Pet and Women Safety Act of 2017

Pet and Women Safety Act of 2017 This bill amends the federal criminal code to broaden the definition of stalking to include conduct that causes a person to experience a reasonable fear of death or serious bodily injury to his or her pet. Additionally, an interstate violation of a protection order includes interstate travel with the intent to violate a protection order against a pet that is included within the scope of the protection order. The bill specifies the applicable criminal penalty—a prison term of up to five years, a fine, or both—for a person who commits an interstate violation of a protection order against a pet. With respect to a defendant who commits a domestic violence offense or an interstate violation of a protection order, mandatory restitution in the "full amount of victim's losses" includes costs incurred for veterinary services related to the pet. The bill directs the Department of Agriculture to award grants for shelter and housing assistance and support services for domestic violence victims with pets. Finally, it expresses the sense of Congress that states should include, in domestic violence protection orders, protections against violence or threats against a person's pet.

Expresses support for: (1) continued U.S.-South Korea bilateral security cooperation and the consideration of additional measures to strengthen the alliance, including expanded foreign military sales, technology development, and joint exercises; and (2) the intelligence sharing agreement between Japan and South Korea signed on November 23, 2016, concerning the direct exchange of intelligence on North Korea threats. Calls upon: (1) China to pressure North Korean leaders to cease their provocative behavior, abandon and dismantle their nuclear and missile programs through the curtailing of vital economic support and trade that support the North Korean government, and comply with all relevant United Nations Security Council Resolutions; and (2) the United States to apply all available economic sanctions, and cooperate with allies and other countries to impose additional sanctions, on North Korea.

Childhood Cancer STAR Act

Childhood Cancer Survivorship, Treatment, Access, and Research Act of 2017 or the Childhood Cancer STAR Act This bill amends the Public Health Service Act to authorize the National Institutes of Health (NIH) to provide support to collect the medical specimens and information of children, adolescents, and young adults with selected cancers that have the least effective treatments in order to achieve a better understanding of these cancers and the effects of treatment. The national childhood cancer registry is reauthorized through FY2022 and revised to authorize the Centers for Disease Control and Prevention to award grants to state cancer registries to improve tracking of childhood cancers. The Department of Health and Human Services (HHS) may: (1) support pilot programs to develop or study models for monitoring and caring for childhood cancer survivors throughout their lives, (2) establish a task force to develop and test standards for high-quality childhood cancer survivorship care, and (3) carry out a demonstration project to improve care coordination as childhood cancer survivors transition to adult care. HHS must convene a Workforce Development Collaborative on Medical and Psychosocial Care for Pediatric Cancer Survivors. The NIH may support research on: (1) outcomes for, and barriers faced by, pediatric cancer survivors within minority or medically underserved populations; and (2) follow-up care for pediatric cancer survivors, including research on the late effects of cancer treatment and long-term complications. The Government Accountability Office must make recommendations to address barriers to childhood cancer survivors obtaining and paying for adequate medical care.

Investing in Opportunity Act

Investing in Opportunity Act This bill amends the Internal Revenue Code to authorize the designation of opportunity zones in low-income communities and to provide tax incentives for investments in the zones, including deferring the recognition of capital gains that are reinvested in the zones. Governors may submit nominations for a limited number of opportunity zones to the Department of the Treasury for certification and designation. Governors must give particular consideration to areas that: are currently the focus of mutually reinforcing state, local, or private economic development initiatives to attract investment and foster startup activity; have demonstrated success in geographically targeted development programs such as promise zones, the new markets tax credit, empowerment zones, and renewal communities; and have recently experienced significant layoffs due to business closures or relocations. Treasury must designate zones if a governor fails to submit nominations within a specified period of time. An "opportunity fund" is any investment vehicle organized as a corporation or a partnership to invest in opportunity zones that holds at least 90% of its assets in opportunity zone assets. Taxpayers may temporarily defer the recognition of capital gains that are invested in opportunity zones. Investments in opportunity zones or opportunity funds that are held for at least five years are eligible for capital gains tax reductions or exemptions, depending on how long the investment is held. Treasury must report to Congress on the opportunity zone incentives enacted in this bill, including an assessment of opportunity fund investments at the national and state levels.

