Ensuring Lasting Smiles Act This bill requires private health insurance plans to cover diagnosis and treatment services for congenital anomalies and birth defects, such as reconstructive services and prosthetics. Coverage must include services that functionally improve, repair, or restore any body part that is medically necessary for normal bodily functions or appearance, as determined by the treating physician.

Cambodia Trade Act of 2019 This bill directs the President to report on Cambodia's classification under the Generalized System of Preferences (GSP), a U.S. trade preference program that provides duty-free access to imports on products from certain developing countries. (Currently, Cambodia is a beneficiary of the GSP program.)

Responsible Additions and Increases to Sustain Employee Health Benefits Act of 201 9 This bill modifies the tax exclusion for distributions from health flexible spending arrangements provided to employees under a cafeteria plan to (1) increase the annual limit on employee salary reduction contributions to $5,000, with an additional $500 for each additional employee dependent above two dependents that has not been taken into account by another person for the year; (2) revise the adjustment for inflation after 2020; and (3) allow a carryforward into the next year for unused amounts in such plans.

Small Business Tax Fairness and Compliance Simplification Act This bill expands the tax credit for a portion of the employer-paid Social Security taxes for employee cash tips to include beauty service establishments. (Under current law, the credit is limited to tips received for providing, serving, or delivering food or beverages.) The credit applies to tips received in connection with providing beauty services to a customer or client if tipping employees who provide the service is customary. "Beauty services" include barbering and hair care, nail care, esthetics, and body and spa treatments. The bill also (1) establishes an employer tip reporting safe harbor for beauty service establishments, and (2) specifies reporting requirements for income received from renting space to individuals who provide beauty services. The employer tip reporting safe harbor for beauty service establishments provides an exemption from certain Internal Revenue Service tip examinations for employers who meet certain requirements for educational programs, reporting procedures, compliance with tax law, and recordkeeping.

Protect and Serve Act of 2019 This bill establishes a new criminal offense for knowingly assaulting a law enforcement officer causing serious bodily injury (or attempting to do so) in circumstances that affect interstate commerce. It imposes criminal penalties—a prison term of up to 10 years, a fine, or both—on a violator.

History and Tradition Protection Act of 2019 This bill limits the remedies available for certain civil actions involving the deprivation of rights under color of law. Specifically, remedies will be limited to injunctive and declaratory relief for claims where the deprivation of rights consists of violation of a prohibition in the Constitution against the establishment of religion. Additionally, no attorney's fees shall be awarded in proceedings in vindication of civil rights with respect to such a claim concerning the actions of states and localities. With regard to a claim brought against the United States or a federal official acting in his or her official capacity, the bill prohibits the award of reasonable fees and expenses of attorneys to the prevailing party.

Restore Our Parks and Public Lands Act This bill establishes the National Park Service and Public Lands Legacy Restoration Fund into which, through FY2024, there shall be deposited an amount equal to 50% of all energy development revenues due to the federal government from oil, gas, coal, or alternative or renewable energy development on federal lands and waters. Deposited amounts must not exceed $1.3 billion for any fiscal year. From such amounts 80% shall be allocated to the National Park Service for high-priority deferred maintenance projects, ensuring parity between transportation and nontransportation projects; 10% shall be for the national wildlife refuge system maintenance backlog; 5% shall be for the public access and recreation backlog on public lands; and 5% shall be for school construction and deferred maintenance backlogs. The Department of the Interior must submit to Congress, with the President's annual budget submission, a list of projects receiving allocations from the fund and a description of each such project. Interior, and other specified agencies, may accept cash or in-kind donations that advance efforts to reduce maintenance backlogs and encourage public-private partnerships.

Advancing Care for Exceptional Kids Act of 2019 or the ACE Kids Act of 2019 This bill establishes a state Medicaid option to provide for medical assistance with respect to coordinated care provided through a health home (i.e., a designated provider or team of health-care professionals) for children with medically complex conditions. States must determine payment methodologies in accordance with specified requirements; payments also temporarily qualify for an enhanced federal matching rate.

Preserving Teacher Loan Forgiveness for Military Spouses Act of 2019 This bill modifies the qualifying service requirement of the teacher loan forgiveness program for certain military spouses who have student federal loans. Under current law, an otherwise qualified full-time teacher must complete five consecutive years of service to be eligible for the teacher loan forgiveness program. This bill permits a teacher who completes five full-time years of nonconsecutive service to be eligible for loan forgiveness if the teacher's spouse was relocated by the military.

