients are certified by the Secretary as being in a crisis period; and (2) the recipients' percentage of revenue for the operating costs of public transportation equipment and facilities from non-federal sources (excluding system-generated revenue) is equal to the previous fiscal year's revenue, or the revenue is derived from dedicated sources. Specifies percentage limitations on the use of funds for urbanized areas with populations between 200,000 and 500,000, between 500,000 and 1 million, and over 1 million. Defines "crisis period" to mean that: (1) the unemployment rate within the recipients' service area is 7% or higher for the preceding month, or (2) the national average retail price of regular gasoline during a quarter has increased by more than 10%.
