Recreational Marine Employment Act of 2003 - Amends the Longshore and Harbor Workers' Compensation Act with respect to employer liability for death and disability compensation payable to longshore, harbor workers, and other specified marine employees not otherwise covered by State workers compensation laws. Excludes from the definition of employee any individuals employed by or at, or engaged in the construction or maintenance of, a recreational marine facility or structure. Expands the range of individuals whose work is concerned with recreational vessels who do not qualify as employees, including people who principally buy and sell, or test, such vessels. Makes such exclusions contingent on the employer's being in compliance with a State workers' compensation law. (Currently they are contingent on workers' being covered under such a law). Modifies requirements for third part actions against vessels for negligence to apply them only to injuries to maritime workers who do not qualify as seamen under specified Federal law. (Currently they apply to injuries to all persons covered under the Act).

Reforestation Tax Act of 2003 - Amends the Internal Revenue Code to allow a deduction to a taxpayer who has a qualified timber gain in an amount equal to the qualified percentage of such gain. Allows a deduction, for qualified timber property, for reforestation expenditures and terminates current provisions allowing for the amortization of such expenditures.

Columbia Orbiter Memorial Act - Directs the Secretary of the Army to construct in Arlington National Cemetery, Virginia, a memorial marker honoring the seven members of the crew of the Columbia Orbiter who died on February 1, 2003, during the landing of space shuttle mission STS-107. Authorizes the Administrator of the National Aeronautics and Space Administration to: (1) accept gifts and donations for that or another memorial or monument to the crew; and (2) transfer any donations accepted to the Secretary for the Arlington National Cemetery memorial.

Employee Leasing Organization Act of 2003 - Amends the Internal Revenue Code to provide that employee leasing organizations are considered employers for purposes of: (1) income tax withholding; (2) the federal unemployment tax; (3) the federal insurance contributions tax; (4) life and health insurance; and (5) 401(k) contributions, and etc.

Amends the Internal Revenue Code to permit: (1) Federal civilian and military retirees to pay Federal Employees Health Benefits Program and TRICARE supplemental premiums on a pretax basis; and (2) a deduction (available to itemizers and nonitemizers) for TRICARE supplemental premiums and enrollment fees. Sets an implementation deadline of the first open enrollment period beginning not less than 90 days following enactment.

Authorizes and urges the President to award the John Eopolucci United States Navy Armed Guard Service Medal to recognize service of members of the United States Navy Armed Guard during World War I or II as service in a special force or in a military organization of the Navy.

Veterans' Education Affordability Act - Increases for months occurring during FY 2005 the amounts authorized for veterans' basic educational assistance. Repeals provisions which require basic pay reductions for eligibility for such assistance.

Commercial Driver's License Devolution Act of 2003 - Amends Federal transportation law to authorize an individual to operate a commercial motor vehicle solely within the borders of a State (intrastate) if such individual: (1) meets State-prescribed minimum standards for fitness for operating a commercial motor vehicle; and (2) has passed written and driving tests meeting those same standards. Requires States to test the fitness of commercial motor vehicle operators, including with written and driving tests, who operate intrastate.

Amends the Internal Revenue Code to set forth that a plan or other arrangement shall not cease to count as a cafeteria plan solely because qualified benefits under such plan include a health flexible spending arrangement under which, with respect to any plan year, not more than $500 of unused health benefits may be carried forward to the next year of such arrangement or paid to or on behalf of an employee as compensation from employment. Sets forth rules for determining whether or not such benefits shall be included or excluded from income.

Makes all remarried surviving spouses of veterans eligible for burial in a national cemetery. (Currently, such eligibility is permitted only for remarried former spouses whose subsequent marriage was terminated by death or divorce.)

Family Time Flexibility Act - Amends the Fair Labor Standards Act of 1938 to provide for compensatory time for all employees. Allows an employee to receive, in lieu of monetary overtime compensation, compensatory time off at a rate not less than one and one-half hours for each hour of employment for which overtime compensation is required under the Act.

