Expanding America's National Cemetery Act of 2023 This bill requires the Department of Veterans Affairs, before Arlington National Cemetery reaches capacity, to expand or otherwise modify an existing national cemetery to ensure that full military honors are provided in a specified manner. Specifically, the VA must expand or modify such a cemetery to ensure that full military honors are provided (1) in a manner consistent with the full military honors provided for interment in Arlington National Cemetery as of March 31, 2023; and (2) using the eligibility criteria in effect on March 31, 2023, for providing full military honors for interment in Arlington National Cemetery.

Major Richard Star Act This bill provides that combat-disabled uniformed services retirees with fewer than 20 years of creditable service may concurrently receive, without reduction, veterans' disability compensation and retired pay or combat-related special compensation.

Law Enforcement Officers Equity Act This bill expands the definition of law enforcement officer under provisions of the Federal Employees Retirement System (FERS) and the Civil Service Retirement System (CSRS). Specifically, the bill expands the definition to include (1) federal employees whose duties encompass the investigation or apprehension of suspected or convicted criminals and who are authorized to carry a firearm; (2) Internal Revenue Service employees whose duties are primarily the collection of delinquent taxes and the securing of delinquent returns; (3) U.S. Postal Inspection Service employees; (4) Department of Veterans Affairs police officers; and (5) certain U.S. Customs and Border Protection employees who are seized-property specialists with duties relating to custody, management, and disposition of seized and forfeited property. The bill deems service performed by an incumbent law enforcement officer on or after the enactment date of this bill to be service performed as a law enforcement officer for retirement purposes. The past service of such incumbents shall be treated as service performed by a law enforcement officer for retirement purposes only if a written election is submitted to the Office of Personnel Management within five years after the enactment of this bill or before separation from government service, whichever is earlier. An incumbent who makes an election before the enactment of this bill may pay a deposit into the Civil Service Retirement and Disability Fund to cover prior service. A law enforcement officer shall not be subject to mandatory separation during the three-year period beginning on the enactment of this bill.

United States Foundation for International Conservation Act of 2023 This bill requires the Department of State to establish the U.S. Foundation for International Conservation as a tax-exempt organization to promote international conservation efforts, including by providing grants for eligible projects. The foundation shall fund projects that support effective area-based conservation measures and the long-term management of protected or conserved areas and their contiguous buffer zones. Such areas include terrestrial, coastal, and marine-protected or conserved parks, conservancies, and reserves. Projects must be cost-matched from sources other than the U.S. government. Project grants shall focus on countries that (1) have low-income, lower middle-income, or upper-middle-income economies; (2) have a high degree of biological diversity or important species or ecosystems; and (3) have demonstrated a commitment to conservation through their actions. The foundation may not provide support for any government, or any entity owned or controlled by a government, that has repeatedly provided support for acts of international terrorism or has engaged in a consistent pattern of gross human rights violations. Additionally, the foundation may not engage in any dealings prohibited under U.S. sanctions.

Parents Bill of Rights Act This bill establishes various rights of parents and guardians regarding the elementary or secondary school education of their children. Local educational agencies (LEAs) and schools must comply with the requirements of the bill in order to receive federal education funds. Specifically, the bill requires schools to notify parents and guardians of their rights regarding the education of their children. These rights include the right to review the curriculum of their child's school; know if the state alters its challenging academic standards; meet with each teacher of their child at least twice each school year; review the budget, including all revenues and expenditures, of their child's school; review a list of the books and other reading materials in the library of their child's school; address the school board of the LEA; receive information about violent activity in their child's school; and receive information about any plans to eliminate gifted and talented programs in the child's school. Additionally, the bill directs each LEA to post on a publicly accessible website (or otherwise widely disseminate to the public) the curriculum for each elementary and secondary school grade level. The LEA must also include in its annual report card the overall budget of the LEA and the budget for each elementary and secondary school. The bill also provides for additional family educational and privacy rights, including by prohibiting schools from selling student information for commercial or financial gain.

Facilitating Innovative Nuclear Diagnostics Act of 2023 This bill establishes separate payment requirements for diagnostic radiopharmaceuticals under the Medicare prospective payment system for hospital outpatient department services. The bill's requirements apply to diagnostic radiopharmaceuticals that have an average daily cost of $500 or more in 2024 and as adjusted based on a specified fee schedule factor in each year thereafter.

Resident Education Deferred Interest Act or the REDI Act This bill allows borrowers in medical or dental internships or residency programs to defer student loan payments until the completion of their programs.

