Larry Doby Congressional Gold Medal Act This bill directs the Speaker of the House of Representatives and the President pro tempore of the Senate to arrange for the presentation of a Congressional Gold Medal in honor of Larry Doby in recognition of his achievements and contributions to American major league athletics, civil rights, and the Armed Forces during World War II.

Allow States and Victims to Fight Online Sex Trafficking Act of 2017 This bill amends the Communications Act of 1934 to specify that communications decency provisions protecting providers or users of interactive computer services from liability for the private blocking or screening of offensive material shall not be construed to impair the enforcement of, or limit availability of victim restitution or civil remedies under, state or federal criminal or civil laws relating to sexual exploitation of children or sex trafficking. The bill amends the federal criminal code to specify that the violation for benefiting from "participation in a venture" engaged in sex trafficking of children, or by force, fraud, or coercion, includes knowing or reckless conduct by any person or entity and by any means that furthers or in any way aids or abets the violation. A provider of an interactive computer service that publishes information provided by an information content provider with reckless disregard that the information is in furtherance of a sex trafficking offense shall be subject to a criminal fine or imprisonment for not more than 20 years.

Sets forth the rule for consideration of the bill (H.R. 1304) to amend the Employee Retirement Income Security Act of 1974, the Public Health Service Act, and the Internal Revenue Code of 1986 to exclude from the definition of health insurance coverage certain medical stop-loss insurance obtained by certain plan sponsors of group health plans.

Comprehensive Fentanyl Control Act This bill amends the Controlled Substances Act to modify the drug quantity thresholds that trigger a mandatory minimum prison term for a defendant who manufactures, distributes, or possesses with intent to distribute fentanyl. It also establishes a consecutive mandatory prison term for a defendant who commits a drug offense involving a detectable amount of heroin or fentanyl. The bill establishes a rebuttable presumption that the illegal manufacture of a controlled substance that contains a detectable amount of heroin or fentanyl creates a substantial risk of harm to human life. The Drug Enforcement Administration may temporarily place a drug or substance into schedule I based on a finding: (1) that the drug or substance satisfies the criteria for being a synthetic opioid, and (2) that adding it will prevent abuse or misuse. The bill makes it a crime to knowingly mail to an unauthorized person equipment that may be used to manufacture counterfeit controlled substances. A violator is subject to criminal penalties. Finally, it makes it a crime to import, export, manufacture, distribute, dispense, or possess with intent to manufacture, distribute, or dispense, a synthetic opioid that is not clearly labeled. A violator is subject to criminal and civil penalties.

Combating Anti-Semitism Act of 2017 This bill amends the federal criminal code to modify prohibitions with respect to intentionally defacing, damaging, or destroying religious real property. Specifically, the bill broadens the scope of prohibited conduct to also criminalize threats to deface, damage, or destroy religious real property. Additionally, it establishes a criminal penalty—a fine, a prison term of up to five years, or both—for a violation that results in damage or destruction to religious property. Finally, the bill broadens the definition of "religious real property" to include real property owned or leased by a nonprofit, religiously affiliated organization.

Farmers Undertake Environmental Land Stewardship Act or the FUELS Act This bill amends the Water Resources Reform and Development Act of 2014 to require the Environmental Protection Agency, in implementing the Spill Prevention, Control, and Countermeasure rule (concerning oil pollution prevention) with respect to any farm, to: require certification by a professional engineer for a farm with an aggregate aboveground storage capacity of more than 42,000 gallons (currently, 20,000 gallons); allow self-certification by the owner or operator of a farm with an aggregate aboveground storage capacity of more than 10,000 gallons but less than 42,000 gallons (currently, of less than 20,000 gallons and more than the lesser of 6,000 gallons and the adjustment quantity established under such Act); and not require compliance with the rule by any farm with an aggregate aboveground storage capacity of 10,000 gallons or less (currently, of more than 2,500 gallons and less than the lesser of 6,000 gallons and such adjustment quantity). The rule shall apply to aboveground storage containers at farms on a separate parcel that have an individual capacity of not more than 1,320 gallons (currently, 1,000 gallons) and an aggregate capacity of not more than 3,000 gallons (currently, 2,500 gallons).