Disabled Veterans Adaptive Benefits Improvement Act of 2003 - Increases from: (1) $48,000 to $50,000 the maximum amount authorized to be provided by the Department of Veterans Affairs to certain disabled veterans for the construction of specially adapted housing; (2) $9,250 to $10,000 the maximum amount authorized for specially adapted features within a home; and (3) $9,000 to $11,000 the maximum amount authorized for automobile and adaptive equipment for such veterans.

American History and Civics Education Act of 2003 - Directs the Chairperson of the National Endowment for the Humanities (NEH) to award competitive grants to nonprofit educational institutions to establish: (1) Presidential Academies for Teaching of American History and Civics to offer workshops for teachers of American history and civics; and (2) Congressional Academies for Students of American History and Civics to offer workshops for outstanding students of American history and civics. Directs the NEA Chairperson to award a grant to an organization for the creation of a national alliance of elementary school and secondary school teachers of American history and civics.

Securing Consumers' Assurance in Moving Act of 2003 - Amends Federal transportation law to provide that Federal regulations covering the transportation of household goods by motor private carriers shall not preempt State regulation of intrastate transportation of household goods by such carriers. Authorizes an individual or a State or local government to enforce a consumer protection law, regulation, or other provision with respect to the interstate transportation of household goods by a motor private carrier. Establishes a working group of State attorneys general, State consumer protection administrators, and Federal and local law enforcement officials to develop practices and procedures to enhance the Federal-State partnership in enforcement efforts with respect to interstate transportation of household goods by motor private carriers. Sets forth both civil and criminal penalties for persons found holding a household goods shipment hostage (failure to deliver to, or unload at, the destination of a shipment of household goods). Requires: (1) publication OCE 100 of the Department of Transportation (DOT), entitled "Your Rights and Responsibilities When You Move" be prominently displayed on the DOT Web site; and (2) motor carriers or brokers that maintain a web site to display certain household goods information. Establishes a system for filing and logging consumer complaints relating to motor carriers providing transportation of household goods. Requires the Secretary to review current Federal regulations regarding insurance coverage provided by a motor carrier providing transportation of household goods and to revise such regulations in order to enhance protection for shippers in the case of loss or damage. Provides civil penalties for a broker for transportation of household goods (or a person that provides transportation of household goods) that: (1) makes an estimate of transportation costs of such goods before entering into a carrier agreement; or (2) provides services for such transportation without being registered.

English Language Unity Act of 2003 - Amends specified Federal law to declare English to be the official language of the United States. Gives representatives of the Federal Government an affirmative obligation to preserve and enhance the role of English as the official language of the Federal Government, including encouraging greater opportunities for individuals to learn the English language. Requires the official functions of the United States (meaning, in this case, the States and the District of Columbia) to be conducted in English. Sets forth exceptions to and rules of construction for such requirements. Requires a uniform English language rule for U.S. naturalization, and all naturalization ceremonies to be conducted in English. Amends specified Federal law to declare, as a general rule of construction, that English language requirements and workplace policies, whether in the public or private sector, shall be presumptively consistent with the Laws of the United States. Requires the Department of Justice to issue for public notice and comment a proposed rule for uniform testing of English language ability of candidates for naturalization, based upon the principles that: (1) all citizens should be able to read and understand generally the English language text of the Declaration of Independence, the Constitution, and the Laws of the United States; and (2) any exceptions to this standard should be limited to extraordinary circumstances, such as asylum.

Senator Paul Wellstone Mental Health Equitable Treatment Act of 2003 - Amends the Employee Retirement Income Security Act of 1974 and the Public Health Service Act to prohibit certain employee group health plans or related insurances providing both medical-surgical and mental health benefits from imposing mental health treatment limitations or financial requirements unless comparable limitations and requirements are imposed upon medical-surgical benefits. States that the foregoing shall not be construed as requiring a group health plan (or related insurances) to: (1) provide any mental health benefits; (2) prevent the medical management of mental health benefits; or (3) require the provision of specific mental health services, except to the extent that failure to provide such services would result in a disparity between the coverage of mental health and medical-surgical benefits. Exempts specified small employers from such requirements. Requires that, in the case of a group health plan that offers a participant or beneficiary two or more benefit package options, the coverage requirements shall be applied separately with respect to each such option. Provides that, in the case of a plan or insurance providing in-network mental health benefits, out-of-network mental health benefits need not be provided at parity to medical-surgical benefits, as long as in-network mental health benefits are provided at parity with medical-surgical benefits and the plan or insurance provides reasonable access to in-network providers and facilities. Requires a General Accounting Office study of such requirements' effects upon health insurance costs, access, and quality and a cost estimation of extending such requirements to the treatment of substance abuse and chemical dependency.