National Right-to-Work Act This bill repeals those provisions of the National Labor Relations Act and the Railway Labor Act that permit employers to make an agreement with a labor union to require employees to join such union as a condition of employment. Currently, at least 27 states have enacted laws prohibiting employers from compelling employees to become members of a union as a condition of employment.

Elimination of Future Technology Delays Act of 2023 This bill establishes new requirements for the Environmental Protection Agency (EPA) when it makes certain determinations under the Toxic Substance Control Act (TSCA) related to chemical substances that are considered to be a critical energy resource (i.e., any energy resource that is essential to the U.S. energy sector and energy systems and has a vulnerable supply chain). Currently, under TSCA, manufacturers and processors of chemical substances must notify the EPA before manufacturing a new chemical substance or before manufacturing or processing a substance for a significant new use. The EPA must review such notices and provide a determination on the substance or significant new use. Under the bill, the EPA must consider economic, societal, and environmental costs and benefits when making determinations on notices for (1) new chemical substances that are considered to be a critical energy resource, or (2) significant new uses for such chemicals. If the EPA fails to make a determination by the end of the applicable review period and the submitter has not withdrawn the notice, the submitter may proceed in manufacturing or processing the substance. Applicable fees must not be refunded if a submitter proceeds with manufacturing or processing. The EPA may suggest the withdrawal of a notice for a chemical substance that is a critical energy resource, or request a suspension of the review period, if the EPA has conducted a preliminary review of the notice and provided a draft of determination to the submitter.

Keeping America's Refineries Act This bill revises the EPA's Risk Management program to exempt a petroleum (e.g., gasoline) refinery that uses a hydrofluoric acid alkylation unit from certain hazard assessment requirements. Petroleum refineries use the acid during the gasoline production process. Hydrofluoric acid is hazardous and corrosive. If it is accidently released, it can form a toxic vapor cloud. Currently, petroleum refineries are required to include in a hazard assessment an evaluation of safer technology and alternative risk management measures for a hydrofluoric acid alkylation unit. This bill eliminates that requirement if the petroleum refinery (1) has obtained a construction permit or operating permit under the program, or (2) demonstrates that it will conform to the most recent version of American Petroleum Institute Recommended Practice 751. This practice provides guidance on the safe operation of such a unit.

Protecting American Energy Production Act This bill prohibits the President from declaring a moratorium on the use of hydraulic fracturing unless Congress authorizes the moratorium. The bill also expresses the sense of Congress that states should maintain primacy for the regulation of hydraulic fracturing for oil and natural gas production on state and private lands. Hydraulic fracturing, or fracking, is a process to extract underground resources such as oil or gas from a geologic formation by injecting water, a propping agent (e.g., sand), and chemical additives into a well under enough pressure to fracture the formation.

Unlocking our Domestic LNG Potential Act of 2023 This bill repeals certain restrictions on the import and export of natural gas under the Natural Gas Act, including (1) a requirement that the Federal Energy Regulatory Commission (FERC) authorize an order to export or import natural gas only if it is in the public interest, and (2) restrictions related to free trade agreements. The bill also grants the FERC the exclusive authority to approve or deny applications for the siting, construction, expansion, or operation of facilities (e.g., liquefied natural gas terminals) to export natural gas to foreign countries or import natural gas from foreign countries.

This bill allows the Environmental Protection Agency (EPA) to issue a temporary waiver of requirements under the Clean Air Act or the Solid Waste Disposal Act for a critical energy resource facility if the EPA finds that the processing or refining of a critical energy resource at the facility is necessary to meet national security or energy security needs. Further, the EPA may issue such waiver with or without notice, hearing, or other report.

Promoting Interagency Coordination for Review of Natural Gas Pipelines Act This bill expands the authority of the Federal Energy Regulatory Commission (FERC) to act as the only lead agency for the purpose of coordinating the environmental review process under the National Environmental Policy Act of 1969 (NEPA) of natural gas pipeline project applications under the Natural Gas Act. Thus, federal, state, and local agencies involved in the environmental review process must defer to FERC's approved scope for a NEPA review. FERC must invite and designate the other participating agencies involved in the authorization process. In addition, FERC must consult with the Transportation Security Administration regarding pipeline infrastructure security, pipeline cybersecurity, pipeline personnel security, and other pipeline security measures. The bill establishes a deadline for agencies to complete NEPA reviews of pipeline projects and requires concurrent reviews when multiple federal or state agencies are involved. If a federal or state agency requires the person applying for a pipeline authorization to submit data, the agency must consider any such data gathered by aerial or other remote means that the person submits.