Israel Anti-Boycott Act This bill declares that Congress: (1) opposes the United Nations Human Rights Council resolution of March 24, 2016, which urges countries to pressure companies to divest from, or break contracts with, Israel; and (2) encourages full implementation of the United States-Israel Strategic Partnership Act of 2014 through enhanced, governmentwide, coordinated U.S.-Israel scientific and technological cooperation in civilian areas. The bill amends the Export Administration Act of 1979 to declare that it shall be U.S. policy to oppose: requests by foreign countries to impose restrictive practices or boycotts against other countries friendly to the United States or against U.S. persons; and restrictive trade practices or boycotts fostered or imposed by an international governmental organization, or requests to impose such practices or boycotts, against Israel. The bill prohibits any U.S. person engaged interstate or foreign commerce from supporting: any request by a foreign country to impose any boycott against a country that is friendly to the United States and that is not itself the object of any form of boycott pursuant to United States law or regulation, or any boycott fostered or imposed by any international governmental organization against Israel or any request by any international governmental organization to impose such a boycott. The bill amends the Export-Import Bank Act of 1945 to include as a reason for the Export-Import Bank to deny credit applications for the export of goods and services between the United States and foreign countries, opposition to policies and actions that are politically motivated and are intended to penalize or otherwise limit commercial relations specifically with citizens or residents of Israel, entities organized under the laws of Israel, or the government of Israel.

Preserving Access to Manufactured Housing Act of 2017 This bill amends the Truth in Lending Act (TILA) to specify that a retailer of manufactured housing is generally not a "mortgage originator" subject to requirements under that Act. Similarly, the bill amends the Secure and Fair Enforcement for Mortgage Licensing Act of 2008 to specify that such a retailer is generally not a "loan originator" subject to requirements under that Act. In addition, the bill increases the annual percentage rates and transaction values at which mortgages for certain dwellings are considered "high-cost mortgages" under TILA.

Iran Ballistic Missiles and International Sanctions Enforcement Act This bill states that it is U.S. policy to prevent Iran from undertaking any activity related to nuclear-capable ballistic missiles. The President shall report to Congress regarding the foreign and domestic supply chain in Iran that supports Iran's ballistic missile program. The report shall identify individuals and companies involved in such activities. The President shall submit to Congress a determination of whether any Iranian ballistic missile test violates United Nations Security Council Resolution 2231. Such resolution endorses the Joint Comprehensive Plan of Action and sets out a mechanism to monitor Iranian compliance. The President shall impose sanctions against: (1) Iranian government agencies involved in ballistic missile development; (2) foreign entities that supply material for, or otherwise facilitate or finance, such efforts; (3) foreign persons or foreign government agencies that import, export, or re-export prohibited arms or related material to or from Iran; and (4) foreign persons or entities that transfer goods or technologies contributing to Iran's ability to acquire or develop ballistic missiles, including launch technology, and destabilizing numbers and types of advanced conventional weapons. The President shall investigate potential violations of ballistic missile and conventional weapons sanctions against Iran. The President shall report to Congress regarding credible information about Iran's violations of arms restrictions and attempts to pursue sanctionable activities.