Disabled Veterans' Return-to-Work Act of 2003 - Establishes a new period of five years from the date of enactment of this Act for a program of vocational training by the Department of Veterans Affairs for low-income, pension-receiving veterans under the age of 45. (The previous period ran from February 1, 1985, through December 31, 1995.) Directs the Secretary of Veterans Affairs to provide appropriate program outreach.

Protection of Lawful Commerce in Arms Act - Prohibits any qualified civil liability action from being brought in any State or Federal court and requires pending actions to be dismissed. Defines such an action to: (1) include an action brought against a manufacturer or seller of a firearm, ammunition, or a component of a firearm that has been shipped or transported in interstate or foreign commerce, or against a trade association of such manufacturers or sellers, for damages resulting from the criminal or unlawful misuse of a firearm; and (2) exclude an action brought against persons who transfer a firearm knowing that it will be used to commit a crime of violence or a drug trafficking crime; an action brought against a seller for negligent entrustment or negligence per se; an action in which a manufacturer or seller of a firearm willfully violated a State or Federal statute applicable to the sale or marketing of the firearm and the violation was a proximate cause of the harm for which relief is sought; an action for breach of contract or warranty in connection with the purchase of the firearm; or an action for physical injuries or property damage resulting directly from a defect in design or manufacture of the firearm when used as intended.

Training for Realtime Writers Act of 2003 - Directs the Secretary of Education to make competitive grants to eligible entities to promote training and placement of individuals, including individuals who have completed a court reporting training program, as realtime writers to meet requirements for closed captioning in video programming. Sets forth priorities to be given in the award of such grants. Limits grants to a two-year period and a maximum amount of $1.5 million.

Bankruptcy Abuse Prevention and Consumer Protection Act of 2003 - Amends Federal bankruptcy law governing: (1) conversion of bankruptcy petitions; (2) abusive creditor practices; (3) domestic support obligations; (4) consumer protections, including protection of personally identifiable information; (5) measures to discourage bankruptcy abuse, including reduction of the homestead exemption for fraud; (6) guidelines for general and small business bankruptcies, including appointment of a committee of retired employees; (7) bankruptcy data dissemination and bankruptcy tax provisions; (8) ancillary and other cross-border cases to incorporate the Model Law on Cross-Border Insolvency; and (9) financial contracts and transfers entered into with an insolvent insured depository institution before its conservatorship or receivership. Reenacts Chapter 12, Adjustment of Debts of a Family Farmer with Regular Annual Income. Brings family fishermen within the purview of Federal bankruptcy protection. Prescribes guidelines for insolvent health care businesses and related patients' rights. Bankruptcy Judgeship Act of 2003 - Amends the Federal Judicial Code to mandate appointments for additional temporary bankruptcy judgeships in designated States. Prescribes additional consumer credit disclosures, including open end credit plans and introductory rates.

Jobs and Growth Tax Act of 2003 - Amends the Internal Revenue Code to accelerate the following previously enacted tax reductions: (1) the 10-percent individual income tax rate bracket expansion: (2) the reduction in individual income tax rates; (3) the 15-percent individual income tax rate bracket expansion for married taxpayers filing joint returns; (4) the increase in the standard deduction for married taxpayers filing joint returns; and (5) the increase in the child tax credit. Triples the small business expensing limit. Excludes from gross income the excludable portion of dividends. Sets forth definitions and rules concerning such exclusion.

