Safety From Violence for Healthcare Employees Act or the SAVE Act This bill establishes a new criminal offense for knowingly assaulting or intimidating hospital personnel during the performance of their official duties in a manner that interferes with their performance of the duties or limits their ability to perform the duties. Additionally, the bill authorizes grants to reduce the incidence of violence at hospitals, including violence or intimidation against hospital personnel in the performance of their duties.

Safe Step Act This bill requires a group health plan to establish an exception to medication step-therapy protocol in specified cases. A medication step-therapy protocol establishes a specific sequence in which prescription drugs are covered by a group health plan or a health insurance issuer. A request for such an exception to the protocol must be granted if (1) an otherwise required treatment has been ineffective, (2) such treatment is expected to be ineffective and delaying effective treatment would lead to irreversible consequences, (3) such treatment will cause or is likely to cause an adverse reaction to the individual, (4) such treatment is expected to prevent the individual from performing daily activities or occupational responsibilities, (5) the individual is stable based on the prescription drugs already selected, or (6) there are other circumstances as determined by the Employee Benefits Security Administration. The bill requires a group health plan to implement and make readily available a clear process for an individual to request an exception to the protocol, including required information and criteria for granting an exception. The bill further specifies timelines under which plans must respond to such requests.

Federal Firearms Licensee Protection Act of 2023 This bill modifies criminal penalties for an offense involving the theft of a firearm from a licensed importer, manufacturer, or dealer, or from their business premises. Specifically, the bill does the following: increases from 10 to 20 years the maximum prison term, and creates a 3- or 5-year mandatory minimum prison term for an offense that occurs during the commission of a burglary or robbery. An attempt to commit an offense is subject to the same penalties as a substantive offense.

Strengthening Community Care Act of 2023 This bill extends funding through FY2028 for the Community Health Center Fund (CHCF) and the National Health Service Corps (NHSC) Fund. The CHCF supports grants for outpatient health care facilities that provide care to medically underserved populations; the NHSC Fund supports the provision of scholarships and student loan repayment awards to health care providers who agree to work in areas with health care provider shortages.

Optimizing Postpartum Outcomes Act of 2023 This bill requires (1) the Centers for Medicare & Medicaid Services to issue guidance to support coverage of prenatal and postpartum pelvic health services under Medicaid and the Children's Health Insurance Program (CHIP), (2) the Government Accountability Office to study gaps in Medicaid coverage of these and other services for postpartum women, and (3) the Centers for Disease Control and Prevention to educate health professionals and postpartum women on pelvic health services.

New Markets Tax Credit Extension Act of 2023 This bill makes the new markets tax credit permanent. It also modifies the credit to (1) provide for an inflation adjustment to the limitation amount for the credit after 2023, and (2) allow an offset against the alternative minimum tax for the credit (determined with respect to qualified equity investments initially made after 2022).

Strengthening Medicare for Patients and Providers Act This bill modifies certain adjustments to payment amounts under the Medicare physician fee schedule. Payment amounts under the Medicare physician fee schedule are based on a service's relative value, a conversion factor, and a geographic adjustment factor. Current law provides for separate conversion factors for physicians that are qualifying participants in advanced alternative payment models (also known as qualifying APM participants) and for other physicians beginning in 2026, with an annual update of 0.75% and 0.25%, respectively. The bill replaces the separate conversion factors for qualifying APM participants and other physicians with a single conversion factor and provides for an update that is equal to the annual percentage increase in the Medicare Economic Index, beginning in 2024. (The Medicare Economic Index is a specialized index that is generally used to determine allowed charges for physician services based on annual price changes.)

Nancy Gardner Sewell Medicare Multi-Cancer Early Detection Screening Coverage Act This bill allows for Medicare coverage and payment for multi-cancer early detection screening tests that are approved by the Food and Drug Administration and that are used to screen for cancer across many cancer types, if the Centers for Medicare & Medicaid Services determines such coverage is appropriate.

Saving Access to Laboratory Services Act This bill modifies provisions relating to Medicare payment rates for clinical diagnostic laboratory services, including by requiring payment rates for certain widely available clinical diagnostic laboratory tests to be based on a statistical sampling of private sector rates.

Pausing Enhanced Pandemic Pathogen Research Act of 2023 This bill generally prohibits the National Institutes of Health from conducting or supporting gain-of-function research through March 30, 2028. The bill defines gain-of-function research as any research that could enhance the transmissibility, virulence, or pathogenicity of any pathogen or non-pathogen agent in a way that could lead to (1) moderate or high transmissibility, virulence, or pathogenicity in human populations; (2) significant morbidity or mortality in humans; or (3) severe threats to public health or U.S. national security. The prohibition does not apply to the characterization or testing of naturally occurring influenza virus or coronavirus unless the characterization or testing could increase viral pathogenicity or transmissibility.

