Israel Anti-Boycott Act This bill prohibits participation by certain entities and individuals in boycotts or requests for boycotts imposed by international governmental organizations (i.e., the United Nations and the European Union). Specifically, the bill applies to covered persons the prohibition of specified actions in compliance with or in support of a boycott against a country that is friendly to the United States and that is not itself the object of a U.S. boycott. The bill defines a covered person as a domestic concern, the U.S. government or a state government, or a representative or official of such domestic concern or government. The bill also adds to the list of specified prohibited actions the act of furnishing information to any foreign country or international governmental organization that furthers an imposed boycott. Under current law, a person who violates the prohibitions against such boycotts may be subject to a monetary fine or imprisonment; however, the bill removes imprisonment as a potential penalty for certain violations.

This resolution condemns the actions of Iran with respect to Ukraine International Airlines Flight 752. It also expresses support for the protestors in Iran and condemns Iran for killing citizens protesting their government. In addition, it calls on Iran to refrain from using violence and to protect the rights of freedom of expression and peaceful assembly.

Comprehensive Immunosuppressive Drug Coverage for Kidney Transplant Patients Act of 2019 This bill indefinitely extends Medicare coverage of immunosuppressive drugs for kidney transplant recipients for individuals who do not have other coverage. Under current law, Medicare coverage is limited to 36 months following a transplant.

FISA Improvements Act of 2019 This bill makes various changes to the Foreign Intelligence Surveillance Court, such as by requiring amicus curiae (i.e., outside parties that assist in consideration of a case) involvement in certain matters. An amicus curiae shall assist the court when it is considering an initial application seeking permission to target an identifiable U.S. person for certain types of foreign intelligence investigative activities (such as electronic surveillance or a physical search). An application to the court for an order for electronic surveillance shall include a statement fully disclosing any information used in the application that the government cannot substantiate. The bill also requires transcriptions of proceedings before the court. The Department of Justice shall maintain all written communications with the court and written summaries of oral communications with the court.

Promoting Better Patient Data Security Act of 2019 This bill addresses health information technology provisions concerning cybersecurity practices. Specifically, the Department of Health and Human Services may reduce fines and penalties for violations of certain federal privacy standards for health information if an entity subject to those standards has adopted particular cybersecurity practices.

Lower Costs, More Cures Act of 2019 This bill establishes and modifies several requirements to address prescription drug prices under Medicare, Medicaid, and other programs. The bill generally limits payment amounts for drugs and biologics under Medicare medical services, reduces cost-sharing under the Medicare prescription drug benefit, modifies certain authorities and requirements under the Medicaid Drug Rebate Program, revises provisions relating to regulatory approval and commercial availability of generics and biosimilars, and establishes several reporting requirements for drug manufacturers with respect to drug prices.

Prostate-Specific Antigen Screening for High-risk Insured Men Act or the PSA Screening for HIM Act This bill requires group health insurance plans to cover preventive prostate cancer screenings that are not already covered under the recommendations of the U.S. Preventive Services Task Force for men with a family history of prostate cancer, without imposing any cost-sharing requirement.

Realizing the Economic Opportunities and Value of Expanding Recycling Act or the RECOVER Act This bill authorizes the Environmental Protection Agency (EPA) to establish a Recycling Infrastructure Program. Under the program, the EPA may award financial assistance to states, local governments, and tribal governments to support and expand their recycling infrastructure and programs.

Protecting Seniors Through Immunization Act of 2019 This bill specifies that certain deductible, coinsurance, initial coverage limit, and cost-sharing requirements that apply under the Medicare prescription drug benefit shall not apply with respect to vaccines that are recommended by the Advisory Committee on Immunization Practices of the Centers for Disease Control and Prevention. The Centers for Medicare & Medicaid Services must provide to Medicare beneficiaries specified information regarding (1) coverage of vaccines for seniors, and (2) access to recommended vaccines without cost-sharing.