Target Practice and Marksmanship Training Support Act This bill amends the Pittman-Robertson Wildlife Restoration Act to facilitate the construction and expansion of public target ranges by: (1) authorizing a state to pay up to 90% of the costs of acquiring land for, expanding, or constructing a public target range; (2) authorizing a state to elect to allocate 10% of a specified amount apportioned to it from the federal aid to wildlife restoration fund for those costs; (3) limiting the federal share of those costs under such Act to 90%; and (4) requiring amounts provided for those costs under such Act to remain available for expenditure and obligation for five fiscal years. The United States shall be shielded from any civil action or claim for money damages for injury to or loss of property, personal injury, or death caused by an activity occurring at a public target range that is funded by the federal government pursuant to such Act or located on federal land, except to the extent provided under the Federal Tort Claims Act with respect to the exercise or performance of a discretionary function. The bill urges the Forest Service and the Bureau of Land Management to cooperate with state and local authorities and other entities to carry out waste removal and other activities on any federal land used as a public target range to encourage its continued use for target practice or marksmanship training.

Common Sense Nutrition Disclosure Act of 2017 This bill amends the Federal Food, Drug, and Cosmetic Act to revise the nutritional information that restaurants and retail food establishments must disclose. The nutrient content disclosure statement on the menu or menu board must include: (1) the number of calories contained in the whole menu item; (2) the number of servings and number of calories per serving; or (3) the number of calories per common unit of the item, such as for a multi-serving item that is typically divided before presentation to the consumer. Nutritional information may be provided solely by a remote-access menu (e.g., an Internet menu) for food establishments where the majority of orders are placed by customers who are off-premises. Establishments with self-serve food may comply with the requirements for restaurants or place signs with nutritional information adjacent to each food item. An establishment's nutrient content disclosures may vary from actual nutrient content if the disclosures comply with current standards for reasonable basis. Establishments with standard menu items that come in different flavors, varieties, or combinations, that are listed as a single menu item may determine and disclose nutritional information using specified methods or methods allowed by the Food and Drug Administration (FDA). Regulations pursuant to this bill or the clause amended by this bill may not take effect earlier than two years after final regulations are promulgated. The FDA may not exempt states from nutrition labeling requirements.

Ensuring Access to Quality Complex Rehabilitation Technology Act of 2017 This bill amends title XVIII (Medicare) of the Social Security Act to establish a separate Medicare benefit category for complex rehabilitation technology (CRT) items that: (1) are designed or configured to meet an individual's unique needs and capacities; (2) are primarily used to serve a medical or functional purpose; and (3) require certain services to ensure appropriate design, configuration, and use. The Centers for Medicare & Medicaid Services (CMS) shall designate CRT items and establish eligibility criteria with respect to such items, in accordance with specified exclusions and other requirements.  The CMS must also establish: (1) a payment system applicable to CRT items, subject to clinical conditions and other specified requirements; (2) quality standards for suppliers of CRT items; and (3) a formal process for the submission of certain CRT code-set modification requests by stakeholder groups. If specified requirements are met, Medicare payment must be made for the replacement of a CRT item (or item part), without regard to certain continuous-use or useful-lifetime restrictions applicable to items of durable medical equipment. In addition, Medicare payment may be made for the temporary rental of a CRT item if such an item owned by a qualified enrollee is undergoing necessary repairs.

Individuals seeking coverage through an exchange during a special enrollment period must submit to the exchange the documents necessary to verify their eligibility for the special enrollment period. The Office of the Inspector General of the Department of Health and Human Services must report on enrollment during special enrollment periods for plan year 2016. The report must include the number of individuals who: (1) sought to enroll during a special enrollment period but were prohibited, (2) were prohibited because they did not provide documentation supporting eligibility, and (3) were prohibited because they provided invalid documentation.