Craft Beverage Modernization and Tax Reform Act of 2019 This bill modifies the tax treatment of certain alcoholic beverages to exclude the aging period from the production period for beer, wine, or distilled spirits for purposes of determining whether a taxpayer can expense, rather than capitalize, interest costs paid or incurred during the production period; reduce excise tax rates on beer and distilled spirits; permit the transfer of beer between bonded facilities without payment of tax; increase the amount of the small wine producer tax credit and expand the categories of producers covered by such credit; allow an adjustment to the producer credit for hard cider; and modify the alcohol content limitations that apply to certain wines for tax purposes. The Department of the Treasury must amend applicable regulations with respect to the use of wholesome products suitable for human consumption in the production of fermented beverages. The bill also increases funding for the Alcohol and Tobacco Tax and Trade Bureau.

Aviation Funding Stability Act of 2019 This bill provides continuing appropriations to the Federal Aviation Administration (FAA) from the Airport and Airway Trust Fund if an appropriations bill for the FAA has not been enacted before a fiscal year begins or a joint resolution making continuing appropriations for the FAA is not in effect. The bill provides appropriations at the rate of operations that was provided for the prior fiscal year to continue programs, projects, and activities for which funds were provided in the preceding fiscal year.

Ensuring Quality in the Unemployment Insurance Program (EQUIP) Act This bill allows states to enact unemployment compensation laws that require an applicant for unemployment compensation, before receiving any such compensation, to (1) complete a substance abuse risk assessment, and (2) test negative for controlled substances within one week after the results of such assessment if determined to be high-risk. It prescribes retesting requirements and payment suspensions for applicants who test positive.

Providing Accountability Through Transparency Act of 2019 This bill requires the notice of a proposed rule by a federal agency to include the Internet address of a summary of the rule. The summary must be 100 words or fewer, written in plain language, and posted on regulations.gov.

This bill prohibits a provider of broadband internet access service from taking certain actions to restrict content and requires the Federal Communications Commission (FCC) to enforce such obligations. Specifically, the bill bars a broadband internet provider from (1) blocking lawful content, applications, or services; (2) prohibiting the use of non-harmful devices; (3) throttling lawful internet traffic; and (4) engaging in paid prioritization. Additionally, a provider is required to disclose accurate and relevant management practices, performance information, and commercial terms sufficient for consumers to make informed choices and for providers of content, applications, services, and devices to develop and market new internet offerings. Additionally, the bill prohibits the FCC or a state commission from relying on their duty to encourage the deployment of advanced telecommunications capability as a grant of authority.

Give it Back to the Taxpayers Act This bill requires appropriations for Member's Representational Allowances for the House of Representatives that remain at the end of the fiscal year to be deposited in the Treasury and used for deficit or debt reduction. The Member's Representational Allowance is the budget authorized for each Member of Congress in support of the conduct of official and representational duties.

Autism Collaboration, Accountability, Research, Education, and Support Act of 2019 or the Autism CARES Act of 2019 This bill reauthorizes through FY2024 and revises several programs and activities relating to autism spectrum disorder (ASD). Among other things, the bill reauthorizes provisions relating to (1) expanded ASD research at the National Institutes of Health; (2) ASD education, early detection, and intervention activities supported by the Health Resources and Services Administration; and (3) the Interagency Autism Coordinating Committee. The bill also generally revises the scope of such programs and activities to encompass ASD individuals of all ages, rather than only youth.

SFC Sean Cooley and SPC Christopher Horton Congressional Gold Star Family Fellowship Program Act This resolution establishes in the House of Representatives the Congressional Gold Star Family Fellowship Program under which certain family members of a member of the Armed Forces who is a hostile casualty or died from a training-related injury may serve a 12-month fellowship in the office of a Member of the House.

Born-Alive Abortion Survivors Protection Act This bill establishes requirements for the degree of care a health care practitioner must exercise in the event a child is born alive following an abortion or attempted abortion. A health care practitioner who is present must (1) exercise the same degree of care as reasonably provided to another child born alive at the same gestational age, and (2) immediately admit the child to a hospital. The bill also requires a health care practitioner or other employee to immediately report any failure to comply with this requirement to law enforcement. A person who violates the requirements is subject to criminal penalties—a fine, up to five years in prison, or both. Additionally, an individual who intentionally kills or attempts to kill a child born alive is subject to prosecution for murder. The bill bars the criminal prosecution of a mother of a child born alive for conspiracy to violate these provisions, for being an accessory after the fact, or for concealment of felony. A woman who undergoes an abortion or attempted abortion may file a civil action for damages against an individual who violates this bill.

Saving Children Act This bill establishes a new criminal offense that prohibits a physician from knowingly performing a dismemberment abortion. It provides a definition of the term "dismemberment abortion." A physician who performs a dismemberment abortion is subject to a criminal fine, up to two years in prison, or both, unless the dismemberment abortion was necessary to save the mother's life. A woman or a parent of a minor who undergoes a dismemberment abortion may file a civil action for damages against an individual who violates this bill. The legislation bars the criminal prosecution of a woman who undergoes a dismemberment abortion for conspiracy to violate the provisions of this bill, for being a principal or an accessory after the fact, or for concealing a dismemberment abortion.