Aviation Workforce Development Act This bill expands the qualified tuition program (commonly referred to as 529 plans) to allow distributions to pay education-related expenses required for participation in certain aviation maintenance and commercial pilot courses.

Purple Heart Freedom to Work Act This bill increases the monthly income limit that is used to determine whether certain Purple Heart recipients are eligible for Social Security Disability Insurance (SSDI) benefits. Specifically, when making such determinations with respect to Purple Heart recipients who are entitled to SSDI benefits based on combat-related injuries, the Social Security Administration must use the limit that applies to individuals who are blind rather than the lower limit that applies to other SSDI recipients. In addition, the bill phases out SSDI benefits for these Purple Heart recipients, with benefits reduced by $1 for every $4 of earnings in excess of the limit.

Historic Tax Credit Growth and Opportunity Act of 2023 This bill increases the rehabilitation tax credit and modifies certain requirements for the credit. The bill increases the rate of the credit for qualified rehabilitation expenditures in taxable years beginning after December 31, 2020, and before January 1, 2028, after which the rate reverts to 20%. The bill increases the rate of the credit to 30% for certain small projects whose qualified rehabilitation expenditures do not exceed $2.5 million. The bill also expands the types of buildings eligible for rehabilitation by decreasing the rehabilitation threshold from 100% to 50% of project expenses. It also eliminates the basis adjustment requirement for the credit and modifies rules relating to tax-exempt use property eligible for the credit.

United States-Israel Future of Warfare Act of 2023 This bill requires the Department of Defense to establish the United States-Israel Future of Warfare Research and Development Fund to conduct collaborative defense projects between the United States and Israel in areas of emerging technologies (e.g., artificial intelligence). The purpose of the fund is to enable the Armed Forces of the United States and Israel to meet emerging defense challenges.

Equitable Community Access to Pharmacist Services Act This bill expands Medicare coverage to permanently include services provided by a pharmacist, including incidental services and supplies, related to testing, vaccines, and treatment for COVID-19, influenza, and certain other illnesses. Specifically, the bill provides for continued coverage of pharmacist services relating to evaluation and management of patients for testing and treatment for COVID-19, influenza, respiratory syncytial virus (RSV), or streptococcal pharyngitis (strep throat), as well as vaccines for pneumococcal disease, COVID-19, influenza, or hepatitis B. It also generally provides for coverage of pharmacist services during a public health emergency.

Ensuring Patient Access to Critical Breakthrough Products Act of 2023 This bill provides for Medicare coverage of medical devices that are approved under the Food and Drug Administration (FDA) Breakthrough Devices Program. (Under the program, manufacturers work with the FDA to expedite the review and approval of certain medical devices that provide for more effective treatment or diagnosis of life-threatening or irreversibly debilitating human diseases or conditions.) The bill allows designated medical breakthrough devices to be temporarily covered under Medicare during a four-year transitional period. The Centers for Medicare & Medicaid Services (CMS) must assign payment codes for such devices within three months of FDA approval. The CMS must also establish a process to allow for continued coverage after the transitional period has expired, taking into account any additional evidence or data the CMS deems necessary. The CMS must also provide for temporary and, where appropriate, permanent Medicare coverage of breakthrough devices for which there is no existing benefit category (i.e., classification).

Protecting Access to Ground Ambulance Medical Services Act of 2023 This bill extends the specialized rate increase for Medicare payment of ground ambulance services in rural areas for an additional three years (until January 1, 2028).

Prevent Interruptions in Physical Therapy Act of 2023 This bill allows a physical therapist to receive payment under Medicare for services provided to the physical therapist's patients by another physical therapist through a qualifying temporary arrangement, regardless of the geographic area or population served. Currently, physical therapists may only receive payment with respect to such arrangements for services provided in medically underserved, rural, or health professional shortage areas.

This joint resolution nullifies the rule issued by the Bureau of Alcohol, Tobacco, Firearms and Explosives titled Factoring Criteria for Firearms With Attached "Stabilizing Braces" and published on January 31, 2023. The rule establishes criteria for determining whether a firearm equipped with an attached stabilizing brace that facilitates shoulder fire is a rifle subject to regulation (e.g., registration) under the National Firearms Act.

