Treat and Reduce Obesity Act of 2019 This bill expands Medicare coverage of intensive behavioral therapy for obesity. Specifically, the bill allows coverage for therapy that is provided by (1) a physician who is not a primary care physician; or (2) other health care providers (e.g., physician assistants and nurse practitioners) and approved counseling programs, if provided upon a referral from, and in coordination with, a physician or primary care practitioner. Currently, such therapy is covered only if provided by a primary care practitioner. The bill also allows coverage under Medicare's prescription drug benefit of drugs used for the treatment of obesity or for weight loss management for individuals who are overweight.

This resolution commends the international community, health organizations, the private sector, school and community leaders, and faith-based organizations for bolstering health through vaccination. It also recognizes that the lack of vaccination can create an environment in which a public health crisis could emerge, and that there is no credible evidence that vaccines cause life-threatening or disabling diseases in healthy children or adults. The resolution also encourages a continued commitment to vaccine research, and urges everyone to follow the scientific evidence and consensus of medical experts in favor of timely vaccinations.

Competitive Health Insurance Reform Act of 2019 This bill declares that nothing in the McCarran-Ferguson Act modifies, impairs, or supersedes the operation of antitrust laws with respect to the business of health insurance, including the business of dental insurance. This declaration does not apply to a contract, combination, or conspiracy to (1) collect, compile, or disseminate historical loss data; (2) determine a loss development factor for historical loss data; (3) perform actuarial services if the collaboration does not involve a restraint of trade; or (4) develop or disseminate a standard insurance policy form if adherence to the form is not required. Prohibitions against unfair methods of competition apply to the business of health insurance without regard to whether the business is for profit.

Stop Corrupt Iranian Oligarchs and Entities Act This bill directs the Department of the Treasury to report to Congress on Iranian individuals and parastatal groups that have close relationships with the Iranian government, including information regarding (1) their known sources of income, (2) their indices of corruption, (3) their involvement in key U.S. economic sectors, (4) the structures and ownership of the parastatal groups, and (5) the potential effects of imposing sanctions on such entities and individuals.

Education Freedom Scholarships and Opportunity Act This bill allows individual and corporate taxpayers a tax credit for cash contributions to tax-exempt scholarship-granting organizations for elementary and secondary education expenses. It imposes a cap of $5 billion on the amount of contributions that qualify for a tax credit. The bill directs the Department of Education, in coordination with the Department of the Treasury, to establish, host, and maintain a web portal that (1) lists all eligible scholarship-granting organizations; (2) enables contributions to such organizations; (3) provides information about the benefits of this bill; and (4) enables a state to submit and update information about its programs and scholarship-granting organizations, including information on student eligibility and allowable educational expenses.

This resolution calls upon the governments of Bangladesh and Pakistan to stop Jamaat-e-Islami (an Islamist political party) from threatening regional stability and urges U.S. agencies to end partnerships with groups affiliated with Jamaat-e-Islami . Additionally, this resolution presses law enforcement to investigate the reported collaboration between the Hand for Relief and Development (a charitable organization) and a Pakistani terrorist organization.

Health Insurance Tax Relief Act of 2019 This bill delays reimposition of the annual fee on health insurers until 2022. Under current law, the annual fee for a health insurer is calculated based on the insurer's share of total premiums from the preceding year. The fee is suspended for 2019 (i.e., there is no fee based on premiums from 2018); reimposition is scheduled for 2020.

ALS Disability Insurance Access Act of 2019 This bill eliminates the five-month waiting period for disability benefits under the Old Age, Survivors, and Disability Insurance program for individuals with amyotrophic lateral sclerosis (a progressive neurodegenerative disease, also known as Lou Gehrig's disease, that affects nerve cells in the brain and spinal cord). Under current law, individuals must wait five months after becoming disabled before their disability insurance benefit payments may begin.

Provide Accurate Information Directly Act or PAID Act This bill requires the Centers for Medicare & Medicaid Services to identify, in response to an inquiry from certain non-group health plans (e.g., liability insurers), whether an individual was enrolled in Medicare, Medicare Advantage, or the Medicare prescription drug benefit during the preceding three-year period.

