Food and Fuel Consumer Protection Act of 2016 This bill amends the Clean Air Act by revising the renewable fuel program, which requires transportation fuel to contain a minimum volume of renewable fuel. The Environmental Protection Agency (EPA) must cap the total volume of ethanol blended into the transportation fuel supply at 9.7% of projected gasoline demand as determined by the Energy Information Administration.

Christa McAuliffe Commemorative Coin Act of 2016 This bill directs the Department of the Treasury to mint and issue not more than 350,000 $1 silver coins in commemoration of Christa McAuliffe. The design of the coins shall bear an image of and the name of Christa McAuliffe on the obverse side and a design on the reverse side that depicts the legacy of McAuliffe as a teacher. Treasury may issue the coins from January 1-December 31, 2018. All surcharges received by Treasury from the sale of the coins shall be paid to the FIRST robotics program for the purpose of engaging and inspiring young people, through mentor-based programs, to become leaders in the fields of science, technology, engineering, and mathematics.

Curb Opioid Misuse By Advancing Technology Act of 2016 This bill amends the Federal Food, Drug, and Cosmetic Act to extend the marketing exclusivity period for certain brand name drugs that the Food and Drug Administration approves: (1) on the basis of new clinical abuse potential studies, and (2) with labeling that characterizes the drug's abuse-deterrent properties. This extension does not apply to the marketing exclusivity period for new chemical entities. The bill also extends the marketing exclusivity period for generics of these drugs.

Suppressor Export Act This bill amends the Arms Export Control Act to provide that a regulation or related implementing policy or practice regarding registration and licensing requirements for manufacturers, exporters, or importers of designated defense articles and defense services may not prohibit the otherwise lawful export for sale or transfer of any firearm silencer or component, if: the item may be lawfully manufactured in the United States; and the importing country has a lawful public or private use market for such item and is not listed as a country prohibited from receiving arms exports.

S tability and Democracy for Ukraine Act or the STAND for Ukraine Act This bill provides that no federal agency should take any action or extend any assistance that recognizes Russian sovereignty over Crimea, its airspace, or its territorial waters. The bill urges that the Government Publishing Office not print any document indicating Crimea as part of the Russian Federation (Russia). U.S. sanctions provided for in Executive Orders 13660, 13661, 13662, (blocking property of persons contributing to the situation in Ukraine) and 13685 (blocking property of persons contributing to the situation in Crimea) shall remain in effect until the President certifies to Congress that: Ukraine's sovereignty over Crimea has been restored, or the status of Crimea has been resolved to the satisfaction of a democratically elected government of Ukraine. The Support for the Sovereignty, Integrity, Democracy, and Economic Stability of Ukraine Act of 2014 is amended to authorize the President to block and prohibit a foreign person's transactions of property or property interests that are U.S.-sited or controlled by a U.S. person if the foreign person has knowingly: (1) violated such executive orders, or (2) facilitated deceptive or structured transactions for or on behalf of any person subject to U.S. sanctions against Russia. The President shall: use U.S. influence to seek North Atlantic Treaty Organization (NATO) adoption of a policy that opposes the transfer of defense articles and services to Russia while Russia occupies the territory of Ukraine or of a NATO member, and direct appropriate U.S. agencies to monitor and identify transfers by NATO members of defense articles and services to Russia. A license application or other authorization for the transfer of any defense article or service to or on behalf of a NATO member so identified shall be subject to a presumption of denial. The Sergei Magnitsky Rule of Law Accountability Act of 2012 is amended to include in the list of persons responsible for gross violations of human rights persons committing such actions in any territory forcibly occupied or otherwise controlled by Russia. The Department of State shall seek to establish an international consortium to increase private investment in Ukraine that shall include the United States. It is the sense of Congress that the Broadcasting Board of Governors shall establish Crimean Tatar services (subordinate to the Ukrainian language services) and broadcast Crimean Tatar language content into Crimea.

This bill bars the Department of Transportation (DOT) from issuing a foreign air carrier permit, or an exemption from certain economic regulations, to furnish foreign air transportation under the United States-European Union-Norway-Iceland Air Transport Agreement of June 21, 2011, unless DOT: finds that issuing the permit or exemption would be consistent with the intent of the parties, set forth in article 17 bis of the agreement, that opportunities created by the agreement do not undermine labor standards or the labor-related rights and principles contained in the parties' respective laws; and imposes conditions on the permit or exemption necessary to ensure that the foreign air transportation furnished complies with the intent of article 17 bis .