Caesar Syria Civilian Protection Act of 2017 This bill declares that it is U.S. policy to use all diplomatic and economic means to compel the government of Bashar al-Assad to halt the slaughter of the Syrian people and work toward a democratic government. The President shall prohibit, or impose conditions on, the opening or maintaining in the United States of a correspondent account or payable-through account by any domestic financial institution or domestic financial agency for or on behalf of the Central Bank of Syria that is of primary money laundering concern. The bill directs the President to impose specified entry and U.S.-based property sanctions against a foreign person that knowingly: (1) provided significant financial or material support to Syria, the Central Bank of Syria, or to a foreign person subject to specified sanctions; (2) supported Syria's domestic production of natural gas or petroleum; (3) sold or provided civilian aircraft or spare parts or other significant goods or services to a foreign person operating in Syria's shipping, transportation, or telecommunications sectors; or (4) financed money laundering activities. The President shall impose specified entry and U.S.-based property sanctions against a foreign person that has knowingly provided support to Syria to acquire or develop ballistic missiles, chemical, biological or nuclear weapons, or advanced conventional weapons. The Syria Human Rights Accountability Act of 2012 is amended to direct the President to impose entry and U.S.-based property sanctions against persons responsible for: (1) committing serious human rights abuses against Syrian citizens or their family members, or (2) transferring to Syria certain military items or goods or technologies that may be used to commit human rights abuses. The President shall submit and update a list of, and impose entry and U.S.-based property sanctions against, persons responsible for hindering access to humanitarian relief activities in Syria. The President shall report with respect to whether each of specified Syrian persons, including Bashar al Assad, meets the requirements for inclusion on the list of persons who are responsible for certain human rights abuses against Syrian citizens. The President may: (1) provide assistance to advance a comprehensive relief and recovery strategy in Syria, and (2) suspend sanctions against Syria under specified conditions.

National Purple Heart Hall of Honor Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half-dollar clad coins emblematic of the National Purple Heart Hall of Honor. The bill limits the issuance of such coins to the one-year period beginning on January 1, 2020. The bill prescribes surcharges for coin sales, which shall be paid to the National Purple Heart Hall of Honor, Inc., to help finance the construction of a new building and renovation of existing National Purple Heart Hall of Honor facilities.

Certainty in Enforcement Act of 2017 This bill amends equal employment opportunity requirements under the Civil Rights Act of 1964 to deem an employer's, labor organization's, employment agency's, or joint labor management committee's consideration or use of credit or criminal records or information, as mandated by federal, state, or local law, to be job related and consistent with business necessity. The use of credit or criminal records shall not be the basis of liability under any theory of disparate impact. (Currently, an unlawful employment practice based on disparate impact is established if a complaining party demonstrates that a respondent uses a particular employment practice that causes a disparate impact on the basis of race, color, religion, sex, or national origin and the respondent fails to demonstrate that the challenged practice is job related for the position in question and consistent with business necessity.)

Commission to Study the Creation of a National Museum of Irish American History This bill establishes a commission to study the potential for creating a National Museum of Irish American History. The commission shall report to the President and Congress on: its recommendations for a plan of action for the establishment of the museum in Washington, DC; the availability and cost of the collections to be acquired and housed; the impact of the museum on regional Irish-American-related museums; whether the museum should be located within the Smithsonian Institution; the governance and organizational structure of the museum; how to engage the Irish-American community in the museum's development and design; and the cost of constructing, operating, and maintaining the museum. The commission shall: (1) develop and obtain an independent review of a fund-raising plan to support the museum through public contributions, and (2) submit recommendations for a legislative plan of action for the creation and construction of the museum. The commission may host a national conference on the museum for individuals who are committed to the advancement of Irish-American life, art, history, and culture.

Fair and Open Competition Act or FOCA Act This bill prohibits a federal executive agency that awards any construction contract after the enactment of this bill from requiring or prohibiting a contract bidder from entering into agreements with labor organizations (i.e., Project Labor Agreements [PLAs]) or otherwise discriminating against a bidder or contractor who signs, or refuses to sign, a PLA. Agencies that award grants, provide financial assistance, or enter into cooperative agreements for construction projects after the enactment of this bill must ensure that the bid specifications, project agreements, or other controlling documents for such projects do not contain any requirements or prohibitions relating to PLAs. An agency may exempt a particular project or grant from the prohibition of this bill if it determines that special circumstances exist requiring an exemption to avert an imminent threat to public health or safety or to serve the national security.