Natural Gas Tax Repeal Act This bill eliminates a program administered by the Environmental Protection Agency (EPA) that provides incentives for petroleum and natural gas systems to reduce their emissions of methane and other greenhouse gases. It also repeals a charge on methane emissions from specific types of facilities that are required to report their greenhouse gas emissions to the EPA's Greenhouse Gas Emissions Reporting Program.

Debbie Smith Act of 2023 This bill reauthorizes through FY2029 the Debbie Smith DNA Backlog Grant Program. The program provides grants to state and local governments to improve and expand the collection and analysis of DNA evidence, including evidence in sexual assault kits.

250th Anniversary of the United States Marine Corps Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the 250th anniversary of the United States Marine Corps. All surcharges received by Treasury from the sale of such coins must be paid to the Marine Corps Heritage Foundation and shall only be used for the purposes of supporting the mission of the Marine Corps Heritage Center.

Promoting Cross-b order Energy Infrastructure Act This bill establishes a new process for approving the construction and operation of energy infrastructure across an international border of the United States and replaces the existing process established under specified executive orders. Specifically, this bill requires a person to obtain a certificate of crossing before constructing, connecting, operating, or maintaining a border-crossing facility for the import or export of oil, natural gas, or electricity across a U.S. border between Canada or Mexico. A certificate must be obtained from the Federal Energy Regulatory Commission (FERC) for a facility consisting of oil or natural gas pipelines or the Department of Energy (DOE) for an electric transmission facility. As a condition of issuing a certificate, DOE must require that an electric transmission facility be constructed, connected, operated, or maintained consistent with specified policies and standards. FERC and DOE must meet a deadline for issuing a certificate as set forth by this bill. The bill also requires FERC to meet a deadline for approving applications to import or export natural gas to or from Canada or Mexico.

This bill gives a facility that processes or refines a critical energy resource an interim status permit under the Resource Conservation and Recovery Act until (1) the final administrative disposition of its permit application, or (2) it is proven that the facility failed to provide information needed to process the permit application.

Securing America's Critical Minerals Supply Act This bill requires the Department of Energy (DOE) to secure the supply of critical energy resources that are essential to the energy security of the United States. As part of its duties, DOE must conduct ongoing assessments of the supply of critical energy resources, strengthen the supply chains for those resources, develop substitutes and alternatives to those resources, improve technology that reuses and recycles critical energy resources, and evaluate how energy security is affected by the reliance of the United States on importing critical energy resources.

Shirley Chisholm Congressional Gold Medal Act This bill provides for the posthumous presentation of a Congressional Gold Medal in commemoration of Shirley Chisholm, in recognition of her activism, independence, and groundbreaking achievements in politics, including election as the first African American woman in Congress.

Cardiac Arrest Survival Act of 2023 This bill expands immunity from civil liability related to emergency use of automated external defibrillator devices (AEDs). In particular, the bill specifies that immunity applies regardless of whether the person who used the AED complied with signage, received training, or was assisted or supervised by another person, such as a licensed physician. Additionally, the bill limits the liability of the person who owns or acquires an AED for harm resulting from its use unless that person fails to appropriately maintain the AED.

TCJA Permanency Act This bill makes permanent provisions affecting individual and business taxpayers that were enacted in 2017 by the Tax Cuts and Jobs Act and are scheduled to expire at the end of 2025. The bill makes permanent reductions in individual and capital gain tax rates. The bill increases the standard tax deduction for individual taxpayers. It also increases and modifies the child tax credit and raises the contribution base for the tax deduction for charitable contributions. The bill allows additional contributions to ABLE accounts (tax-exempt accounts designed to enable individuals with disabilities to save and pay for disability-related expenses). It exempts from taxation combat zone benefits of members of the Armed Forces serving in the Sinai Peninsula of Egypt and limits the deduction for moving expenses to active duty members of the Armed Forces. Additionally, the bill expands the types of elementary and secondary school expenses eligible for payment from qualified tuition programs (529 programs); lowers to $750,000 the amount of mortgage debt eligible for an interest expense tax deduction; reinstates after 2024 the exclusion of income from the gross income of student loan borrowers for loan debt discharged due to death or total and permanent disability; makes permanent the limitation on the tax deduction for state and local taxes and denies a deduction for foreign real property taxes; makes permanent the tax deduction of the income of certain pass-through business entities; repeals the tax deduction for personal tax exemptions and the exclusion of employer-provided bicycle commuter fringe benefits; terminates certain miscellaneous itemized tax deductions; doubles the estate and gift tax exemption amount; and makes permanent the increase of the alternative minimum tax exemption amount for individual taxpayers.