Better Accounting for Medicaid Costs Act of 2016 This bill amends title XI (General Provisions) of the Social Security Act to require the Centers for Medicare & Medicaid Services (CMS) to follow rulemaking procedures with respect to certain Medicaid subregulatory policies. Before issuing a Medicaid subregulatory policy, CMS must determine the extent to which the policy is projected, with respect to each year in a 10-year period, to increase state or federal expenditures under the Medicaid program. If the policy is projected to increase expenditures by an amount exceeding a specified threshold, CMS may implement the policy only through notice and comment rulemaking.

Synthetic Drug Awareness Act of 2016 This bill requires the Surgeon General to report to Congress on the public health effects of the increased use since January 2010 by individuals who are 12 to 18 years old of drugs developed and manufactured to avoid control under the Controlled Substances Act (e.g., synthetic marijuana, also known as "spice," and synthetic amphetamines, also known as "bath salts").

This joint resolution disapproves and nullifies a Department of Labor rule published on April 8, 2016, relating to the definition of the term "fiduciary" and the conflict of interest rule with respect to retirement investment advice. (The rule defines who is a fiduciary with respect to pension and retirement plans. Under current law, a person who provides investment advice has a fiduciary obligation that requires the person to provide advice in the sole interest of plan participants and beneficiaries. The rule changes the definition of "investment advice" to treat people who provide investment advice to pension and retirement plans for a fee or other compensation as fiduciaries in a wider array of advice relationships.)

Advanced Nuclear Technology Development Act of 2016 This bill requires the Department of Energy (DOE) and the Nuclear Regulatory Commission (NRC) to enter into a memorandum of understanding to: ensure that DOE has sufficient technical expertise to support the civilian nuclear industry's timely development and commercial deployment of safe, innovative advanced reactor technology; ensure that the NRC has sufficient technical expertise to support the evaluation of requests for regulatory approval for advanced reactors; use computers and software codes to calculate the behavior and performance of advanced reactors based on mathematical models of their physical behavior; and ensure that the DOE maintains and develops the facilities to support the civilian nuclear industry's timely development and commercial deployment of safe, innovative reactor technology and ensuring that the NRC has access to such facilities, as needed. DOE must submit a report to Congress within 180 days evaluating activities intended to facilitate the testing and demonstration of advanced reactors on DOE land and facilities and the potential for DOE to test and demonstrate on private land. In addition, the NRC is required to develop a regulatory framework for licensing advanced nuclear reactors. This bill amends the Omnibus Budget Reconciliation Act of 1990 to require that the aggregate amount of fees collected by the NRC from licensees and certificate holders in a fiscal year be decreased by the amount of appropriations for activities related to the development of regulatory infrastructure for advanced nuclear reactor technologies.

Firearm Due Process Protection Act This bill amends the Brady Handgun Violence Protection Act to establish a 60-day time limit for the Department of Justice to make a final disposition of a request to correct a record in the National Instant Criminal Background Check System. With respect to violations of that limit, the bill establishes a private right to action.

End Executive Overreach Act This bill prohibits, until January 21, 2017, the use of federal funds, fees, or resources to implement an executive order issued on or after the enactment of this bill. The bill prohibits any agency, until such date, from making or finalizing: a major rule (a rule that is likely to result in an annual effect on the economy of $100 million or more); a rule that may raise novel legal or policy issues arising out of legal mandates, the President's priorities, or the principles set forth in Executive Order 12866 (which requires that significant regulatory actions be submitted for review by the Office of Information and Regulatory Affairs of the Office of Management and Budget); or a rule that may create a serious inconsistency or otherwise interfere with an action taken or planned by another agency.

Ensuring Access to General Surgery Act of 2016 This bill requires the Department of Health and Human Services (HHS) to study access by underserved populations to general surgeons, including whether the health professional shortage area designation under the National Health Service Corps program accurately assesses adequacy of access or whether another measure or designation would be more appropriate. HHS must consider potential methodologies for designating surgical health professional shortage areas.

This bill provides that the monthly stipend under the Post-9/11 Educational Assistance program for a member of the reserve components of the Armed Forces who is pursuing a program of education using assistance under such program and performing certain active duty service shall be payable on a pro rata basis for the period of such month in which the individual is not performing active duty service.

