National Food Stamp Reform Act

National Food Stamp Reform Act - Defines "household" under the Food Stamp Act as meaning a group of individuals who are sharing common living quarters, but who are not residents of an institution or boarding house, and who have access to cooking facilities and for whom food is customarily purchased in common. Provides that the Secretary of Agriculture may not approve any plan which permits any household to simultaneously participate in both the food stamp program and the distribution of federally donated foods. Requires the Secretary to establish uniform national standards of eligibility for participation by households in the food stamp program. States that the income standards of eligibility shall be the income poverty guidelines prescribed by the Office of Management and Budget adjusted pursuant to the Economic Opportunity Act. Directs the Secretary to prescribe additional standards of eligibility which shall include, but not be limited to, the amounts of liquid and nonliquid assets. Provides that household income for purposes of the food stamp program shall be the gross income of the household less: (1) a standard deduction of $100 a month applicable to all households; (2) an additional deduction of $25 a month for any household in which there at least one member who is age sixty-five or older. Limits eligibility to participate in the food stamp program to citizens and aliens lawfully admitted for permanent residency. States that no individual shall be considered eligible for the food stamp program as a member of a household if he is: (1) over 18; (2) is enrolled at an institution of higher education; and (3) is a dependent child for income tax purposes of a taxpayer who is not a member of an eligible household. Prohibits households which transfer liquid or nonliquid assets for the purpose of qualifying for the food stamp program from becoming eligible for at least a ninety-day period. Requires the Secretary to issue photo identification cards to households certified eligible to participate in the program. States that households shall be charged thirty percent of their income for the coupon allotment issued to them. Provides that if a State agency does not comply with the provisions of the Food Stamp Act, the Secretary may refer the matter to the Attorney General with a request for an injunction, or he may direct that there be no further inssuance of coupons in the political subdivisions where such failure has occurred until such time as satisfactory corrective action has been taken. Directs the Secretary to pay to each State agency out of funds appropriated by Congress an amount equal to 75 percent of all direct costs of State food stamp program investigations, prosecutions, and State activities related to recovering losses sustained in the food stamp program. Provides for a civil money penalty of up to $10,000 for each violation of the Food Stamp Act.

Authorizes to be appropriated to make the grants authorized by this Act $57,000,000 for fiscal year 1976, $14,500,000 for the period beginning July 1, 1976, and ending September 30, 1976, and $29,000,000 for fiscal year 1977.

Social Security Reform Amendments - Repeals the earnings limitation under title II (Old-Age, Survivors, and Disability Insurance) of the Social Security Act. Provides benefits under such title to husbands, widowers, and fathers on the same basis as wives, widows, and mothers who presently receive benefits. Eliminates the five-month waiting period for disability benefits. Continues the benefit entitled under such title through the month of the beneficiary's death. Permits individuals 65 years of age or older to elect an exemption from Social Security coverage and payment of Social Security taxes. Eliminates marriage or remarriage of a beneficiary as a factor in terminating or reducing the amount of benefits available. Authorizes direct payments to physicians and other providers at their option under the supplementary medical insurance program of title XVIII (Medicare) of the Social Security Act.

Directs the Secretary and the Director of the Office of Management and Budget to jointly initiate the development of uniform methods and procedures in producing statistical information used in effecting the delivery of Federal benefits to State and local governments and report progress toward the development of such procedures not later than one year after enactment of this Act. Specifies that this Act does not limit the present authority of the Office of Management and Budget to develop statistical standards. (Amends 13 U.S.C. 181; Adds 13 U.S.C. 182, 183, 184)

Provides, under the Omnibus Crime Control and Safe Streets Act, that specific grants under such Act shall not be made to any State, unit of general local government, or public agency, unless there is in effect a law enforcement officer's bill of rights. States that such bill of rights must substantially provide as a minimum the rights enumerated in this Act, including: (1) the right of a law enforcement officer to engage in political activity during off-duty hours or to refrain from such activity; and (2) observance of specified standards with respect to the investigation of a law enforcement officer who is under investigation for alleged malfeasance, misfeasance, or nonfeasance of official duty, with a view to possible disciplinary action, demotion, dismissal, or criminal charges. States that such standards shall include: (1) informing the law enforcement officer of the nature of the investigation, the names of any complainants, and the identity and authority of the person conducting such investigation; (2) full recordation of the investigation; and (3) allowing the law enforcement officer to have his counsel present at any interrogation in connection with the investigation. Grants a law enforcement officer the right to recover pecuniary and other damages from persons violating any of the rights established under the bill of rights. Provides that no law enforcement officer shall be required to disclose, for the purposes of promotion or assignment, any item of his property, income, assets, debts, or expenditures. Establishes a Law Enforcement Officers' Grievance Commission composed of representatives of the general public, law enforcement agencies, and other public agencies. Gives the Commission the authority to receive, investigate, and determine grievances of any law enforcement officer, and to require testimony under oath and the production of documents. Defines terms used in this Act.