Verify Eligibility Coverage Act The bill amends title XIX (Medicaid) of the Social Security Act to allow a state to delay or deny an individual's initial eligibility for Medicaid benefits without providing a reasonable opportunity to submit evidence of a satisfactory immigration status or pending official verification of such status. A state that elects to provide a reasonable period for an individual to provide such evidence may not receive payment for amounts expended on the individual's medical assistance during that period. In FY2018-FY2026, the Centers for Medicare & Medicaid Services, using the Medicaid Improvement Fund, shall pay a 90% federal matching rate to eligible states for home- and community-based services furnished under a state Medicaid waiver to patients who had been on a waiting list for such services.

Child Interstate Abortion Notification Act This bill amends the federal criminal code to make it a crime to knowingly transport a minor across a state line to obtain an abortion without satisfying a parental involvement law in the minor's resident state. A parental involvement law requires parental consent or notification, or judicial authorization, for a minor to obtain an abortion. A violator is subject to criminal penalties—a fine, up to one year in prison, or both. The bill provides an exception for an abortion that is necessary to save the life of a minor whose life is endangered by a physical disorder, illness, or condition. This bill prohibits an individual who has committed incest with a minor from knowingly transporting the minor across a state line to receive an abortion. Additionally, this bill makes it a crime for a physician to knowingly perform or induce an abortion on an out-of-state minor without first complying with parental notification requirements, subject to specified exceptions. A physician violator is subject to criminal penalties—a fine, up to one year in prison, or both.

Conscience Protection Act of 2017 This bill amends the Public Health Service Act to codify the prohibition against the federal government and state and local governments that receive federal financial assistance for health-related activities penalizing or discriminating against a health care provider based on the provider's refusal to be involved in, or provide coverage for, abortion. Health care providers include health care professionals, health care facilities, social services providers, health care professional training programs, and health insurers. The Office for Civil Rights of the Department of Health and Human Services, in coordination with the Department of Justice (DOJ), must investigate complaints alleging discrimination based on an individual's religious belief, moral conviction, or refusal to be involved in an abortion. DOJ or any entity adversely affected by such discrimination may obtain equitable or legal relief in a civil action. Administrative remedies do not need to be sought or exhausted prior to commencing an action or granting relief. Such an action may be brought against a governmental entity.

VA Accountability First and Appeals Modernization Act of 2017 This bill authorizes the Department of Veterans Affairs (VA) to remove or demote a VA employee based on performance or misconduct. The VA may remove such individual from the civil service or demote the individual through a reduction in grade or annual pay rate. A demoted individual shall not be placed on administrative leave or any other category of paid leave during the appeals period and can receive pay only if he or she reports for duty. The bill: (1) establishes an expedited appeals process by the Merit Systems Protection Board, (2) amends the disability benefits appeals process, (3) prescribes restrictions on the VA's authority to remove or demote an employee, and (4) establishes whistleblower protections. The VA shall reduce the federal annuity of an individual removed from the VA Senior Executive Service (SES) who is convicted of a felony that influenced his or her performance while employed in such position. The VA may reduce the federal annuity of an individual who was convicted of such a felony and was subject to removal or transfer from the SES but who left the VA before final action was taken. The VA may recoup an award, a bonus, or relocation expenses paid to a VA employee under specified circumstances. The VA may suspend, reprimand or admonish an SES employee for misconduct or performance that does not merit removal. Appeals may be made to the Senior Executive Disciplinary Appeals Board (as provided for by this bill). The bill amends the disability benefits appeals process. The bill prohibits payment of an award or bonus to any SES employee during each of FY2017-FY2021.

