Expresses the sense of the House of Representatives that due to the allegations of fraud, mismanagement, and abuse within the United Nations oil-for-food program Kofi Annan should resign as Secretary General of the United Nations to help restore confidence that the investigations into those allegations are being fully and independently accomplished.

Authorizes the Secretary of Veterans Affairs to: (1) work with the Secretary of the Navy in developing a site suitable for a medical facility on the grounds of the Navy Supply Corps School in Athens, Georgia; and (2) construct on that site a joint Navy-Veterans Affairs Community-Based Outpatient Clinic as called for in a strategic plan approved by the Secretary of Veterans Affairs.

Directs the Secretary of Agriculture to provide emergency financial assistance to agricultural producers who have incurred qualifying 2003 or 2004 crop losses due to weather or related conditions. Permits producers with qualifying losses in both years to elect to receive payments in either, but not both, of such years. Makes producers ineligible for crop disaster assistance if they did not: (1) get Federal crop insurance for insurable commodities; and (2) file required paperwork and pay related fees for noninsurable commodities. Sets forth: (1) waiver provisions; and (2) payment limitations, including reductions for amounts received under the Florida Disaster Programs. Directs the Secretary to provide payments to livestock producers who have incurred 2003 or 2004 losses in an emergency-designated county, with discretionary set-asides for the American Indian livestock program. Permits producers with qualifying losses in both years to elect to receive payments in either, but not both, of such years. Directs the Secretary to provide assistance to commercial orchardists and tree farmers who have suffered losses during the December 1, 2003 through December 31, 2004 period. Directs the Secretary to provide assistance to emergency conservation program participants. Amends the Food Security Act of 1985 to limit Commodity Credit Corporation amounts available for the conservation security program for FY 2005 through 2014.

Senior Elder Care Relief and Empowerment (SECURE) Act - Amends the Internal Revenue Code to allow a nonrefundable income tax credit for 50 percent of expenses exceeding $1,000 that are incurred for the care of chronically ill individuals who have attained normal retirement age (as determined under the Social Security Act). Allows the credit for certain long-term care services, respite care, or adult day care, but disqualifies expenses that are compensated by insurance or paid to a nursing facility.

Taxpayer-Teacher Protection Act of 2004 - Amends the Higher Education Act of 1965 to: (1) reduce certain special allowance payments to holders of student loans; and (2) provide for additional amounts of student loan forgiveness for certain elementary or secondary school teachers of mathematics, science, or special education.

Directs the Secretary of Defense to change the reimbursement rules and cost sharing requirements under the TRICARE program to be the same as, or as similar as possible to, the reimbursement rules and cost sharing requirements under the Blue Cross/Blue Shield Standard Plan provided under the Federal Employee Health Benefit program (FEHBP).

Cancer Care Preservation Act of 2004 - Amends title XVIII (Medicare) of the Social Security Act, as amended by the Medicare Prescription Drug, Improvement, and Modernization Act of 2003, to allow the average sales price system to go into effect but also to ensure that Medicare payments for cancer drugs do not go below 95 percent of 2004 levels in 2005, and 95 percent of 2005 levels in 2006. Amends the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 with respect to the transitional adjustment in practice expense relative value units in the physician fee schedule for drug administration services. Extends application of the transition adjustment through December 31, 2006. Increases from three percent to 27 percent during 2005 the applicable percentage of the fee schedule amount that shall be paid to a physician from the Federal Supplementary Medical Insurance Trust Fund. Reduces this applicable percentage during 2006 to 22 percent. (Current law reduces the 32 percent transitional payment for practice expenses in 2004 to 3 percent in 2005 and 0 percent in 2006.)

Constitutional Amendment - Marriage Protection Amendment - Declares that marriage in the United States shall consist only of the union of a man and a woman. Prohibits the Constitution or any State constitution from being construed to require that marital status or its legal incidents be conferred upon any union other than that of a man and a woman.

Federal Hydroelectric and Environmental Enhancement Act of 2004 - Directs the Secretary of the Interior and the Secretary of the Army to study and report to Congress on: (1) the potential for creating or increasing electric power production capability at facilities under their respective administrative jurisdiction; and (2) operational methods and water scheduling techniques to increase operational efficiencies at certain-sized hydroelectric power plants. Requires each Secretary to coordinate with the Administrator of each Federal power marketing administration in determining how the value of electric power produced by each hydroelectric power facility that produces power marketed by the administration can be optimized.

