Financial Oversight Commission Act of 2008 - Establishes the Financial Oversight Commission to investigate facts and circumstances relating to the financial crisis of 2008, including any relevant legislation, Executive Order, regulation, plan, policy, practice, or procedure that pertains to: (1) government sponsored enterprises (GSEs), including the Federal National Mortgage Association (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac); (2) the stock market; (3) the housing market; (4) credit rating agencies; (5) the financial services sector, including hedge funds, private equity, and the insurance industry; and (6) the role of congressional oversight and resource allocation. Directs the Commission to identify, evaluate, and report to Congress and the President on the lessons learned from the financial crisis regarding the structure, coordination, management policies, and procedures of governmental and nongovernmental entities related to crisis detection, prevention, and response.

Presidential Historical Records Preservation Act of 2008 - Authorizes appropriations for the National Historical Publications and Records Commission for FY2010. Requires the Commission to make grants to eligible entities on a competitive basis to promote the historical preservation of, and public access to, historical records and documents relating to any President who does not have a presidential archival depository currently managed and maintained by the federal government pursuant to the Presidential Libraries Act of 1955. Defines eligible entities as specified tax-exempt organizations or state or local governments. Prohibits the use of grants for the maintenance, operating costs, or construction of any facility to house the historical records or documents. Prohibits the Commission from approving a grant application unless an entity establishes that it meets certain requirements, including that it: (1) ensures the preservation of, and access to, such historical works and collections of historical sources at no charge to the public; (2) has educational programs that make the use of such documents part of the entity's mission; and (3) has raised funds from nonfederal sources in support of the entity's efforts to promote such preservation and access.

Electronic Employment Eligibility Verification and Illegal Immigration Control Act of 2008 - Amends the Immigration and Nationality Act to direct the Secretary of Homeland Security to establish a toll-free telephone- or electronic media-based employment eligibility verification system. Requires such system to: (1) provide verification or tentative non-verification of an individual's identity and employment eligibility within three days of an inquiry; and (2) provide, in the case of tentative non-verification, a secondary process for final verification or non-verification within 10 days. Provides that: (1) the Commissioner of Social Security shall develop a process for comparing names and social security numbers against appropriate databases in response to employer inquiries; and (2) the Secretary shall develop a process for comparing names and alien identification or authorization numbers and shall investigate uses of the same social security number that suggest fraud. Limits verification system-related individual relief to procedures under the Federal Tort Claims Act. Prohibits class actions. Immunizes from civil or criminal liability a person or entity who takes action in good faith reliance on verification system information. Sets forth employer verification requirements with respect to an affirmative defense to liability for employment of unauthorized workers, including revision of attestation and retention of verification form provisions. Places limits on the collection and use of data from the verification system. Expands the employment eligibility verification system to include: (1) previously hired individuals; and (2) recruitment and referral. Provides for: (1) voluntary employer verification utilizing such system two years after enactment of this Act for previously hired individuals; (2) mandatory employer verification three years after enactment of this Act by federal, state, and local governments, and the military for employees not verified under such system working at federal, state or local government buildings, military bases, nuclear energy sites, weapons sites, airports, or critical infrastructure sites; and (3) mandatory employer verification six years after enactment of this Act for all employees not previously verified under such system. Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to extend the E-Verify program (formerly the basic pilot program) until two years after enactment of this Act. Applies employment eligibility verification requirements to labor service agencies. Revises civil and criminal penalty provisions. Establishes in the Treasury the Employment Verification Compensation Fund. Directs the Secretary to establish a publicly available contractor database. Requires the Commissioner to report to Congress on Social Security card-based verification, including requirements for: (1) durable and machine-readable cards; (2) a unified database that specifies work authorizations; and (3) employer verification of new hires using the new Social Security cards and an electronic mechanism to seek verification. Authorizes the Commissioner (subject to limits) to carry out verification responsibilities under this Act. Prohibits funds from the Federal Old-Age and Survivors Insurance Trust Fund or the Federal Disability Insurance Trust Fund from being used to carry out such responsibilities. Sets forth other reporting requirements by the Secretary and the Commissioner.

