Turkey International Financial Institutions Act This bill requires the Department of the Treasury to: oppose the extension by the International Finance Corporation (IFC) and the European Bank for Reconstruction and Development of loans or financial or technical assistance to Turkey or to any entity for a project in Turkey, and work with other donor countries to develop a lending policy with Turkey that advances human rights. Treasury may waive the IFC restriction for projects to diversify Turkey's energy resources and lessen its dependence on Russian or Iranian oil or gas. Such restrictions: shall terminate after the President certifies to Congress that Turkey is no longer arbitrarily detaining or denying freedom of movement to U.S. citizens (including dual citizens) or locally employed staff of the U.S. mission to Turkey, and shall not apply to loans or financial or technical assistance for humanitarian purposes.

Targeting Rogue and Opaque Letters Act of 2018 This bill makes sending bad faith patent demand letters an unfair or deceptive act in violation of the Federal Trade Commission Act. A patent demand letter is a written communication claiming that the recipient may be liable for patent infringement. "Bad faith" means making knowingly false or misleading statements, making claims with reckless disregard for the truth, or omitting information with the intent to deceive. Bad faith representations under the bill include false or misleading claims about the sender's right to assert the patent, whether lawsuits have been filed against the recipient or others, and whether others have purchased a license to exercise the patent. It is also bad faith to make written demands for compensation for invalid patents, or to demand compensation without identifying the ultimate parent entity of the letter sender. The sender has an affirmative defense that it acted in good faith, by proving its misstatements or omissions were unintentional and it made an error in spite of procedures to avoid such errors. The bill preempts state laws relating to patent assertion communications. The Federal Trade Commission and state attorneys general can bring actions to enforce these provisions.

Increasing Access to Lower Premium Plans and Expanding Health Savings Accounts Act of 2018

This bill modifies the requirements for the premium assistance tax credit and allows all individuals to purchase catastrophic health plans in the individual market. (Under current law, the premium assistance tax credit is provided to eligible individuals and families to subsidize the purchase of health insurance plans on an exchange established under the Patient Protection and Affordable Care Act.) The bill modifies the credit to: make the credit available for catastrophic qualified health plans and plans that are not offered through an exchange, but otherwise meet the requirements for qualified health plans; prohibit advance payments of the credit from being made for a health plan that is not enrolled in through an exchange; and prohibit the credit from being used for health plans that cover abortions (other than abortions necessary to save the life of the mother or abortions with respect to a pregnancy that is the result of an act of rape or incest). The bill also modifies the requirements for minimum essential health benefits to allow all individuals purchasing health insurance in the individual market to purchase a lower premium catastrophic plan. (The plans are currently limited to individuals who are under 30 or qualify for a hardship or affordability exemption.)

Protect Kids and Parents Act This bill requires that a child of alien parents or legal guardians who are asylum applicants must be detained in the same facility. A "child" is defined as an individual who has not reached the age of 18, has no permanent immigration status, and was in the custody and presence of a parent or legal guardian when the parent or legal guardian was detained for illegally entering the United States. The bill also: directs the Department of Justice (DOJ) to increase the total number of immigration judges and Board of Immigration staff attorneys; directs Department of Homeland Security (DHS) to increase the total number of DHS personnel who process asylum applications; requires DOJ and DHS to establish procedures for expedited consideration and processing of asylum applications; requires expedited removal of asylum applicants whose applications have been denied; establishes a strong presumption in favor of family unity; requires DHS to publish guidance for locating separated children; and requires the Government Accountability Office to study, and report on, the prosecution of asylum seekers between January 1, 2008, and December 31, 2018.

