Telemental Health Care Access Act of 2023 This bill eliminates certain restrictions relating to Medicare coverage of mental health services that are provided through telehealth. Current law allows for coverage of such services regardless of the geographic location of the originating site (i.e., the location of the beneficiary), as long as the beneficiary previously received in-person services and continues to receive in-person services at specified intervals (effective January 1, 2025). The bill eliminates these in-person requirements.

Give Kids a Chance Act of 2023 This bill authorizes certain targeted clinical trials involving combinations of drugs to treat pediatric cancer. Specifically, the bill modifies requirements relating to molecularly targeted pediatric cancer investigations so as to authorize investigations of new drugs that are used in combination with active ingredients that have already been approved and that (1) have been determined to be the standard of care for treating a pediatric cancer, or (2) have been approved to treat an adult cancer and are directed at molecular targets for pediatric cancer. The Food and Drug Administration must issue guidance and report on the bill's implementation. The Government Accountability Office must report on the effectiveness of the bill's changes with respect to the development of pediatric cancer drugs.

Gabriella Miller Kids First Research Act 2.0 This bill reauthorizes through FY2028 a pediatric disease research initiative within the National Institutes of Health (NIH) and requires the NIH to coordinate pediatric research activities to avoid duplicative efforts. Additionally, the Department of Health and Human Services must report to Congress about research funded through the initiative.

Repair Abuses of MSP Payments Act or the RAMP Act This bill restricts the private right of action against insurance plans that do not provide appropriate primary payment in cases in which Medicare is a secondary payer. Current law allows for a private right of action against primary plans that do not provide appropriate primary payment in cases in which Medicare is a secondary payer; this provision applies to group health plans, workers' compensation plans, automobile or liability insurance plans, and no-fault insurance plans. The bill limits this provision to group health plans.

National Law Enforcement Officers Remembrance, Support and Community Outreach Act This bill directs the Department of Justice (DOJ) to establish a National Law Enforcement Officers Remembrance, Support, and Community Outreach Program. The bill further directs DOJ to award a grant under the program to the National Law Enforcement Officers Memorial Fund for the expenses associated with community outreach, public education, and officer safety and wellness programs operated by the of the National Law Enforcement Officers Memorial Fund and National Law Enforcement Museum.

Promoting Transparency and Healthy Competition in Medicare Act This bill requires Medicare Advantage (MA) organizations and prescription drug plan (PDP) sponsors and pharmacy benefit managers (PBMs) under the Medicare prescription drug benefit to report certain information relating to their ownership interests in participating providers. Specifically, MA organizations must report on items and services, patient risk scores and associated diagnoses, prior authorization requests, and incentive payments with respect to providers in which the MA organization has an ownership interest as compared to other providers. Similarly, PDP sponsors under the Medicare prescription drug benefit must report on the prices of prescription drugs with respect to pharmacies in which the PDP sponsor has an ownership interest as compared to other pharmacies. The bill also prohibits PDP sponsors from contracting with PBMs in which the PDP sponsor has an ownership interest unless the PBM reports certain information on rebates and payments between the PBM, PDP sponsor, pharmacies, and drug manufacturers.

Providers and Payers COMPETE Act This bill requires the Centers for Medicare & Medicaid Services (CMS) to report annually on the impact of Medicare regulatory changes on provider and payer consolidation (e.g., vertical or horizontal integration among providers, suppliers, and other health care entities). The CMS must also solicit public comment on the projected impact of a proposed rule with respect to provider and payer consolidation. The bill also requires the Center for Medicare and Medicaid Innovation to evaluate the impact of tested models on provider and payer consolidation.

Maternal Health for Veterans Act This bill requires the Department of Veterans Affairs (VA) to report annually through FY2028 on its activities relating to the coordination of maternity health care. The reports must also include (1) data on the maternal health outcomes of veterans who receive medical care or services from the VA or a non-VA provider that is authorized to provide care or services under VA programs, and (2) VA recommendations to improve the maternal health outcomes of veterans. The reports must be made publicly available. The bill also authorizes funding through FY2028 for VA programs relating to the coordination of maternity health care.

Coastal Broadband Deployment Act This bill excludes projects to deploy or modify certain transmitting devices, towers, antennas, or other communications facilities from specified environmental and historic preservation reviews if the project is carried out entirely within a floodplain (the lowland and relatively flat areas adjoining inland and coastal waters). In particular, it specifies such projects are not considered major federal actions under the National Environmental Policy Act of 1969 or undertakings under the National Historic Preservation Act. This excludes the projects from relevant reviews required under those acts.

