Whole Milk for Healthy Kids Act of 2023 This bill revises requirements for milk provided by the National School Lunch Program of the Department of Agriculture (USDA). Currently, schools participating in the program must provide milk that is consistent with the most recent Dietary Guidelines for Americans; USDA regulations require milk to be fat-free or low-fat and allow milk to be flavored or unflavored. The bill modifies these restrictions and instead permits schools to offer students whole, reduced-fat, low-fat, and fat-free flavored and unflavored milk. In addition, schools currently participating in the program must provide meals that meet certain nutrition requirements; USDA regulations require that the average saturated fat content of the meals offered must be less than 10% of the total calories. Under the bill, USDA must revise these requirements to increase the allowable average saturated fat content of a meal to account for milk fat included in whole milk.

John Lewis Civil Rights Fellowship Act of 2023 This bill establishes the John Lewis Civil Rights Fellowship Program within the J. William Fulbright Educational Exchange Program (commonly referred to as the Fulbright Program). The fellowship program shall honor the legacy of Representative John Lewis and advance U.S. foreign policy priorities by promoting studies, research, and international exchange in the subject of nonviolent civil rights movements around the world. The Fulbright Foreign Scholarship Board shall annually select qualified individuals to serve as fellows in the fellowship program. The Bureau of Educational and Cultural Affairs may determine the number of fellows for each year, with at least 25 fellows each year whenever feasible. Each fellow shall (1) work in an internship or research position with an approved organization in a country with an operational Fulbright U.S. Student Program, and (2) receive an award sufficient to cover the fellow's reasonable costs during the fellowship period and certain travel and lodging expenses related to the program.

This bill allows the Environmental Protection Agency (EPA) to issue a temporary waiver of requirements under the Clean Air Act or the Solid Waste Disposal Act for a critical energy resource facility if the EPA finds that the processing or refining of a critical energy resource at the facility is necessary to meet national security or energy security needs. Further, the EPA may issue such waiver with or without notice, hearing, or other report.

Natural Gas Tax Repeal Act This bill eliminates a program administered by the Environmental Protection Agency (EPA) that provides incentives for petroleum and natural gas systems to reduce their emissions of methane and other greenhouse gases. It also repeals a charge on methane emissions from specific types of facilities that are required to report their greenhouse gas emissions to the EPA's Greenhouse Gas Emissions Reporting Program.

Debbie Smith Act of 2023 This bill reauthorizes through FY2029 the Debbie Smith DNA Backlog Grant Program. The program provides grants to state and local governments to improve and expand the collection and analysis of DNA evidence, including evidence in sexual assault kits.

250th Anniversary of the United States Marine Corps Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the 250th anniversary of the United States Marine Corps. All surcharges received by Treasury from the sale of such coins must be paid to the Marine Corps Heritage Foundation and shall only be used for the purposes of supporting the mission of the Marine Corps Heritage Center.

This bill gives a facility that processes or refines a critical energy resource an interim status permit under the Resource Conservation and Recovery Act until (1) the final administrative disposition of its permit application, or (2) it is proven that the facility failed to provide information needed to process the permit application.

Shirley Chisholm Congressional Gold Medal Act This bill provides for the posthumous presentation of a Congressional Gold Medal in commemoration of Shirley Chisholm, in recognition of her activism, independence, and groundbreaking achievements in politics, including election as the first African American woman in Congress.

Global Nuclear Energy Assessment and Cooperation Act This bill establishes requirements concerning international nuclear energy cooperation and safety. Specifically, the Department of Energy (DOE) must develop and carry out a program to train foreign nuclear energy experts and standardize safety practices. DOE must also study the global status of the civilian nuclear energy industry and its supply chain. In addition, the bill prohibits any person from possessing or owning enriched uranium from Russian or China unless specifically authorized by the Nuclear Regulatory Commission (NRC). NRC may not issue a license to possess or own such fuel if DOE and the Department of State determine that the possession or ownership would pose a threat to national security. NRC must establish an International Nuclear Reactor Export and Innovation Branch within its Office of International Programs to carry out and coordinate certain nuclear reactor export and innovation activities. NRC must also identify in its annual budget justification such activities.

Nuclear Assistance for America's Small Businesses Act This bill provides assistance to eligible small businesses that seek to engage in the research, development, and deployment of advanced nuclear reactors. Upon the request of small businesses, the Nuclear Regulatory Commission must delay collecting a certain portion of application fees for construction permits, operating licenses, or combined licenses for advanced nuclear reactors.

Nuclear Regulatory Commission Survey Act or the NRC Survey Act This bill requires the inspector general of the Nuclear Regulatory Commission (NRC) to distribute surveys about NRC's efficiency and effectiveness. The inspector general must first draft and distribute an optional and anonymous survey to NRC's employees. If feasible, the inspector general must also draft and distribute a similar survey to stakeholders in the nuclear industry.