Increases the death gratuity payable with respect to members of the Armed Forces from $12,000 to $50,000. Makes this increase applicable to deaths occurring on or after September 11, 2001. Requires the Secretary of Defense to derive funds for payments under this Act in FY 2005 from travel funds for personnel of the Office of the Secretary.

Military Personnel Financial Services Protection Act - Amends the Investment Company Act of 1940 to make it unlawful, 30 days after the enactment of this Act, for: (1) any registered investment company to issue any periodic payment plan certificate; or (2) such company, or any depositor of or underwriter for such certificate, to sell such certificate. Applies any authority of a State insurance department with respect to insurers or insurance agents to activities of insurers or agents on a U.S. military installation or any Federal land or facility, except to the extent that the authority directly conflicts with any applicable authorized Federal regulation or directive. States that: (1) Congress intends for each State to implement standards to protect members of the Armed Forces, while on a military installation or any Federal land or facility, from dishonest and predatory insurance sales practices; and (2) until a State has implemented such standards, life insurance may not be sold to any member without prior disclosure that subsidized life insurance may be available from the Federal Government and the State may not license or renew the license of any entity that has violated such prohibition.

NASA and JPL 50th Anniversary Commemorative Coin Act - Directs the Secretary of the Treasury, in commemoration of the 50th anniversary of the establishment of the National Aeronautics and Space Administration (NASA) and the Jet Propulsion Laboratory (JPL) to mint and issue: (1) ten dollar gold coins; (2) five dollar gold coins; (3) one dollar silver coins; and (4) half-dollar silver coins emblematic of the 50 years of exemplary and unparalleled achievements of NASA and JPL. Directs each Federal agency and U.S. instrumentality that has in its possession any craft or any part of a craft that flew in space to: (1) retrieve any gold, silver, copper, and other precious metal that may be used in the production of any coins under this Act from such craft or part; and (2) deposit such metals with the Director of the United States Mint. Requires that all sales of coins minted under this Act include a surcharge of : (1) $75 per coin for the ten dollar coin; (2) $35 per coin for the five dollar coin; (3) $10 per coin for the one dollar coin; and (4) $3 for the half-dollar coin, which shall be paid by the Secretary to the NASA Family Assistance Fund for the purposes of providing financial assistance to the families of NASA personnel who die as a result of injuries suffered in the performance of their official duties.

Tax Simplification for Americans Act of 2004 - Amends the Internal Revenue Code to: (1) provide that an individual shall be treated as attaining an age on the date of the anniversary of such individual's birth which corresponds to such age; (2) rename "head of household" filing status as "single head of household;" and (3) increase to $100,000 (with annual inflation adjustments after 2004) the income limit for use of tax forms 1040EZ and 1040A. Repeals or amends certain expired or inoperative provisions of the Internal Revenue Code. Enacts a savings provision to prevent changes in tax liability resulting from repeals or amendments made by this Act for periods ending after enactment of this Act.

States that the House of Representatives: (1) condemns the Palestinian leadership for failing to carry out its responsibilities under the Roadmap and under other obligations it has assumed, and to bring an end to terrorist attacks directed at Israel; (2) deplores the misuse of the International Court of Justice (ICJ) for the political purpose of advancing the Palestinian position on matters Palestinian authorities have said should be the subject of negotiations, the ICJ's willingness to acquiesce in efforts that are likely to undermine its reputation and interfere with a resolution of the Palestinian-Israeli conflict, and the attempt to infringe upon Israel's right to self defense; (3) commends the President and the Secretary of State for their leadership in marshaling opposition to the misuse of the ICJ; (4) calls on members of the international community to reflect on the steps taken by the Government of Israel to mitigate the impact of the security barrier on Palestinians, including steps it has taken by order of its High Court of Justice; and (5) cautions members of the international community that they risk a strongly negative impact on their relationship with the people and Government of the United States should they use the ICJ's advisory judgment as an excuse to interfere in the Roadmap process and impede efforts to achieve progress toward a negotiated settlement.