Connecting Communities Post Disasters Act of 2023 This bill excludes from specified environmental and historic preservation reviews certain projects to replace or improve communications facilities following a presidentially declared major disaster or emergency. In particular, it specifies such projects are not considered major federal actions under the National Environmental Policy Act of 1969 or undertakings under the National Historic Preservation Act. This excludes the projects from relevant reviews that are required under those acts. The projects must be carried out (1) within an area for which the President has declared a major disaster or an emergency, and (2) not later than five years after the date on which the President made the declaration.

This bill requires certain health care entities to disclose specific information about their ownership and finances. Specifically, the bill requires entities, subject to civil penalties, to annually report to the Department of Health and Human Services (HHS) information relating to mergers, acquisitions, and changes in ownership over the previous year, as well as information on the entity's parent company, if applicable. The requirements apply to hospitals, certain ambulatory surgical centers, independent freestanding emergency departments, physician-owned practices that have more than 25 physicians, and physician practices that are owned by a hospital, health plan, private equity company, or venture capital firm. Hospitals must also report information about their business structure, debts, real estate transactions, and certain investments. HHS must post a summary of the reported information on its website, including trends in consolidation.

Energy Emergency Leadership Act This bill expands the list of functions that the Secretary of Energy must assign to assistant secretaries under the Department of Energy Organization Act to include energy emergency and energy security functions, such as responsibilities with respect to infrastructure and cybersecurity. The Department of Energy must ensure that such functions are performed in coordination with relevant federal agencies.

Air Traffic Control Tower Replacement Process Report Act of 2023 This bill directs the Federal Aviation Administration (FAA) to submit a report to Congress on the process by which air traffic control tower facilities are chosen for replacement. The FAA must also establish, maintain, and publish on the FAA website a list of all of the air traffic control tower facilities replaced within the previous 10-year period and any such facilities in the process of being replaced or under consideration for replacement.

Affordable Housing Credit Improvement Act of 2023 This bill revises provisions of the low-income housing tax credit and renames it as the affordable housing tax credit . The bill increases the per capita dollar amount of the credit and its minimum ceiling amount beginning in 2023 and extends the inflation adjustment for such amounts. The bill modifies tenant income eligibility requirements and the average income formula for determining such income. It also revises rules for student occupancy of rental units and tenant voucher payments, and prohibits any refusal to rent to victims of domestic abuse. The bill further modifies the credit to increase state allocations of the credit; repeal the qualified census tract population cap; prohibit consideration of local approval and local government contribution requirements for housing projects; increase the credit for certain projects designated to serve extremely low-income households; increase the credit for certain bond-financed projects designated by state agencies; eliminate the basis reduction for properties that receive certain energy-related tax benefits; and increase the population cap for difficult development areas (i.e., areas with high construction, land, and utility costs relative to area median gross income). The bill also includes Indian and rural areas as difficult development areas and modifies other requirements relating to casualty losses, tax-exempt bond financing, and foreclosures.

Homes for Every Local Protector, Educator, and Responder Act of 2023 or the HELPER Act of 2023 This bill establishes a program administered by the Department of Housing and Urban Development to provide mortgage assistance to law enforcement officers, elementary and secondary school teachers, firefighters, or other first responders. Specifically, these individuals may be eligible for a first-time mortgage on a primary family residence with no down payment. Instead, the mortgage is subject to a one-time, up-front mortgage insurance premium.

Back the Blue Act of 2023 This bill establishes new criminal offenses for killing, assaulting, and fleeing to avoid prosecution for killing a judge, law enforcement officer, or public safety officer. Additionally, the bill expands the list of statutory aggravating factors in death penalty determinations to also include the killing or attempted killing of a law enforcement officer, judge, prosecutor, or firefighter or other first responder; broadens the authority of federal law enforcement officers to carry firearms; and limits federal court review of challenges to state court convictions for killing a public safety officer or judge.

This resolution supports the designation of Tardive Dyskinesia Awareness Week. Tardive dyskinesia is a movement disorder characterized by involuntary and uncontrolled movements of muscles in the face, torso, and extremities. It is caused by prolonged use of certain medications, including ones used to treat schizophrenia.

