Merchant Mariners of World War II Congressional Gold Medal Act of 2018 This bill requires the House of Representatives and the Senate to award a Congressional Gold Medal to the U.S. merchant mariners of World War II, in recognition of their service during World War II.

First Division Monument Modification Act This bill authorizes the Society of the First Infantry Division to modify the First Division Monument located on federal land in Presidential Park, District of Columbia, to honor members of the First Infantry Division of the U.S. Army who died during U.S. operations, including Operation Desert Storm, Operation Iraqi Freedom, Operation New Dawn, and Operation Enduring Freedom. The First Infantry Division must provide the society with a list of names to be added to the monument. The Commemorative Works Act, which prohibits monuments to military units, shall not apply to this authorization. Federal funds may not be used to pay for the activities authorized by this bill.

Agricultural Certainty for Reporting Emissions Act This bill amends the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to exempt air emissions from animal waste at a farm from specified release notification requirements, recordkeeping requirements, and associated penalties.

Electricity Reliability and Fuel Security Act This bill amends the Internal Revenue Code to allow a tax credit through 2022 for a portion of the expenses for the operation or maintenance of a coal-powered electric generation unit, excluding expenses for coal. The credit applies to taxpayers who own or lease an electric generation unit that uses coal to produce at least 75% of the electricity produced by the unit. Qualified public entities may transfer the credit to an eligible project partner. A "qualified public entity" is: (1) a federal, state, or local government entity or any political subdivision, agency, or instrumentality thereof; (2) a mutual or cooperative electric company; or (3) a not-for-profit electric utility which had or has received a loan or loan guarantee under the Rural Electrification Act of 1936. An "eligible project partner" is a person who: is responsible for operating, maintaining, or repairing the unit; participates in the provision, including transportation, of coal to the unit; provides financing for the construction or operation of the unit; or leases the unit.

Ski Area Fee Retention Act This bill amends the Omnibus Parks and Public Lands Management Act of 1996 to establish the Ski Area Fee Retention Account. A specified portion of rental charges for ski area permits on a Forest Service unit shall be deposited in such account, and a specified portion of such amounts shall be available to such unit for ski area administration, improvements, and visitor services.

Sets forth the rule for consideration of the bill (H.R. 1119) to establish the bases by which the Administrator of the Environmental Protection Agency shall issue, implement, and enforce certain emission limitations and allocations for existing electric utility steam generating units that convert coal refuse into energy, and providing for consideration of the bill (H.R. 1917) to allow for judicial review of any final rule addressing national emission standards for hazardous air pollutants for brick and structural clay products or for clay ceramics manufacturing before requiring compliance with such rule.

Cardiac Arrest Survival Act of 2018 This bill expands immunity from civil liability related to emergency use of automated external defibrillator devices (AEDs). Among other things, the bill specifies that immunity applies regardless of whether the person who used the AED complied with signage, received training, or was assisted or supervised, including by a licensed physician.

Pay Our Protectors Not Our Politicians Act of 2018 This bill provides FY2018 appropriations for military pay during any period in which interim or full-year appropriations for FY2018 are not in effect. The appropriations provided by this bill are available until the earlier of: (1) the enactment into law of specified appropriations legislation, or (2) January 1, 2019. The bill provides continuing appropriations for pay and allowances of: members of the Armed Forces, including reserve components, who perform active service; members of the reserve components of the Armed Forces who perform inactive-duty training; civilian personnel or contractors of the Department of Defense (and the Department of Homeland Security [DHS] in the case of the Coast Guard) who are providing support to members of the Armed Forces; and DHS employees who are performing national security activities. It also provides continuing appropriations for payments related to: death gratuities, funeral and burial expenses, authorized funeral travel and travel related to the dignified transfer of remains and unit memorial services, and the temporary continuation of a basic allowance of housing for dependents of members dying on active duty. The bill also prohibits Members of Congress from being paid when a government shutdown is in effect during the 116th and succeeding Congresses. During the 115th Congress, congressional pay must be withheld during a government shutdown and released at the end of the Congress.

Iran Freedom Policy and Sanctions Act This bill sets forth requirements concerning the imposition of sanctions against entities owned or controlled by the Armed Forces of Iran, the reinstatement of certain sanctions that were suspended pursuant to the Joint Comprehensive Plan of Action, and the expansion or extension of sanctions with respect to Iran's ballistic missile program.