Big Cat Public Safety Act This bill revises requirements governing the trade of big cats (i.e., species of lion, tiger, leopard, cheetah, jaguar, or cougar or any hybrid of such species). Specifically, it revises restrictions on the possession and exhibition of big cats, including to restrict direct contact between the public and big cats.

Developing Responsible Individuals for a Vibrant Economy Act or the DRIVE-Safe Act This bill directs the Department of Transportation to promulgate regulations to implement an apprenticeship program for licensed commercial motor vehicle drivers under the age of 21.

Vietnam Human Rights Act This bill amends various reporting requirements related to foreign assistance and human rights. It also authorizes various aid programs related to Vietnam. In its annual reports to Congress on human rights in foreign countries and U.S. security assistance programs, the Department of State shall include assessments of online freedom of expression in each country, including efforts by governments to censor information, punish individuals for their speech, and monitor communications. The State Department's annual report on human rights in Vietnam shall include information regarding the country's progress in various areas, including with respect to ending torture and violence against religious groups and returning property improperly confiscated by the Vietnamese government. The bill authorizes the State Department to establish programs to (1) monitor and halt sex trafficking of women from Vietnam and other Asian countries, and (2) address Vietnam's growing sex-ratio disparity. It authorizes the President to provide assistance for ethnic minority groups in Vietnam affected by human rights violations and directs the State Department to report on such efforts.

Responsible Additions and Increases to Sustain Employee Health Benefits Act of 201 9 This bill modifies the tax exclusion for distributions from health flexible spending arrangements provided to employees under a cafeteria plan to (1) increase the annual limit on employee salary reduction contributions to $5,000, with an additional $500 for each additional employee dependent above two dependents that has not been taken into account by another person for the year; (2) revise the adjustment for inflation after 2020; and (3) allow a carryforward into the next year for unused amounts in such plans.

Honest Elections and Campaign, No Gain Act This bill requires each authorized candidate committee or leadership political action committee (PAC) to disburse all unused funds within a specified time period beginning after an election, unless the candidate files to run for office again before the disbursement period begins. A committee or PAC disbursing unspent funds shall first pay any obligations incurred and, if funds are left over, it may disburse the funds in specified ways, such as by transferring the funds to a national or state committee of a political party.

Let It Go Act This bill requires individuals to use contributions or donations not later than six years following the most recent federal election in which the individual was a candidate and before the individual becomes a registered lobbyist. The bill requires remaining contributions or donations to be disposed of within 30 days, first by paying debts or obligations owed in connection with the campaign for that office. Additional remaining funds must be disposed of by (1) returning those contributions or donations to the individuals, entities, or both, who made them; (2) making contributions to a charitable organization; or (3) making transfers to a national, state, or local committee of a political party.

United States Coast Guard Commemorative Coin Act of 2019 This bill directs the Department of the Treasury to mint and issue in commemoration of the U.S. Coast Guard (1) $5 gold coins, (2) $1 silver coins, and (3) half-dollar clad coins. The design of such coins shall be emblematic of the traditions, history, and heritage of the Coast Guard and its role in securing the United States since 1790. The issuance of such coins is restricted to the one-year period beginning on January 1, 2020. The bill prescribes the sale price of the coins and coin surcharges. Surcharges shall be paid by Treasury to the National Coast Guard Museum Association to help finance the design, construction, operations, and maintenance of the museum.

Restore Our Parks and Public Lands Act This bill establishes the National Park Service and Public Lands Legacy Restoration Fund into which, through FY2024, there shall be deposited an amount equal to 50% of all energy development revenues due to the federal government from oil, gas, coal, or alternative or renewable energy development on federal lands and waters. Deposited amounts must not exceed $1.3 billion for any fiscal year. From such amounts 80% shall be allocated to the National Park Service for high-priority deferred maintenance projects, ensuring parity between transportation and nontransportation projects; 10% shall be for the national wildlife refuge system maintenance backlog; 5% shall be for the public access and recreation backlog on public lands; and 5% shall be for school construction and deferred maintenance backlogs. The Department of the Interior must submit to Congress, with the President's annual budget submission, a list of projects receiving allocations from the fund and a description of each such project. Interior, and other specified agencies, may accept cash or in-kind donations that advance efforts to reduce maintenance backlogs and encourage public-private partnerships.