This bill amends the Internal Revenue Code, with respect to the tax credit for the production of electricity from advanced nuclear power facilities, to: (1) establish requirements for the allocation of unutilized portions of the national megawatt capacity limitation, and (2) allow public entities to transfer the credit to project partners. If a portion of the 6,000 national megawatt capacity limitation for the credit is unutilized after December 31, 2020, the Internal Revenue Service must allocate the unutilized capacity: (1) first to facilities that were placed in service on or before December 31, 2020, and did not receive an allocation equal to their full nameplate capacity, and (2) then to facilities placed in service after December 31, 2020, in the order in which the facilities are placed in service. The placed-in-service sunset date of January 1, 2021, does not apply to the allocations of unutilized national megawatt capacity. Qualified public entities may transfer the credit to an eligible project partner. A "qualified public entity" is: (1) a federal, state, or local government or any political subdivision, agency, or instrumentality thereof; (2) a mutual or cooperative electric company; or (3) a not-for-profit electric utility which has or had received a loan or loan guarantee under the Rural Electrification Act of 1936. An "eligible project partner" includes any person who: (1) is responsible for, or is participating in, the design or construction of the facility; (2) participates in the provision of nuclear steam or nuclear fuel to the facility, or (3) has an ownership interest in the facility.

Making Online Banking Initiation Legal and Easy Act of 2017 or the MOBILE Act of 2017 This bill authorizes a financial institution, with an individual's consent, to record personal information from a swipe or copy of an individual's driver's license or personal identification card and store the information electronically for the purpose of verifying the authenticity of the driver's license or identification card, verifying the identity of the individual, or complying with legal requirements. Financial institutions must not sell, rent, transfer, or make such information available to another person, other than an affiliate.

Flexible Pell Grant for 21st Century Students Act This bill amends title IV (Student Assistance) of the Higher Education Act of 1965 to allow an eligible student to receive more than one Federal Pell Grant award in a single award year. An eligible student is a student who: (1) has already received a Pell Grant during an award year and is enrolled in an eligible program for one or more additional payment periods (e.g., a summer term) during the same award year, (2) continues to meet Pell Grant program eligibility requirements, and (3) is accelerating progress toward a degree or certificate. An eligible student's total Pell Grant amount must not exceed 150% of the annual maximum Pell Grant for that award year. An institution must notify a student that any period of additional Pell Grant receipt counts toward that student's lifetime Pell Grant eligibility period (currently 12 full-time semesters). If an additional Pell Grant spans two award years, then an institution must determine the award year to which such Pell Grant applies. The Department of Education must provide to each Pell Grant recipient an annual status report that includes certain information related to such student's remaining lifetime Pell Grant eligibility period.

Repeal Sequestration for Defense Act This bill amends the Balanced Budget and Emergency Deficit Control Act of 1985 to eliminate the sequestration for security and defense spending. (Sequestration is a process of automatic, usually across-the-board spending reductions under which budgetary resources are permanently cancelled to enforce specific budget policy goals.)

Timber Innovation Act of 2017 This bill directs the Department of Agriculture (USDA), acting through the Research and Development and the State and Private Forestry deputy areas of the Forest Service, to conduct performance-driven research and development, education, and technical assistance to facilitate the use of innovative wood products in wood building construction in the United States. Such activities shall give priority to: (1) improving the commercialization of such products, (2) analyzing the safety of tall wood building materials, (3) calculating and reducing the life cycle environmental footprint of tall wood building construction, and (4) analyzing the potential implications of the use of innovative wood products in building construction on wildlife. "Tall wood building" means a building designed to be over 85 feet high and constructed with large panelized wood construction, including cross-laminated timber, nail laminated timber, glue laminated timber, laminated strand lumber, and laminated veneer lumber. USDA shall carry out an annual competition for FY2017-FY2021 for a tall wood building design, or other innovative wood product demonstration, in accordance with the requirements for prize competitions carried out under the Stevenson-Wydler Technology Innovation Act of 1980. The Forest Service, in carrying out a wood innovation grant program, may make grants to advance the use of innovative wood products, with priority to grant proposals that include the use or retrofitting of existing sawmill facilities in counties where the average annual unemployment rate exceeded the national average by more than 1% in the previous year.

