Charlie Norwood CLEAR Act of 2007

Clear Law Enforcement for Criminal Alien Removal Act of 2007 or the Charlie Norwood CLEAR Act of 2007 - States that: (1) state and local law enforcement personnel, in the course of their routine duties, have the inherent authority to investigate, apprehend, or transfer to federal custody aliens in the United States (including interstate transportation of such aliens to detention centers) in order to assist in the enforcement of U.S. immigration laws; and (2) effective two years after enactment of this Act, a state that has in effect a statute, policy, or practice prohibiting such law enforcement assistance shall not receive certain federal incarceration assistance. Provides for the listing of immigration violators in the National Crime Information Center database. Directs states and localities to provide the Secretary of Homeland Security (DHS) with specified information about apprehended aliens who are believed to be in violation of U.S. immigration laws. Provides federal reimbursement for related state and local costs. (States that such provision shall not require state or local enforcement officials to provide DHS with information related to a victim of a crime or witness to a criminal offense.) Directs the Secretary to make grants to states and political subdivisions that enforce immigration laws in the course of their routine law enforcement duties for special equipment and facilities related to arresting, detaining, or transporting illegal aliens. Directs the Secretary to: (1) construct or acquire 20 additional detention facilities for aliens detained pending removal (or a decision on removal); and (2) consider the transfer of military installations under base closure laws for such purposes. Amends the Immigration and Nationality Act with respect to illegal aliens apprehended by state or local authorities to provide for: (1) federal custody upon state or local request; and (2) state or local compensation for related incarceration and transportation costs. States with respect to an alien subject to removal that the Attorney General or Secretary shall ensure such alien's detention in an adequate (as defined by this Act) state or local prison, detention center, or other comparable facility prior to his or her removal examination. Directs the Secretary to establish immigration-related training for state and local personnel. Provides: (1) personal liability immunity to the same extent as corresponding federal immunity for state or local personnel enforcing immigration laws within the scope of their duties under this Act; and (2) civil rights money damage immunity for state or local agencies enforcing immigration laws unless their personnel violated criminal law in such enforcement. Continues the institutional removal program (IRP), which shall be expanded to all states. Authorizes state or local detention of an illegal alien after completion of such alien's prison sentence for: (1) up to 14 days to facilitate federal transfer; or (2) until transfer to the U.S. Immigration and Customs Enforcement. Authorizes appropriations for FY2008 and subsequent fiscal years for the state criminal alien assistance program (SCAAP).

Travel Promotion Act of 2007 - Establishes the Corporation for Travel Promotion as a nonprofit corporation that is not an agency or establishment of the U.S. government. Makes the Corporation subject to the provisions of the District of Columbia Nonprofit Corporation Act. Requires the Corporation, among other things, to provide useful information to people interested in traveling to the United States, identify and address perceptions in other countries regarding U.S. entry policies, and promote U.S. travel. Establishes in the Treasury the Travel Promotion Fund. Requires the transfer of Treasury funds to the Corporation, requiring nonfederal matching funds. Authorizes the U.S. government, if a fully automated electronic system is implemented to determine, in advance of travel, the eligibility of an alien to travel to the United States, to charge an applicant a system use fee. Amends the International Travel Act of 1961 to replace references to the United States National Tourism Organization with references to the Corporation. Modifies various requirements applicable to the Tourism Policy Council. Amends the Department of Commerce and Related Agencies Appropriations Act, 2003 to remove provisions establishing the United States Travel and Tourism Promotion Advisory Board.

Directs a state which provides medical assistance for covered outpatient drugs to establish a minimum Medicaid dispensing fee of at least $8 per unit for covered outpatient multiple source drugs. Revises the requirement for application of the federal upper pharmacy reimbursement limit in the calculation of the payment for covered outpatient drugs. Increases from 250% to 300% the percentage of the average manufacturer price (AMP) the Secretary of Health and Human Services is required to substitute for 150% of the published price. Repeals the state option to increase the cap on the equity asset test for an individual's eligibility for long-term care assistance under Medicaid. Directs the Secretary, for purposes of verifying financial eligibility for Medicaid, to collaborate with the Commissioner of Social Security for use of the Commissioner's system for obtaining information held by financial institutions in order to verify eligibility for benefits under SSA title VI (Supplemental Security Income) (SSI).