National Strategy to Utilize Microreactors for Natural Disaster Response Efforts Act This bill directs the President to develop a national strategy to utilize microreactors to assist with natural disaster response efforts. A microreactor is a nuclear reactor with at most 20 megawatts of thermal energy generating capacity. Specifically, such strategy must include an assessment of the effectiveness of utilizing diesel generators to assist with natural disaster response efforts; a comprehensive, research-based, and long-term discussion of goals, objectives, and priorities for utilizing microreactors instead of diesel generators to assist with such efforts; a Department of Defense analysis regarding the use of such microreactors to assist with such efforts; recommendations on how the Nuclear Regulatory Commission can work with other federal agencies to expedite the approval of designs for microreactors and issuing licenses; an assessment of the challenges and barriers to deploying microreactors to assist with such efforts and solutions; and recommendations on how to utilize microreactors as charging stations for electric vehicles in the event of a mass evacuation resulting from a natural disaster.

Audit and Return It Act This bill establishes requirements for auditing and rescinding unobligated funds that were provided to address COVID-19. Specifically, the bill requires the Office of Management and Budget (OMB) to (1) conduct an audit of specified funds that were provided to address COVID-19, and (2) issue a report listing the unobligated funds that remain available. The bill also requires the unobligated funds to be (1) rescinded on the date the OMB report is issued, and (2) deposited into the Treasury for the sole purpose of deficit reduction. The bill applies to unobligated funds that were provided by the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020; the Families First Coronavirus Response Act; the Coronavirus Aid, Relief, and Economic Security Act (CARES Act); the Paycheck Protection Program and Health Care Enhancement Act; Divisions M and N of the Consolidated Appropriations Act, 2021; and the American Rescue Plan Act of 2021.

Patient Access to Higher Quality Health Care Act of 2023 This bill repeals provisions under the Stark law (i.e., the Physician Self-Referral Law) that limit, for purposes of Medicare participation, self-referrals by newly constructed or expanded physician-owned hospitals.

Prime Minister Golda Meir Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins in commemoration of Golda Meir, former Prime Minister of Israel, and the 75th anniversary of the United States-Israel relationship. All surcharges received by Treasury from the sale of such coins must be paid to the American Friends of Kiryat Sanz Laniado Hospital Inc.

TCJA Permanency Act This bill makes permanent provisions affecting individual and business taxpayers that were enacted in 2017 by the Tax Cuts and Jobs Act and are scheduled to expire at the end of 2025. The bill makes permanent reductions in individual and capital gain tax rates. The bill increases the standard tax deduction for individual taxpayers. It also increases and modifies the child tax credit and raises the contribution base for the tax deduction for charitable contributions. The bill allows additional contributions to ABLE accounts (tax-exempt accounts designed to enable individuals with disabilities to save and pay for disability-related expenses). It exempts from taxation combat zone benefits of members of the Armed Forces serving in the Sinai Peninsula of Egypt and limits the deduction for moving expenses to active duty members of the Armed Forces. Additionally, the bill expands the types of elementary and secondary school expenses eligible for payment from qualified tuition programs (529 programs); lowers to $750,000 the amount of mortgage debt eligible for an interest expense tax deduction; reinstates after 2024 the exclusion of income from the gross income of student loan borrowers for loan debt discharged due to death or total and permanent disability; makes permanent the limitation on the tax deduction for state and local taxes and denies a deduction for foreign real property taxes; makes permanent the tax deduction of the income of certain pass-through business entities; repeals the tax deduction for personal tax exemptions and the exclusion of employer-provided bicycle commuter fringe benefits; terminates certain miscellaneous itemized tax deductions; doubles the estate and gift tax exemption amount; and makes permanent the increase of the alternative minimum tax exemption amount for individual taxpayers.

Combating Organized Retail Crime Act of 2023 This bill expands federal enforcement of criminal offenses related to organized retail crime. Organized retail crime typically refers to large-scale retail theft and fraud by organized groups of professional shoplifters, or boosters, who make money by stealing merchandise and reselling it for a fraction of the retail cost. First, with respect to criminal offenses involving the transportation of stolen property across state lines and the sale or receipt of stolen goods, the bill broadens the scope of conduct that qualifies as offenses. Additionally, the bill makes the offenses predicate offenses (i.e., underlying offenses) for prosecutions under the federal money laundering statute and authorizes the criminal forfeiture of any property representing or traceable to the gross proceeds obtained as a result of an offense or a conspiracy to commit an offense. Second, with respect to criminal offenses involving theft from an interstate or foreign shipment, the bill makes an offense an underlying offense for prosecution under the federal money laundering statute and authorizes the criminal forfeiture of any property representing or traceable to the gross proceeds obtained as a result of an offense or a conspiracy to commit an offense. Finally, the bill establishes a center—the Organized Retail Crime Coordination Center—within the Department of Homeland Security to coordinate the federal law enforcement activities related to organized retail crime.