Defending U.S. Government Communications Act This bill prohibits federal agencies from procuring or obtaining, renewing or extending a contract to obtain or procure, or entering into a contract with an entity that uses any equipment, system, or service with telecommunications equipment or services as a substantial or essential component of any system that is from Huawei Technologies Company, ZTE Corporation, or an entity reasonably believed to be owned or controlled by China.

Born-Alive Abortion Survivors Protection Act This bill amends the federal criminal code to require any health care practitioner who is present when a child is born alive following an abortion or attempted abortion to: (1) exercise the same degree of care as reasonably provided to any other child born alive at the same gestational age, and (2) ensure that such child is immediately admitted to a hospital. The term "born alive" means the complete expulsion or extraction from his or her mother, at any stage of development, who after such expulsion or extraction breathes or has a beating heart, pulsation of the umbilical cord, or definite movement of voluntary muscles, regardless of whether the umbilical cord has been cut. Also, a health care practitioner or other employee who has knowledge of a failure to comply with these requirements must immediately report such failure to an appropriate law enforcement agency. An individual who violates the provisions of this bill is subject to a criminal fine, up to five years in prison, or both. An individual who commits an overt act that kills a child born alive is subject to criminal prosecution for murder. The bill bars the criminal prosecution of a mother of a child born alive for conspiracy to violate these provisions, for being an accessory after the fact, or for concealment of felony. A woman who undergoes an abortion or attempted abortion may file a civil action for damages against an individual who violates this bill.

This bill amends the Wyoming Wilderness Act of 1984 to direct the Department of Agriculture, with respect to helicopter skiing in the Palisades Wilderness Study Area in the Bridger-Teton and Targhee National Forests in Wyoming, to authorize the number of permitted days of helicopter skiing to be at least the number of days specified in the High Mountain Heli-Skiing Final Environmental Impact Statement for certain national forest districts in Wyoming and Idaho, issued by the Forest Service on June 30, 2005. Subject to such requirement, all recreational uses occurring before the enactment of this bill within the Palisades, High Lakes, and Shoal Creek Wilderness Study Areas, including horseback riding, snowmobiling, dirt bike riding, mountain biking, and helicopter skiing shall continue to be permitted in those areas. The bill bars the construction of any recreational access points in such wilderness study areas, except by an express authorization of Congress.

Endangered Fish Recovery Programs Extension Act of 2017 This bill extends through FY2023 the authority of the Department of the Interior to use power revenues collected pursuant to the Colorado River Storage Project Act for annual base funding of endangered fish recovery implementation programs for the Upper Colorado and San Juan River Basins. Additionally, Interior must submit to Congress a report that describes the accomplishments and costs of the recovery implementation programs.

Sets forth the rule for consideration of the bill (H.R. 3017) to amend the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to reauthorize and improve the brownfields program, and for other purposes, and providing for consideration of the bill (H.R. 3905) to require congressional approval of any mineral withdrawal or monument designation involving the National Forest System lands in the State of Minnesota, to provide for the renewal of certain mineral leases in such lands.

Admiral Lloyd R. "Joe" Vasey Pacific War Commemorative Display Establishment Act This bill authorizes the Pacific Historic Parks to establish and maintain a commemorative display to honor the members of the U.S. Armed Forces and Allies who served in the Pacific Theater during World War II. Federal funds may not be used to design, procure, prepare, install, or maintain the commemorative display, but the National Park Service may accept and expend contributions of nonfederal funds and resources for such purposes.

Foreign Investment Risk Review Modernization Act of 2017 This bill amends the Defense Production Act of 1950 to expand the scope of "covered transaction" subject to the review of the Committee on Foreign Investment in the United States (CFIUS). CFIUS analyzes the national security implications of foreign investment in the United States. A covered transaction includes: any merger, acquisition, or takeover that could result in foreign control of any U.S. business, the purchase or lease of real estate located in the United States that is in close proximity to a U.S. military installation or to another U.S. government facility or property that is sensitive for reasons relating to national security, other investment in a U.S. critical technology company or U.S. critical infrastructure company, any change in a foreign investor's rights that results in foreign control of a U.S. business, the contribution of intellectual property to a foreign person, or any other transaction, transfer, agreement, or arrangement designed to evade or circumvent the authority of CFIUS. The bill revises other provisions relating to CFIUS, including the length of its review period, special hiring authority and funding, and authority to mandate reviews or take unilateral action.