Cardiac Arrest Survival Act of 2019 This bill expands immunity from civil liability related to emergency use of automated external defibrillator devices (AEDs). Among other things, the bill specifies that immunity applies regardless of whether the person who used the AED complied with signage, received training, or was assisted or supervised by another person, such as a licensed physician.

Advancing Care for Exceptional Kids Act of 2019 or the ACE Kids Act of 2019 This bill establishes a state Medicaid option to provide for medical assistance with respect to coordinated care provided through a health home (i.e., a designated provider or team of health-care professionals) for children with medically complex conditions. States must determine payment methodologies in accordance with specified requirements; payments also temporarily qualify for an enhanced federal matching rate.

Living Donor Protection Act of 2019 This bill prohibits discrimination based on an individual's status as a living organ donor in the offering, issuance, cancellation, coverage, price, or any other condition of a life-insurance policy, disability-insurance policy, or long-term-care insurance policy. The bill also specifically includes recovery from organ-donation surgery as a serious health condition that entitles covered private-sector and federal civil-service employees to medical leave. The Department of Health and Human Services must update public-service announcements, websites, and other media regarding live organ donation to educate the public on the benefits of live organ donation and on access to insurance for living organ donors.

Craft Beverage Modernization and Tax Reform Act of 2019 This bill modifies the tax treatment of certain alcoholic beverages to exclude the aging period from the production period for beer, wine, or distilled spirits for purposes of determining whether a taxpayer can expense, rather than capitalize, interest costs paid or incurred during the production period; reduce excise tax rates on beer and distilled spirits; permit the transfer of beer between bonded facilities without payment of tax; increase the amount of the small wine producer tax credit and expand the categories of producers covered by such credit; allow an adjustment to the producer credit for hard cider; and modify the alcohol content limitations that apply to certain wines for tax purposes. The Department of the Treasury must amend applicable regulations with respect to the use of wholesome products suitable for human consumption in the production of fermented beverages. The bill also increases funding for the Alcohol and Tobacco Tax and Trade Bureau.

This resolution expresses support for the designation of DIPG Awareness Day. (DIPG is diffuse intrinsic pontine glioma, a terminal childhood brain cancer.) It also encourages public and private sources of research funding to elevate their consideration of the mortality rate of a type of cancer as well as the life years lost as factors considered during the grant application process.

Fairness for High-Skilled Immigrants Act of 2019 This bill increases the per-country cap on family-based immigrant visas from 7% of the total number of such visas available that year to 15%, and eliminates the 7% cap for employment-based immigrant visas. It also removes an offset that reduced the number of visas for individuals from China. The bill also establishes transition rules for employment-based visas from FY2020-FY2022, by reserving a percentage of EB-2 (workers with advanced degrees or exceptional ability), EB-3 (skilled and other workers), and EB-5 (investors) visas for individuals not from the two countries with the largest number of recipients of such visas. Of the unreserved visas, not more than 85% shall be allotted to immigrants from any single country.

Employer Participation in Repayment Act of 2019 This bill expands the tax exclusion for employer-provided educational assistance to include payments of qualified education loans by an employer to either an employee or a lender.

Full Military Honors Act of 2019 This bill requires full military honors to be provided for the funerals of certain veterans. Specifically, a veteran shall receive full military honors if the veteran (1) is first interred or inurned in Arlington National Cemetery, (2) was awarded the medal of honor or the prisoner-of-war medal, and (3) is not entitled to full military honors because of such veteran's grade.

Open Internet Act of 2019 This bill prohibits a provider of broadband internet access service from taking certain actions to restrict content and requires the Federal Communications Commission to enforce such obligations. Specifically, the bill bars a broadband internet provider from (1) blocking lawful content, applications, or services; (2) prohibiting the use of non-harmful devices; and (3) discriminating in transmitting lawful internet traffic. Additionally, a provider is required to disclose accurate and relevant information regarding price, performance, and network management practices sufficient for consumers to make informed choices and for providers of content, applications, services, and devices to develop and market new internet offerings.