Free File Act of 2016 This bill requires the Department of the Treasury to continue to operate the Internal Revenue Service (IRS) Free File Program. The program must work with state government agencies to enhance and expand the use of the program, while continuing to: provide free commercial-type online individual income tax preparation and electronic filing services to the lowest 70% of taxpayers by income; provide all taxpayers (regardless of income) with a basic, online electronic fillable forms utility; and work with the private sector to provide the free tax preparation and electronic filing services. Treasury must work with the private sector through the program to identify and implement innovative new program features to improve and simplify the taxpayer's experience with completing and filing individual income tax returns. The IRS and members of the tax software and electronic industry involved in the program must support and promote improvements within the program by mutually testing, piloting, and offering innovative solutions to: simplify the tax system, reduce compliance and reporting burdens, increase tax return accuracy through financial data authentication, strengthen the tax system against fraud through cybersecurity collaboration, avoid duplication, and maximize the use of electronic technology.

Kevin and Avonte's Law of 2016 Missing Americans Alert Program Act of 2016 This bill amends the Violent Crime Control and Law Enforcement Act of 1994 to revise and rename the Missing Alzheimer's Disease Patient Alert Program as the Missing Americans Alert Program and to reauthorize it through FY2021. It directs the Department of Justice's (DOJ's) Bureau of Justice Assistance to award grants to state and local law enforcement or public safety agencies and nonprofit organizations to prevent wandering and locate missing individuals with dementia or developmental disabilities. DOJ must establish and certain grant recipients must comply with standards and best practices related to the use of tracking technology to locate missing individuals with dementia or developmental disabilities. The bill amends the Missing Children's Assistance Act to specify that, with respect to training and technical assistance provided by the National Center for Missing and Exploited Children, cases involving missing and exploited children include cases involving children with developmental disabilities such as autism.

Conscience Protection Act of 2016 This bill amends the Public Health Service Act to codify the prohibition against the federal government and state and local governments that receive federal financial assistance for health-related activities penalizing or discriminating against a health care provider based on the provider's refusal to be involved in, or provide coverage for, abortion. Health care providers include health care professionals, health care facilities, social services providers, health care professional training programs, and health insurers. The Office for Civil Rights of the Department of Health and Human Services, in coordination with the Department of Justice (DOJ), must investigate complaints alleging discrimination based on an individual's religious belief, moral conviction, or refusal to be involved in an abortion. DOJ or any entity adversely affected by such discrimination may obtain equitable or legal relief in a civil action. Administrative remedies do not need to be sought or exhausted prior to commencing an action or granting relief. Such an action may be brought against a governmental entity.

Bringing Entertainment Artists to the States (BEATS) Act of 2016 This bill amends the Immigration and Nationality Act to prescribe special procedures for the nonimmigrant entry of P-2 visa Canadian citizens (artists or entertainers participating in a government approved reciprocal exchange program). Such persons may, after U.S. admission and without filing an amended petition, alter or add to the dates and venues of performances listed in the original petition, provided that the altered or additional performances constitute no more than one third of the originally listed performances.

Protecting Workplace Advancement and Opportunity Act This bill declares that the proposed or the final rule of the Department of Labor entitled "Defining and Delimiting the Exemptions for Executive, Administrative, Professional, Outside Sales and Computer Employees" shall cease to have any force or effect. The rule revises the "white collar" exemption of executive, administrative, professional, outside sales, and computer employees from minimum wage and maximum hour, or overtime, requirements of the Fair Labor Standards Act of 1938 (FLSA). If the proposed rule is a final rule on the date of enactment of this bill: Labor shall not enforce it based on conduct occurring before that enactment date, an employee shall not have any right of action against an employer for the employer's failure to comply with the final rule at any time before that enactment date, any regulations that were amended by the final rule shall be restored and revived as if the final rule had never taken effect, and nothing in this bill shall be construed to create a right of action for an employer against an employee for the recoupment of any payments made to the employee before the enactment of this bill that were in compliance with that final rule. Labor may promulgate any substantially similar rule only if it has completed certain required actions; but the rule shall not contain any automatic updates to the salary threshold for purposes of exemptions to minimum wage and maximum hour requirements under the FLSA. The requirement that definitions applicable for such exemptions be defined and delimited from time to time by Labor regulations shall be construed to: require Labor to issue a new rule through notice and comment rulemaking for each change in any salary threshold it has proposed; and exclude any rule that would result in changes to any salary threshold for multiple time periods, including through any automatic updating procedure. Labor may not promulgate any final rule that includes any revision to duties tests for exemption from minimum wage and maximum hours requirements unless specific regulatory text for the provision was proposed in the proposed rule.