Comprehensive Health Care Insurance Act

Comprehensive Health Care Insurance Act - States that the purpose of this Act is to establish a national health care insurance program that will provide comprehensive benefits, including institutional, medical, dental, and other health care, protecting against ordinary and catastrophic expenses of illnesses for all individuals. Requires every employer to offer each of his employees and their families qualified health care insurance. States that such coverage shall be optional with the employee. Provides that when an employee elects to obtain such coverage, the employer shall contribute to the cost of such coverage for the benefit of the employee and his family at least 65 percent of the premium; the employee shall contribute the balance. Permits the Attorney General to bring suit to compel an employer to comply with the provisions of this Act. Stipulates that employers experiencing substantial increases in payroll costs due to the provisions of this Act will be entitled to a cash payment by the Secretary of Health, Education, and Welfare or a credit against income tax. Authorizes appropriations of such sums as are necessary for the Secretary to make such payments. Provides that premiums for employee groups of one to 100 persons and self-employed persons shall not exceed 125 percent of the estimated average in the State of annual premium for employee groups of more than 100 persons. Establishes a program of Federal participation, through a system of certificates of entitlement issued by the Secretary and credits against income tax, in the premium for qualified health care insurance providing comprehensive hospital, medical, dental, and other health care services for non-employed and self-employed individuals and families. States that the amount of Federal participation shall be related to income of the individual or family, the Government to pay the full premium for those whose annual incomes are insufficient to create income tax liability, and to pay a gradually smaller proportion of the premium for others in relation to increasing amounts of income tax liability. Provides that if an individual or family incurs no income tax liability for a base year, such individual or family shall be eligible for a certificate of entitlement or a credit against income tax for 100 percent of the premium for qualified health care insurance. Stipulates that the premium rate to be charged for a qualified health care insurance policy offered under this part for any year shall in no case exceed 125 percent of the estimated average of premiums paid in the State for qualified health care insurance for groups of employees with more than 100 members. Excludes from qualified health care insurance coverage payment for stipulated items, including: (1) personal comfort items; (2) eyeglasses, hearing aids, or orthopedic shoes; and (3) private room inpatient hospital accomodations. Limits the aggregate amount of expenditures for castastrophic illness expenses. Sets forth requirements which must be met by qualified health care insurance plans. Defines terms used in this Act. Establishes the Federal Health Insurance Redemption Fund. Authorizes appropriations to the fund of amounts equal to the aggregate amount of premiums paid under this Act. Requires carriers offering qualified health care insurance policies to participate in an assigned-risk pool which may be established in such State by the State insurance department or by such agency as may be authorized by the State. Establishes a Health Insurance Advisory Board to: (1) prescribe such regulations as may be necessary to carry out the purposes and provisions of this Act; (2) establish minimum Federal standards for the use of State insurance departments in determining whether an insurance company and plan are qualified under this Act; (3) in consultation with carriers, providers of services, and consumers, plan, review, and develop, where necessary programs whose purposes are to provide for maintaining the quality of medical care; and (4) review the effectiveness of the program established in this Act. Stipulates that individuals collecting unemployment compensation are eligible for coverage under this Act, unless covered through an employed member of his family. Permits an income tax credit for premiums paid for qualified insurance plans under this Act.

National Aquaculture Development Act

National Aquaculture Development Act - States that it is the purpose of this Act to provide for a national program for aquaculture development in order to increase sources of marine protein for the consumer; to increase the availability and quality level of consumer fishery products; to develop new resources; to improve or maintain recreational fisheries; and to initiate new business, industry, and employment. Requires the Secretary of Commerce, in consultation with interested Federal agencies and other public and private organizations and with the concurrence of the Secretary of the Interior, to establish national objectives for aquaculture development. Requires the Secretary to act as the interagency coordinator for all Federal programs and activities in aquaculture. Sets forth activities regarding aquaculture development which the Secretary may, as he deems appropriate, carry out pursuant to this Act, including: (1) construction, operation, and maintenance of hatcheries or similar facilities and undertaking of natural habitat improvement activities; (2) assistance to public and private organizations and individuals interested or engaged in aquaculture through advisory and other services; (3) consultation and cooperation with Federal, State, and local governments, regional commissions, institutions of higher learning, and private industry; and (4) performance of basic and applied research to establish a sound information base for the development of aquaculture. Provides that the Secretary, in consultation with affected States, shall locate, construct, operate, and maintain such pilot aquaculture facilities as he deems appropriate in order to develop aquaculture technology relative to particular species of fish and shellfish. Authorizes the Secretary to carry out such functions and duties authorized by this Act as he deems appropriate through grants to or contracts with the States, regional commissions, local governments, institutions of higher learning, private industry, and other public and private organizations. Authorizes an appropriation for each fiscal year beginning with fiscal year 1975, equal to 30 percent of the gross receipts from duties collected under the customs laws on fishery products during the period January 1 to December 31, both inclusive, preceding the beginning of each such fiscal year. Authorizes the Secretary to carry out such other research as he deems appropriate in order to perform his functions and duties under this Act. Provides that the authority contained in this Act shall expire at the end of the fiscal year during which occurs the fifth anniversary of the date of enactment.

Requires the Administrator to conduct a survey to determine the reasonable cost of interment and prepetual care maintenance for the purposes of payment under this Act. Authorizes the Administrator to pay transportation costs of the bodies of eligible veterans to national cemeteries.