Due Process Continuity of Care Act This bill allows an otherwise eligible individual who is in custody pending disposition of charges (i.e., pretrial detainees) to receive Medicaid benefits at the option of the state. The bill also provides for state planning grants to support the provision of such benefits.

The resolution also (1) encourages NATO allies to work with their partners in the Indo-Pacific to address shared global security challenges; and (2) commends the people of Taiwan for their commitment to democracy, civil liberties, and human rights.

North Korean Human Rights Reauthorization Act of 2023 This bill reauthorizes through FY2028 various activities to promote human rights in North Korea. These activities include (1) providing grants to nonprofit organizations to promote human rights, democracy, rule of law, and the development of a market economy in North Korea; (2) increasing the availability of sources of information inside North Korea that are not controlled by North Korea's government; and (3) supporting organizations that provide humanitarian assistance to North Koreans who are outside of North Korea without the permission of North Korea's government.

Treatment and Relief through Emerging and Accessible Therapy for PTSD Act or the TREAT PTSD Act This bill requires the Department of Veterans Affairs (VA) and the Department of Defense (DOD) to furnish stellate ganglion block to certain veterans or members of the Armed Forces (including reserve components) diagnosed with post-traumatic stress disorder (PTSD). Blocking the stellate ganglion (a group of nerves at the base of the neck) by injecting a local anesthetic is a treatment that may alleviate PTSD symptoms. The bill authorizes this treatment for any veteran or member of the Armed Forces who (1) is enrolled in the VA health care system or TRICARE program, (2) has been diagnosed with PTSD, and (3) has elected to receive stellate ganglion block after being informed by a physician of the risks and benefits. Such treatment may be furnished at a VA medical center, DOD medical facility, or through health care provider under the Veterans Community Care Program or TRICARE health insurance program. The bill also requires the VA and DOD to update the VA/DOD Clinical Practice Guideline (CPG) for the Management of PTSD to ensure that information about stellate ganglion block is included.

Conservation Reserve Program Amendments Act of 2023 This bill amends the Conservation Reserve Program (CRP) of the Farm Service Agency to provide for the enrollment of citrus land in the program. CRP is a land conservation program that provides an annual rental payment to farmers in exchange for removing environmentally sensitive land from agricultural production and planting species that will improve environmental health and quality. Specifically, the bill allows the Department of Agriculture (USDA) to include cropland in the program that is otherwise ineligible if the land has been used to plant a citrus crop during the 10-year period preceding the date of the bill's enactment. USDA must enroll citrus land using existing continuous enrollment procedures. USDA may give priority to citrus land that is at risk of conversion or development, is of ecological significance, or is affected by huanglongbing (i.e., citrus greening, a bacterial disease spread by an insect that is known as the Asian citrus psyllida and feeds on citrus). The total acreage of citrus land enrolled in the conservation reserve must not exceed 100,000 acres for each of FY2024-FY2028. Further, the bill excludes citrus land from existing adjusted gross income limitations for payments or benefits under CRP.

Hydrogen Permitting Simplification Act This bill exempts certain major federal actions, including actions that produce hydrogen from nuclear, solar, wind, or geothermal energy sources, from requirements under the National Environmental Policy Act of 1969.

Living Donor Protection Act of 2023 This bill prohibits certain insurance carriers from discriminating against, and provides other protections for, living organ donors. Specifically, carriers may not deny, cancel, or otherwise impose conditions on policies for life insurance, disability insurance, or long-term care insurance based on an individual's status as a living organ donor. The bill also expressly specifies that recovery from organ-donation surgery constitutes a serious health condition that entitles eligible employees to job-protected medical leave. In addition, the Department of Health and Human Services must update educational materials on living organ donation to include information about the benefits of living organ donation and about access to insurance for living organ donors.

Fleet Reserve Association 100th Anniversary Act This bill directs the Department of the Treasury to mint and issue 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins in recognition and celebration of the 100th anniversary of the Fleet Reserve Association. All sales of coins issued under this bill shall include a surcharge which shall be paid to the Fleet Reserve Association.

Sinkhole Mapping Act of 2023 This bill directs the United States Geological Survey (USGS) to establish a program to study the short-term and long-term mechanisms that cause sinkholes, including extreme storm events, prolonged droughts causing shifts in water management practices, aquifer depletion, and other major changes in water use; and develop maps depicting the zones that are at greater risk of forming sinkholes. The USGS must establish a public website that displays such maps and other relevant information critical for use by community planners and emergency managers.