Amends the Omnibus Parks and Public Lands Management Act of 1996 to: (1) extend to September 30, 2027, the authorization for making grants or providing assistance with respect to the National Coal Heritage Area, Tennessee Civil War Heritage Area, Augusta Canal National Heritage Area, Steel Industry Heritage Project (the Steel Industry American Heritage Area), Essex National Heritage Area, South Carolina National Heritage Corridor, America's Agricultural Heritage Partnership, Ohio & Erie Canal National Heritage Corridor (redesignated by this Act as the Ohio & Erie National Heritage Canalway), and Hudson River Valley National Heritage Area; (2) increase the total amount that may be appropriated for such areas (with the exception of the Hudson River Valley National Heritage Area); and (3) increase the amount authorized to be appropriated for such Area.

Priorities for Graduate Studies Act of 2004 - Amends the Higher Education Act of 1965 (HEA) to revise requirements and reauthorize appropriations for the following Graduate and Postsecondary Improvement Programs under title VII: (1) the Jacob K. Javits fellowship program; (2) the program of graduate assistance in areas of national need; (3) the Thurgood Marshall legal educational opportunity program; (4) the Fund for the Improvement of Postsecondary Education; and (5) demonstration projects to ensure that students with disabilities receive a quality higher education. Eliminates the Urban Community Service program and certain continuation awards.

Child Credit Preservation and Expansion Act of 2004 - Amends the Internal Revenue Code to repeal the scheduled reductions in the amount of the child tax credit for taxable years beginning in 2005 through 2009 (from $1,000 to $700 in 2005 through 2008 and $800 in 2009). Makes the $1,000 credit amount permanent. Increases the income threshold amount for calculating reductions in the credit amount to $125,000 ($250,000 for married taxpayers filing a joint return). Eliminates the reduction in the percentage of earned income for calculating the refundable portion of the credit (15 to 10 percent) for taxable years beginning before 2005. Includes in earned income for purposes of calculating the refundable portion of the credit otherwise tax excludable combat zone compensation of members of the armed forces. Exempts from the general termination date in the Economic Growth and Tax Relief Reconciliation Act of 2001 (December 31, 2010) provisions of that Act disregarding as income any refunds from the child tax credit for purposes of determining eligibility for federally funded assistance programs.

Secret Ballot Protection Act of 2004 - Amends the National Labor Relations Act to make it an unfair labor practice for: (1) an employer to recognize or bargain collectively with a labor organization that has not been selected by a majority of the employees in a secret ballot election conducted by the National Labor Relations Board; and (2) a labor organization to cause or attempt to cause an employer to recognize or bargain collectively with a representative that has not been selected in such manner. Make such amendments inapplicable to collective bargaining relationships recognized before enactment of this Act.

Improving Access to Assistive Technology for Individuals with Disabilities Act of 2004 - Amends the Assistive Technology Act of 1998 (ATA) to reauthorize and revise ATA programs, including: (1) grants to States for purchase of assistive technology (AT) devices and AT services, with an emphasis on AT needs of individuals with disabilities; (2) grants to States for protection and advocacy related to AT; and (3) national activities, including a National Public Internet Site and technical assistance.

Help Efficient, Accessible, Low Cost, Timely Healthcare (HEALTH) Act of 2004 -Sets forth provisions regulating lawsuits for health care liability claims concerning the provision of health care goods or services or any medical product affecting interstate commerce. Sets a statute of limitations of three years after the date of manifestation of injury or one year after the claimant discovers the injury, with certain exceptions. Allows the recovery of unlimited economic damages. Limits noneconomic damages to $250,000. Makes each party liable only for the amount of damages directly proportional to such party's percentage of responsibility. Allows the court to restrict the payment of attorney contingency fees. Limits the fees to a percentage based on the amount awarded. Allows: (1) any party to a lawsuit involving injury or wrongful death to introduce evidence of collateral source benefits; and (2) any opposing party to then introduce evidence of any amount paid or contributed to secure the right to such benefits. Authorizes the award of punitive damages only where: (1) it is proven that a person acted with malicious intent to injure the claimant or deliberately failed to avoid unnecessary injury the claimant was substantially certain to suffer; and (2) compensatory damages are awarded. Limits punitive damages to the greater of two times the amount of economic damages or $250,000. Limits the liability of manufacturers, distributors, suppliers, and providers of medical products that comply with Food and Drug Administration standards. Provides for periodic payments of future damage awards.