Puppies Assisting Wounded Servicemembers (PAWS) Act of 2016 This bill directs the Department of Veterans Affairs (VA), through the Office of Patient Centered Care and Cultural Transformation, to carry out a five-year pilot program under which the VA shall provide service dogs and veterinary health insurance to certain veterans who: (1) served on active duty on or after September 11, 2001; and (2) were diagnosed with, and continue to suffer from, post-traumatic stress disorder. The provision of a service dog shall be done in addition to other types of treatment for post-traumatic stress disorder and shall not replace established treatment modalities.

Nicholas and Zachary Burt Memorial Carbon Monoxide Poisoning Prevention Act of 2016 This bill directs the Consumer Product Safety Commission to establish a grant program to provide assistance to states that require compliant carbon monoxide alarms to be installed in dwelling units. A "compliant carbon monoxide alarm" is an alarm that complies with: (1) the American National Standard for Single and Multiple Station Carbon Monoxide Alarms, and (2) the American National Standard for Gas and Vapor Detectors and Sensors. States receiving such grants may use the funds to: (1) purchase and install such alarms in dwelling units of low-income families or elderly persons, childcare facilities, public schools, senior centers, or student dwelling units owned by public universities; (2) train state or local fire code enforcement officials regarding compliance and installation; and (3) educate the public about the risk of carbon monoxide poisoning.

School-Based Asthma Management Program Act This bill amends the Public Health Service Act to add requirements that states must meet to receive a preference for asthma grants. (Currently, the preference is given to states that meet requirements regarding administration of epinephrine to students having severe allergic reactions.) To receive the preference, states must additionally: (1) provide civil liability protection to trained school personnel who administer asthma-related rescue medication to a student with asthma; and (2) require schools to permit trained school personnel to administer asthma-related rescue medication to students with asthma, maintain a supply of asthma-related rescue medication, and have a comprehensive asthma management program.

Promoting Travel, Commerce, and National Security Act of 2016 This bill amends the federal criminal code to allow the United States to prosecute certain U.S. employees who engage in conduct in Canada that would constitute a federal criminal offense if the conduct had occurred in the United States. This bill applies to employees, contractors, and grantees of a U.S. department or agency other than the Department of Defense who are stationed in Canada pursuant to a border security initiative.

Veteran Suicide Prevention Act This bill directs the Department of Veterans Affairs (VA) to complete a publicly available review of the deaths of all covered veterans who died by suicide during the preceding five-year period. Such review shall include: the total number of veterans who died by suicide during the five-year period; a summary that includes age, gender, and race; a list of the medications prescribed to, and found in the systems of, such veterans at the time of their deaths, and a summary of medical diagnoses by VA physicians which led to the prescribing of such medications; the number of instances in which the veteran was concurrently on multiple medications prescribed by VA physicians; the percentage of veterans who were not taking any medication prescribed by a VA physician; the percentage of veterans with combat experience or trauma; Veterans Health Administration facilities with markedly high prescription and patient suicide rates; a description of VA policies governing the prescribing of medications; and recommendations to improve the safety and well-being of veterans. "Covered veteran" means any veteran who received VA hospital care or medical services during the five-year period preceding the veteran's death.

Diabetic Eye Disease Prevention Act of 2016 This bill amends title XVIII of the Social Security Act (Medicare) to establish a demonstration project through which primary care practices may receive incentives for referring diabetic Medicare beneficiaries to local eye doctors for comprehensive dilated eye exams. The project must test the extent to which these incentives: (1) improve early detection and treatment of diabetes-related vision problems, (2) reduce the cost of Medicare services, and (3) achieve beneficiary satisfaction. The project shall identify for participation at least 100 primary care practices in at least 10 states that have high per capita costs of diabetes care for Medicare beneficiaries. Project costs shall be paid from the Federal Supplementary Medical Insurance Trust Fund.