USPSTF Transparency and Accountability Act of 2017 This bill amends the Public Health Service Act to expand the scope and responsibilities of the United States Preventive Services Task Force to require it to: (1) publish research plans to guide its review of scientific evidence relating to the effectiveness of preventive services; (2) make evidence reports and recommendations available for public comment; (3) establish a system for grading preventive care (Grades A, B, C, and D and a Grade I for insufficient information); and (4) convene a preventive services stakeholders board to provide feedback on task force activities and recommend preventive services and scientific evidence for the task force to review. Members of the task force and the preventive services stakeholders board must disclose conflicts of interest. The Government Accountability Office must report on: (1) current recommendations of the task force; (2) task force recommendations and recommendations of other federal health agencies, national medical professional societies, and patient and disease advocacy organizations; and (3) the impact of task force recommendations on insurance coverage, access, and outcomes, including the impact on morbidity and mortality. This bill amends title XVIII (Medicare) of the Social Security Act to revise HHS's authority to modify coverage of preventive services. HHS may modify such coverage only based on a task force grade or recommendation that was developed or updated in accordance with this bill. Medicare quality measures related to a recommendation of the task force may only be applied if the recommendation was developed or updated in accordance with this bill.

United States Commission on the Organization of Petroleum Exporting Countries Act of 2017 This bill establishes the United States Commission on the Organization of Petroleum Exporting Countries (OPEC) to investigate and address any practices on the part of OPEC that prevent or reduce competition in the global oil market. The Commission shall be composed of a bipartisan group of 16 experts on energy and related matters chosen by the leadership of both parties in Congress and appointed by the President. All members of the Commission must be U.S. citizens. The bill requires the Commission to: determine whether the anti-competitive behavior of OPEC is designed to disadvantage U.S. oil producers; assess the impact of OPEC's policies on U.S. economic and energy security interests; assess how federal agencies are working to alleviate the potential negative impacts of OPEC's behavior; and produce policy recommendations for tax, trade, defense, diplomacy, and other areas where OPEC's behavior is found to cause adverse impacts. The Commission must submit a report of its findings and recommendations to Congress and the President within 12 months. The Commission shall terminate within 90 days after submission of its report. On receipt of the Commission's report, the President will have 90 days to submit Congress a proposal to implement or respond to the recommendations.

Prioritizing the Most Vulnerable Medicaid Patients This bill amend title XI (General Provisions) of the Social Security Act to require the Centers for Medicare & Medicaid Services, in approving Medicaid demonstration projects, to: prioritize projects that have been proven effective in improving care and outcomes with respect to uninsured, Medicaid-eligible, or low-income individuals; require participating states to make publicly available data regarding the health outcomes for individuals to be served; ensure that projects are not duplicative of any federal program or funding opportunity; and require participating states to make publicly available an analysis of the degree to which such projects preclude private and charitable sector efforts to improve care and outcomes with respect to uninsured, Medicaid-eligible, or low-income individuals.

Better Accounting for Medicaid Costs Act of 2017 This bill amends title XI (General Provisions) of the Social Security Act to require the Centers for Medicare & Medicaid Services (CMS) to follow rulemaking procedures with respect to certain Medicaid subregulatory policies. Before issuing a Medicaid subregulatory policy, CMS must determine the extent to which the policy is projected, with respect to each year in a 10-year period, to increase state or federal expenditures under the Medicaid program. If the policy is projected to increase expenditures by an amount exceeding a specified threshold, CMS may implement the policy only through notice and comment rulemaking.

Improving Oversight and Accountability in Medicaid Non-DSH Supplemental Payments Act This bill amends title XIX (Medicaid) of the Social Security Act to direct the Centers for Medicare & Medicaid Services to: (1) issue guidance to states that identifies permissible methods for calculating certain supplemental payments, excluding disproportionate-share payments, made by state Medicaid programs to providers; and (2) establish annual reporting and auditing requirements for states making such supplemental payments. Federal payment with respect to such supplemental payments shall be conditioned upon a state's compliance with these reporting and auditing requirements.

No Taxpayer Funding for Abortion and Abortion Insurance Full Disclosure Act of 2017 This bill makes permanent the prohibition on the use of federal funds, including funds in the budget of the District of Columbia, for abortion or health coverage that includes abortion. The prohibitions in this bill, and current prohibitions, do not apply to abortions in cases of rape or incest, or where a physical condition endangers a woman's life unless an abortion is performed. Abortions may not be provided in a federal health care facility or by a federal employee. This bill amends the Internal Revenue Code and the Patient Protection and Affordable Care Act to prohibit qualified health plans from including coverage for abortions. (Qualified health plans are sold on health insurance exchanges, are the only plans eligible for premium subsidies and small employer health insurance tax credits, and fulfill an individual's requirement to maintain minimum essential coverage.) Currently, qualified health plans may cover abortion, but the portion of the premium attributable to abortion coverage is not eligible for subsidies.