Give Our Fishermen Immediate Snapper Help Act or the GOFISH Act This bill establishes requirements and restrictions for the 2017 and 2018 red snapper fishing seasons in the Gulf of Mexico. The recreational season shall begin on July 1 of each year and last for 62 consecutive days. The bill also sets forth red snapper allocation and season duration requirements for the commercial and charter fishing sectors. The catch and size limits for all three sectors shall be no less than the limits that applied to each sector for the 2016 fishing season. Additionally, the National Marine Fisheries Service shall issue a proposed rule for the 2017 and 2018 red snapper fishing seasons.

RFS Reform Act of 2017 This bill amends the Clean Air Act to revise the renewable fuel standard program. Beginning in 2017, the renewable fuel that is required to be blended into gasoline must be advanced biofuel, which cannot be ethanol derived from corn starch. This bill revises the renewable fuel standards by decreasing the total volume of renewable fuel that must be contained in gasoline sold or introduced into commerce for years 2017 through 2022. The Environmental Protection Agency (EPA) must determine the target amount of cellulosic biofuel to be blended into transportation fuel based on the actual volume of cellulosic biofuel produced in the current year. The EPA must reduce the required volume of renewable fuel in transportation fuel by the same volume of cellulosic biofuel in the fuel. The EPA may not allow gasoline containing greater than 10% ethanol by volume to be introduced into commerce. Waivers that allow gasoline containing a greater percentage of ethanol are nullified.

Renewable Fuel Standard Elimination Act This bill amends the Clean Air Act to repeal the Environmental Protection Agency's renewable fuel program, which requires transportation fuel to contain a minimum volume of renewable fuel.

Servicemember Retirement Improvement Act This bill amends the Internal Revenue Code to allow members of the Ready Reserve of a reserve component of the Armed Forces to make the maximum allowable contribution ($18,000 in 2017) to their Thrift Savings Plans (TSPs) without limiting the amount such members may contribute to a retirement plan based upon other employment. The bill also doubles the maximum allowable contribution amount to the TSPs of federal employees in the Ready Reserve who are not eligible to make contributions to any plan other than the TSP.

CT Colonography Screening for Colorectal Cancer Act of 2017 This bill amends title XVIII (Medicare) of the Social Security Act to: (1) provide Medicare coverage for screening computed tomography colonography (CTC) as a colorectal cancer screening test, and (2) exclude screening CTC from a special Medicare payment rule applicable to certain imaging services.

VA Accountability First Act of 2017 This bill authorizes the Department of Veterans Affairs (VA) to remove, demote by a reduction in grade and pay, or suspend a VA employee, including a member in a senior executive position, for reasons of performance or misconduct. The bill prescribes VA removal and employee appeals procedures. Whistle-blower protections are revised, including by prohibiting VA from taking any such action against a person who has a pending whistle-blower complaint. This bill provides for the reduction of federal annuities of VA employees and retirees convicted of a felony that influenced their performance while employed in such position. The VA may recoup certain bonuses, awards, and reallocation expenses. The VA may directly appoint qualifying individuals to the positions of Medical Center Director and Director of Veterans Integrated Service Network. The bill revises time periods for adverse action reviews with respect to physicians, dentists, podiatrists, chiropractors, optometrists, registered nurses, physician assistants, and expanded-function dental auxiliaries.