Democracy in Design Act This bill requires the General Services Administration (GSA) to ensure that the design of federal public buildings (e.g., agency office buildings) adheres to the principles of the report titled Guiding Principles for Federal Architecture . The report was published by the Ad Hoc Committee on Federal Office Space on June 1, 1962, and serves as the policy directive for the GSA's Design Excellence Program within its Public Buildings Service. Among other principles, the report prescribes against the development of an official architectural style for government buildings and encourages the government to avoid excessive uniformity in building design. The GSA must issue regulations to implement the amendment made by this bill and to establish minimum standards for the design of public buildings.

This bill requires the President to provide periodic reports and briefings to Congress on matters related to certain U.S. laws concerning North Korea. Annually, the President must submit a report to Congress relating to (1) arms trafficking involving North Korea, (2) operators of foreign airports and sea ports that fail to inspect cargo to or from North Korea, and (3) cooperation between North Korea and Iran. Twice a year, the President must submit a report regarding persons responsible for activities undermining cybersecurity. The bill also requires the President to provide a briefing to Congress twice a year regarding measures to deny specialized financial messaging services to designated North Korean financial institutions.

Simplifying Grants Act of 2023 This bill sets forth procedures for simplifying the grant process for nonurbanized areas, for both existing and new grant programs. Each agency must make publicly available a checklist for covered local governments with respect to each grant program of the agency for which such governments are otherwise eligible that includes each requirement for every step of the grant process. The Office of Management and Budget must report to Congress (1) within 270 days of this bill's enactment, evaluating the extent to which agencies have simplified the requirements and made the checklist available; and (2) each April 1st, evaluating the amount of technical assistance provided and the amount of funds awarded.

Outpatient Surgery Quality and Access Act of 2023 This bill establishes and modifies certain requirements relating to Medicare payments for ambulatory surgical center (ASC) services. Specifically, the bill (1) requires the payment system for ASC services to feature certain positive annual adjustments equivalent to those made with respect to hospital outpatient department (OPD) services; (2) revises quality reporting requirements to permit publicly available, side-by-side comparisons of quality measures for ASCs and OPDs in the same geographic area; and (3) requires the Centers for Medicare & Medicaid Services (CMS), when excluding requested procedures from the list of those approved to be performed in ASCs, to cite specified reasons for doing so. With respect to excluding procedures from the approved list for ASCs, the CMS may not cite as a basis for exclusion that a procedure can only be reported using an unlisted surgical procedure code. (Physicians sometimes use unlisted codes when performing new procedures or services if no existing code is adequately descriptive.) The bill also limits the copayment amount for ASC services under Medicare to that of the inpatient hospital deductible.

This joint resolution nullifies a Department of Labor rule concerning the fiduciary duties with respect to employee benefit plans. Under the rule issued on December 1, 2022, plan fiduciaries may consider climate change and other environmental, social, and governance factors when they make investment decisions and when they exercise shareholder rights, including voting on shareholder resolutions and board nominations.

Presidential Budget Accountability Act This bill restricts the use of federal funds for presidential travel if the President's budget is not submitted to Congress by the first Monday in February as required by law. Specifically, if the President's budget is not submitted to Congress on or before the first Monday in February of a year, federal funds may not be used for the cost of travel by the President during the period beginning on the first Tuesday of February of that year and ending on the date the budget is submitted. For the purposes of this bill, federal funds includes funds provided for the expense allowance of the President, travel expenses of the President, entertainment expenses of the President, and subsistence expenses in connection with the travel of the President.

Presidential Accountability for Yearly Submission of The United States' Budget Act or the PAYSTUB Act This bill restricts the use of federal funds for the salaries or expenses of political employees if the President's budget is not submitted to Congress by the first Monday in February as required by law. Specifically, if the President's budget is not submitted to Congress on or before the first Monday in February of a year, federal funds may not be used for the salary or expenses of any political employee during the period beginning on the first Tuesday of February of that year and ending on the date the budget is submitted. On the earliest possible date after the President's budget is submitted, political employees whose salaries or expenses were not paid during a period in which the President's budget had not yet been submitted must be paid for that period.

The resolution also expresses support for the people of Iran who are legitimately defending their rights for freedom against repression and condemns the killing of Iranian protesters by the Iranian regime.

Help Ensure Lower Patient Copays Act or the HELP Copays Act This bill requires health insurance plans to apply certain payments made by, or on behalf of, a plan enrollee toward a plan's cost-sharing requirements. Specifically, plans must apply third-party payments, financial assistance, discounts, product vouchers, and other reductions in out-of-pocket expenses toward the requirements.