Born-Alive Abortion Survivors Protection Act This bill establishes requirements for the degree of care a health care practitioner must exercise in the event a child is born alive following an abortion or attempted abortion. A health care practitioner who is present must (1) exercise the same degree of care as reasonably provided to another child born alive at the same gestational age, and (2) immediately admit the child to a hospital. The bill also requires a health care practitioner or other employee to immediately report any failure to comply with this requirement to law enforcement. A person who violates the requirements is subject to criminal penalties—a fine, up to five years in prison, or both. Additionally, an individual who intentionally kills or attempts to kill a child born alive is subject to prosecution for murder. The bill bars the criminal prosecution of a mother of a child born alive for conspiracy to violate these provisions, for being an accessory after the fact, or for concealment of felony. A woman who undergoes an abortion or attempted abortion may file a civil action for damages against an individual who violates this bill.

No Oil Producing and Exporting Cartels Act of 2019 or NOPEC This bill prohibits a foreign state from engaging in collective action impacting the market, supply, price, or distribution of oil, natural gas, or other petroleum product in the U.S. Specifically, a foreign state is prohibited from collective action that limits the production or distribution of such product, collective action to set or maintain the price of such product, or any other action that restrains trade of such product. Specified defenses such as sovereign immunity (i.e., a foreign state's immunity from the jurisdiction of U.S. courts) and the act of state doctrine (i.e., the prohibition of a court invalidating an official act of a foreign sovereign performed within its own territory) shall not apply to a foreign state's violation of this bill.

Never Again Education Act This bill creates the Holocaust Education Assistance Program Fund for the Department of Education (ED) to (1) award grants to eligible entities to carry out Holocaust education programs, and (2) conduct periodic regional workshops to provide teachers with technical assistance on how to incorporate Holocaust education within state and local education standards. The fund may accept donations and in-kind contributions. ED shall (1) create and maintain a Holocaust education program website containing resources for middle grades and high schools; and (2) establish the Holocaust Education Advisory Board to advise on developing application criteria for the fund's grants, to advise on content for the Holocaust education program website, and to lead efforts to solicit donations for the fund.

Veteran Treatment Court Coordination Act of 2019 This bill directs the Department of Justice to establish a Veterans Treatment Court Program to provide grants and technical assistance for state, local, and tribal governments to develop and maintain veterans treatment courts.

Covering Life-saving Investigations Needed in Cancer and Other Life-threatening Conditions through Timely use of Resources for Easy and Affordable Treatment from Medicaid for Enrollees in Need Today Act or the CLINICAL TREATMENT Act This bill requires state Medicaid programs to cover routine patient costs for items and services that are provided in connection with a qualifying clinical trial regarding cancer or other life-threatening conditions. The bill defines "routine patient costs" to include items and services that would otherwise be covered under Medicaid absent the patient's participation in the clinical trial; the term includes items and services relating to trial complications, but excludes those items and services that are the subject of the trial or that are provided solely in relation to data analysis. Additionally, a "qualifying clinical trial" means, among other things, a clinical trial that is approved or funded by specified entities (e.g., the National Institutes of Health) or is an authorized new drug trial.

Merrill's Marauders Congressional Gold Medal Act This bill directs Congress to award a Congressional Gold Medal to the 5307th Composite Unit (Provisional), commonly known as Merrill's Marauders, in recognition of their bravery and outstanding service in the jungles of Burma (Myanmar) during World War II. Following its award, the gold medal shall be given to the Smithsonian Institution where it shall be displayed and made available for research.

Threat Assessment, Prevention, and Safety Act of 2019 This bill directs the Department of Homeland Security (DHS) to establish a Joint Behavioral Threat Assessment and Management Task Force, which shall provide recommendations to Congress and DHS on the development and implementation of a national strategy for preventing targeted violence through behavioral threat assessment and management. The bill defines behavioral threat assessment and management as the systematic and evidence-based process of (1) identifying individuals whose behavior indicates a capacity for committing acts of violence, (2) investigating and gathering information from multiple sources to assess whether such individuals pose a threat, and (3) the subsequent management of such a threat. DHS shall (1) develop and implement the national strategy and provide information and training services related to it, and (2) award grants to establish community based units for implementing the national strategy.

Protecting Life and Taxpayers Act of 2019 This bill requires federally funded entities to certify that they will not perform, and will not provide funds to any other entity that performs, an abortion, except in cases of rape or incest or where a physical condition endangers the woman's life unless an abortion is performed.