Truth in Healthcare Marketing Act of 202 3 This bill prohibits a person from misrepresenting (1) whether the person holds a state health care license; or (2) the person's education, training, degree, license, or clinical expertise. A person's advertisement for the person's health care services must disclose the license under which the person is authorized to provide those services. The bill also provides for enforcement by the Federal Trade Commission by requiring a violation of this bill to be treated as an unfair or deceptive act or practice.

Simplifying Grants Act of 2023 This bill sets forth procedures for simplifying the grant process for nonurbanized areas, for both existing and new grant programs. Each agency must make publicly available a checklist for covered local governments with respect to each grant program of the agency for which such governments are otherwise eligible that includes each requirement for every step of the grant process. The Office of Management and Budget must report to Congress (1) within 270 days of this bill's enactment, evaluating the extent to which agencies have simplified the requirements and made the checklist available; and (2) each April 1st, evaluating the amount of technical assistance provided and the amount of funds awarded.

Outpatient Surgery Quality and Access Act of 2023 This bill establishes and modifies certain requirements relating to Medicare payments for ambulatory surgical center (ASC) services. Specifically, the bill (1) requires the payment system for ASC services to feature certain positive annual adjustments equivalent to those made with respect to hospital outpatient department (OPD) services; (2) revises quality reporting requirements to permit publicly available, side-by-side comparisons of quality measures for ASCs and OPDs in the same geographic area; and (3) requires the Centers for Medicare & Medicaid Services (CMS), when excluding requested procedures from the list of those approved to be performed in ASCs, to cite specified reasons for doing so. With respect to excluding procedures from the approved list for ASCs, the CMS may not cite as a basis for exclusion that a procedure can only be reported using an unlisted surgical procedure code. (Physicians sometimes use unlisted codes when performing new procedures or services if no existing code is adequately descriptive.) The bill also limits the copayment amount for ASC services under Medicare to that of the inpatient hospital deductible.

This concurrent resolution expresses congressional disapproval of the revocation of the presidential permit for the Keystone XL pipeline. The permit authorized the TransCanada Keystone Pipeline to construct, connect, operate, and maintain the pipeline facilities in Phillips County, Montana, for the import of oil from Canada to the United States.

Independent and Objective Oversight of Ukrainian Assistance Act The bill establishes the Office of the Special Inspector General for Ukrainian Military, Economic, and Humanitarian Aid. The office's duties shall include (1) conducting and coordinating audits and investigations of the handing of funds made available for aid to Ukraine, and (2) monitoring and reviewing contracts and activities involving those funds. The Special Inspector General shall report directly to, and be under the general supervision of, the Secretary of State and Secretary of Defense. Federal agencies may not prevent the office from carrying out any audit or investigation related to aid to Ukraine. The office shall terminate 180 days after the date on which there is less than $250 million in unexpended amounts that were made available for the reconstruction of Ukraine.

Working Dog Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue 50,000 $5 gold coins, 500,000 $1 silver coins, and 750,000 half-dollar clad coins in commemoration of the service that working dogs provide to society. The designs of the coins minted under this bill shall be emblematic of the contributions of working dogs to society, including in detection, military service, therapy, and assistance. Treasury may issue coins only during the one-year period beginning on January 1, 2025. All sales of coins shall include a surcharge, which shall be paid to America's VetDogs for general expenses associated with the fulfillment of its mission.

Preventive Health Savings Act This bill requires the Congressional Budget Office (CBO), upon receiving a request from Congress, to determine if proposed legislation would reduce spending outside of the 10-year budget window through the use of preventive health and preventive health services. If CBO determines that the legislation would result in substantial spending reductions from the use of preventive health and preventive health services, a description and estimate of the spending reductions must be included in CBO projections.

This joint resolution nullifies the rule titled Revised Definition of "Waters of the United States," which was submitted by the U.S. Army Corps of Engineers and the Environmental Protection Agency on January 18, 2023. The rule specifies which bodies of water fall under the scope of the Clean Water Act and are thereby under federal jurisdiction. The 2023 rule replaced a 2020 rule that included a narrower definition of waters of the United States .

Protect and Serve Act of 2023 This bill establishes a new criminal offense for knowingly assaulting a law enforcement officer and causing serious bodily injury (or attempting to do so) in circumstances that affect interstate commerce. It imposes criminal penalties—a prison term, a fine, or both—on a violator.

