Israel Anti-Boycott Act

Israel Anti-Boycott Act This bill declares that Congress: (1) opposes the United Nations Human Rights Council resolution of March 24, 2016, which urges countries to pressure companies to divest from, or break contracts with, Israel; and (2) encourages full implementation of the United States-Israel Strategic Partnership Act of 2014 through enhanced, governmentwide, coordinated U.S.-Israel scientific and technological cooperation in civilian areas. The bill amends the Export Administration Act of 1979 to declare that it shall be U.S. policy to oppose: requests by foreign countries to impose restrictive practices or boycotts against other countries friendly to the United States or against U.S. persons; and restrictive trade practices or boycotts fostered or imposed by an international governmental organization, or requests to impose such practices or boycotts, against Israel. The bill prohibits any U.S. person engaged interstate or foreign commerce from supporting: any request by a foreign country to impose any boycott against a country that is friendly to the United States and that is not itself the object of any form of boycott pursuant to United States law or regulation, or any boycott fostered or imposed by any international governmental organization against Israel or any request by any international governmental organization to impose such a boycott. The bill amends the Export-Import Bank Act of 1945 to include as a reason for the Export-Import Bank to deny credit applications for the export of goods and services between the United States and foreign countries, opposition to policies and actions that are politically motivated and are intended to penalize or otherwise limit commercial relations specifically with citizens or residents of Israel, entities organized under the laws of Israel, or the government of Israel.

Small Business Development Centers Improvement Act of 2018

Small Business Development Centers Improvement Act of 2017 This bill amends the Small Business Act with respect to the authority of the Small Business Administration (SBA) to use certain SBA programs, including the small business development center (SBDC) program, to provide grants, financial assistance, loans, export assistance, and subcontracting opportunities on federal contracts to specified small businesses, organizations, state governments, universities, companies, and other entities that assist smaller enterprises. The SBA shall use such programs only to deliver entrepreneurial development services, entrepreneurial education, support for the development and maintenance of clusters, or business training. Such program requirements shall not apply to services provided to assist small businesses owned by an Indian tribe. The SBA shall not prohibit SBDC grant recipients from marketing and advertising their services to individuals and small business concerns. The SBA shall establish a Data Collection Working Group to determine the best way to capture data collection and create or revise existing systems dedicated to data collection. The bill: (1) increases the portion of certain available funds the SBA may use to pay the expenses of the National Small Business Development Center Advisory Board, the information sharing system, and the SBDC association for conducting an SBCD accreditation program; and (2) removes a limitation on the amount the SBA may use to pay the examination expenses of the SBDC accreditation program. The SBA may not award grants (including contracts and cooperative agreements) under the SBDC program to entities other than those that received them before September 30, 2015, and seek to renew them after that date, with an exception for not-for-profit institutions of higher education.

Iran Ballistic Missiles and International Sanctions Enforcement Act This bill states that it is U.S. policy to prevent Iran from undertaking any activity related to nuclear-capable ballistic missiles. The President shall report to Congress regarding the foreign and domestic supply chain in Iran that supports Iran's ballistic missile program. The report shall identify individuals and companies involved in such activities. The President shall submit to Congress a determination of whether any Iranian ballistic missile test violates United Nations Security Council Resolution 2231. Such resolution endorses the Joint Comprehensive Plan of Action and sets out a mechanism to monitor Iranian compliance. The President shall impose sanctions against: (1) Iranian government agencies involved in ballistic missile development; (2) foreign entities that supply material for, or otherwise facilitate or finance, such efforts; (3) foreign persons or foreign government agencies that import, export, or re-export prohibited arms or related material to or from Iran; and (4) foreign persons or entities that transfer goods or technologies contributing to Iran's ability to acquire or develop ballistic missiles, including launch technology, and destabilizing numbers and types of advanced conventional weapons. The President shall investigate potential violations of ballistic missile and conventional weapons sanctions against Iran. The President shall report to Congress regarding credible information about Iran's violations of arms restrictions and attempts to pursue sanctionable activities.