Comprehensive Care for Alzheimer's Act This bill allows the Center for Medicare and Medicaid Innovation (CMMI) to test a Dementia Care Management Model that provides comprehensive care to Medicare beneficiaries with Alzheimer's disease or a related dementia. Under the model, participating health care providers receive payment under Medicare for comprehensive care management services that are provided to individuals with diagnosed dementia, excluding Medicare Advantage enrollees, hospice care recipients, and nursing home residents. Required services include medication management, care coordination, and health, financial, and environmental monitoring, as well as trainings and other support services for unpaid caregivers. Providers must furnish services through interdisciplinary teams and must ensure access to a team member or primary care provider 24-7. The CMMI must set payments and determine quality measures for the model in accordance with specified requirements. The bill also allows the CMMI to design a similar model under Medicaid.

Drug Price Transparency in Medicaid Act of 2023 This bill requires pass-through pricing models, and prohibits spread-pricing, for payment arrangements with pharmacy benefit managers under Medicaid. The bill also extends funding for retail pharmacy surveys and requires additional information with respect to price concessions and survey participation to be made publicly available.

Hello Girls Congressional Gold Medal Act of 2023 This bill provides for the award of a single Congressional Gold Medal in honor of the female telephone operators of the Army Signal Corps, commonly known as the Hello Girls , in recognition of their military service, devotion to duty, and 60-year struggle for veterans' benefits and recognition as soldiers.

Personal Health Investment Today Act of 2023 or the PHIT Act of 2023 This bill allows a medical care tax deduction for up to $1,000 ($2,000 for a joint return or a head of household) of qualified sports and fitness expenses per year. The bill defines qualified sports and fitness expenses as amounts paid exclusively for participating in a physical activity, including (1) fitness facility memberships, (2) physical exercise or activity programs, or (3) equipment for a physical exercise or activity program.

Lower Energy Costs Act This bill provides for the exploration, development, importation, and exportation of energy resources (e.g., oil, gas, and minerals). For example, it sets forth provisions to (1) expedite energy projects, (2) eliminate or reduce certain fees related to the development of federal energy resources, and (3) eliminate certain funds that provide incentives to decrease emissions of greenhouse gases. The bill expedites the development, importation, and exportation of energy resources, including by waiving environmental review requirements and other specified requirements under certain environmental laws, eliminating certain restrictions on the import and export of oil and natural gas, prohibiting the President from declaring a moratorium on the use of hydraulic fracturing (a type of process used to extract underground energy resources), directing the Department of the Interior to conduct sales for the leasing of oil and gas resources on federal lands and waters as specified by the bill, and limiting the authority of the President and executive agencies to restrict or delay the development of energy on federal land. In addition, the bill reduces royalties for oil and gas development on federal land and eliminates charges on methane emissions. It also eliminates a variety of funds, such as funds for energy efficiency improvements in buildings as well as the greenhouse gas reduction fund.

Eliminating Backlogs Act of 2023 This bill increases the number of employment-based immigration visas available. The total number of additional visas made available under this bill shall be based on a formula relating to certain types of visas issued from FY1992-FY2021. These visas shall be available in FY2024 and in subsequent fiscal years until they are used. Furthermore, the yearly cap on the number of employment-based immigration visas that are made available to a single country shall not apply to the visas made available under this bill. (Generally, individuals from a single country may only receive up to 7% of such visas made available in a fiscal year.)

The act sets forth a variety of measures that focus on policing, including measures prohibiting the use of certain neck restraints by law enforcement officers, requiring additional procedures related to body-worn cameras, and expanding access to police disciplinary records.

Black Vulture Relief Act of 2023 This bill allows livestock producers and their employees to take certain actions against black vultures to protect livestock. (Black vultures are protected under the Migratory Bird Treaty Act.) Specifically, livestock producers and their employees may (1) take (i.e., capture, kill, disperse, or transport) a black vulture that they reasonably believe will cause death, injury, or destruction to livestock; or (2) in the course of taking or attempting to take the black vulture, cause injury to the bird. Livestock producers and their employees must submit an annual report to the U.S. Fish and Wildlife Service (FWS) on black vultures taken under this bill. The FWS must make this reporting form available on its website. Currently, the FWS has a permit process under the Migratory Bird Treaty Act for the taking of black vultures.

Preserving Choice in Vehicle Purchases Act This bill modifies the waiver process under the Clean Air Act related to state emission control standards for new motor vehicles (or new motor vehicle engines). Under current law, states are preempted from adopting or enforcing emission control standards for new motor vehicles (or new motor vehicle engines) unless the Environmental Protection Agency (EPA) provides a waiver authorizing a state to adopt such standards if certain requirements are met. The bill provides that state standards that directly or indirectly limit the sale or use of new motor vehicles with internal combustion engines are not eligible for waivers. The bill also prohibits the EPA from determining that any state standards amended after the bill's enactment are within the scope of an existing waiver. Additionally, the bill requires the EPA to revoke waivers granted between January 1, 2022, and the date of enactment of this bill if the standards directly or indirectly limit the sale or use of new motor vehicles with internal combustion engines.