No Social Security for Illegal Aliens Act of 2023 This bill prohibits an individual from collecting Social Security benefits based on wages and income earned for services illegally performed in the United States while the individual was an alien.

Working Dog Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue 50,000 $5 gold coins, 500,000 $1 silver coins, and 750,000 half-dollar clad coins in commemoration of the service that working dogs provide to society. The designs of the coins minted under this bill shall be emblematic of the contributions of working dogs to society, including in detection, military service, therapy, and assistance. Treasury may issue coins only during the one-year period beginning on January 1, 2025. All sales of coins shall include a surcharge, which shall be paid to America's VetDogs for general expenses associated with the fulfillment of its mission.

This joint resolution nullifies the rule titled Revised Definition of "Waters of the United States," which was submitted by the U.S. Army Corps of Engineers and the Environmental Protection Agency on January 18, 2023. The rule specifies which bodies of water fall under the scope of the Clean Water Act and are thereby under federal jurisdiction. The 2023 rule replaced a 2020 rule that included a narrower definition of waters of the United States .

The act makes a variety of changes to DC criminal laws, including by providing statutory definitions for various elements of criminal offenses, modifying sentencing guidelines and penalties, and expanding the right to a jury trial for certain misdemeanor crimes.

Protect and Serve Act of 2023 This bill establishes a new criminal offense for knowingly assaulting a law enforcement officer and causing serious bodily injury (or attempting to do so) in circumstances that affect interstate commerce. It imposes criminal penalties—a prison term, a fine, or both—on a violator.

Terrorist Deportation Act of 2023 This bill establishes that non-U.S. nationals ( aliens under federal law) identified in the terrorist screening database, except for lawful permanent residents, shall be deportable and inadmissible into the United States. The Department of Homeland Security (DHS) may temporarily waive the inadmissibility of such an individual if it is in the national security interests of the United States. DHS shall grant such a waiver only with the unanimous concurrence of the Department of Justice, the Federal Bureau of Investigation, the Office of the Director of National Intelligence, and the Department of State. An individual identified in the terrorist screening database shall be ineligible for various immigration benefits, including asylum, withholding or cancellation of removal, voluntary departure, or adjustment of status. DHS shall determine on an expedited basis whether to remove an individual identified in the terrorist screening database, if the individual has not received a waiver and does not have lawful permanent residence status. The individual shall be entitled to various protections, including the right to be represented by counsel (at no cost to the government) and judicial review.

Mobilizing Against Sanctuary Cities Act This bill imposes penalties on certain state and local governments that do not assist federal immigration enforcement actions. Specifically, a state or local government shall be ineligible for federal financial assistance for at least one year if it restricts or prohibits an agency or official from (1) communicating with the responsible federal immigration agency regarding an individual's citizenship or immigration status, or (2) maintaining or exchanging information about an individual's status. (Jurisdictions that take such actions are sometimes referred to as sanctuary cities or sanctuary jurisdictions .) The bill restores eligibility for federal assistance if the Department of Justice (DOJ) determines that the jurisdiction no longer takes such actions. DOJ shall determine each year which state or local jurisdictions are ineligible for federal assistance under this bill and report such determinations to Congress.

FTO Passport Revocation Act of 2022 This bill authorizes the Department of State to revoke or refuse to issue a passport for an individual who has aided an organization that the State Department has designated as a foreign terrorist organization. The individual may request a hearing with the State Department upon being notified of a revocation or refusal.

Visa Overstay Enforcement Act of 2023 This bill imposes various penalties on non-U.S. nationals ( aliens under federal law) who overstay a visa or lawful immigration status. An individual who overstays shall be fined or imprisoned for up to six months, or both. Such an individual may not be admitted into the United States for 5 years, and may not be granted a visa for 10 years. For subsequent offenses, the individual shall be fined or imprisoned for up to two years, or both, and may not be admitted into the United States or granted a visa. The Department of Homeland Security shall make case-by-case exceptions for individuals who overstay due to medical necessity, public safety, or national security reasons.

Build up Illegal Line Defenses with Assets Lawfully Lifted Act of 2023 This bill directs certain amounts from the Department of Justice (DOJ) Assets Forfeiture Fund to the deployment of additional border security measures. Specifically, DOJ must report annually on the amount of total deposits into the fund that are derived from Mexican cartels. The bill makes available 50% of that amount for the construction of additional physical barriers and roads near the border to deter illegal crossings into the United States. Additionally, the bill prohibits the release of seized currency or contraband that likely belongs to or supports a foreign illegal trafficking organization while a civil forfeiture action is pending.

Repealing Illegal Freedom and Liberty Excises Act or the RIFLE Act This bill repeals the excise tax on the transfer of firearms. The bill shall not be construed as placing any regulated firearms under the jurisdiction of the U.S. Consumer Product Safety Commission.