Protecting Home Oxygen & Medical Equipment Access Act of 2017 or the Protecting HOME Access Act of 2017 This bill: (1) requires the Centers for Medicare & Medicaid Services (CMS) to delay by one year the full implementation of new Medicare payment rates for durable medical equipment, and (2) revises a Medicare budget-neutrality requirement related to oxygen. Under current law, the CMS may establish separate payment classes under Medicare for items of oxygen and related equipment only if doing so does not result in increased program expenditures. The bill provides an exception to this budget-neutrality requirement with respect to such items that are included in a competitive acquisition program.

Securing All Livestock Equitably Act of 2017 or the SALE Act of 2017 This bill amends the Packers and Stockyards Act, 1921 to require all livestock purchased by a dealer in cash sales and all inventories of, or receivables or proceeds from, such livestock to be held by the dealer in a trust until all unpaid cash sellers of the livestock have been paid. The bill exempts from the requirement any dealer whose average annual purchases of livestock do not exceed $500,000.

Federal Land Freedom Act This bill authorizes a state with an oil and gas leasing program to take responsibility from the federal government for leasing and regulating the exploration and development of oil, gas, and other forms of energy on federal land in the state. A state must submit to the Department of the Interior and the Department of Agriculture a regulatory program which demonstrates that it has the capability to take responsibility from the federal government, including that it has a state law which provides sanctions for violations of state laws, regulations, or conditions of permits concerning oil and gas exploration, development, and production activities.

Rightsizing Pension Premiums Act of 2017 This bill amends the Employee Retirement Income Security Act of 1974 (ERISA) to: (1) modify the formula that the Pension Benefit Guaranty Corporation (PBGC) uses to calculate the funded percentage of single-employer pension plans, and (2) reduce single-employer PBGC premiums for pension plans that are sponsored by certain small employers or have specified PBGC funded percentages. The bill also prohibits the budget effects of provisions that change PBGC premiums from being counted for the purposes of determining budget points of order for legislation in the House or the Senate. (The PBGC is a federal agency that insures the benefits of private sector, defined benefit pension plans. The PBGC is financed by insurance premiums paid by sponsors of the plans, investment income, assets from pension plans taken over by the PBGC, and recoveries from the companies formerly responsible for the plans.)

Hizballah International Financing Prevention Amendments Act of 2017 This bill amends the Hizballah International Financing Prevention Act of 2015 to impose specified sanctions on: (1) foreign persons that knowingly assist in or provide support for fund raising or recruitment activities for Hizballah; (2) agencies of foreign governments that provide Hizballah with financial support, arms, or other assistance (export license requirements are included in addition to sanctions if such government is a state sponsor of terrorism); and (3) Hizballah, including by reason of Hizballah's significant transnational criminal activities. The bill expresses the sense of Congress that sanctions should be placed on financial institutions that serve Lebanese government officials affiliated with Hizballah. The Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 is amended to sanction foreign financial institutions that facilitate efforts by Iran or the Islamic Revolutionary Guard Corps to aid Hizballah. The bill prescribes reporting requirements or reporting modifications with respect to: (1) foreign persons that knowingly assist or provide significant financial, material, or technological support for foreign persons assisting Hizballah; (2) financial institutions that are owned or organized under the laws of state sponsors of terrorism; (3) Hizballah's racketeering activities; (4) combating illicit tobacco trafficking networks used by Hizballah and other foreign terrorist organizations to finance their operations; (5) the estimated net worth of senior Hizballah officials and how these funds were acquired and used; and (6) countries that support Hizballah or in which Hizballah maintains important logistics networks or financial networks and steps such countries are taking to disrupt such networks.

Hunting, Education, and Recreational Development Act or the HEARD Act This bill authorizes the Department of the Interior and the Department of Agriculture (USDA) to dispose of federal lands under their respective jurisdictions by offering them for sale or exchange to units of local government in accordance with this bill. The bill prescribes requirements for disposition of the gross proceeds of the sales of lands under this bill, including that: 15% be paid to the state where the sale takes place to be used to supplement the education of students in kindergarten through grade 12, to supplement public support of institutions of public higher education, and to supplement state agricultural and natural resource agencies; and 10% of such proceeds be deposited in a special account to be created in the Treasury which may be used for the acquisition of recreational beneficial lands and interests (providing an opportunity for hunting, recreational fishing, recreational shooting, recreational off-highway vehicles, or other recreational purposes, or to achieve better management of public lands through consolidation of federal ownership).

