Never Forget the Heroes: Permanent Authorization of the September 11th Victim Compensation Fund Act This bill funds through FY2090 the September 11th Victim Compensation Fund of 2001. Additionally, the bill modifies the Victim Compensation Fund (VCF): to allow claims to be filed until October 2089, to require VCF policies and procedures to be reassessed at least once every five years (currently, at least once annually), to require claimants to be paid for the amount by which a claim was reduced on the basis of insufficient funding, to remove the cap on noneconomic damages in special circumstances, and to adjust the annual limit on economic loss compensation for inflation.

No Federal Funds for Public Charge Act of 2018 This bill prohibits the use of federal funds to implement, administer, enforce, or carry out the proposed rule of the Department of Homeland Security entitled "Inadmissibility on Public Charge Grounds." The rule makes aliens who are likely at any time to become a public charge and receive public benefits inadmissible.

Violence Against Women Veterans Act This bill requires the Department of Veterans Affairs (VA) to carry out a program to assist veterans who have experienced domestic violence or sexual assault access VA benefits. The VA shall establish a national task force to address domestic violence and sexual assault among veterans and conduct a study to determine the scope of the problem.

Invest in America Act This bill amends the Internal Revenue Code to repeal several provision that were added by the Foreign Investment in Real Property Tax Act of 1980. The bill repeals provisions that imposed: (1) capital gains taxes on dispositions of investments in U.S. real property by foreign citizens, and (2) related tax withholding and reporting requirements.

Rewarding American Investments to Support Employees Act of 2018 or the RAISE Act of 2018 This bill allows employers a tax credit for a portion of the raises given to certain employees who earn $75,000 or less per year. The credit is equal to 10% of the increase in wages compared to the previous year and may not exceed $500,000 per year. The limitations on the amount of the credit and employee earnings must be adjusted for inflation after 2018.

Violence Against Women Reauthorization Act of 2018 This bill revises and reauthorizes through FY2023 various programs and activities under the Violence Against Women Act that seek to prevent and respond to domestic violence, sexual assault, dating violence, and stalking. Among other things, the bill also authorizes new programs, makes changes to federal firearms laws, and establishes new protections to promote housing stability and economic security for victims of domestic violence, sexual assault, dating violence, and stalking.

Reducing Unnecessary Senior Hospitalizations Act of 2018 or the RUSH Act of 2018 This bill establishes a program through which qualified group practices may provide certain items and services that are normally provided at hospital emergency departments to individuals who (1) are entitled to Medicare hospital services, (2) are enrolled for Medicare medical services, and (3) reside in qualified skilled nursing facilities.

Fairness in Liver Allocation Act of 2018 This bill requires the Organ Procurement and Transplantation Network to reform the criteria for liver allocation so that allocation is not based on the donor candidate's place of residence or listing, unless it is necessary to avoid wasting organs.

Protecting Immigrant Communities from Consumer Fraud Act of 2018 This bill directs the Department of Justice to make grants for immigration consumer fraud information websites and hotlines. It also establishes a grant program to carry out an outreach campaign to provide: (1) access to legal resources, including free or low-cost legal resources for low-income individuals; (2) workshops educating the public on immigration consumer fraud; and (3) translation services. Grant recipients may not disclose or use personally identifiable information provided by individuals participating in outreach campaigns. The bill requires the Federal Trade Commission to impose and enforce requirements on immigration consultants relating to advertising of immigration services, contracts for such services, and the retention and disposal of client documents. Immigration consultants must disclose in advertising materials and contracts that they are not immigration attorneys and may not represent aliens before an immigration court or the Board of Immigration Appeals.

Continue American Safety Act (CASA) This bill extends temporary protected status (TPS) for certain designated countries until January 21, 2021. It also grants TPS to nationals of Guatemala who meet certain requirements for 18 months after the enactment of this bill.

Reunifying Separated Families Act of 2018 This bill directs the Department of Homeland Security (DHS) to reunite each alien child (i.e., under age 18 and no permanent immigration status) who was separated from a parent or legal guardian on or after April 6, 2018, unless a state court or child welfare agency determines that it is in the best interests of the child to remain separated from a parent or legal guardian or there are DHS findings of trafficking or abuse. DHS is subject to a fine of $1,000 per child for each day such child is not reunited with a parent. The bill prohibits an agent or officer of DHS, the Department of Justice, or the Department of Health and Human Services from removing a child from a parent or legal guardian at or near a port of entry or within 100 miles of the border, unless a state court, child welfare agency, or the Chief Patrol Agent or the Area Port Director make findings relating to the best interests of the child or the threat of trafficking or abuse. No such agent or officer may separate a child from a parent or legal guardian solely for the policy goals of deterring individuals from migrating to the United States or for promoting compliance with civil immigration laws.