Amends the Outer Continental Shelf Lands Act to authorize the governor of Virginia to petition the Secretary of the Interior for authorization to conduct natural gas or crude oil (or both) exploration and extraction activities in any area that is at least 50 miles beyond the state's coastal zone. Requires the Secretary of the Treasury to deposit into a Clean Energy Fund of 50% of all rentals, royalties, bonus bids, and other sums due and payable to the United States from leases entered into under this Act for natural gas or crude oil (or both) exploration and extraction activities. Requires deposit of the other 50% into a special account in the Treasury from which the Secretary shall disburse: (1) 75% to the state; (2) 12.5% to provide financial assistance to states in accordance with the Land and Water Conservation Fund Act of 1965; and (3) 12.5% to a reserve fund to be used to mitigate for any environmental damage that occur as a result of extraction activities authorized under this Act. Specifies alternative mandatory uses of such funds by Virginia. Declares that the lines extending seaward and defining the state's Adjacent Zone are as indicated on the map entitled "Atlantic OCS Region State Adjacent Zones and OCS Planning Areas," dated September 2005 and on file in the Office of the Director, Minerals Management Service.

Calls for the Secretary of Defense to develop a comprehensive strategy to increase and encourage investigation and prosecution of sexual assault and rape cases in the military. Sets forth elements to be included in such strategy, including: (1) requiring commanders to be held accountable for sexual assaults and rapes in their units and for disposition of such cases; (2) developing prevention and response programs to create a culture that prevents sexual assault and rape in the military and encourages more reporting by victims; (3) reviewing the capacity of the legal infrastructure in the military to investigate and prosecute effectively sexual assault cases; (4) examining any barriers on military facilities to conducting effective investigations of sexual assault and rape cases; and (5) ensuring that the command affords an alleged sexual assault victim an opportunity for a base transfer should a military protection order be issued.

Over-Classification Reduction Act - Requires the Archivist of the United States, in coordination with the Director of National Intelligence and the heads of other affected federal agencies, to promulgate regulations to prevent the over-classification of information. Requires the Inspector General of each federal agency to audit randomly classified information from each component of the agency with employees that have classification authority. Directs the Archivist to: (1) require personal identifiers of the employee or contractor at the time of such classification, including the individual's agency, office, and position; (2) require specified annual training for such individuals with classification authority and certain classified information responsibilities; and (3) implement a one-year detailee program for federal agency personnel, on a nonreimbursable basis, to the National Archives and Records Administration for training.

Reducing Information Control Designations Act - Requires each federal agency to reduce and minimize its use of information control designations on information that is not classified. Requires the Archivist of the United States to promulgate regulations regarding the use of such designations, including : (1) standards for utilizing such designations in a manner that is narrowly tailored to maximize public access to information; (2) procedures for identifying, marking, dating, and tracking information assigned to the designations; and (3) penalties for employees and contractors who repeatedly fail to comply. Requires each federal agency head to implement the regulations promulgated by the Archivist in a manner that ensures that: (1) information can be shared within the agency, with other agencies, and with state, local, tribal, and territorial governments, the private sector, and the public; (2) the number of agency employees and contractors with authority to utilize such designations is limited; and (3) designations may be placed only on the portion of information that requires control. Requires each federal agency's Inspector General to randomly audit unclassified information with such a designation. Directs the Archivist, for the purpose of assessing and addressing the misuse of designations, to require at the time of marking of information that the following appear on the information: (1) the name or personal identifier of the employee or contractor marking the information; and (2) the agency, office, and position of the employee or contractor. Directs the Archivist to: (1) require training for federal agency employees or contractors who are responsible for analyzing, disseminating, preparing, producing, receiving, publishing, or otherwise communicating information with a designation; and (2) implement a program to detail federal agency personnel to the National Archives and Records Administration (NARA). Requires each federal agency head to ensure that: (1) such designations are not a determinant of public disclosure pursuant to the Freedom of Information Act (FOIA) and; (2) all information in the agency's possession that is releasable pursuant to an appropriate FOIA request is made available to the public.