Firefighter Cancer Registry Act of 2016 This bill requires the Centers for Disease Control and Prevention (CDC) to develop and maintain a voluntary patient registry to monitor, collect, and make available epidemiological information related to cancer incidence and trends among firefighters. The CDC should seek to include specified information in the registry, including the number and type of fire incidents attended by an individual. To collect information for the registry, the CDC may incorporate questions into existing public health surveys, questionnaires, and other databases. The CDC must: (1) encourage the inclusion in the registry of data on minority, female, and volunteer firefighters; and (2) seek feedback on the registry from nonfederal experts. The CDC must develop an approval process for making registry data available for research without a fee if findings or publications derived from the research are made public or available to stakeholders.

Carbon Capture Act This bill amends the Internal Revenue Code, with respect to the tax credit for carbon dioxide sequestration, to: (1) make such credit permanent after 2015; (2) increase such credit after 2024 for a qualified facility originally placed in service after December 31, 2015; (3) allow such credit to a person who disposes of, or uses as a tertiary injectant, the carbon dioxide; and (4) modify the definition of "qualified facility" for purposes of eligibility for such credit to require not less than 150,000 metric tons (currently, 500,000 metric tons) to be captured at such a facility during the taxable year.

United States Commission on the Organization of Petroleum Exporting Countries Act of 2016 This bill establishes the United States Commission on the Organization of Petroleum Exporting Countries (OPEC) to investigate and address any practices on the part of OPEC that prevent or reduce competition in the global oil market. The Commission shall be composed of a bipartisan group of 16 experts on energy and related matters chosen by the leadership of both parties in Congress and appointed by the President. All members of the Commission must be U.S. citizens. The bill requires the Commission to: determine whether the anti-competitive behavior of OPEC is designed to disadvantage U.S. oil producers; assess the impact of OPEC's policies on U.S. economic and energy security interests; assess how federal agencies are working to alleviate the potential negative impacts of OPEC's behavior; and produce policy recommendations for tax, trade, defense, diplomacy, and other areas where OPEC's behavior is found to cause adverse impacts. The Commission must submit a report of its findings and recommendations to Congress and the President within 12 months. The Commission shall terminate within 90 days after submission of its report. On receipt of the Commission's report, the President will have 90 days to submit Congress a proposal to implement or respond to the recommendations.

Combating BDS Act of 2016 This bill authorizes a state or local government to adopt and enforce measures to divest its assets from, or prohibit investment of its assets in: (1) an entity that such government determines, using credible information available to the public, engages in a commerce or investment-related boycott, divestment, or sanctions activity targeting Israel; or (2) an entity that owns or controls, is owned or controlled by, or is under common ownership or control with, such an entity. Such government shall provide written notice to such an entity before applying such a measure. Such a measure by a state or local government is not preempted by any federal law or regulation. The bill applies to measures adopted by a state or local government before, on, or after the date of this Act's enactment. The bill amends the Investment Company Act of 1940 to prohibit any person from bringing any civil, criminal, or administrative action against any registered investment company, or any officer or employee thereof, based solely upon such company divesting from, or avoiding investing in, securities issued by persons that such company determines, using credible information available to the public, engage in commerce or investment-related boycotts, divestments, or sanctions activities targeting Israel.

This bill authorizes the Department of Veterans Affairs (VA) to establish the PFC Joseph P. Dwyer Veteran Peer Support program to make grants to eligible entities for peer-to-peer mental health programs for veterans. "Eligible entity" means: (1) a nonprofit organization having historically served the mental health needs of veterans; (2) a congressionally chartered veteran service organization; or (3) a state, local, or tribal veteran service agency, director, or commissioner. The VA shall establish an advisory committee to create appropriate program standards.

Promoting Responsible Opioid Prescribing Act of 2016 or the PROP Act of 2016 This bill amends title XVIII (Medicare) of the Social Security Act to exclude certain pain-related measures for purposes of calculating incentive payments under the value-based purchasing program (VBP). (VBP is a program that links hospital payments to the quality of care provided.) Specifically, VPB measures shall not include measures based on a patient's assessment of: (1) the patient's need for pain medicine during a hospital stay; (2) how often, during the stay, the patient's pain was well controlled; or (3) how often, during the stay, hospital staff did everything they could to help manage the patient's pain.