Small Business Health Fairness Act of 2004 - Amends the Employee Retirement Income Security Act of 1974 (ERISA) to provide for establishment and governance of association health plans (AHPs), which are group health plans whose sponsors are trade, industry, professional, chamber of commerce, or similar business associations, and which meet certain ERISA certification requirements. (Thus, through ERISA preemption of State laws, certified AHPs are exempted from State regulation of health insurance providers, including State consumer protection laws and State requirements for health care benefits to be offered by such entities, with certain exceptions.) Establishes rules governing AHPs, including requirements relating to certification, sponsors and boards of trustees, participation and coverage, nondiscrimination, plan documents, contribution rates, benefit options, applications for certification, notice of voluntary termination, corrective actions, and mandatory termination. Requires AHPs which provide health benefits in addition to health insurance coverage to maintain certain reserves and comply with other solvency requirements. Directs the Secretary of Labor to apply for appointment, and carry out specified duties, as trustee of any insolvent AHPs which provide health benefits in addition to health insurance coverage. Allows a State to impose a contribution tax on any AHP commencing operations in such State after the enactment of this Act. Sets forth limits on such tax, including reduction by the amount of any tax or assessment otherwise imposed by the State on specified other insurance related items maintained by the AHP. Requires AHPs to include in their summary plan descriptions, in connection with each benefit option, a description of the form of any solvency or guarantee fund protection secured under ERISA or applicable State law. Allows a certified AHP to exist in a State regardless of any State law that would preclude it. Preempts State requirements for benefits to be offered by AHPs; but allows a State in which an AHP is domiciled to require the domiciled AHP to cover particular types of diseases and conditions. Allows health insurance issuers to offer coverage of the same policy type offered in connection with a particular AHP to eligible employers, regardless of whether such employers are members of the particular association and regardless of State law. Deems health insurance coverage policy forms filed and approved in a particular State in connection with an insurer's offering under an AHP as approved in any other State in which such coverage is offered when the insurer provides a complete filing in the same form and manner to the authority in the other State. Makes inapplicable to certified AHPs certain current ERISA provisions which allow State regulation of multiple employer welfare arrangements (MEWAs). Revises ERISA preemption rules to permit State regulation of self-insured MEWAs providing medical care which do not elect to meet the certification requirements for AHPs. Directs the Secretary to report to specified congressional committees by January 1, 2009, on the effect, if any, AHPs have had on the number of uninsured individuals. Revises requirements for treatment of single employer arrangements. Allows two or more trades or businesses to be deemed a single employer if they are in the same control group offering medical care benefits, under specified conditions. Provides for enforcement of AHP requirements, including criminal penalties for certain willful misrepresentations, issuance of cease and desist orders, and the responsibility of AHP boards of trustees for certain claims procedures. Directs the Secretary, regarding the exercise of authority, to consult only with the recognized primary domicile State for an AHP. Provides for transitional and other rules relating to treatment of certain existing health benefit programs.

Expresses the sense of the House of Representatives (House) that: (1) it is in the interests of the United States to immediately resolve long-standing military mail delivery problems so that our troops can receive mail from home and are not disenfranchised in the 2004 election; (2) the Secretary of Defense should establish a system that expedites the delivery of election ballots to members and accurately tracks military postal transit times; and (3) the House stands ready to assist in resolving these issues.

Amends Federal provisions concerning the National Guard Challenge Program (a civilian youth opportunities program conducted by the Secretary of Defense) to: (1) provide a maximum Federal matching funds level of 65 percent of the costs of operating the State program during FY 2005, 70 percent during FY 2006, and 75 percent for FY 2007 and beyond; (2) authorize appropriations for the Program for FY 2005; and (3) rename it the National Guard Youth Challenge Program.

Amends the Internal Revenue Code to permanently extend: (1) the increased standard deduction for married taxpayers filing joint returns or for surviving spouses (twice the deduction for single taxpayers); and (2) the increase in the taxable income level for qualifying married taxpayers filing joint returns or surviving spouses for the 15-percent tax bracket. Provides that the general terminating date under the Economic Growth and Tax Relief Reconciliation Act of 2001 (December 31, 2010) shall not apply to the extensions provided by this Act.

Carlie's Law - Amends the Federal criminal code to provide for mandatory revocation of probation and supervised release for anyone who commits: (1) a felony crime of violence; or (2) a crime of violence against, or an offense that consists of or is intended to facilitate unlawful sexual contact with, a person under age 16. Amends the Prosecutorial Remedies and Other Tools to end the Exploitation of Children Today (PROTECT) Act of 2003 to require a State, to be eligible for a grant for changeable message signs or other information systems to notify motorists about abductions of children, to certify that it will make a good faith effort to notify any non-custodial parent of a minor residing in the State if: (1) the minor is the victim of a crime of violence or sexual abuse; or (2) the custodial parent of the minor is charged with a drug offense, rape, or crime of violence or sexual abuse.