Hometown Heroes Survivors Benefits Act - Amends the Omnibus Crime Control and Safe Streets Act of 1968 to provide that a public safety officer who dies as the direct and proximate result of a heart attack or stroke suffered while on duty or within 24 hours after participating in a training exercise or responding to an emergency situation shall be presumed to have died as the direct and proximate result of a personal injury sustained in the line of duty, for purposes of survivor benefits.

Bond Financing Renewal Act of 2003 - Amends the Internal Revenue Code regarding qualified small issue bonds to: (1) increase the cap and capital expenditure amounts from $10 million to $20 million, with an inflation adjustment beginning in 2004; and (2) expand the definition of "manufacturing facility" to include certain biotech and software production.

Local Railroad Rehabilitation and Investment Act of 2003- Amends the Internal Revenue Code to establish a railroad track maintenance credit for qualified railroad track maintenance expenditures with respect to which the expenditures were paid or incurred by the taxpayer for the taxable year for Class II or Class III railroads.

Renewing the Dream Tax Credit Act - Amends the Internal Revenue Code to permit a community homeownership tax credit based upon an applicable percentage of each qualified residence's eligible basis. Makes such credit available to residences located: (1) in a census tract with a median gross income not exceeding 80 percent of the greater area or statewide median gross income; (2) in a rural area; (3) on an Indian reservation; or (4) in an area of chronic economic distress. Prohibits a buyer's income from exceeding 80 percent (70 percent for families of less than three) of the area gross median income and requires owner occupancy. Specifies that the aggregate homeownership credit dollar amount which a homeownership credit agency (an "agency") may disburse is the portion of the "State homeownership credit ceiling" (the "ceiling") allocated to such agency. Allows "unused homeownership credit carryovers" to be allocated among qualified States. Sets aside at up to 90 percent least ten percent of a State's ceiling for certain housing projects in which a qualified nonprofit organization owns an interest and materially participates in the given project's development and operation throughout the credit period. Requires allocation of credit to residences to be in accordance with a "qualified allocation plan" of the agency issuing credit. Lists certain specified criteria such a plan must include and specifies that the plan must be approved by the governmental unit of which such agency is a part.

Responsible Lending Act - Amends the Truth in Lending Act to define: (1) high cost mortgage; and (2) points and fees. Revises specified liability and other related provisions. Provides for continuation of late fee and prepayment provision identification under the Alternative Mortgage Transaction parity Act of 1982. Amends the Housing and Urban Development Act of 1968 to establish in the Department of Housing and Urban Development the Consumer Mortgage Protection Board, which shall: (1) provide homeownership and rental counseling and related toll-free telephone and web site services; (2) provide grants for housing counseling services; and (3) prepare and update a mortgage information booklet. Directs the Secretary of Housing and Urban Development to establish Federal mortgage broker requirements. Sets forth uniform State mortgage broker law guidelines, and states that Federal requirements shall apply to those States that have not enacted uniform laws.

The American Horse Slaughter Prevention Act - Prohibits a person from: (1) slaughtering a horse for human consumption; (2) importing to, or exporting from, the United States horseflesh or horses for human consumption; (3) selling, bartering, transferring, receiving, or distributing horseflesh or horses for human consumption; or (4) soliciting or knowingly causing any such actions. Sets forth provisions respecting: (1) criminal and civil penalties; (2) enforcement authority of the Secretary of Agriculture; (3) placement of confiscated horses; (4) euthanasia of unplaceable or severely injured or diseased horses; (4) funding of animal rescue facilities; and (5) exemptions.

Medicare Patient Access to Physical Therapists Act of 2003 - Amends title XVIII (Medicare) of the Social Security Act (SSA) to authorize qualified physical therapists to provide services for Medicare beneficiaries without the requirement of a physician referral. Provides for treatment of outpatient speech-language pathology services separately from outpatient physical therapy services.