Federal Regulatory Certainty for Water Act This bill nullifies the Environmental Protection Agency's Clean Water Rule signed on May 27, 2015, which describes the scope of the Federal Water Pollution Control Act (commonly known as the Clean Water Act). Under this bill, the Clean Water Act applies to waters of the United States that are: (1) navigable-in-fact; or (2) permanent or continuously flowing bodies of water that form geographical features commonly known as streams, oceans, rivers, and lakes that are connected to waters that are navigable-in-fact. Under this bill, the Act does not apply to: (1) waters that do not physically abut those waters of the United States through an actual and continuous surface water connection; (2) man-made or natural structures or channels through which water flows intermittently or ephemerally; or (3) wetlands (including playa lakes, prairie potholes, wet meadows, wet prairies, and vernal pools) that lack that continuous surface water connection. The aggregation of wetlands or waters may not be used to determine whether the wetlands or waters are navigable waters.

Naismith Memorial Basketball Hall of Fame Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 50,000 $5 coins, 400,000 $1 coins, and 750,000 half-dollar coins in recognition and celebration of the Naismith Memorial Basketball Hall of Fame. The coins shall be in the shape of a dome, and the design on the common reverse of the coins shall depict a basketball. Treasury shall hold a competition to determine the design of the common obverse of the coins, which shall be emblematic of the game of basketball. The bill requires all sales of such coins to include specified surcharges, which shall be paid by Treasury to the Hall to fund an endowment for increased operations and educational programming.

Burial Rights for America's Veterans' Efforts Act of 2017 or the BRAVE Act of 2017 This bill increases the amounts payable through the Department of Veterans Affairs (VA) for: (1) burial and funeral expenses of certain veterans, and (2) such expenses in connection with a veteran's death due to a service-connected disability. The VA shall increase such amounts each fiscal year by the percentage increase in the Consumer Price Index.

Reducing Barriers for Veterans Education Act of 2017 This bill makes an individual who is eligible for educational assistance under the Post-9/11 Educational Assistance program eligible for assistance with the fees for applying to institutions of higher education (IHEs). The amount of such assistance payable to an individual shall be the lesser of: (1) the total application fees charged to the individual by the IHEs, or (2) $750.

Social Security Fairness Act of 2017 This bill amends title II (Old Age, Survivors, and Disability Insurance) (OASDI) of the Social Security Act to repeal the "government pension offset" and the "windfall elimination provision." Under current law, those provisions reduce OASDI benefits for individuals who receive a pension based on earnings in government employment that was not covered under the Social Security program.

Collegiate Housing and Infrastructure Act of 201 7 This bill amends the Internal Revenue Code to allow tax-exempt charitable or educational organizations to make collegiate housing and infrastructure grants to certain tax-exempt social clubs (e.g., college fraternities and sororities) which apply such grants to their collegiate housing property. A "collegiate housing and infrastructure grant" is a grant to provide, improve, operate, or maintain collegiate housing property that may involve more than incidental social, recreational, or private purposes. The grant must be for purposes that would be permissible for a dormitory or other residential facility of the college or university with which the collegiate housing property is associated. The grant may not be used to provide physical fitness facilities.

No Hero Left Untreated Act This bill requires the Department of Veterans Affairs (VA) to carry out a one-year pilot program to provide access to magnetic EEG/EKG-guided resonance therapy to treat veterans suffering from post-traumatic stress disorder, traumatic brain injury, military sexual trauma, chronic pain, or opiate addiction. The VA shall: (1) carry out the program at up to two VA facilities, and (2) provide access to such therapy to more than 50 veterans.

Taylor Force Act This bill prohibits certain assistance under the Foreign Assistance Act of 1961 from being made available for the West Bank and Gaza unless the Department of State certifies that the Palestinian Authority: is taking steps to end acts of violence against U.S. and Israeli citizens perpetrated by individuals under its jurisdictional control, such as the March 2016 attack that killed former Army officer Taylor Force; is publicly condemning such acts of violence and is investigating, or cooperating in investigations of, such acts; and has terminated payments for acts of terrorism against U.S. and Israeli citizens to any individual who has been convicted and imprisoned for such acts, to any individual who died committing such acts, and to family members of such an individual.