Amends the Water Resources Development Act of 1996 to eliminate the pilot program status of the Chesapeake Bay environmental restoration and protection program. Permits the nonfederal share of project costs of a local cooperation agreement to include in-kind services. Treats funds provided for a project by a federal agency other than the Corps of Engineers as nonfederal funds for purposes of cost sharing requirements. Authorizes the Secretary of the Army to carry out projects under the program in the Chesapeake Bay watershed, with the goal of carrying out projects in Delaware, New York, Maryland, Pennsylvania, Virginia, West Virginia, and the District of Columbia (currently the Secretary is required to establish at least one project in each of Maryland, Virginia, and Pennsylvania). Directs the Secretary to establish a program, to be administered by the National Fish and Wildlife Foundation, to provide small watershed grants for technical and financial assistance to local governments and nonprofit organizations in the Chesapeake Bay region. Permits the use of grant funds only for implementation of cooperative tributary basin and other Chesapeake Bay-wide strategies that address storm water management or the establishment, restoration, protection, or enhancement of natural habitat associated with the Chesapeake Bay ecosystem. Increases the authorization of appropriations for the Cheasapeake Bay program. Directs the Secretary to develop at federal expense and submit to Congress a comprehensive plan to prioritize projects within the Chesapeake Bay watershed.

Thrift Savings Plan Enhancement Act of 2008 - Revises requirements for participation in the Thrift Savings Plan (TSP) to require the Federal Retirement Thrift Investment Board to provide regulations for automatic enrollment of new participants to make contributions at the default percentage of basic pay. Allows a default investment in an alternative fund or funds (in lieu of the Government Securities Investment Fund (G Fund)), as the Board may designate in regulations, if an election has not been made with respect to any TSP sums available for investment. Requires the Board to include in the TSP, by regulation, a qualified Roth contribution progam (under which an employee may elect to make designated Roth contributions in lieu of elective deferrals under the retirement plan). Authorizes the Board to permit the addition of self-directed investment options under the TSP if it determines that such an addition would be in the best interests of participants. Limits such investment options to: (1) low-cost, passively-managed index funds that offer diversification benefits; and (2) other appropriate retirement investment vehicles for participants. Deems a participant, in the case of a default investment in the G Fund or an alternative fund, to have: (1) elected to invest in such fund; and (2) executed the acknowledgement of risk otherwise required.

National Guard Technician Recruitment and Retention Act of 2008 - Provides that if an individual is first employed by the National Guard as a military technician (dual status) while already a member of a reserve component, the Secretary of the military department concerned may not require the individual to repay any enlistment, reenlistment, or affiliation bonus connected with the individual's enlistment or reenlistment before such employment. Prohibits such individual from being precluded from receiving any such bonus or denied the opportunity to participate in any Department of Defense (DOD) educational loan repayment program as an additional incentive to accept and maintain reserve membership. Repeals the prohibition against overtime pay for such technicians.

Afghanistan-Pakistan Security and Prosperity Enhancement Act - Authorizes the President to designate Reconstruction Opportunity Zones within Afghanistan or Pakistan, provided certain eligibility criteria are met, including that: (1) such countries establish, or make progress toward establishing, a market-based economy, instituting rule of law, protecting core labor standards, and eliminating barriers to trade and investment; (2) such countries can be designated as a beneficiary developing country; and (3) the designation of a Reconstruction Opportunity Zone is appropriate taking into account certain qualifying factors. Provides for the duty-free treatment of certain textile and apparel products, as well as nontextile and nonapparel products, from a Reconstruction Opportunity Zone through September 30, 2023. Sets forth requirements to prevent the unlawful transshipment of such products. Continues the duty-free treatment of such products from a Reconstruction Opportunity Zone in Afghanistan or Pakistan only if the President certifies to Congress that such countries have met certain requirements, including: (1) designation of a labor official; and (2) have agreed to require textile or apparel exporting enterprises to participate in a technical assistance, capacity building, compliance assessment, and remediation program. Authorizes the President to withdraw, suspend, or limit the application of duty-free treatment under this Act.

Federal Employees Deserve to Volunteer on the Elections Act of 2008 or the FEDVOTE Act of 2008 - Entitles executive agency employees to leave, without loss of or reduction in pay, leave to which otherwise entitled, credit for time or service, or performance or efficiency rating, not exceeding six days in a leave year, in order to: (1) provide election administration assistance to a state or unit of local government at a polling place on the date of any election for public office; or (2) receive training without which the employee would be ineligible to provide such assistance. Directs the Election Assistance Commission to make grants to eligible states for recruiting and training individuals to serve as poll workers on dates of elections for public office. Requires grant recipients to use the manual prepared by the Commission on successful practices for poll worker recruiting, training, and retention as an interactive training tool and develop training programs with the participation and input of experts in adult learning. Provides a formula for grant amounts based upon a state's voting age population percentage. Requires reports to the Commission and to Congress on activities conducted with funds provided under this Act. Exempts the Commission from application of the Paperwork Reduction Act.