No Oil Producing and Exporting Cartels Act of 2019 or NOPEC This bill prohibits a foreign state from engaging in collective action impacting the market, supply, price, or distribution of oil, natural gas, or other petroleum product in the U.S. Specifically, a foreign state is prohibited from collective action that limits the production or distribution of such product, collective action to set or maintain the price of such product, or any other action that restrains trade of such product. Specified defenses such as sovereign immunity (i.e., a foreign state's immunity from the jurisdiction of U.S. courts) and the act of state doctrine (i.e., the prohibition of a court invalidating an official act of a foreign sovereign performed within its own territory) shall not apply to a foreign state's violation of this bill.

Never Again Education Act This bill creates the Holocaust Education Assistance Program Fund for the Department of Education (ED) to (1) award grants to eligible entities to carry out Holocaust education programs, and (2) conduct periodic regional workshops to provide teachers with technical assistance on how to incorporate Holocaust education within state and local education standards. The fund may accept donations and in-kind contributions. ED shall (1) create and maintain a Holocaust education program website containing resources for middle grades and high schools; and (2) establish the Holocaust Education Advisory Board to advise on developing application criteria for the fund's grants, to advise on content for the Holocaust education program website, and to lead efforts to solicit donations for the fund.

Rabbi Michoel Ber Weissmandl Congressional Gold Medal Act of 2019 This bill orders the posthumous award of a Congressional Gold Medal to Rabbi Michoel Ber Weissmandl, in recognition of his acts of valor during World War II. The U.S. Mint may strike and sell duplicates in bronze.

Merrill's Marauders Congressional Gold Medal Act This bill directs Congress to award a Congressional Gold Medal to the 5307th Composite Unit (Provisional), commonly known as Merrill's Marauders, in recognition of their bravery and outstanding service in the jungles of Burma (Myanmar) during World War II. Following its award, the gold medal shall be given to the Smithsonian Institution where it shall be displayed and made available for research.

Child Welfare Provider Inclusion Act of 2019 This bill prohibits discrimination or adverse action against a child welfare provider that declines to provide services due to the provider's sincerely held religious beliefs or moral convictions. The prohibition applies to the federal government and any state, tribal, or local government that receives federal funding for child and family services or foster care and adoption assistance. However, government entities may still take adverse action against a provider that denies adoption or foster care placement based on the prospective parent or child's race, color, or national origin. If a state, tribal, or local entity engages in such prohibited actions, the Department of Health and Human Services shall withhold 15% of the federal funds the entity would have received to provide child and family services or foster care and adoption. The bill also provides a private right of action for child welfare providers to sue the government entity for such discrimination, and a prevailing provider shall be entitled to recover reasonable attorney's fees and costs. A government entity that accepts federal funding for child and family services or foster care and adoption assistance shall have waived sovereign entity as a defense to such discrimination allegations.

Agency Accountability Act of 201 9 This bill requires any agency that receives a fee, fine, penalty, or proceeds from a settlement to deposit the amount in the general fund of the Treasury. The bill also prohibits the funds from being used unless the funding is provided in advance in an appropriations bill. The bill includes exceptions for funds to be paid to a whistle-blower, loan guarantee programs, and insurance programs. The requirements do not apply to the U.S. Postal Service or the U.S. Patent and Trademark Office (USPTO). The Department of Commerce and the USPTO must report annually to Congress on funds collected by the USPTO from a settlement. The bill also requires offsetting receipts and collections to be treated as revenue for the purpose of carrying out the Congressional Budget Act of 1974 and other laws. (Offsetting receipts and collections are funds collected by agencies from other government accounts or from the public in businesslike or market-oriented transactions. Under current law, the collections are treated as negative budget authority and outlays rather than revenue and may be used to offset spending for budget enforcement purposes.)

Threat Assessment, Prevention, and Safety Act of 2019 This bill directs the Department of Homeland Security (DHS) to establish a Joint Behavioral Threat Assessment and Management Task Force, which shall provide recommendations to Congress and DHS on the development and implementation of a national strategy for preventing targeted violence through behavioral threat assessment and management. The bill defines behavioral threat assessment and management as the systematic and evidence-based process of (1) identifying individuals whose behavior indicates a capacity for committing acts of violence, (2) investigating and gathering information from multiple sources to assess whether such individuals pose a threat, and (3) the subsequent management of such a threat. DHS shall (1) develop and implement the national strategy and provide information and training services related to it, and (2) award grants to establish community based units for implementing the national strategy.