Furthering Access to Stroke Telemedicine Act of 2017 or the FAST Act of 2017 This bill specifies that, under Medicare, telehealth services include telehealth-eligible stroke services provided to an individual soon after the onset of acute-stroke symptoms. Certain originating-site requirements applicable to telehealth services under Medicare shall not apply with respect to such stroke services.

Working Families Flexibility Act of 2017 This bill amends the Fair Labor Standards Act of 1938 to authorize employers to provide compensatory time off to private employees at a rate of not less than 1 1/2 hours for each hour of employment for which overtime compensation is required, but only if it is in accordance with an applicable collective bargaining agreement or, in the absence of such an agreement, an agreement between the employer and employee. The bill prohibits an employee from accruing more than 160 hours of compensatory time. An employer must provide monetary compensation for any unused compensatory time off accrued during the preceding year. The bill requires an employer to give employees 30-day notice before discontinuing compensatory time off. The bill prohibits an employer from intimidating, threatening, or coercing an employee in order to: (1) interfere with the employee's right to request or not to request compensatory time off in lieu of payment of monetary overtime compensation, or (2) require an employee to use such compensatory time. The bill makes an employer who violates such requirements liable to the affected employee in the amount of the compensation rate for each hour of compensatory time accrued, plus an additional equal amount as liquidated damages, reduced for each hour of compensatory time used.

Small Business Health Fairness Act of 2017 This bill amends the Employee Retirement Income Security Act of 1974 (ERISA) to provide for the establishment and governance of association health plans (AHPs), which are group health plans sponsored by business associations. The bill establishes requirements for AHPs relating to certification, sponsors and boards of trustees, participation and coverage, nondiscrimination, contribution rates, and voluntary termination. AHPs offering benefits that are not health insurance must: (1) establish and maintain sufficient reserves and stop-loss insurance to cover those benefits, and (2) make annual payments to a fund to be used to pay for stop-loss insurance for such AHPs for which there is a reasonable expectation that claims would not be satisfied without such insurance. AHPs that fail to meet these requirements are subject to termination. The Department of Labor must establish a Solvency Standards Working Group. States may tax contributions to AHPs, with certain conditions. The bill preempts state laws that preclude health insurers from: (1) offering health insurance in connection with a certified AHP; or (2) offering health insurance of the same policy type to other employers in the state that are eligible for coverage under AHPs. The bill establishes criminal penalties for willfully making false representations regarding an AHP.

Shauna Hill Post 9/11 Education Benefits Transferability Act This bill authorizes the reassignment a veteran's or Armed Forces member's Post-9/11 education benefits to another eligible dependent in cases where the original designated beneficiary dies without having used all of such benefits. Such provision shall apply to deaths occurring on or after August 1, 2009.

Fair Medicare Hospital Payments Act of 2017 This bill amends title XVIII (Medicare) of the Social Security Act to establish, with respect to hospitals not located in a frontier state, a floor on the area wage adjustment factor for hospital inpatient and outpatient services covered under Medicare. (Such a floor already applies with respect to hospitals located in frontier states.)

Commercial Vessel Incidental Discharge Act This bill requires the U.S. Coast Guard to: (1) address the regulation of discharges incidental to the normal operation of a commercial vessel into navigable waters, including ballast water discharges; and (2) preempt applicable state laws and federal regulations issued under the Federal Water Pollution Control Act (commonly known as the Clean Water Act). Ballast water is water and suspended matter taken on board a commercial vessel to control or maintain trim, draught, stability, or stresses of the commercial vessel. This bill requires commercial vessels to meet ballast water discharge standards established by the Coast Guard. By 2022, the Coast Guard must complete an effectiveness review to determine whether revising ballast water discharge standards will result in reducing the risk of introducing or establishing aquatic nuisance species. Further revisions to the standards must be considered every 10 years. If the standard would result in reducing the risk of introducing or establishing aquatic nuisance species, then the Coast Guard must conduct a practicability review to determine whether: (1) a ballast water management system that is capable of achieving the proposed standard is economically achievable and operationally practicable, and (2) testing protocols can accurately measure compliance. The Coast Guard must revise the standard if it meets practicability criteria. The Coast Guard must also issue rules establishing: (1) reasonable and practicable standards for reception facilities to mitigate adverse effects of aquatic nuisance species on navigable waters, and (2) best management practices for certain discharges for commercial vessels that are at least 79 feet in length and are not fishing vessels.