Supply Chain Disruptions Relief Act This bill modifies the treatment of liquidations of new motor vehicle inventory as qualified LIFO (last in first out accounting method) inventory. It allows new motor vehicle dealers to elect to wait until the end of 2025 to replace their inventory for purposes of determining income attributable to the sale of such inventory during 2020 and 2021.

Forgotten Heroes of the Holocaust Congressional Gold Medal Act This bill provides for the award of a Congressional Gold Medal to 60 diplomats posthumously in recognition of their brave and vital service of saving Jews during World War II.

Educational Choice for Children Act This bill allows individuals and corporations a new tax credit after 2023 for charitable contributions to tax-exempt organizations that provide scholarships to elementary and secondary school students. Such students must be members of a household with incomes not greater 300% of the area median gross income and be eligible to enroll in a public elementary or secondary school. The bill excludes from the gross income of taxpayer dependents any scholarship amount for the elementary or secondary education expenses of eligible students. It also prohibits governmental control over scholarship granting organizations.

Freedom for Health Care Workers Act This bill nullifies the rule titled Medicare and Medicaid Programs; Omnibus COVID-19 Health Care Staff Vaccination , which was issued by the Centers for Medicare & Medicaid Services on November 5, 2021, and prohibits the issuance of any substantially similar rule. The rule requires health care providers, as a condition of Medicare and Medicaid participation, to ensure that staff are fully vaccinated against COVID-19.

Promoting Employment and Lifelong Learning Act or the PELL Act This bill expands student eligibility for Pell Grants by establishing the Workforce Pell Grants Program. Specifically, the bill requires the Department of Education (ED) to award Workforce Pell Grants to students enrolled in eligible short-term programs. Eligible programs are those that provide 150 to 600 clock hours of instructional time over a period of 8 to 15 weeks and meet other eligibility criteria. An accrediting agency or association recognized by ED must determine a program's eligibility based on several criteria, including that the program provides education aligned with the requirements of in-demand industry sectors and occupations and meets specified completion and job placement rates. ED must annually collect and publish information on the College Scorecard regarding each eligible program, including job outcomes. The College Scorecard is a comparison tool for information on school sizes, settings, graduation rates, average costs, and salary ranges per field of study.

Halt All Lethal Trafficking of Fentanyl Act or the HALT Fentanyl Act This bill places fentanyl-related substances as a class into schedule I of the Controlled Substances Act. A schedule I controlled substance is a drug, substance, or chemical that has a high potential for abuse; has no currently accepted medical value; and is subject to regulatory controls and administrative, civil, and criminal penalties under the Controlled Substances Act. Additionally, the bill establishes a new, alternative registration process for schedule I research that is funded by the Department of Health and Human Services or the Department of Veterans Affairs or that is conducted under an investigative new drug exemption from the Food and Drug Administration. The bill also makes several other changes to registration requirements for conducting research with controlled substances, including permitting a single registration for related research sites in certain circumstances, waiving the requirement for a new inspection in certain situations, and allowing a registered researcher to perform certain manufacturing activities with small quantities of a substance without obtaining a manufacturing registration.

Protecting Families from Fertility Fraud Act of 2023 This bill establishes a new federal criminal offense for knowingly misrepresenting the nature or source of DNA used in assisted reproductive technology or assisted insemination. The term assisted reproductive technology includes any treatment or procedure that involves the handling of human oocytes or embryos, such as in vitro fertilization, gamete intrafallopian transfer, and zygote intrafallopian transfer. The term assisted insemination includes any procedure that involves the handling of sperm including intrauterine insemination. A violation is subject to a fine, a prison term of up to 10 years, or both. Additionally, the bill makes the violation a predicate offense (i.e., an underlying offense) for prosecutions under the federal racketeering statute.

Education Savings Accounts for Military Families Act of 2023 This bill directs the Department of Education (ED) to establish a program to provide children with parents on active duty in the uniformed services with funds to pay educational expenses. Specifically, ED must establish a tax-exempt Military Education Savings Account for dependent children of parents in the uniformed services for the payment of the children's educational expenses. Funds in the savings account may be used for specified purposes, including the cost of attendance at a private elementary or secondary school or institution of higher education, private tutoring, or costs associated with an apprenticeship or other vocational training program.

Life at Conception Act This bill declares that the right to life guaranteed by the Constitution is vested in each human being at all stages of life, including the moment of fertilization, cloning, or other moment at which an individual comes into being. Nothing in this bill shall be construed to authorize the prosecution of any woman for the death of her unborn child.

Pandemic is Over Act This bill terminates the COVID-19 public health emergency that was declared on January 31, 2020, on the date of the bill's enactment.