Excellence in Maternal Health Act of 2019 This bill expands initiatives to address maternal health in rural areas and promote innovation in the field. Specifically, the bill requires the Health Resources and Services Administration (HRSA) to establish rural obstetric networks for improving outcomes in birth and maternal morbidity through collaboration, training, and program evaluation. HRSA also must award demonstration program grants to (1) train physicians, medical residents, and other practitioners to provide maternal and obstetric services in rural communities; and (2) support academic programs that develop or provide training to improve maternal care in rural areas. Further, the bill adds maternal health services as part of the telehealth network and telehealth resource centers grant programs. The bill also makes a series of changes to the research and reporting requirements of the Department of Health and Human Services and the Government Accountability Office with respect to data on maternal health outcomes. Additionally, the bill establishes grants to (1) develop best practices to reduce preventable maternal mortality; (2) train health care professionals about reducing and preventing discrimination when providing maternal health services; (3) support the collaboration of professionals across health settings with respect to maternal health; (4) establish evidence-informed, integrated health care services for pregnant and postpartum women and their infants. HRSA also must contract with an independent research organization to study and make recommendations to accredited school training programs about discrimination and implicit and explicit biases.

Safeguarding Medicare Access to Respiratory Therapy Act of 2019 This bill establishes certain requirements relating to Medicare coverage of ventilators. Specifically, the bill (1) excludes ventilators and other covered respiratory items, as specified, from Medicare's competitive acquisition program (in which rates are set through a competitive bidding program rather than by an established fee schedule); and (2) requires the Centers for Medicare & Medicaid Services to establish a technical expert panel to review, and make recommendations regarding, national coverage determinations with respect to Medicare coverage of ventilators and other specified respiratory devices.

Department of Veterans Affairs Contracting Preference Consistency Act This bill requires the Department of Veterans Affairs (VA) to give preference to nonprofit firms that employ the blind and significantly disabled when contracting for covered products and services that are included on the procurement list maintained by the U.S. AbilityOne Commission. The commission provides employment opportunities for people who are blind or have significant disabilities. A covered product or service is one that was included on the commission's procurement list on or before December 22, 2006, or a product or service that (1) is a replacement for a product or service on the commission's procurement list, (2) is essentially the same and meets the same requirements as the product or service being replaced, and (3) meets the VA's quality standards and delivery schedule.

Dignity for Aborted Children Act This bill requires abortion providers to offer patients specified options concerning the human fetal tissue from an abortion. Specifically, patients must be given an informed consent form specifying the options to (1) take possession of the tissue for transfer to an entity that provides interment or cremations services, or (2) in cases where the tissue is expelled on the provider’s premises, release the tissue to the provider. If the tissue is released to the abortion provider, the provider must ensure the tissue is interred or cremated within seven days of the procedure in a manner consistent with state law regarding the disposal of human remains. Abortion providers must report annually about the aggregate number of abortions performed and other specified information. The bill provides civil or criminal penalties for violations of disposal, informed consent, and reporting requirements.

VA Directly Returning Opioid Prescriptions Act This bill requires the Department of Veterans Affairs (VA) to ensure that each VA medical center with an on-site pharmacy or a law enforcement officer has a physical location where patients may dispose of controlled substances medications.

Opioid Prescription Verification Act of 2019 This bill requires the Department of Health and Human Services, in consultation with relevant agencies, to update pharmacist training materials to include information about how to verify the identity of individuals who pick up prescribed medications; it also permits the Centers for Disease Control and Prevention to give preference, in awarding grants to states for overdose prevention, to states that maintain a prescription drug monitoring program and require dispensers of certain controlled substances to verify the identity of individuals who pick up prescribed medications.

This bill reauthorizes through FY2027 the U.S. SAFE WEB Act of 2006, which permits the Federal Trade Commission (FTC) to take certain actions to protect consumers from cross-border fraud and deception occurring over the internet. The bill further requires the FTC to report on its activities concerning cross-border, online fraud and provide any policy recommendations to address such fraud.