Amends the Public Health Service Act to require the Director of the National Institutes of Health (NIH) to establish the Pain Consortium to: (1) establish a national agenda for research on the causes and effective treatments for pain; and (2) convene an annual conference of experts in pain research, treatment, and management to assess and make recommendations on NIH pain research activities and programs. Requires the Director of NIH to establish the National Pain Care Research Advisory Committee. Requires the Director of the Agency for Healthcare Research and Quality to: (1) collect protocols and evidence-based practices regarding pain care at all stages of life; and (2) disseminate such information to regulatory and enforcement agencies, health care programs, payor and providers, health professions schools, hospices, and the general public. Allows the Secretary to provide for the development and implementation of programs to educate and train health care professionals in pain care. Requires the Secretary to establish a national pain care education outreach and awareness campaign.

Establishes the Reagan-Udall Foundation for the Food and Drug Administration as a nonprofit corporation to advance the mission of the Food and Drug Administration (FDA) to modernize medical, veterinary, food, food ingredient, and cosmetic product development, accelerate innovation, and enhance product safety. Provides for recruitment of potential members of FDA advisory committees. Requires the Secretary, acting through the Director of the National Institutes of Health (NIH), to establish and administer a clinical trial registry database and a clinical trial results database for drugs and devices. Authorizes the Secretary to require a responsible person for a drug to conduct a post-approval study on the basis of scientific information.

Local Community Radio Act of 2007 - Repeals provisions in the Departments of Commerce, Justice, and State, the Judiciary, and Related Agencies Appropriations Act, 2001, that required the Federal Communications Commission (FCC) to: (1) modify rules authorizing the operation of low-power FM radio stations to prescribe minimum distance separations for third-adjacent channels; (2) prohibit applicants who have engaged in the unlicensed operation of any station from obtaining a low-power FM license; and (3) conduct a program to test whether low-power FM radio stations will result in harmful interference to existing FM radio stations if minimum distance separations for third-adjacent channels are not required. Requires the FCC to modify its rules to eliminate third-adjacent minimum distance separation requirements between specified stations. Requires the FCC to retain rules that provide third-adjacent channel protection for full-power noncommercial FM stations that broadcast radio reading services via a subcarrier frequency from potential low-power FM station interference. Requires the FCC when licensing FM translator stations to ensure: (1) that licenses are available to both FM translator stations and low-power FM stations; and (2) that such decisions are made based on the needs of the local community.

National Environment and Energy Development Act - Declares without force or effect all federal prohibitions against the expenditure of appropriated funds to conduct natural gas leasing and preleasing activities for any area of the Outer Continental Shelf (OCS). Revokes all withdrawals of federal submerged lands from leasing for natural gas exploration and production. Amends the Outer Continental Shelf Lands Act to prohibit the Secretary of the Interior from: (1) granting a natural gas lease for any OCS located within 25 miles of a state coastline; or (2) issuing any lease for natural gas exploration or development in any OCS area located within 50 miles of a state coastline unless the state has enacted a law approving such lease. Prohibits the Secretary from issuing a lease for natural gas exploration or development in any OCS area located more than 50 miles and less than 100 miles from the coastline of a state if the state has enacted a law disapproving such lease issuance. Sets forth an allocation schedule (including designated reserve accounts) for revenues derived from bonus bids and royalties under qualified gas leases on submerged lands located within the seaward boundaries of a state. Modifies requirements for deeming state seaward boundaries. Authorizes the Secretary to issue leases for development and production of natural gas and associated condensate. Expresses the intent of Congress that this Act result in a healthy and growing American industrial, manufacturing, transportation, and service sector employing America's workforce to assist in the development of affordable energy from the OCS.