Preventing Animal Cruelty and Torture Act or the PACT Act This bill amends the federal criminal code to revise and expand provisions with respect to animal crushing. It retains existing criminal offenses that prohibit knowingly creating or distributing an animal crush video using interstate commerce. The bill also adds a new provision to criminalize an intentional act of animal crushing. A violator is subject to criminal penalties—a fine, a prison term of up to seven years, or both. It provides additional exceptions for conduct, or a video of conduct, including conduct that is: (1) medical or scientific research, (2) necessary to protect the life or property of a person, (3) performed as part of euthanizing an animal, or (4) unintentional.

Cold War Service Medal Act This bill authorizes the military department concerned to issue the Cold War Service Medal to members of the Armed Forces who: (1) served on active duty for at least 24 consecutive months during the Cold War (September 2, 1945, through December 26, 1991), (2) were deployed outside the continental United States for at least 30 days during such period, (3) were members of a reserve component of the Armed Forces and were called or ordered to active duty to participate in exercises or operations directly related to the Cold War, or (4) performed other Cold War service as DOD may prescribe. Any such person who is already discharged or released from the Armed Forces shall be eligible only if the discharge or release was under honorable conditions.

Freedom from Government Competition Act of 2017 This bill requires each executive or military department or independent establishment to obtain all goods and services necessary for or beneficial to the accomplishment of its authorized functions by procurement from private sources, except if: (1) such goods or services are required by law to be produced or performed by such agency; or (2) the agency determines and certifies that federal production, manufacture, or provision of a good or service is necessary for the national defense or homeland security, that a good or service is so critical to the agency's mission or so inherently governmental in nature that it is in the public interest to require production or performance by government employees, or that there is no private source capable of providing the good or service. This bill requires such private sector provision of goods and services to be performed through: (1) the divestiture of federal involvement, (2) the award of a contract using competitive procedures, or (3) conducting a public-private competitive sourcing analysis in accordance with Office of Management and Budget (OMB) procedures and determining that using the private sector is in the best interest of the United States and provides the best value to the taxpayer. The bill authorizes an agency to utilize federal employees to provide goods or services previously provided by a private sector entity upon completion of a public-private competitive sourcing analysis and after determining that provision by federal employees provides the best value. The OMB must carry out a study to evaluate the activities carried out in each agency.

Consumer and Fuel Retailer Choice Act This bill amends the Clean Air Act to address the limitations on Reid vapor pressure (a measure of gasoline's volatility) that are placed on gasoline during the summer ozone season. The bill applies the Reid vapor pressure requirements that are applicable to gasoline blended with 10% ethanol (E10) to gasoline blended with more than 10% ethanol. Thus, the waiver given to E10 gasoline, which allows an increase in the Reid Vapor Pressure volatility, is extended to gasoline blended with more than 10% ethanol.

Discouraging Frivolous Lawsuits Act This bill amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to revise requirements concerning citizen suits. Litigation costs (including reasonable attorney and expert witness fees) must be awarded to the prevailing party, thus the bill removes a court's discretion to award the fees. A prevailing party is defined as the party that prevails on more than half of the claims at issue. The bill repeals the authority of the Environmental Protection Agency (EPA) to deny or restrict the use of any area as a disposal site for dredged or fill material when the discharge of those materials would have an unacceptable adverse effect on municipal water supplies, shellfish beds and fishery areas, wildlife, or recreational areas. Current law requires compensatory mitigation to replace the loss of aquatic resource functions in a watershed when a permit to discharge dredged or fill materials into navigable waters has unavoidable impacts on aquatic resources. This bill prohibits government entities from carrying out compensatory mitigation in excess of existing regulatory requirements.