Honest Elections Act This bill modifies registration requirements for foreign agents who engage in political activities, requires that certain disclosures be made in online political communications, and prohibits a state from receiving certain election assistance funds if the state allows ballot harvesting or voting by noncitizens.

Countering Turkish Aggression Act of 2019 This bill directs the President to impose sanctions related to Turkey. The President shall impose property- and visa-blocking sanctions on (1) specified officials of Turkey's government, such as the president and vice president of Turkey; (2) any foreign person that knowingly sells to, provides support to, or conducts a transaction with Turkey's armed forces; and (3) any foreign person that supplies goods or services that support petroleum production for use by Turkey's armed forces. The President may temporarily stop the application of such sanctions upon certifying to Congress that Turkey (1) is not operating in certain parts of Syria without U.S. support, and (2) has withdrawn its troops and Turkey-supported rebel groups from occupied areas. The President shall impose additional sanctions on Turkey based on Turkey's purchase of a surface-to-air defense system from Russia. No funds may be obligated or expended to transfer to Turkey's armed forces any U.S. defense articles, services, or technology.

Advancing Education on Biosimilars Act of 2019 This bill requires the Department of Health and Human Services (HHS) to maintain a website and undertake other activities to educate health care providers, patients, and caregivers about biological products, biosimilar biological products, and interchangeable biosimilar biological products. Among other activities, HHS must develop or improve continuing education programs that address clinical considerations for biological and related products. Health care providers eligible for the Merit-based Incentive Payment System in Medicare may count completion of such a program as a clinical practice improvement activity.

Support And Value Expectant Moms and Babies Act of 2019 or the SAVE Moms and Babies Act of 2019 This bill prohibits the Food and Drug Administration (FDA) from approving any new drug (either as a brand-name drug or a generic) intended to terminate a pregnancy and imposes additional restrictions on such drugs that are already approved. Under the bill, an already-approved drug intended to terminate a pregnancy may be dispensed to a patient only with a prescription. Furthermore, the FDA may not approve any labeling change that would authorize (1) using the drug after 70 days of gestation, or (2) dispensing the drug by any means other than in-person administration by the prescribing health care practitioner. The FDA must also impose additional restrictions on such already-approved drugs, including by (1) requiring the prescribing health care practitioner to receive a special certification, (2) prohibiting the practitioner to also act as the dispensing pharmacist, and (3) requiring the practitioner to have the ability to provide surgical intervention to the patient. The bill also rescinds any investigational use exemption already granted to such a drug if the bill would have prohibited the FDA from granting the exemption. (Currently, the FDA may grant an exemption to certain market approval requirements if a drug is intended solely for use in safety and effectiveness investigations.)

Puppies Assisting Wounded Servicemembers for Veterans Therapy Act or the PAWS for Veterans Therapy Act This bill requires the Department of Veterans Affairs to implement a pilot program to assess the effectiveness of addressing post-deployment mental health and post-traumatic stress disorder through a method where veterans train service dogs for veterans with disabilities.

NASA Enhanced Use Lease Authority Act of 2019 This bill extends through 2029 and revises the authority of the National Aeronautical and Space Administration (NASA) to lease its non-excess real property and related personal property. The bill expands the purposes for which NASA may enter such leases for in-kind consideration to include (1) maintaining, constructing, modifying, or improving facilities; (2) carrying out aeronautical and space research, development, testing, and evaluation activities; and (3) providing services to NASA, including launch services and payload processing services. The annual report with respect to such leasing shall include information on (1) the value and nature of in-kind consideration, and (2) the controls in place that ensure that NASA takes advantage of such consideration.

Broadband Interagency Coordination Act of 2019 This bill requires the Federal Communications Commission, the National Telecommunications and Information Administration, and the Department of Agriculture to enter into an interagency agreement to coordinate the distribution of federal funds for new broadband deployment.