Autonomy for Disabled Veterans Act This bill increases the maximum amount authorized under the Home Improvements and Structural Alterations (HISA) grant program to $10,000 for veterans with a service-connected disability and $5,000 for those with disabilities that are not service-connected. The HISA grant program provides medically necessary improvements and structural alterations to veterans' (or service members') primary residence for specified purposes (e.g., allowing for entrance to their home). The bill requires the Department of Veterans Affairs to increase the dollar amount of the grant in accordance with inflation as determined by the Consumer Price Index.

Arnold Daniel Palmer Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins in recognition and celebration of Arnold Palmer. All surcharges received by Treasury from the sale of such coins must be paid to the Arnold & Winnie Palmer Foundation.

Armenian Genocide Education Act This bill requires the Library of Congress to maintain a public website and otherwise support educational initiatives to promote understanding about the Armenian Genocide (the killing of Armenians by the Ottoman Empire from 1915 to 1923).

Fighting Inhumane Gambling and High-Risk Trafficking Act or the FIGHT Act This bill expands protections of animals provided under the Animal Welfare Act, including by prohibiting any (1) broadcasts from international, interstate, or intrastate sources of animal fighting ventures in the United States or U.S. territories; and (2) shipments or transport of certain mature roosters.

This resolution encourages the United States and Israel to continue deepening and expanding cooperation on economic, security, and civilian issues. The resolution also encourages the expansion and strengthening of the Abraham Accords. The Abraham Accords are agreements to normalize or improve relations between Israel and four members of the Arab League: the United Arab Emirates, Bahrain, Morocco, and Sudan.

Go Woke, Go Broke Act This bill abolishes the Advisory Committee on Racial Equity in the Department of the Treasury. The bill also prohibits Treasury from reestablishing this advisory committee or establishing any substantially similar advisory committee.

This resolution condemns the deliberate gas attacks on schoolgirls in Iran (up to 7,000 schoolgirls were poisoned in at least 290 attacks, according to human rights groups) and Iran's suppression of individuals participating in demonstrations. The resolution also urges the United States to initiate a formal process for an independent investigation and to work with the United Nations in investigating the gas attacks on schoolgirls in Iran.

Manufacturing API, Drugs, and Excipients in America Act or the MADE in America Act This bill establishes a tax credit for certain manufacturers of pharmaceuticals or medical products. Specifically, the bill establishes a tax credit for manufacturers of pharmaceuticals, active pharmaceutical ingredients, excipients (i.e., inactive ingredients), medical diagnostic devices, or personal protective equipment, if they are located in a designated distressed zone. The tax credit is equal to 25% of the manufacturer's production expenditures; the credit increases to 30% of expenditures if a substantial portion of the manufacturer's employees reside in a distressed zone. The bill defines distressed zone as an area that has been designated as a qualified opportunity zone by the Internal Revenue Service (i.e., an economically distressed community in which certain new investments may be eligible for preferential tax treatment) and that has a poverty rate of over 30%.

Employee Rights Act This bill generally addresses employer obligations related to unionized workplaces. This bill provides that an employer may be considered a joint employer in relation to an employee under federal labor law only if such employer directly, actually, and immediately (and not in a limited and routine manner) exercises significant control over the essential terms and conditions of employment. Such control may by demonstrated by hiring and discharging employees, determining individual employee rates of pay and benefits, day-to-day supervision of employees, assigning individual work schedules, positions, and tasks, and administering employee discipline. The bill also requires a workplace election to approve or reject a union to be conducted by secret ballot. Further, the bill requires an employer to provide limited employee information to union representatives to facilitate a workplace election. An employer that mishandles or fails to provide such information according to the bill's requirements may be liable for an unfair labor practice (i.e., labor law violation). Additionally, the bill requires an employee to authorize in writing any use of the employee's labor organization dues or other contribution for a purpose other than collective bargaining or contract administration. Such authorization must be made upon 35 days' notice and expires after one year. Finally, the bill exempts Indian Tribes, including Indian Tribe enterprises and institutions, from the collective bargaining rights and related provisions of federal labor law.