Partial-Birth Abortion Ban Act of 2003 - Amends the Federal criminal code to prohibit any physician or other individual from knowingly performing a partial-birth abortion, except when necessary to save the life of a mother that is endangered by a physical disorder, illness, or injury. Defines a "partial-birth abortion" as an abortion in which the person performing the abortion: (1) deliberately and intentionally vaginally delivers a living fetus until, in the case of a head-first presentation, the entire fetal head is outside the mother's body, or, in the case of a breech presentation, any part of the fetal trunk past the navel is outside the mother's body; and (2) performs the overt act, other than completion of delivery, that kills the partially delivered living fetus. Authorizes the father, if married to the mother at the time of the abortion, and the maternal grandparents of the fetus, if the mother is under 18 years of age, to obtain specified relief in a civil action, unless the pregnancy resulted from the plaintiff's criminal conduct or the plaintiff consented to the abortion. Authorizes a defendant accused of an offense under this Act to seek a hearing before the State Medical Board on whether the physician's conduct was necessary to save the life of the mother. Prohibits the prosecution of a woman upon whom a partial-birth abortion is performed for conspiracy to violate this Act or under provisions regarding punishment as a principal or an accessory or for concealment of a felony.

Child Modeling Exploitation Prevention Act - Amends the Fair Labor Standards Act of 1938 to prohibit an employer from employing a child model in exploitive child modeling. Defines "exploitive child modeling" as modeling involving the use of a child under 17 years old for financial gain without the purpose of marketing a product or service other than the child's image, regardless of whether the employment relationship of the child is direct or indirect, contractual or non-contractual, or is termed that of an independent contractor. Provides that such term does not apply to an image which, taken as a whole, has serious literary, artistic, political, or scientific value. Sets penalties for violations. Includes employment of a minor in violation of such provision within the definition of "oppressive child labor." Amends the Federal criminal code to prohibit displaying or offering to provide the image of an individual engaged in exploitive child modeling, in or affecting interstate or foreign commerce, with the intent to make a financial gain, except with respect to an image which has serious literary, artistic, political, or scientific value.

Full Expensing for Economic Growth Act of 2003 - Amends the Internal Revenue Code with respect to the special first-year allowance for certain property acquired after September 10, 2001 and before September 11, 2004, to increase such allowance to 100 percent for 18 months from the date of enactment of this Act, if there was no written binding contract in effect before such date, for: (1) the acquisition of such property; or (2) in the case of property manufactured, constructed, or produced for the taxpayer's own use, for the manufacture, construction, or production of such property.

Civil Air Patrol Homeland Security Benefits Act - Amends the Omnibus Crime Control and Safe Streets Act of 1968 to include as a "public safety officer" for purposes of provisions governing death benefits a volunteer civilian member of the Civil Air Patrol engaged in: (1) active service rendered in performance or support of operational missions of the Patrol under the direction of the Department of the Air Force and performed consistent with written authorization that specifies a finite assignment; or (2) travel to or from such service.

Straight Talk on Social Security Act of 2003 - Amends the Social Security Act to require Social Security account statements to contain additional information, such as a statement of the current Social Security tax rates applicable to wages and self-employment income, including an indication of the combined total of such rates of employee and employer taxes with respect to wages.

Southern Campaign of the Revolution Heritage Area Study Act - Directs the Secretary of the Interior to study the suitability and feasibility of designating specified South Carolina counties, including specified public sites, other sites maintained by the State, and National Park Service sites in the State, and, possibly, North Carolina sites, as the Southern Campaign of the Revolution Heritage Area.

Small Business Health Fairness Act of 2003 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to revise provisions relating to access and choice for small business employers with respect to medical care for their employees. Establishes rules governing association health plans (group health plans whose sponsors are trade, industry, professional, chamber of commerce, or similar business associations), including requirements relating to certification, sponsors and boards of trustees, participation, coverage, plan documents, contribution rates, benefit options, applications for certification, notice for voluntary termination, corrective actions, and mandatory termination. Requires association health plans which provide health benefits in addition to health insurance coverage to maintain certain reserves and comply with other solvency provisions. Directs the Secretary of Labor to apply for appointment, and carry out specified duties, as trustee of any such insolvent association health plans which provide health benefits in addition to health insurance coverage. Allows a State to impose a contribution tax on any association health plan commencing operations in such State after the enactment of this Act. Requires association health plans to include in their summary plan descriptions, in connection with each benefit option, a description of the form of any solvency or guarantee fund protection secured under ERISA or applicable State law. Revises provisions relating to treatment of: (1) single employer arrangements; and (2) certain collectively bargained arrangements. Provides for association health plans with respect to: (1) enforcement; (2) cooperation between Federal and State authorities; and (3) treatment of certain existing health benefit programs.