SUPPORT for Patients and Communities Act

Substance Use-Disorder Prevention that Promotes Opioid Recovery and Treatment for Patients and Communities Act or the SUPPORT for Patients and Communities Act This bill makes several changes to state Medicaid programs to address opioid and substance use disorders. Specifically, the bill: modifies provisions related to coverage for juvenile inmates and former foster care youth, establishes a demonstration project to increase provider treatment capacity for substance use disorders, requires the establishment of drug management programs for at-risk beneficiaries, establishes drug review and utilization requirements, extends the enhanced federal matching rate for expenditures regarding substance use disorder health home services, and temporarily requires coverage of medication-assisted treatment. The bill also alters Medicare requirements to address opioid use. Specifically, the bill: exempts substance use disorder telehealth services from specified requirements, requires the initial examination for new enrollees to include an opioid use disorder screening, modifies provisions regarding electronic prescriptions and post-surgical pain management, requires prescription drug plan sponsors to establish drug management programs for at-risk beneficiaries, and requires coverage for services provided by certified opioid treatment programs. The bill also addresses other opioid-related issues. Specifically, the bill: establishes and expands programs to support increased detection and monitoring of fentanyl and other synthetic opioids, and increases the maximum number of patients that health care practitioners may initially treat with medication-assisted treatment (i.e., under a buprenorphine waiver). Additionally, the bill temporarily eliminates the enhanced federal matching rate for Medicaid expenditures regarding specified medical services provided by certain managed care organizations.

Rodchenkov Anti-Doping Act of 2018 This bill prohibits certain conduct to facilitate doping fraud (i.e., the use of a performance-enhancing drug to gain an unfair competitive advantage) at a major international competition. Specifically, the bill makes it unlawful to knowingly and intentionally: participate in doping fraud; administer a performance-enhancing drug; manufacture, distribute, dispense, or possess a performance-enhancing drug with the intent to commit or attempt to commit doping fraud; or retaliate against an individual who discloses evidence of doping fraud. The bill sets forth civil remedies and criminal penalties—a fine and a prison term of up to five years—with respect to a violation.

The Department of Health and Human Services must report on the progress of states in implementing PDMPs that are consistent with such improvements.

Animal Drug and Animal Generic Drug User Fee Amendments of 2018 TITLE I--FEES RELATING TO ANIMAL DRUGS This bill addresses the authority of the Food and Drug Administration (FDA) to collect new animal drug (brand name animal drug) and generic animal drug user fees. Animal Drug User Fee Amendments of 2018 (Sec. 103) The bill amends the Federal Food, Drug, and Cosmetic Act to reauthorize through FY2023 the authority of the FDA to collect and use brand name animal drug user fees. The FDA must not collect fees for (1) supplemental applications that are submitted solely to add the animal drug application number to the label of the drug, and (2) applications for genetically engineered animals that are intended to produce human medical products. The bill revises the total amount of revenue brand name animal drug user fees can generate. The bill also revises the requirements for calculating adjustments to revenue amounts based on changes in the workload for reviewing brand name animal drug applications. (Sec. 104) The bill extends requirements for the FDA to report to Congress on achieving goals related to the animal drug development and review processes and implementation of the authority to collect brand name animal drug user fees. (Sec. 107) The bill terminates the authority of the FDA to collect brand name animal drug user fees on October 1, 2023. TITLE II--FEES RELATING TO GENERIC ANIMAL DRUGS Animal Generic Drug User Fee Amendments of 2018 (Sec. 202) The bill reauthorizes through FY2023 the authority of the FDA to collect and use generic animal drug user fees. The FDA must not collect fees for supplemental abbreviated applications that are submitted solely to add the generic animal drug application number to the label of the drug. The bill revises the total amount of revenue each type of generic animal drug user fee must generate. The bill also revises the requirements for calculating adjustments to revenue amounts based on changes in the workload for reviewing generic animal drug applications. (Sec. 203) The bill extends requirements for the FDA to report to Congress on achieving goals related to the generic animal drug development and review process and the implementation of the authority to collect generic animal drug fees. (Sec. 206) The bill terminates the authority of the FDA to collect generic animal drug user fees on October 1, 2023. TITLE III--MISCELLANEOUS PROVISIONS (Sec. 301) Brand name and generic animal drug applications must be submitted electronically beginning in FY2019. Additionally, applications for conditional approval of brand name animal drugs for minor use and minor species must be submitted electronically beginning in FY2019. (Minor use drugs are for intended uses in major species [horses, dogs, cats, cattle, pigs, turkeys, and chickens] for diseases that occur infrequently or in limited geographic areas and in only a small number of animals annually.) (Sec. 302) Product labeling for certain unapproved brand name animal drugs for minor species must include the index number in order to be marketed. (Sec. 303) The bill prohibits the sale of brand name animal drugs that do not include the FDA application number. (Sec. 304) The bill authorizes the FDA to grant conditional approval of a brand name animal drug not intended for a minor use or minor species if (1) the drug is intended to treat a serious or life-threatening disease or condition or addresses an unmet animal or human health need, and (2) the FDA determines that a demonstration of effectiveness of the drug would require a complex or particularly difficult study or studies. The FDA must issue guidance or regulations that provide further details regarding the criteria for conditional approval. The bill terminates this conditional approval authority on October 1, 2028. The Government Accountability Office must study the effects of the conditional approval pathway for brand name animal drugs. (Sec. 305) The FDA must issue guidance on how to evaluate certain elements of investigations as part of the animal drug application process, and how drug sponsors may obtain feedback from the agency on technical issues before submitting an application. (Sec. 306) The FDA must review investigations conducted in foreign countries when acting on a petition for a food additive intended for use in animal food. The FDA must also issue guidance on the voluntary pre-petition consultation process for such food additives.