Medicaid VBPs for Patients Act or the MVP Act This bill provides statutory authority for regulations that allow for the use of varying best price points under value-based purchasing arrangements for purposes of the Medicaid Drug Rebate Program. ( Value-based purchasing arrangements refer to arrangements in which the price of a drug is linked to clinical outcomes; such arrangements are particularly used for new high-cost treatments, such as gene therapies.) The Government Accountability Office must study the impact of value-based purchasing arrangements on federal health care programs, including with respect to the bill's changes. Additionally, the bill (1) exempts sales of drugs that are made under value-based purchasing arrangements from calculations of the manufacturer average sales price for purposes of payments under Medicare medical services, if the manufacturer reports multiple best prices under Medicaid in accordance with the bill's changes; and (2) requires the Centers for Medicare & Medicaid Services to establish a program under which state Medicaid programs may cover drugs in inpatient settings via value-based purchasing arrangements. The bill's changes terminate five years after enactment; any value-based purchasing arrangements that are in effect as of the date of termination continue to apply.

FEMA Loan Interest Payment Relief Act This bill directs the Federal Emergency Management Agency (FEMA) to provide financial assistance to a local government or electric cooperative as reimbursement for interest paid on a loan used for emergency or disaster recovery activities later paid for by FEMA assistance.

Supporting Safety Net Hospitals Act This bill delays reductions to Medicaid disproportionate-share hospital (DSH) allotments until FY2026. (DSHs are hospitals that receive additional payments under Medicaid for treating a large share of low-income patients.)

Restore Public Health Institution Trust Act of 2023 This bill requires the Government Accountability Office to report on public health messaging and other recommendations of the Centers for Disease Control and Prevention (CDC). The report must specifically address (1) the data used to make recommendations; (2) the effect of inconsistent messaging on the public's trust in the CDC, willingness to follow the CDC's COVID-19 guidance, and attitudes about immunizations both in general and for specific populations; and (3) the degree to which outside entities influenced CDC recommendations.

Safety From Violence for Healthcare Employees Act or the SAVE Act This bill establishes a new criminal offense for knowingly assaulting or intimidating hospital personnel during the performance of their official duties in a manner that interferes with their performance of the duties or limits their ability to perform the duties. Additionally, the bill authorizes grants to reduce the incidence of violence at hospitals, including violence or intimidation against hospital personnel in the performance of their duties.

Safe Step Act This bill requires a group health plan to establish an exception to medication step-therapy protocol in specified cases. A medication step-therapy protocol establishes a specific sequence in which prescription drugs are covered by a group health plan or a health insurance issuer. A request for such an exception to the protocol must be granted if (1) an otherwise required treatment has been ineffective, (2) such treatment is expected to be ineffective and delaying effective treatment would lead to irreversible consequences, (3) such treatment will cause or is likely to cause an adverse reaction to the individual, (4) such treatment is expected to prevent the individual from performing daily activities or occupational responsibilities, (5) the individual is stable based on the prescription drugs already selected, or (6) there are other circumstances as determined by the Employee Benefits Security Administration. The bill requires a group health plan to implement and make readily available a clear process for an individual to request an exception to the protocol, including required information and criteria for granting an exception. The bill further specifies timelines under which plans must respond to such requests.

Federal Firearms Licensee Protection Act of 2023 This bill modifies criminal penalties for an offense involving the theft of a firearm from a licensed importer, manufacturer, or dealer, or from their business premises. Specifically, the bill does the following: increases from 10 to 20 years the maximum prison term, and creates a 3- or 5-year mandatory minimum prison term for an offense that occurs during the commission of a burglary or robbery. An attempt to commit an offense is subject to the same penalties as a substantive offense.

Special Diabetes Program for Indians Reauthorization Act of 2023 This bill extends funding through FY2028 for the Special Diabetes Program for Indians. The program is administered by the Indian Health Service and provides funds to Indian health programs for diabetes prevention and treatment.

Strengthening Community Care Act of 2023 This bill extends funding through FY2028 for the Community Health Center Fund (CHCF) and the National Health Service Corps (NHSC) Fund. The CHCF supports grants for outpatient health care facilities that provide care to medically underserved populations; the NHSC Fund supports the provision of scholarships and student loan repayment awards to health care providers who agree to work in areas with health care provider shortages.

Special Diabetes Program Reauthorization Act of 2023 This bill extends funding through FY2028 for a program carried out by the National Institute of Diabetes and Digestive and Kidney Diseases that supports research on the prevention and cure of type 1 diabetes.