Heartbeat Protection Act of 2017 This bill amends the federal criminal code to make it a crime for a physician to knowingly perform an abortion: (1) without determining whether the fetus has a detectable heartbeat, (2) without informing the mother of the results, or (3) after determining that a fetus has a detectable heartbeat. It provides an exception for an abortion that is necessary to save the life of a mother whose life is endangered by a physical (but not psychological or emotional) disorder, illness, or condition. A physician who performs a prohibited abortion is subject to criminal penalties—a fine, up to five years in prison, or both. A woman who undergoes a prohibited abortion may not be prosecuted for violating or conspiring to violate the provisions of this bill.

Help Extract Animals from Red Tape Act of 2017 or the HEART Act of 2017 This bill amends the federal criminal code to modify the notice period in civil forfeiture proceedings that involve the seizure of an animal involved in animal fighting. It requires the government to send notice of the seizure to interested parties within 30 days (currently, 60 days). The notice period may be extended only if a delay is warranted after considering certain factors, including the cost to the government of providing shelter for the animal, the health of the animal and the effect of a delay on its rehabilitation, and any increased risk that a delay could necessitate the euthanasia of the animal. The bill amends the federal judicial code to authorize the Department of Justice to use amounts from the Department of Justice Assets Forfeiture Fund to pay for costs associated with a seized animal, including transportation, shelter, care, veterinary services, and humane euthanasia.

Veteran Suicide Prevention Act

Veteran Suicide Prevention Act This bill directs the Department of Veterans Affairs (VA) to complete a publicly available review of the deaths of all covered veterans who died by suicide during the preceding five-year period. Such review shall include: the total number of veterans who died by suicide during the five-year period; a summary that includes age, gender, and race; a list of the medications prescribed to, and found in the systems of, such veterans at the time of their deaths, and a summary of medical diagnoses by VA physicians which led to the prescribing of such medications; the number of instances in which the veteran was concurrently on multiple medications prescribed by VA physicians; the percentage of veterans who were not taking any medication prescribed by a VA physician; the percentage of veterans with combat experience or trauma; Veterans Health Administration facilities with markedly high prescription and patient suicide rates; a description of VA policies governing the prescribing of medications; and recommendations to improve the safety and well-being of veterans. "Covered veteran" means any veteran who received VA hospital care or medical services during the five-year period preceding the veteran's death.

Email Privacy Act This bill amends the federal criminal code to revise provisions that limit an electronic communication service (ECS) or remote communication service (RCS) provider from disclosing the contents of a wire or electronic communication that is in electronic storage. Additionally, it revises the standards for the government to compel an ECS or RCS provider to disclose contents of a wire or electronic communication or noncontent records or information pertaining to a subscriber or customer. An ECS or RCS provider may notify a subscriber or customer of the receipt of a warrant, court order, subpoena, or request, unless the government obtains an order for delayed notification. The bill revises the process for obtaining a delayed notification order and lengthens the maximum duration of a delayed notification order.

This bill amends the federal criminal code to revise provisions related to the interstate transportation of firearms and ammunition. An individual may transport a firearm between two places (e.g., states) where it is legal to possess, carry, or transport the firearm. During transport, the firearm must be unloaded and secured or securely stored. Additionally, an individual may transport ammunition, or a detachable magazine or feeding device, between two places where it is legal to possess, carry, or transport the ammunition, magazine, or feeding device. During transport, the ammunition, magazine, or feeding device must not be loaded into a firearm and must be securely stored. This bill prohibits the arrest or detention of an individual for a state or local firearm or ammunition violation unless there is probable cause to believe the individual failed to comply with the provisions of this bill.

This extension of coverage does not apply at a health care facility or while a medical professional licensed in the state is transporting the injured individual to a health care facility.