Identification Integrity Act of 2003 - Prohibits a Federal employee from accepting from individuals for purposes of establishing their identity a form of identification issued by a foreign government, except for a passport that is accepted for such purpose on the date of enactment of this Act.

Prohibits Federal agencies (as defined by this Act) from accepting for any identification-related purpose any State-issued driver's license or other comparable identification document unless the State requires such licenses or documents issued to nonimmigrant aliens to expire on a date that is not later than: (1) the expiration of the alien's authorized U.S. stay; or (2) five years after such document's expiration in any case in which the alien's lawful stay is modified after U.S. admission, or does not expire on a fixed date. Directs the Attorney General to make grants to assist States in issuing appropriate licenses and identification documents.

Social Security Fairness Act of 2003 - Amends title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act to repeal: (1) pension offset provisions applicable to husband's and wife's insurance benefits, widow's and widower's insurance benefits, and mother's and father's insurance benefits with respect to Old-Age and Survivors insurance benefit payments; and (2) windfall elimination provisions with respect to computation of the primary insurance amount of an individual.

Human Cloning Prohibition Act of 2003 - Amends the Federal criminal code to prohibit any person or entity, in or affecting interstate commerce, from knowingly: (1) performing or attempting to perform human cloning; (2) participating in such an attempt; (3) shipping or receiving an embryo produced by human cloning or any product derived from such embryo; or (4) importing such an embryo or derived product. Sets forth criminal and civil penalties. Provides that nothing in this Act restricts areas of scientific research not specifically prohibited above, including research in the use of nuclear transfer or other cloning techniques to produce molecules, DNA, cells other than human embryos, tissues, organs, plants, or animals other than humans.

Military Survivor Benefits Improvement Act of 2003 - Adjusts the basic Survivor Benefit Plan (SBP) annuity amount for surviving spouses, age 62 and older, of former military personnel to: (1) 35 percent of the retired pay of the decedent (current law), for months before October 2004; (2) 40 percent for months during FY 2005; (3) 45 percent for months during FY 2006; (4) 50 percent for months during FY 2007; and (5) 55 percent for months after FY 2007. Adjusts similarly percentage amounts with respect to survivors of reserve personnel and survivors of persons who die while on active duty. Provides a corresponding phased elimination of the SBP supplemental annuity authorized to be provided to such surviving spouses. Requires periodic recomputation of: (1) annuity amounts beginning in October 2004; and (2) retired pay reductions for supplemental survivor annuities. Provides a one-year open enrollment period for SBP participation, commencing October 1, 2004, for those currently not participating, those electing to increase current coverage, and those wishing to participate in the supplemental SBP. Authorizes the Secretary of Defense to require appropriate premiums for SBP participation.

Fair Care for the Uninsured Act of 2003 - Amends the Internal Revenue Code to allow an individual a tax credit in an amount equal to the amount paid for qualified health insurance, subject to stated limitations. Directs the Secretary of the Treasury to make payments to the provider of an individual's qualified health insurance equal to such individual's qualified health insurance credit advance amount (the Secretary's estimate of the amount of credit allowable) with respect to such provider. Requires each health insurer, health maintenance organization, and health service organization to participate in a health insurance safety net which shall assure the availability of health insurance to uninsurable individuals. Funds such safety nets through assessments against such insurers and organizations. Permits such insurers and organizations to add the costs of such assessments to the costs of its insurance or coverage. Amends the Public Health Service Act to allow health benefits coverage through individual membership associations (IMAs). Sets forth IMA requirements, including that the IMA be an organization operated under the direction of an association and that IMA health benefits coverage only be provided through contracts with health insurance issuers. Requires IMAs to include a minimum of two health insurance coverage options.

Dave Thomas Adoption Act of 2003 - Amends the Internal Revenue Code to allow for penalty-free withdrawals from individual retirement plans if used to pay adoption expenses.