Rare disease Advancement, surveillance Research, and Education Act of 2019 or the RARE Act of 2019 The bill reauthorizes through FY2024 the National Institutes of Health Rare Disease Regional Centers of Excellence and expands activities to facilitate research and increase awareness of rare diseases and conditions. (Rare diseases and conditions are those with a prevalence of fewer than 200,000 individuals in the United States.) The Centers for Disease Control and Prevention (CDC) may expand infrastructure and activities to track the epidemiology of up to four rare diseases and conditions and incorporate this information into a National Rare Disease or Condition Surveillance System. The Agency for Healthcare Research and Quality must expand its activities to increase health care providers' awareness of rare diseases and conditions. The National Academies of Sciences, Engineering, and Medicine, or another appropriate entity, must update the 2010 report Rare Diseases and Orphan Products: Accelerating Research and Development.

This concurrent resolution recognizes the 35th anniversary of the Mexico City policy, which prohibits foreign nongovernmental organizations that receive U.S. global-health assistance from performing or promoting abortion as a method of family planning. The resolution expresses support for the codification of this policy in U.S. law.

Eric's Law This bill modifies procedures with respect to capital sentencing hearings. If a jury at a capital sentencing hearing does not reach a unanimous recommendation on the defendant's sentence, then the court must order a new special sentencing hearing and impanel a new jury. If the new jury at the special sentencing hearing does not reach a unanimous recommendation on the defendant's sentence, then the court is prohibited from imposing a death sentence.

Equal Treatment of Public Servants Act of 2019 This bill phases in a new funding formula for determining benefit amounts under the windfall elimination provision (WEP). (The WEP reduces Old-Age, Survivors, and Disability Insurance benefits for those who receive pensions for certain non-covered employment.) The new formula adjusts an individual's total lifetime earnings based on the proportion of those earnings subject to Social Security payroll taxes. It applies to individuals who (1) become eligible for old-age or disability benefits after 2060, and (2) have earnings from non-covered service performed in a year after 1977. Beneficiaries who become eligible for benefits between 2022 and 2060 receive the higher of their benefit calculated under the existing WEP or the new formula. In addition, certain beneficiaries currently impacted by the WEP receive an additional payment. The Social Security Administration must include non-covered earnings in Social Security account statements and must study the feasibility of partnering with certain pension systems to address data sharing issues related to non-covered pensions.

Combatting Impaired Driving Act of 2019 This bill directs the Department of Transportation to provide funding for grants, pilot programs, demonstration projects, and innovative solutions to improve motor vehicle safety and address impaired driving, including alcohol, marijuana, and opioid-impaired driving.

School Violence Prevention and Mitigation Act of 2019 This bill directs the Office of Community Oriented Policing Services within the Department of Justice to award grants to public elementary and secondary schools to (1) conduct independent facility security risk assessments, and (2) make hard security improvements (e.g., video monitoring and alert notification equipment) that are identified as necessary by the risk assessment.

Accessible Care by Curbing Excessive lawSuitS Act of 2019 or ACCESS Act of 2019 This bill establishes rules for health care lawsuits where some amount of coverage or care was provided or paid for by a federal program, regardless of the number of other parties to the claim. The bill sets a three-year maximum statute of limitations from the date of the injury, subject to specific exceptions. Further, noneconomic damages (e.g., damages for pain and suffering) are limited to a maximum of $250,000. The bill permits courts to supervise and limit contingent fees paid to attorneys and sets a maximum contingent fee percentage based on a downward sliding scale as a damages increase. The bill permits either party to introduce evidence of collateral source benefits (e.g., workers’ compensation programs, accident insurance coverage, or other future benefit). Statements by a health care provider expressing fault, sympathy, or apology are, however, inadmissible as evidence of liability. Additionally, a plaintiff must give 90 days’ notice to the health care provider before filing a lawsuit. When filing a health care lawsuit, plaintiffs also must simultaneously submit an affidavit in support of the claim from a health care professional who meets the standards for an expert witness that are provided in the bill. This bill generally does not preempt state laws that impose additional limits on health care liability claims.