Middle Class Health Benefits Tax Repeal Act of 201 9 This bill repeals the excise tax on employer-sponsored health care coverage for which there is an excess benefit (high-cost plans). The repeal applies to taxable years beginning after December 31, 2019.

Pain-Capable Unborn Child Protection Act This bill establishes a new criminal offense for performing or attempting to perform an abortion if the probable post-fertilization age of the fetus is 20 weeks or more. A violator is subject to criminal penalties—a fine, a prison term of up to five years, or both. The bill provides exceptions for an abortion (1) that is necessary to save the life of the pregnant woman, or (2) when the pregnancy is the result of rape or incest. A physician who performs or attempts to perform an abortion under an exception must comply with specified requirements. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

Protecting Our Communities and Rights Act of 2019 This bill authorizes grants for states to implement extreme risk protection order laws (also known as red flag laws). An extreme risk protection order law permits a state court to issue an order that prohibits an individual from purchasing, possessing, or receiving a firearm. Additionally, persons subject to extreme risk protection orders constitute a new category of prohibited persons (i.e., persons barred from receiving, possessing, shipping, or transporting a firearm or ammunition).

Sustainable Shark Fisheries and Trade Act of 2019 This bill revises provisions regarding shark conservation and fishery management. The bill requires any country that seeks to import shark products into the United States to obtain a certification from the Department of Commerce that the country has a regulatory program in effect to provide for the conservation and management of sharks, including measures to prohibit the removal of any of the fins of a shark (including the tail). Commerce must revise its regulations to include rays and skates as species that are subject to the Seafood Traceability Program. (The Seafood Traceability Program has data reporting and recordkeeping requirements at the time of entry for imported fish or fish products entered into U.S. commerce.)

Preventing Animal Cruelty and Torture Act or the PACT Act This bill revises and expands criminal provisions with respect to animal crushing. It retains existing criminal offenses that prohibit knowingly creating or distributing an animal crush video using interstate commerce. The bill also adds a new provision to criminalize an intentional act of animal crushing. A violator is subject to criminal penalties—a fine, a prison term of up to seven years, or both. It provides additional exceptions for conduct, or a video of conduct, including conduct that is (1) medical or scientific research, (2) necessary to protect the life or property of a person, (3) performed as part of euthanizing an animal, or (4) unintentional.

Shark Fin Sales Elimination Act of 2019 This bill makes it illegal to possess, buy, or sell shark fins or any product containing shark fins, except for certain dogfish fins. A person may possess a shark fin that was lawfully taken consistent with a license or permit under certain circumstances. Penalties are imposed for violations under the Magnuson-Stevens Fishery Conservation and Management Act.

Title VIII Nursing Workforce Reauthorization Act of 2019 This bill expands and reauthorizes through FY2024 specified nursing workforce development programs. Specifically, the bill reauthorizes (1) loan repayment and scholarships for nurses; (2) loans for nursing faculty development; (3) advanced education nursing grants; (4) grants for increasing nursing workforce diversity; and (5) nurse education, practice, quality, and retention grants. Eligibility for nurse education, practice, quality, and retention grants is expanded to include nurse-managed health clinics that provide primary care to underserved communities. Further, grants for nursing career ladder programs are expanded to (1) promote career advancement for individuals to become registered nurses or advanced education nurses and (2) support internships and residency programs that encourage mentoring and the development of specialties. In addition, eligibility for advanced education nursing grants is expanded to include education of clinical nurse leaders in combined registered nurse graduate degree programs. Clinical nurse leaders are advanced generalist clinicians who apply research and coordinate care to improve outcomes for patients. Eligibility is also extended to clinical nurse specialist programs that provide registered nurses with full-time clinical nurse specialist education that qualifies participating nurses to provide a full range of care. The bill also revises specified grant reporting and program evaluation requirements.

U.S. Senator Joseph D. Tydings Memorial Prevent All Soring Tactics Act of 2019 or the PAST Act This bill addresses the practice of soring horses. The soring of horses includes various actions taken on horses' limbs to produce higher gaits that may cause pain, distress, inflammation, or lameness. Specifically, the bill expands soring regulation and enforcement at horse shows, exhibitions, sales, and auctions, including by establishing a new system for inspecting horses for soring. In addition, the bill increases penalties for violations.