Safe Drinking Water Act Improved Compliance Awareness Act This bill amends the Safe Drinking Water Act to require public water systems to notify their customers of lead concentration levels in drinking water that exceed lead limits under national primary drinking water regulations. The Environmental Protection Agency (EPA) must notify customers of a violation of a national primary drinking water regulation with significant potential to have serious adverse effects on human health as a result of acute exposure, if the state or the public water system fails to notify the public within 24 hours of receiving notice from the EPA of the exceedance. Community water systems' consumer confidence reports must include a definition of "action level," which is generally a certain contaminant level that triggers a requirement for the public water system to take additional actions to control corrosion. The EPA must establish a strategic plan for conducting targeted outreach, education, technical assistance, and risk communication to populations affected by lead in the public water system. EPA employees must forward to the public water system any data indicating that drinking water contains lead that exceeds limits. The public water system must then disseminate to its customers information on the exceedance of a lead limit, its potential adverse effects on human health, corrective steps underway, and advice on whether customers should seek alternative water supplies. The EPA must disseminate the information if the public water system or the state fails to do so. The EPA must: (1) make information about lead in drinking water available to the public, and (2) carry out targeted outreach strategies that focus on educating groups that are at greater risk than the general population for adverse health effects from exposure to lead in drinking water.

State Sanctions Against Iranian Terrorism Act This bill amends the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 to specify that a state may, in addition to limiting investment in Iran's energy sector, prohibit or limit any person from engaging in specified investment activities in Iran. A state may also enter into interstate compacts to prohibit or limit such financial activities. Enforcement of such measures may include the imposition of disclosure and transparency requirements. The description of "investment activities" is revised to: (1) reduce the threshold for financial involvement from $20 million to $10 million; and (2) include, in addition to the energy sector, involvement in a business enterprise in Iran, including an entity owned or controlled by the Iranian government. The bill declares that a state or local government measure authorized pursuant to the Act is: (1) authorized and not preempted by any federal law or regulation, or any policy, agreement, or exercise of waiver authority of the executive branch; and (2) is consistent with U.S. federal policy, including U.S. foreign policy. A state or local government may enforce a measure adopted before the enactment of this Act that: (1) provides for the divestment of state or local assets from, or prohibits the investment of those assets in, any person that engages in investment activities in Iran or other business activities in Iran identified in the measure; or (2) prohibits or limits any person from engaging in investment activities in Iran.

This bill authorizes the Federal Energy Regulatory Commission (FERC), upon the request of the licensee for FERC project numbered 13287 (Cannonsville Hydroelectric Project, New York), to extend the time period during which the licensee is required to commence the construction of the project for up to four consecutive two-year periods from the date of the expiration of the extension originally issued by FERC.

Protecting Patient Access to Emergency Medications Act of 2016 This bill amends the Controlled Substances Act to direct the Drug Enforcement Administration to register an emergency medical services (EMS) agency as an entity authorized to dispense controlled substances, instead of registering the individual practitioners or medical directors of the agency. A registered EMS agency must be overseen by one or more medical directors. The bill specifies that an EMS practitioner who is employed by a registered EMS agency may administer controlled substances under a standing order issued by a medical director. The standing order does not have to be specific to an individual patient.

This bill amends title XIX (Medicaid) to specify how a state must treat qualified lottery winnings and lump sum income for purposes of determining an individual's income-based eligibility for a state Medicaid program. Specifically, a state shall include such winnings or income as income received: (1) in the month in which it was received, if the amount is less than $60,000; (2) over a period of two months, if the amount is at least $60,000 but less than $70,000; (3) over a period of three months, if the amount is at least $70,000 but less than $80,000; and (4) over an additional one-month period for each increment of $10,000 received, not to exceed 120 months. Qualified lump sum income includes: (1) monetary winnings from gambling; (2) damages received in lump sums or periodic payments, excluding monthly payments, on account of causes of action other than those arising from personal physical injuries or sickness; and (3) income received as liquid assets from the estate of a deceased individual.

Separation of Powers Restoration and Second Amendment Protection Act This bill expresses the sense of Congress that any executive order, memoranda, proclamation, or signing statement issued by the President that infringes on the powers and duties of Congress under article I, section 8 of the Constitution or the Second Amendment, or that would require the expenditure of federal funds not specifically appropriated for such executive action, is advisory only and has no force or effect unless enacted as law. The bill nullifies any such executive action and prohibits the use of appropriated funds to promulgate or enforce any such action. The following persons may bring a civil action in an appropriate U.S. district court to challenge the validity of any such executive action: (1) any Member or either or both chambers of Congress, (2) the highest governmental official of any state or political subdivision if the challenged action infringes on a power of such state under any congressional enactment or relevant treaty, and (3) any person aggrieved of the challenged executive action with respect to a liberty or property interest adversely affected directly by the executive action.