Hot Cars Act of 2019 This bill requires the Department of Transportation (DOT) to issue a final rule requiring all new passenger motor vehicles weighing 10,000 pounds or less to be equipped with an alert system to detect the presence of an occupant (e.g., a child or domestic animal) in a rear designated seating position after the vehicle engine is turned off. DOT must also consider requiring systems that can detect the presence of any occupant unable to independently exit the vehicle and the presence of a child who has entered an unoccupied vehicle independently. The alert must (1) include a distinct auditory and visual alert to notify individuals inside and outside of the vehicle of the presence of an occupant which must be combined with an interior haptic warning (i.e., vibrations), and (2) be activated when the vehicle engine is turned off and the presence of an occupant is detected. DOT must enter into an agreement with an independent third party for a study on retrofitting existing passenger motor vehicles with technology to address the problem of occupants left unattended in motor vehicles.

Laboratory Access for Beneficiaries Act or the LAB Act This bill revises the periods during which laboratories must report clinical diagnostic test information to the Centers for Medicare & Medicaid Services (CMS) for purposes of determining Medicare payment rates. The CMS must also contract with the National Academies of Sciences, Engineering, and Medicine to evaluate the methodology used to determine a specified laboratory fee schedule.

Improve Well-Being for Veterans Act This bill requires the Department of Veterans Affairs (VA) to award grants for a period of three years to eligible entities for the provision of suicide prevention services to veterans and their families. Under the bill, eligible entities include tribally designated housing entities, community-based organizations, and other private entities that meet certain requirements. Entities must submit an application to receive financial assistance that includes a description of the services they propose to provide, among other elements. The bill requires the VA to equitably distribute grants across geographic regions and areas with the most need. Additionally, the VA shall give preference to entities that are experienced in providing suicide prevention services. Entities receiving funding must notify service recipients that funding is wholly or partially from the VA.

Protecting People From Surprise Medical Bills Act This bill makes a series of changes relating to health care costs and billing practices. Among other things, the bill applies in-network cost-sharing requirements to certain emergency and related non-emergency services that are provided out-of-network; requires health insurers to include in-network and out-of-network deductibles, as well as out-of-pocket maximum limitations, on enrollee insurance cards; requires health insurers to provide online and print directories of in-network health care providers; and prohibits health care providers from billing individuals for services more than a year after such services are provided.

Election Security Assistance Act This bill addresses security threats to federal elections. Specifically, the bill authorizes grants to states for election technology and security, requires election poll books to meet voting system standards, allows for expedited security clearances for certain state election officials and officials with the Election Assistance Commission, requires federal entities to share information with the Department of Homeland Security (DHS) regarding election cybersecurity incidents, and requires DHS to share information with state and local officials regarding election cybersecurity incidents.

Stopping Bad Robocalls Act This bill updates various policies and regulations relating to robocalls. Specifically, the bill requires the Federal Communications Commission (FCC) to protect consumer privacy as it relates to robocalls. The FCC must update regulations involving certain robocalls that are exempt from criminal liability to include specific requirements identifying classes of parties who may make such calls, parties who may be called, and how many times they may be called. Additionally, the bill removes the requirement that a citation be issued prior to a forfeiture penalty being imposed in cases where violations involving illegal robocalls have been intentional and where inaccurate caller identification information has been provided. The bill also implements a three-year statute of limitation for such violations requiring notice, and a four-year statute of limitation where an intentional violation has occurred. The FCC must promulgate regulations to address requirements for effective call authentication technology as well as to establish a process to streamline the ways in which a private entity may voluntarily share with FCC information relating to an illegal call or text or for calls with misleading or inaccurate caller identification information. Finally, the bill requires the FCC to ensure robocall blocking services provided on an opt-out basis are provided free of cost with transparency and redress options for consumers and callers.