Reforming EPA Permitting Authority Act or the Reform EPA Act This bill limits the period during which the Environmental Protection Agency may prohibit the specification, or restrict the use, of an area as a disposal site for discharges of dredged or fill materials into waters of the United States.

Protecting Life and Taxpayers Act of 2019 This bill requires federally funded entities to certify that they will not perform, and will not provide funds to any other entity that performs, an abortion, except in cases of rape or incest or where a physical condition endangers the woman's life unless an abortion is performed.

End Government Shutdowns Act This bill provides continuing appropriations to prevent a government shutdown if any appropriations measure for a fiscal year has not been enacted before the fiscal year begins or a joint resolution making continuing appropriations is not in effect. For an initial 120-day period, the bill provides appropriations to continue programs, projects, and activities for which funds were provided in the preceding fiscal year. The bill reduces the continuing appropriations by 1% after the first 120-day period and by an additional 1% for each subsequent 90-day period until the applicable appropriations legislation is enacted.

Middle Class Health Benefits Tax Repeal Act of 201 9 This bill repeals the excise tax on employer-sponsored health care coverage for which there is an excess benefit (high-cost plans). The repeal applies to taxable years beginning after December 31, 2019.

Cyber Diplomacy Act of 2019 This bill establishes the Office of International Cyberspace Policy within the Department of State. The Office's duties include advising the State Department on cyberspace issues. It shall also shall lead diplomatic efforts on issues relating to international cybersecurity, Internet access and freedom, and international cyber threats. The Office shall implement U.S. policy to work internationally to promote an open, interoperable, and secure Internet governed by a multi-stakeholder model. The bill also directs the President to devise a strategy related to U.S. engagement with foreign governments on international norms with respect to responsible state behavior in cyberspace.

This resolution condemns the January 15, 2019, attack by the Al Qaeda-affiliated extremist group Al Shabaab in Nairobi, Kenya, that resulted in the loss of 21 lives. It honors the memory of Jason Spindler, a U.S. citizen killed in the attack, and expresses support for Kenya's efforts to combat terrorism and violent extremism.

Pain-Capable Unborn Child Protection Act This bill establishes a new criminal offense for performing or attempting to perform an abortion if the probable post-fertilization age of the fetus is 20 weeks or more. A violator is subject to criminal penalties—a fine, a prison term of up to five years, or both. The bill provides exceptions for an abortion (1) that is necessary to save the life of the pregnant woman, or (2) when the pregnancy is the result of rape or incest. A physician who performs or attempts to perform an abortion under an exception must comply with specified requirements. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

Preventing Animal Cruelty and Torture Act or the PACT Act This bill revises and expands criminal provisions with respect to animal crushing. It retains existing criminal offenses that prohibit knowingly creating or distributing an animal crush video using interstate commerce. The bill also adds a new provision to criminalize an intentional act of animal crushing. A violator is subject to criminal penalties—a fine, a prison term of up to seven years, or both. It provides additional exceptions for conduct, or a video of conduct, including conduct that is (1) medical or scientific research, (2) necessary to protect the life or property of a person, (3) performed as part of euthanizing an animal, or (4) unintentional.

Shark Fin Sales Elimination Act of 2019 This bill makes it illegal to possess, buy, or sell shark fins or any product containing shark fins, except for certain dogfish fins. A person may possess a shark fin that was lawfully taken consistent with a license or permit under certain circumstances. Penalties are imposed for violations under the Magnuson-Stevens Fishery Conservation and Management Act.

U.S. Senator Joseph D. Tydings Memorial Prevent All Soring Tactics Act of 2019 or the PAST Act This bill addresses the practice of soring horses. The soring of horses includes various actions taken on horses' limbs to produce higher gaits that may cause pain, distress, inflammation, or lameness. Specifically, the bill expands soring regulation and enforcement at horse shows, exhibitions, sales, and auctions, including by establishing a new system for inspecting horses for soring. In addition, the bill increases penalties for violations.

Pre-existing Conditions Protection Act of 2019 This bill reestablishes requirements for private health insurance plans with respect to preexisting conditions, guaranteed enrollment, and discrimination based on health-related factors if they are repealed by another law. In such event, the bill prohibits private health insurance plans from (1) limiting or excluding benefits covering preexisting conditions; (2) denying enrollment to employers or individual applicants, subject to specified limits; (3) establishing rules for eligibility based on an individual's health status; or (4) requiring an individual to a pay higher premium than similarly situated individuals enrolled in the plan based the individual's health status. The bill also prohibits plans from collecting genetic information in connection with issuing health insurance and provides requirements for workplace wellness programs connected to health insurance.