FDA Deeming Authority Clarification Act of 2017 This bill amends the Federal Food, Drug, and Cosmetic Act (FFDCA) to: (1) revise premarket review and reporting requirements for products newly deemed by the Food and Drug Administration (FDA) to be tobacco products; and (2) grant the FDA the authority to regulate vapor products, which include products that produce vapor with nicotine (e.g., e-cigarettes) and nicotine intended to be used with such a product (e.g., nicotine cartridges). A product is not subject to premarket review by the FDA if it is marketed before it is deemed a tobacco product. The bill delays deadlines for reports to the FDA on products similar to a marketed product that are introduced to market less than 21 months after that type of product is deemed a tobacco product. The bill grants the FDA regulatory authority over vapor products that is in addition to the FDA's existing authority to regulate vapor products as tobacco products. Provisions of the FFDCA applicable to tobacco product components also apply to vapor product batteries. The FDA must establish standards for vapor product batteries. Vapor products first marketed not later than 24 months after enactment of this bill are not subject to premarket review or reporting requirements based on changes to the product's battery to conform to standards. Vapor products may not be advertised in publications, except publications with adult readership. Vapor products may be sold only face-to-face, through vending machines in facilities where only adults are permitted, or by mail order. Vapor products must be labeled with their nicotine content and specified phrases. Retailers of vapor products must register with the FDA.

Historic Tax Credit Improvement Act of 201 7 This bill amends the Internal Revenue Code, with respect to the tax credit for the rehabilitation of buildings and historic structures, to: (1) allow an increased 30% credit, up to $750,000, for projects with rehabilitation expenditures not exceeding $3.75 million, for which no credit was allowed in either of the two prior taxable years (smaller projects); (2) allow the transfer of tax credit amounts for smaller projects; (3) treat a building as substantially rehabilitated if rehabilitation expenditures exceed the greater of 50% of the adjusted basis of the building or $5,000 (currently, the greater of the adjusted basis of the building or $5,000); (4) reduce the required basis adjustment from 100% of the credit to 50% of the amount of the credit; and (5) limit the application of disqualified lease rules to tax-exempt use property.

Technologies for Energy Security Act of 2017 This bill amends the Internal Revenue Code to extend and modify the tax credits for residential energy efficient property and investments in energy property. The bill modifies the tax credit for residential energy efficient property to extend through 2021 the credits for expenditures for fuel cell property, small wind energy property, and geothermal heat pump property. For each extended credit, the bill phases out the current credit rate of 30% of expenditures by reducing it to 26% or 22%, depending on the date that the property is placed in service. The bill extends the tax credit for investments in energy property for the following property with construction that begins before January 1, 2022: fiber-optic solar energy property, fuel cell property, microturbine property, combined heat and power system property, small wind energy property, and thermal energy property. The bill phases out the current credit rate of 30% for investments in fuel cell property, small wind energy property, and fiber-optic solar energy property by reducing it to 26% or 22%, depending on the date that the property is placed in service.

Calls on the government of Ethiopia to: lift the state of emergency; end the use of excessive force by security forces; investigate the killings and excessive use of force that took place as a result of protests in the Oromia and Amhara regions; release dissidents, activists, and journalists who have been imprisoned for exercising constitutional rights; respect the right to peaceful assembly and guarantee freedom of the press; engage in open consultations with citizens regarding its development strategy; allow a United Nations rapporteur to conduct an independent examination of the state of human rights in Ethiopia; address the grievances brought forward by representatives of registered opposition parties; hold accountable those responsible for killing, torturing, and detaining innocent civilians who exercised their constitutional rights; and investigate and report on the circumstances surrounding the September 3, 2016, shootings and fire at Qilinto Prison, the deaths of persons in attendance at the annual Irreecha festivities at Lake Hora near Bishoftu on October 2, 2016, and the ongoing killings of civilians over several years in the Somali Regional State by police. Calls on such government to repeal proclamations that: can be used to harass or prohibit funding for organizations that investigate human rights violations, engage in peaceful political dissent, or advocate for greater political freedoms; prohibit those displaced from their land from seeking judicial redress; permit the detention of peaceful protesters and political opponents who legally exercise their rights to freedom of expression and association; and limit peaceful nonprofit operations in Ethiopia. Calls on: (1) the Department of State to review security assistance and improve oversight of U.S. assistance to Ethiopia; (2) the U.S. Agency for International Development to lead efforts to develop a strategy to support improved democracy and governance in Ethiopia; and (3) the State Department, in cooperation with the Department of the Treasury, to apply appropriate sanctions on foreign persons or entities responsible for extrajudicial killings, torture, or other gross violations of internationally recognized human rights committed against any nationals in Ethiopia;. Synthetics Trafficking and Overdose Prevention Act of 2017 or the STOP Act of 2017 This bill amends the Tariff Act of 1930 to make the Postmaster General the consignee (i.e., the entity financially responsible for the receipt of a shipment) for merchandise, excluding documents, imported through the mail into the United States. The Postmaster General must designate licensed customs brokers to file required documents or information for such shipments. The bill amends the Consolidated Omnibus Budget Reconciliation Act of 1985 to impose a customs user fee on postal shipments or any other item valued at $2,000 or less arriving at an international mail facility. The bill amends the Trade Act of 2002 to direct the Department of the Treasury to require the Postmaster General to provide for the advanced electronic transmission to the U.S. Customs and Border Protection of certain information for all postal shipments made by the U.S. Postal Service (USPS), including postal shipments it receives from foreign postal operators. The Postmaster General: shall be liable for civil penalties for postal shipment violations committed by a foreign postal operator or the USPS; may be directly or indirectly responsible for discrepancies resulting from omissions made or false information provided by a foreign postal operator or the USPS; and shall ensure that all costs and penalties associated with complying with this bill are recouped from foreign shippers, foreign postal operators, or U.S. ultimate consignees.