ELD Extension Act of 2017 This bill delays for an additional two years the effective date of regulations implementing the requirement that a commercial motor vehicle involved in interstate commerce and operated by a driver subject to federal hours of service (HOS) and record of duty status regulations be equipped with an electronic logging device to improve vehicle operator compliance with HOS regulations.

Sets forth the rule for consideration of the bill (H.R. 2910) to provide for Federal and State agency coordination in the approval of certain authorizations under the Natural Gas Act, and for other purposes; providing for consideration of the bill (H.R. 2883) to establish a more uniform, transparent, and modern process to authorize the construction, connection, operation, and maintenance of international border-crossing facilities for the import and export of oil and natural gas and the transmission of electricity; providing for consideration of the bill (H.R. 218) to provide for the exchange of Federal land and non-Federal land in the State of Alaska for the construction of a road between King Cove and Cold Bay.

Transparency and Honesty in Energy Regulations Act of 2017 This bill prohibits the Department of Energy, the Environmental Protection Agency (EPA), the Department of the Interior, and the Council on Environmental Quality from considering the social cost of carbon, methane, or nitrous oxide as part of any cost benefit analysis in the rule making process, unless a federal law is enacted authorizing such consideration. They may also consider those social costs if they use an estimate that: (1) complies with the requirements of the Office of Management and Budget's "Circular A-4" document; (2) uses the discount rates of three and seven percent specified in that document; (3) considers only the domestic costs and benefits of the activity; and (4) uses only the most up to date and empirically estimated equilibrium climate sensitivity distributions, and realistic time horizons. The EPA must report on the number of proposed and final rulemakings, guidance documents, and agency actions since January 2009 that use those social costs, including as part of any cost benefit analysis required under Executive Order 12866 or other relevant authority.

This bill amends the Clean Air Act to provide that a modification of a stationary source results in an increase in air pollution only when the maximum achievable hourly emissions rate from the source is higher than: (1) the rate of the source as it was originally designed, and (2) the rate that was actually achieved during the 10 years before the change.

Securing the Homeland by Increasing our Power on the Seas Act or the SHIPS Act This bill declares that it shall be the policy of the United States to have available, as soon as practicable, at least 355 battle force ships, comprised of the optimal mix of platforms, with funding subject to the annual authorization and appropriation of funds.

Resilient Federal Forests Act of 2017 This bill shall apply whenever the Department concerned, either the Department of Agriculture for National Forest System (NFS) lands or the Department of the Interior for public lands, prepares an environmental assessment or an environmental impact statement pursuant to the National Environmental Policy Act of 1969 (NEPA) for specified forest management activities, including those that: will occur on lands identified as suitable for timber production; or will occur on a landscape-scale area designated by the Department concerned as part of an insect and disease treatment program on NSF land pursuant to the Healthy Forests Restoration Act of 2003, notwithstanding whether such activity is initiated before September 30, 2018. In such an environmental assessment or environmental impact statement, the Department concerned shall study, develop, and describe only these two alternatives: the forest management activity, and the alternative of no action. In the case of the alternative of no action, the Department concerned shall evaluate: the effect of no action on forest health, habitat diversity, wildfire potential, insect and disease potential, and timber production; and the implications of a resulting decline in forest health, loss of habitat diversity, wildfire, or insect or disease infestation on domestic water supply in the project area, wildlife habitat loss, and other economic and social factors. The bill establishes categorical exclusions regarding certain other forest management actions. A process is established for declaration of a major disaster for wildfire on federal lands managed by specified federal land management agencies.

Planning for American Energy Act of 2017 This bill requires the Department of the Interior to develop and publish a quadrennial federal onshore energy production strategy for energy development and department resource allocation in order to promote the energy security and national security of the United States.