Violet's Law This bill requires federal research facilities to facilitate the adoption or nonlaboratory placement of dogs, cats, nonhuman primates, guinea pigs, hamsters, and rabbits with animal rescue organizations, animal sanctuaries, animal shelters, or individuals. In order to be adopted or placed, the animals must no longer be needed for research and be suitable for release. To be suitable for release, the animal must be free of any infectious disease or physical abnormality that would endanger the animal, other animals, or public health.

Expanding America's National Cemetery Act of 2023 This bill requires the Department of Veterans Affairs, before Arlington National Cemetery reaches capacity, to expand or otherwise modify an existing national cemetery to ensure that full military honors are provided in a specified manner. Specifically, the VA must expand or modify such a cemetery to ensure that full military honors are provided (1) in a manner consistent with the full military honors provided for interment in Arlington National Cemetery as of March 31, 2023; and (2) using the eligibility criteria in effect on March 31, 2023, for providing full military honors for interment in Arlington National Cemetery.

Dentist and Optometric Care Access Act of 2023 or the DOC Access Act of 20 23 This bill prohibits private health insurance plans from setting rates for items and services, except for dental cleanings, provided by a doctor of optometry, of dental surgery, or of dental medicine for which the plan does not pay a substantial amount. Additionally, an agreement between a plan and such a doctor for limited scope dental or vision benefits may last longer than two years only with the prior acceptance of the doctor for each term extension. Plans also may not restrict such a doctor's choice of laboratories or suppliers. Such doctors may elect to waive the application of the payment amount and choice of laboratories provisions of this bill. The bill does not supersede state laws regarding health insurers and dental or vision benefit plans.

American Safety And Fairness through Expedited Removal Act of 2023 or the American SAFER Act of 202 3 This bill expands the classes of non-U.S. nationals ( aliens under federal law) who are subject to expedited removal (i.e., removal from the United States without further hearing or review). Specifically, the bill nullifies a 2004 Department of Homeland Security (DHS) rule that generally limits expedited removal to certain situations, such as for non-U.S. nationals encountered within 14 days of entry into the United States without inspection and within 100 miles of a U.S. international land border. The bill also (1) prohibits DHS from implementing a rule that limits expedited removal based on how far a non-U.S. national was from the border when encountered or apprehended, and (2) modifies the relevant statute to state that expedited removal authority applies regardless of where the non-U.S. national was encountered or apprehended.

Taking Account of Bureaucrats' Spending Act of 2023 or the TABS Act of 2023 This bill restructures the Consumer Financial Protection Bureau and renames it as the Consumer Financial Empowerment Agency. The new agency is established as an independent agency outside of the Federal Reserve System. The bill also changes the funding structure of the agency by prohibiting the transfer of funds to the agency from the Federal Reserve System and by authorizing appropriations for FY2024-2025.

Sultana Steamboat Disaster Commemorative Coin Act of 2023 This bill directs the Department of the Treasury to mint and issue not more than 100,000 $5 gold coins, 500,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the Sultana steamboat explosion that occured on April 27, 1865, on the Mississippi River. All surcharges received by Treasury from the sale of such coins must be paid to the Sultana Historical Preservation Society for the purpose of establishing, operating, and maintaining a museum.

Institute for Telecommunication Sciences Codification Act or the ITS Codification Act This bill provides statutory authority for the Institute for Telecommunication Sciences, which serves as the telecommunications research and engineering arm of the National Telecommunications and Information Administration. In addition, the institute must establish an initiative to support the development of emergency communication and tracking technologies for use in locating trapped individuals in confined spaces where conventional radio communication is limited.

Spectrum Coordination Act This bill requires periodic updates to the memorandum of understanding (MOU) that guides federal efforts to coordinate the efficient management and use of the electromagnetic spectrum. It also requires documentation of interagency coordination during spectrum actions. Specifically, the Federal Communications Commission (FCC) and the National Telecommunications and Information Administration (NTIA) must update the current MOU within three years and then update subsequent MOUs at least every four years thereafter. Additionally, the NTIA and the FCC must document their efforts to coordinate the identification and resolution of technical, procedural, or policy concerns of federal entities that are affected by a spectrum action (i.e., a proposed action by the FCC to reallocate spectrum that is anticipated to result in an auction or licensing that could potentially impact the spectrum operations of a federal entity). In particular, the NTIA must file specified information in the public record during the period for submitting comments about the spectrum action. The information must include (1) the date on which the FCC notified the NTIA about the action, (2) a list of federal entities that may be affected by the action, (3) the date on which the NTIA notified those entities about the action, and (4) a summary of concerns with the action raised by affected entities. The bill also requires the FCC to include in any final rule for a spectrum action an interagency coordination summary that describes (1) the date the FCC notified the NTIA about the spectrum action, (2) whether federal entities raised concerns, and (3) how any concerns were resolved.