9/11 Memorial Act This bill directs the Department of the Interior to award competitive grants for the continued operation, security, and maintenance of the on-site memorials to the events and victims of the September 11, 2001, terrorist attacks on the World Trade Center, the Pentagon, and United Airlines Flight 93.

Democracy Is Strengthened by Casting Light On Spending in Elections Act of 2018 or the DISCLOSE Act of 2018 This bill expands the ban on election contributions by foreign nationals to include corporations subject to specified levels of ownership or control by foreign nationals. The bill also expands (1) reporting requirements related to campaign contributions, and (2) disclosure requirements related to the funding sources of political advertisements.

Central America Family Protection and Reunification Act This bill states that it shall be: (1) U.S. policy to not separate immigrant families as a deterrent and to reunite families that were separated due to the criminal prosecution of parents for illegal entry, and (2) Department of State policy to prioritize supporting governments and citizens to facilitate reunification of such families. The State Department shall submit to Congress: reports concerning gender-based violence in the Northern Triangle (the region encompassing Guatemala, Honduras, and El Salvador); reports concerning gang and organized-crime related violence in the Northern Triangle; strategies to use portions of funds for the U.S. Strategy for Engagement in Central America to combat gender-based violence in the Northern Triangle, as well as to address the damage to the health and well-being of children and caregivers caused by separating children from their families at the U.S.-Mexico border. The State Department shall establish an office to study serious crimes committed against aliens who were removed from the United States and against U.S. citizens who left the United States because of having an alien parent who was removed from the United States.

Guarantee Access to Arts and Music Education Act of 2018 or the GAAME Act of 2018 This bill amends the Elementary and Secondary Education Act of 1965 to specify that Title I funds (which support the instructional needs of students from low-income families) may be used for arts and music programs.

Keep Families Together Act This bill prohibits an agent or contractor of the Department of Homeland Security, the Department of Justice, or the Department of Health and Human Services from removing a child who is under the age of 18 and has no permanent immigration status from his or her parent or legal guardian at or near the port of entry or within 100 miles of the U.S. border unless: an authorized state court determines that it is in the child's best interests to be removed; a state or county child welfare official with expertise in child trauma and development determines that it is in the child's best interests to be removed because of abuse or neglect; or the Chief Patrol Agent or the Area Port Director authorizes separation based on a documented finding that the child is a trafficking victim or is at significant risk of becoming a victim, a strong likelihood exists that the adult is not the parent or legal guardian, or the child is in danger of abuse or neglect. A child may not be removed from a parent or guardian unless an independent licensed child welfare expert authorizes the separation within 48 hours of such removal. An agency may not remove a child from a parent or legal guardian solely for the policy goals of deterring migration to the United States or of promoting immigration law compliance. The bill sets forth presumptions: (1) in favor of family and sibling unity and parental rights, and (2) that detention is not in the best interests of families and children. The bill limits the prosecution of asylum seekers.

National Commission of the Federal Response to Natural Disasters in Puerto Rico Act of 2018 This bill establishes a National Commission of the Federal Response to Natural Disasters in Puerto Rico to examine the federal preparedness, response, and recovery to the 2017 natural disasters in Puerto Rico. The commission shall take into consideration the federal preparedness, response, and recovery efforts in Puerto Rico as compared to other jurisdictions impacted by the 2017 hurricane season, and consider other issues, including the impact and destruction of Hurricanes Irma and Maria, the vulnerability of Puerto Rico's economic situation on preparedness, the implications of Puerto Rico's reliance on imported oil for power generation, and the adequacy of the telecommunications network in Puerto Rico.

Stretching Entity Resources for Vulnerable Communities Act or the SERV Communities Act This bill makes a series of changes to the 340B drug pricing program (i.e., a program that allows entities to receive covered outpatient drugs at reduced prices from manufacturers), including alterations relating to program integrity, discrimination against participating entities, and program eligibility.

International Human Rights Defense Act of 2018 This bill establishes in the Department of State a permanent Special Envoy for the Human Rights of LGBTI (lesbian, gay, bisexual, transgender, or intersex) Peoples who shall serve as the principal State Department advisor regarding human rights for LGBTI people and represent the United States in diplomatic matters relevant to the human rights of LGBTI people. The special envoy shall periodically provide Congress with a U.S. global strategy to prevent and respond to criminalization, discrimination, and violence against LGBTI people. The State Department and the U.S. Agency for International Development may provide assistance to prevent and respond to such activities against LGBTI people. The Foreign Assistance Act of 1961 is amended to require that annual country reports on human rights practices include information on criminalization, discrimination, and violence based on sexual orientation and gender identity.

School Overcrowding Reduction Act This bill directs the Department of Education (ED) to award competitive grants to qualifying local educational agencies for activities relating to the construction of a school facility. In selecting grantees, ED shall prioritize agencies that demonstrate that grant amounts will be used to construct a school facility located within two miles of a school in which the average class size (excluding special education classes) exceeds 25 students.