Combating BDS Act of 2017 This bill allows a state or local government to adopt and enforce measures to divest its assets from, prohibit investment of its assets in, or restrict contracting with: (1) an entity that engages in a commerce- or investment-related boycott, divestment, or sanctions activity targeting Israel; or (2) an entity that owns or controls, is owned or controlled by, or is under common ownership or control with such an entity. Such measures are not preempted by federal law. A state or local government that seeks to adopt or enforce such measures shall comply with specified requirements related to notice, timing, and opportunity for comment. In addition, the bill amends the Investment Company Act of 1940 to prohibit a person from bringing any civil, criminal, or administrative action against a registered investment company based solely upon that company's divestment from securities issued by a person that engages in a commerce- or investment-related boycott, divestment, or sanctions activity targeting Israel.

Outdoor Recreation Enhancement Act This bill amends the Fair Labor Standards Act of 1938 to extend the exemption from minimum wage and maximum hours requirements to an employee of a recreational establishment engaged in providing services or facilities directly related to outfitting and guiding or similar outdoor recreation activities, or rental of outdoor recreational equipment. Federal agencies shall notify their contractors of the applicability of this exemption. This bill exempts from service contract labor standards and paid sick leave requirements contracts with the Department of the Interior or the Department of Agriculture that provide services directly related to the recreational activities specified by this bill.

Employee Rights Act This bill amends the National Labor Relations Act to: (1) make it an unlawful labor practice for a labor organization to interfere (currently, restrain or coerce) with the rights of employees to organize and collectively bargain; (2) require union recertification after a turnover in the workforce exceeding 50% of the bargaining unit; (3) require the National Labor Relations Board (NLRB) to give 14 days advance notice before a hearing investigating an election petition; and (4) require an employer to provide the NLRB with a list consisting only of employee names and addresses of all eligible voters within seven days after an NLRB determination of the appropriate bargaining unit or an agreement on eligible voters. The bill: (1) grants union and nonunion employees the right to vote by secret ballot on whether to ratify a collective bargaining agreement or engage in a strike, (2) prohibits the use of union dues for any purpose not directly related to collective bargaining, (3) prohibits a strike without the consent of a majority of all represented employees determined by secret ballot, and (4) prohibits the use or threat of force or violence to obtain the right to represent employees. .

State Mineral Revenue Protection Act This bill amends the Mineral Leasing Act to provide a mechanism for states to receive their entitled percentage of sales, bonuses, royalties, and rentals for all public land or deposits located in the state. The bill eliminates the 2% fee that the federal government currently deducts from a state's entitled share to cover administrative or other costs. On request of a state, the Department of the Interior must convey to the state their entitled percentage of all right, title, and interest for all public land or deposits located in the state. Interior must provide prompt notice of any such conveyance and the duty of the leaseholder to make direct payments to the state.

Modernizing the Pittman-Robertson Fund for Tomorrow's Needs Act of 2017 This bill amends the Pittman-Robertson Wildlife Restoration Act to make it one of the purposes of the Act to provide financial and technical assistance to the states for the promotion of hunting and recreational shooting. The bill also prescribes a formula for the allocation of funds apportioned to a state that may be used for any activity or project to recruit or retain hunters and recreational shooters. In addition to other uses authorized under this bill, amounts apportioned to the states from any taxes on pistols, revolvers, bows, and arrows may be used for hunter recruitment and recreational shooter recruitment. The funds apportioned to a state for wildlife restoration management may be used for related public relations. If a state has not used all of the tax revenues apportioned to it for firearm and bow hunter education and safety program grants, it may use its remaining apportioned funds for the enhancement of hunter recruitment and recreational shooter recruitment. Up to $5 million of the revenues covered into the wildlife restoration fund in the Treasury from any tax imposed for a fiscal year on the sale of certain bows, arrows, and archery equipment shall be available to the Department of the Interior exclusively for making hunter recruitment and recreational shooter recruitment grants that promote a national hunting and shooting sport recruitment program, including related communication and outreach activities.

American Legion 100th Anniversary Commemorative Coin Act This bill requires the Department of the Treasury to mint and issue commemorative coins in recognition and celebration of the 100th anniversary of the American Legion. Surcharges received from the sale of these coins shall be paid to the American Legion for costs related to promoting the importance of: (1) caring for those who have served, and those who are still serving, in the Armed Forces; and (2) maintaining patriotic values, strong families, and assistance for at-risk children.

Expresses the sense of Congress that the United States should withdraw from the Paris Agreement on climate change, adopted in December 2015.