Local Public Works Capital Development and Investment Act - States that the current depressed condition of the national economy has had an especially heavy impact upon local governments, making it no longer possible for them to finance needed public facilities, thereby threatening the health, safety, and general welfare of their citizens. Declares it to be needless and unwise public policy for a vast pool of idle manpower to coexist with a backlog of needed and long overdue local public facilities work. Authorizes the Secretary of Commerce acting through the Economic Development Administration to make grants to any State or local government for local public works projects, including but not limited to: (1) those public works projects of State and local governments for which Federal financial assistance is authorized under provisions of law other than this Act; and (2) the architectural design, engineering, and related planning of local public works projects. Provides that the Federal share of any project for which a grant is made under this Act shall be 100 percent of the cost of such project. Directs the Secretary to prescribe those rules, regulations, and procedures necessary to carry out this Act. States factors that the Secretary shall consider in accordance with the relative needs of the various sections of the country. Authorizes the Secretary to make a grant for the purpose of increasing to 100 percent the Federal contribution to a public works project for which Federal financial assistance is authorized under provisions of law other than this Act. States that not more than 10 percent of all amounts authorized to carry out this Act shall be granted for local public works projects within any one State. Provides that all laborers and mechanics employed by contractors or subcontractors on projects assisted by this Act shall be paid wages a rate not less than those prevailing on similar construction in the locality as determined by the Secretary of Labor in accordance with the Davis-Bacon Act. Authorizes to be appropriated an amount not to exceed $5,000,000,000 to carry out this Act.

Administrative Rulemaking Control Act - States that it is the purpose of this Act to establish a procedure whereby Congress may review certain rulemaking activities of executive agencies, thereby exercising greater control and oversight over the operations of such agencies. Provides that an administrative rule, the violation of which subjects an individual to a criminal penalty, shall take effect only: (1) if published in the Federal Register; (2) after the expiration of 30 days of continuous session of Congress after the date on which the rule was published; and (3) if neither House of Congress passes a resolution disfavoring such a rule. Sets forth procedures governing the consideration of such rules by the Congress.

Creates a select committee in the House of Representatives with authority to conduct a full and complete investigation of the problem of United States servicemen missing in action or known to be dead whose bodies have not been recovered, as a result of military operations in North Vietnam, South Vietnam, Laos and Cambodia. Provides that such investigation shall include an examination of the need for additional international inspection teams to determine whether there are servicemen still held as prisoner of war. Authorizes the Committee to hold hearings, issue subpenas, and maintain a staff as necessary to carry out its responsibilities under this resolution. Directs the committee to report to the House the results of its investigation no later than one year after adoption of this resolution. Provides that the committee's authority shall expire 30 days after the filing of such report. Directs that the expenses of the select committee shall be paid from the contingent fund of the House of Representatives upon vouchers signed by the Chairman.

Occupational Safety and Health Act Amendments

Occupational Safety and Health Act Amendments - Provides that the Secretary of Health, Education, and Welfare shall not propose any rule promulgating a new occupational health or safety standard before (1) he has as part of each such proposal reviewed and published in the Federal Register the financial impact of such proposed standard and (2) he has determined with due regard for that impact that the benefit to be derived from such standard justified such proposal. Directs the Secretary to provide for an emergency standard to take effect immediately after publication in the Federal Register if he determines (1) that there is clear and recognized evidence of employees being exposed to serious danger from exposure to substances or agents determined to be toxic or physically harmful or from new hazards, and (2) that such emergency standard is necessary to protect employees from such danger. Requires the Secretary to provide at least twenty-four hours advance notice to the employer to be inspected that an inspection will be made where (1) such notice would afford the employer an opportunity to have qualified management personnel or consultants present during the inspection and (2) where the Secretary has determined that such notice would not unreasonably hamper or defeat the purposes of the Occupational Safety and Health Act. Directs the Secretary to visit the workplace of employees for the purposes of affording consultation and advice to such employers, upon the request of the employers.

Directs the Secretary of Commerce, during intervals between decennial censuses of population, to produce and publish for each State, county, and local unit of government with a population of 50,000 or more current data on total population. Authorizes the Secretary to make surveys on subjects (other than population) covered by the censuses provided for in this title. Requires that data most recently produced and published shall be used in the administration of any law of the United States in which population is used to determine the amount of benefit received by State and local units of general purpose government (other than laws relating to the apportionment of U.S. Representatives). Directs the Secretary and the Director of the Office of Management and Budget to jointly initiate the development of uniform methods and procedures in producing statistical information used in effecting the delivery of Federal benefits to State and local governments and report progress toward the development of such procedures not later than one year after enactment of this Act. Specifies that this Act does not limit the present authority of the Office of Management and Budget to develop statistical standards. (Amends 13 U.S.C. 181; Adds 13 U.S.C. 182, 183, 184)

Notifies the governments of the Soviet Union and the Peoples' Republic of China that their actions in Vietnam shall be considered a test of faith in efforts toward detente. Calls upon individual nations and the United Nations to take action to assure the right of asylum to Vietnamese refugees.