American Bald Eagle Recovery and National Emblem Commemorative Coin Act - Directs the Secretary of the Treasury, in celebration of the recovery of the bald eagle, in commemoration of the 35th anniversary of the enactment of the Endangered Species Act of 1973, and the placement of the bald eagle on the endangered species list under such Act, to mint and issue not more than: (1) 100,000 $5 gold coins; (2) 500,000 $1 silver coins; and (3) 750,000 half dollar coins. Directs that the design of the coins be emblematic of the bald eagle and its history, natural biology, and national symbolism. Requires that sales of the coins include a surcharge of $35 per coin for the $5 coin, $10 for the $1 coin, and $3 for the half dollar coin, which shall be promptly paid by the Secretary to the American Eagle Foundation of Tennessee to: (1) establish an interest-bearing endowment called the American Eagle Fund as a permanent source of support for the care, monitoring, maintenance, and recovery of the bald eagle and its habitat in the United States; (2) make annual grants to Federal, State, and private eagle restoration, protection, and enhancement projects; (3) administer the Fund in an annual amount not to exceed the lesser of ten percent of the annual income of the Fund or $250,000; and (4) provide financial support for capital projects and for continuation and expansion of the Foundation's efforts to educate the American people about the bald eagle.

Simple Tax for Seniors Act - Allows eligible seniors (or their spouses in the case of a joint return) with Social Security and pension income to use new Form 1040SR (similar to Form 1040EZ) to file their Federal income tax returns without regard to the amount of their taxable interest or other taxable income.

States that Congress: (1) condemns the Government of the Republic of Sudan for its attacks on innocent civilians in the Darfur region of Sudan and demands their cessation; (2) calls on the international community to condemn such attacks and demand their cessation; and (3) urges the President to direct the United States representative to the United Nations to seek an official investigation into whether Sudan has committed crimes against humanity in Darfur.

Federal Contractor Security Act - Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to require the following Federal service contractors to participate in a pilot program for employment eligibility confirmation: (1) those contractors required to pay at least minimum wage; and (2) those contractors exempted from the requirements of the Service Contract Act of 1965.

Fair and Equitable Tobacco Reform Act of 2004 - Amends, and repeals, specified agricultural Acts to eliminate tobacco quota and price support programs. Provides for: (1) transitional payments (funded by appropriations made by this Act) to tobacco quota holders and active producers of quota tobacco; (2) geographic restrictions on tobacco expansion through penalties for tobacco grown outside traditional tobacco counties; and (3) county committee resolution of payment disputes.

Pell Grants Plus Act - Amends the Higher Education Act of 1965 (HEA) to direct the Secretary of Education to establish a program to award Pell Grants Plus grants to students who: (1) have completed a rigorous secondary school program for State Scholars; (2) are enrolled full-time in their first year of undergraduate education; and (3) are eligible to receive Federal Pell Grants for that year. Sets such Plus grant award at $1,000. Provides for a continuation award for the second year of undergraduate education if the student maintains compliance with certain eligibility requirements and obtains a grade point average of at least 3.0 for the first year. Repeals HEA provisions for Academic Achievement Incentive Scholarships.

States that Congress: (1) condemns the detention of Father Thaddeus Nguyen Van Ly by the Government of the Socialist Republic of Vietnam and calls for his immediate and unconditional release; (2) condemns the violations of freedom of speech, religion, movement, association, and the lack of due process afforded to individuals in Vietnam; and (3) urges the Government of Vietnam to consider the implications of its actions for the broader relationship with the United States, including the United States-Vietnam Bilateral Trade Agreement. Expresses the sense of Congress that the United States should: (1) make the immediate release of Father Ly a top concern; (2) reiterate its deep concern regarding the violation of Father Ly's and other prisoners' human rights, and continue to urge the Government of Vietnam to comply with international standards for freedom and human rights; and (3) make it clear to the Government of Vietnam that the detention and human rights violations of Father Ly and other persons create obstacles to improved bilateral relations with the United States.

Declares that Congress: (1) supports Israel's construction of a security fence to prevent Palestinian terrorist attacks; and (2) condemns the United Nations General Assembly's decision to request the International Court of Justice to render an opinion on the legality of the fence.