Concrete Masonry Products Research, Education, and Promotion Act of 2017 This bill directs the Department of Commerce to issue orders applicable to U.S. manufacturers of concrete masonry products. Any such order must provide for the establishment of a Concrete Masonry Products Board to carry out a program of generic promotion, research, and education regarding concrete masonry products. An order must also provide that assessments be paid by concrete masonry product manufacturers for concrete masonry products manufactured and marketed in the United States. At least 50% of the assessments paid by a manufacturer must be used to support research, education, and generic promotion programs and projects in support of the geographic region of the manufacturer. During the 60-day period preceding the proposed effective date of an order, Commerce shall conduct a referendum for order approval among manufacturers. The bill allows petition and review of an order, and order enforcement through U.S. district courts. The bill requires a study and a report by: (1) the Government Accountability Office on how the board spends assessments collected, the impact of board activities, and other matters relating to the demand for concrete masonry products; and (2) Commerce on the appropriateness and effectiveness of applying the commodity check-off program model to a nonagricultural industry.

"Covered aircraft" is defined as a commercial aircraft: (1) equipped with more than 75 passenger seats, and (2) with a maximum gross takeoff weight of more than 75,000 pounds.

Right to Try Act of 2017 This bill requires the federal government to allow unrestricted manufacturing, distribution, prescribing, and dispensing of experimental drugs, biological products, and medical devices that are: (1) intended to treat a patient who has been diagnosed with a terminal illness, and (2) authorized by state law. The federal government must allow unrestricted possession and use of such treatments by patients certified by a physician as having exhausted all other treatment options. A manufacturer, distributor, prescriber, dispenser, possessor, or user of such a treatment has no liability regarding the treatment. The outcome of manufacture, distribution, prescribing, dispensing, possession, or use of such a treatment may not be used by a federal agency to adversely impact review or approval of the treatment. Allocation for Music Producers Act or the AMP Act This bill amends federal copyright law to require a collective designated by the Copyright Royalty Judges to implement a policy providing for the acceptance of instructions (referred to as a "letter of direction") from a person who owns the exclusive right to publicly perform a sound recording by means of a digital audio transmission, or from a recording artist of a such a sound recording, to distribute a portion of royalty payments to a producer, mixer, or sound engineer who was part of the creative process behind the sound recording. The collective must adopt special procedures for a producer, mixer, or sound engineer to receive a portion of royalties for recordings fixed before November 1, 1995, by certifying that a reasonable effort has been made to obtain a letter of direction from an artist who owns the right to receipts payable with respect to the sound recording.