Department of Homeland Security Accountability and Transparency Act or the DATA Act This bill requires law enforcement officials (i.e., officers or agents of U.S. Customs and Border Protection (CBP) and U.S. Immigration and Customs Enforcement (ICE), or certain state or local officials carrying out the functions of an immigration officer) who initiate a patrol stop or who detain any individual beyond a brief and limited inquiry, such as a primary inspection at a checkpoint, to record certain data, including (1) the date, time, location, and duration of the contact; (2) the basis for the contact and if it was race-related; (3) a description of any items seized during any search; (4) whether a body-worn camera recorded the stop or detention; and (5) whether force was used by the law enforcement official. The bill also requires the CBP to collect data on the number of permanent and temporary checkpoints used by its officers, the location and a description of each checkpoint, and the dates on which a temporary checkpoint was used. The Department of Homeland Security must compile the data collected by ICE and the CBP and consider it in making policy and program decisions.

Burma Unified through Rigorous Military Accountability Act of 2018 or the BURMA Act of 2018 This bill provides humanitarian assistance for Burma (Myanmar) and Bangladesh and imposes sanctions on Burmese military or security officials responsible for serious human rights abuses. The bill provides humanitarian assistance for Burma, Bangladesh, and the surrounding region, including assistance for the Rohingya minority. The Department of State, the Department of the Treasury, and the U.S. Agency for International Development shall jointly submit to Congress a strategy for promoting economic growth in Burma.

Opioid Workforce Act of 2018 This bill increases the number of residency positions eligible for graduate medical education payments under Medicare for hospitals that have addiction or pain management programs, with an aggregate increase of 1,000 positions over a five-year period.

Students Living Irrespective of Veterans Educational Assistance Act of 2018 or the Students LIVE Act of 2018 This bill requires a landlord to treat veteran's educational assistance and benefits as income when determining whether the service member, veteran, or a spouse or child of a service member or veteran has sufficient income to enter into a lease. The bill makes violations of this bill punishable by a fine, imprisonment for up to one year, or both.

Special Operations Forces Tax Cut Act of 2018 This bill amends the Internal Revenue Code, with respect to the exclusion from gross income for certain combat zone compensation of members of the Armed Forces, to expand the provision to include compensation for service outside of a combat zone by members of the Armed Forces assigned to special operations forces in support of operations to combat terrorism.

Workplace Democracy Act This bill amends the National Labor Relations Act and related labor laws to preserve workers' rights to join labor organizations and engage in collective bargaining. Specifically, it prohibits employers from classifying employees as independent contractors or supervisors to avoid employee participation in union activities; allows the National Labor Relation Board to certify a union, without a secret election, if it receives the consent of the majority of eligible workers; requires employers to begin negotiating with a new union within 10 days of its certification; prohibits coercion of employees to to participate in campaign activities unrelated to their job duties; requires employers to make disclosures of anti-labor organization activities; and repeals provisions allowing states to prevent labor organizations from collecting dues from nonunion workers who benefit from union representation (right to work laws).

Peaceful Learning Act of 2018 This bill directs the Department of Transportation (DOT) to enter into an agreement with the National Academy of Sciences to study railway noise in the United States. DOT must: (1) establish a single system of measuring railway noise that has a highly reliable relationship between projected railway noise exposure and surveyed reactions of individuals to noise and is applied uniformly in measuring railway noise near urbanized areas, (2) establish a single system for determining the exposure of individuals to railway noise in urbanized areas, and (3) determine minimum standards for railway noise levels on the property of a school located in an urbanized area. Each rail operator shall submit to DOT a noise exposure map showing any areas of nonconforming railway noise levels that adversely impact a school located in an urbanized area and are caused by operations of the rail operator. Rail operators who submit a noise exposure map may also submit a noise compatibility program. DOT may award grants to carry out noise compatibility projects.

Burn Pits Accountability Act This bill requires the Department of Defense (DOD) and the military departments to evaluate whether each member of the Armed Forces has been (1) based or stationed where an open air burn pit was used to dispose of waste, or (2) exposed to toxic airborne chemicals. Members located where an open burn pit was used or exposed to toxic airborne chemicals must be enrolled in the Airborne Hazards and Open Burn Pit Registry, unless the member elects not to enroll. The evaluations must be included in periodic health assessments, physical exams conducted immediately prior to separation from active duty, and deployment assessments. DOD must share the results of the evaluations with the Department of Veterans Affairs.

Restoring and Improving Merger Enforcement Act of 2018 This bill revises the standard for determining whether a proposed corporate acquisition would substantially lessen competition. Specifically, the bill establishes that a court may consider a claim that the acquisition would increase efficiency only if such increased efficiency (1) is verifiable, (2) could not be accomplished without the acquisition, and (3) would promote competition. The bill also places the burden of proof on the defendant claiming that increased efficiency will eliminate the substantial lessening of competition that would result from the proposed acquisition.