FDA Deeming Authority Clarification Act of 2017 This bill amends the Federal Food, Drug, and Cosmetic Act (FFDCA) to: (1) revise premarket review and reporting requirements for products newly deemed by the Food and Drug Administration (FDA) to be tobacco products; and (2) grant the FDA the authority to regulate vapor products, which include products that produce vapor with nicotine (e.g., e-cigarettes) and nicotine intended to be used with such a product (e.g., nicotine cartridges). A product is not subject to premarket review by the FDA if it is marketed before it is deemed a tobacco product. The bill delays deadlines for reports to the FDA on products similar to a marketed product that are introduced to market less than 21 months after that type of product is deemed a tobacco product. The bill grants the FDA regulatory authority over vapor products that is in addition to the FDA's existing authority to regulate vapor products as tobacco products. Provisions of the FFDCA applicable to tobacco product components also apply to vapor product batteries. The FDA must establish standards for vapor product batteries. Vapor products first marketed not later than 24 months after enactment of this bill are not subject to premarket review or reporting requirements based on changes to the product's battery to conform to standards. Vapor products may not be advertised in publications, except publications with adult readership. Vapor products may be sold only face-to-face, through vending machines in facilities where only adults are permitted, or by mail order. Vapor products must be labeled with their nicotine content and specified phrases. Retailers of vapor products must register with the FDA.

Workforce Development Tax Credit Act of 201 7 This bill amends the Internal Revenue Code to allow a business-related tax credit for: (1) 50% of wages (up to $2,000) paid to an apprenticeship employee during an apprenticeship period, and (2) 40% of wages (up to $6,000) paid to such an employee during a post-apprenticeship period. The bill defines "apprenticeship employee" as any employee employed by an employer pursuant to an apprentice agreement registered with the Office of Apprenticeship of the Employment and Training Administration of the Department of Labor or a recognized state apprenticeship agency.

Historic Tax Credit Improvement Act of 201 7 This bill amends the Internal Revenue Code, with respect to the tax credit for the rehabilitation of buildings and historic structures, to: (1) allow an increased 30% credit, up to $750,000, for projects with rehabilitation expenditures not exceeding $3.75 million, for which no credit was allowed in either of the two prior taxable years (smaller projects); (2) allow the transfer of tax credit amounts for smaller projects; (3) treat a building as substantially rehabilitated if rehabilitation expenditures exceed the greater of 50% of the adjusted basis of the building or $5,000 (currently, the greater of the adjusted basis of the building or $5,000); (4) reduce the required basis adjustment from 100% of the credit to 50% of the amount of the credit; and (5) limit the application of disqualified lease rules to tax-exempt use property.

HBCU Capital Financing Improvement Act This bill amends title III (Institutional Aid) of the Higher Education Act of 1965 to modify the HBCU Capital Financing Program. (The program guarantees low-cost private loans to historically black colleges and universities [HBCUs] to finance infrastructure repairs, maintenance, and construction.) It replaces statutory references to "escrow account" with "bond insurance fund." The bill authorizes the Department of Education to provide financial counseling that prepares an eligible HBCU to qualify for, apply for, and maintain a capital improvement loan. It revises and expands reporting requirements for the HBCU Capital Financing Advisory Board.