Agency Accountability Act of 2017 This bill requires any agency that receives a fee, fine, penalty, or proceeds from a settlement to deposit the amount in the general fund of the Treasury. The funds may not be used unless the funding is provided in advance in an appropriations bill. Any amounts deposited during the fiscal year in which this bill is enacted may not be obligated during the fiscal year and must be used for deficit reduction. The bill includes an exception for funds to be paid to an individual entitled to receive the funds as a whistle-blower, including funds received as a percentage of amounts received by the government pursuant to a judgment or settlement agreement. The bill amends the Congressional Budget Act of 1974 to require offsetting receipts and collections to be treated as revenue. (Offsetting receipts and collections are funds collected by agencies from other government accounts or from the public in businesslike or market-oriented transactions. Under current law, the collections are treated as negative budget authority and outlays rather than revenue and may be used to offset spending for budget enforcement purposes.) The requirements of the bill do not apply to the U.S. Postal Service or the U.S. Patent and Trademark Office (USPTO). The Under Secretary of Commerce for Intellectual Property and the Director of the USPTO must submit annually to Congress a report describing any fee, fine, penalty, or proceeds from a settlement collected by the USPTO during the previous year.

Military Surviving Spouses Equity Act This bill: (1) repeals certain provisions that require the offset of amounts paid in dependency and indemnity compensation from Survivor Benefit Plan (SBP) annuities for the surviving spouses of former military personnel who are entitled to military retired pay or who would be entitled to retired pay except for being under 60 years of age, (2) prohibits requiring repayment of certain amounts previously paid to SBP recipients in the form of a retired pay refund, and (3) requires (current law authorizes) the Secretary of the military department concerned to pay an annuity to a member's dependent children when there is no eligible surviving spouse. The Secretary concerned shall restore annuity eligibility to a surviving spouse who earlier agreed to transfer such eligibility to the surviving child or children of a member.

Childhood Cancer STAR Act

Childhood Cancer Survivorship, Treatment, Access, and Research Act of 2017 or the Childhood Cancer STAR Act This bill amends the Public Health Service Act to authorize the National Institutes of Health (NIH) to provide support to collect the medical specimens and information of children, adolescents, and young adults with selected cancers that have the least effective treatments in order to achieve a better understanding of these cancers and the effects of treatment. The national childhood cancer registry is reauthorized through FY2022 and revised to authorize the Centers for Disease Control and Prevention to award grants to state cancer registries to improve tracking of childhood cancers. The Department of Health and Human Services (HHS) may: (1) support pilot programs to develop or study models for monitoring and caring for childhood cancer survivors throughout their lives, (2) establish a task force to develop and test standards for high-quality childhood cancer survivorship care, and (3) carry out a demonstration project to improve care coordination as childhood cancer survivors transition to adult care. HHS must convene a Workforce Development Collaborative on Medical and Psychosocial Care for Pediatric Cancer Survivors. The NIH may support research on: (1) outcomes for, and barriers faced by, pediatric cancer survivors within minority or medically underserved populations; and (2) follow-up care for pediatric cancer survivors, including research on the late effects of cancer treatment and long-term complications. The Government Accountability Office must make recommendations to address barriers to childhood cancer survivors obtaining and paying for adequate medical care.

Common Sense Nutrition Disclosure Act of 2017 This bill amends the Federal Food, Drug, and Cosmetic Act to revise the nutritional information that restaurants and retail food establishments must disclose. The nutrient content disclosure statement on the menu or menu board must include: (1) the number of calories contained in the whole menu item; (2) the number of servings and number of calories per serving; or (3) the number of calories per common unit of the item, such as for a multi-serving item that is typically divided before presentation to the consumer. Nutritional information may be provided solely by a remote-access menu (e.g., an Internet menu) for food establishments where the majority of orders are placed by customers who are off-premises. Establishments with self-serve food may comply with the requirements for restaurants or place signs with nutritional information adjacent to each food item. An establishment's nutrient content disclosures may vary from actual nutrient content if the disclosures comply with current standards for reasonable basis. Establishments with standard menu items that come in different flavors, varieties, or combinations, that are listed as a single menu item may determine and disclose nutritional information using specified methods or methods allowed by the Food and Drug Administration (FDA). Regulations pursuant to this bill or the clause amended by this bill may not take effect earlier than two years after final regulations are promulgated. The FDA may not exempt states from nutrition labeling requirements.

Additionally, the Department of Transportation (DOT) must conduct an annual inspection of any vessel that is exempted from fire-retardant materials standards. DOT may withdraw a certificate of inspection for any vessel that does not comply with requirements under this bill.