Keep Young Athletes Safe Act of 2018 This bill authorizes the Department of Justice to award a grant to an eligible nonprofit nongovernmental entity to support oversight of the United States Olympic Committee, each national governing body, and each paralympic sports organization with regard to safeguarding amateur athletes against abuse. An entity receiving a grant must demonstrate that it has: (1) nationally recognized expertise in preventing and investigating emotional, physical, and sexual abuse in the athletic programs of these sports organizations; and (2) the capacity to oversee regular and random audits to ensure that their policies and procedures to prevent the abuse of amateur athletes are followed correctly.

Trickett Wendler, Frank Mongiello, Jordan McLinn, and Matthew Bellina Right to Try Act of 2018 This bill amends the Federal Food, Drug, and Cosmetic Act to exempt, from specified requirements and restrictions under that Act and other laws, the provision of certain unapproved, investigational drugs to a terminally ill patient who has exhausted approved treatment options and is unable to participate in a clinical trial involving the drugs. The manufacturer or sponsor of an eligible investigational drug must publish annual summaries on any use of the drug in accordance with these provisions. The bill limits the liability of a sponsor, manufacturer, licensed physician, clinical investigator, or hospital that provides, or declines to provide, an eligible investigational drug to an eligible patient in accordance with the bill.

United States-Israel Security Assistance Authorization Act of 2018 This bill extends Military Financing Program grants for Israel through FY2023. The Department of Defense shall conduct a joint assessment with Israel regarding: (1) precision guided munitions needed by Israel in a sustained armed confrontation with Hezbollah and other armed groups and terrorist organizations, and (2) related U.S. assistance and resupply planning. The President may utilize the Special Defense Acquisition Fund to transfer precision guided munitions and related defense articles and services to reserve stocks for Israel. Authorities for loan guarantees and the war reserves stockpile for Israel are extended through FY2023. The Department of Homeland Security shall establish a seven-year grant program with Israel to support: (1) cybersecurity research and development, and (2) commercialization of cybersecurity technology. The U.S. Agency for International Development may enter into memoranda of understanding with Israel to advance common goals on energy, agriculture and food security, democracy, economic growth, education, and health. The National Aeronautics and Space Administration (NASA) shall continue to work with the Israel Space Agency to pursue peaceful space exploration and science initiatives. The President may enter into a cooperative project agreement with Israel to carry out research and joint production of defense articles and services to detect and destroy unmanned aerial vehicles (i.e., drones) that threaten the United States or Israel. The bill states that it is U.S. policy to ensure that Israel maintains its qualitative military edge.

The President shall report to Congress regarding: foreign and domestic supply chains that significantly aid the IRGC; Iranian state-owned entities that provide support to terrorist entities, including Mahan Air; and foreign persons owned or controlled by the IRGC, including companies listed on the Tehran Stock Exchange or companies with a value in excess of $100 million. The bill states that it is U.S. policy to prevent Iran's membership in the World Trade Organization and similar international bodies as long as Iran remains a state sponsor of terrorism.