Sunshine Protection Act of 2023 This bill makes daylight saving time the new, permanent standard time. States with areas exempt from daylight saving time may choose the standard time for those areas.

Major Richard Star Act This bill provides that combat-disabled uniformed services retirees with fewer than 20 years of creditable service may concurrently receive, without reduction, veterans' disability compensation and retired pay or combat-related special compensation.

Parents Bill of Rights Act This bill establishes various rights of parents and guardians regarding the elementary or secondary school education of their children. Local educational agencies (LEAs) and schools must comply with the requirements of the bill in order to receive federal education funds. Specifically, the bill requires schools to notify parents and guardians of their rights regarding the education of their children. These rights include the right to review the curriculum of their child's school; know if the state alters its challenging academic standards; meet with each teacher of their child at least twice each school year; review the budget, including all revenues and expenditures, of their child's school; review a list of the books and other reading materials in the library of their child's school; address the school board of the LEA; receive information about violent activity in their child's school; and receive information about any plans to eliminate gifted and talented programs in the child's school. Additionally, the bill directs each LEA to post on a publicly accessible website (or otherwise widely disseminate to the public) the curriculum for each elementary and secondary school grade level. The LEA must also include in its annual report card the overall budget of the LEA and the budget for each elementary and secondary school. The bill also provides for additional family educational and privacy rights, including by prohibiting schools from selling student information for commercial or financial gain.

Help Independent Tracks Succeed Act or the HITS Act This bill permits taxpayers to treat as currently deductible expenses the cost of qualified sound recording productions not exceeding $150,000 in a taxable year. The bill defines qualified sound recording production as certain sound recordings produced and recorded in the United States.

Fair and Open Competition Act or the FOCA Act This bill prohibits federal construction contracts or controlling documents for federally supported construction projects from requiring or prohibiting project labor agreements. Such documents also may not discriminate against or give preference to a bidder or contractor who signs or refuses to sign a project labor agreement. An agency may exempt a project from this prohibition to avert an imminent threat to public health or safety or to serve the national security.

Facilitating Innovative Nuclear Diagnostics Act of 2023 This bill establishes separate payment requirements for diagnostic radiopharmaceuticals under the Medicare prospective payment system for hospital outpatient department services. The bill's requirements apply to diagnostic radiopharmaceuticals that have an average daily cost of $500 or more in 2024 and as adjusted based on a specified fee schedule factor in each year thereafter.

National Right-to-Work Act This bill repeals those provisions of the National Labor Relations Act and the Railway Labor Act that permit employers to make an agreement with a labor union to require employees to join such union as a condition of employment. Currently, at least 27 states have enacted laws prohibiting employers from compelling employees to become members of a union as a condition of employment.

Patients' Right to Know Their Medication Act of 2023 This bill establishes requirements relating to the form, content, and distribution of patient safety labels for prescription drugs. Specifically, the Food and Drug Administration must issue regulations with requirements relating to the authorship, content, format, color, printing, and dissemination of such patient safety information. The regulations must require labels to include the drug's approved uses, known interactions with other drugs or substances, contact information for the drug's manufacturer, and other specified information relating to patient safety. The information must be in plain, neutral language and must be given in printed form with each prescription.

Keeping America's Refineries Act This bill revises the EPA's Risk Management program to exempt a petroleum (e.g., gasoline) refinery that uses a hydrofluoric acid alkylation unit from certain hazard assessment requirements. Petroleum refineries use the acid during the gasoline production process. Hydrofluoric acid is hazardous and corrosive. If it is accidently released, it can form a toxic vapor cloud. Currently, petroleum refineries are required to include in a hazard assessment an evaluation of safer technology and alternative risk management measures for a hydrofluoric acid alkylation unit. This bill eliminates that requirement if the petroleum refinery (1) has obtained a construction permit or operating permit under the program, or (2) demonstrates that it will conform to the most recent version of American Petroleum Institute Recommended Practice 751. This practice provides guidance on the safe operation of such a unit.