Requires distribution of the first $4 million to the NASA Family Assistance Fund for financial assistance to the families of NASA personnel who die as a result of injuries suffered in the performance of their official duties. Requires distribution of: (1) one-half of the next $1 million of the remaining amounts to the Dr. Ronald E. McNair Educational (D.R.E.M.E.) Science Literacy Foundation and the Dorothy Jemison Foundation for Excellence; and (2) the remainder to the Secretary of the Smithsonian Institution for the preservation, maintenance, and display of space artifacts at the National Air and Space Museum (including the Steven F. Udvar-Hazy Center). Authorizes the Secretary to strike and sell bronze duplicates of the $50 gold coins.

Expresses the sense of the House of Representatives that the Committee on Ways and Means should report legislation on or before December 31, 2008, to simplify the federal income tax system.

Boutique Fuel Reduction Act of 2007 - Amends the Clean Air Act to add as "extreme and unusual circumstances that prevent the distribution of an adequate supply of fuel or fuel additives to consumers" under which the Administrator of the Environmental Protection Agency (EPA) may temporarily waive a control or prohibition on the use of a fuel or fuel additive circumstances that are the result of unexpected problems with equipment necessary for transportation and delivery of fuel or fuel additives. States that EPA shall have no authority, when considering a state implementation plan (SIP) or SIP revision, to approve any fuel included in such plan or revision if the effect of such approval increases the total number of fuels set forth on the published list of approved fuels (currently EPA does not have the authority to approve a fuel if it increases the total number of fuels approved as of September 1, 2004, in all SIPs). Requires notice and opportunity for comment before the Administrator removes a fuel from the list. Requires EPA to remove a fuel from the list if such fuel has ceased to be included in an SIP or is identical to a federal fuel control or prohibition. Repeals provisions prohibiting EPA from reducing the total number of authorized fuels. Requires EPA to publish a revised list reflecting the reduction in the number of fuels. Deletes as a condition under which the Administrator's authority to approve a control or prohibition respecting any new fuel is limited that such new fuel will increase the total number of fuels on the list.

Border Law Enforcement Enhancement Act - Authorizes the Secretary of Homeland Security to make grants to sheriff's offices and local and tribal police departments in jurisdictions within 25 miles of the U.S. southern border for: (1) law enforcement operations; (2) detention (including construction and operation of detention facilities) and transfer of illegal aliens to federal authorities; (3) enforcement of substance trafficking laws and other state and federal criminal laws; and (4) hiring, equipping, training, and overtime. States that nothing in this Act shall be construed to authorize state or local law enforcement agencies to exercise federal immigration law enforcement authority.

Terminates such minting authority after December 31, 2014. Requires coin sales to include a $10 surcharge per coin, with distribution of such surcharges to the Susan G. Komen for the Cure and the National Osteoporosis Foundation for the purpose of furthering research.

Coal Liquid Fuel Act - Amends the Energy Policy Act of 2005 to authorize the Secretary of Energy to enter into: (1) standby loan agreements with up to six qualifying CTL projects, at least one of which shall be owned by two or more small coal producers; and (2) a profit-sharing agreement with the project at the time the standby loan agreement is executed. Defines "qualifying CTL project" as: (1) a commercial-scale project that converts coal to liquid or gaseous transportation fuels; or (2) not more than one project at a facility that converts petroleum refinery waste products, including petroleum coke, into liquids or gaseous transportation fuels, and demonstrates the capture, sequestration, or disposition of carbon dioxide produced in the conversion process.

Requires providers to certify to the Secretary of Health and Human Services compliance with this Act.

Amends the Immigration and Nationality Act to impose criminal penalties on individuals present in the United States in violation of immigration laws. Requires the Department of Homeland Security to continue to operate and implement the Institutional Removal Program for the identification and removal from the United States of criminal aliens. Requires such program to be extended to all states. Authorizes states to detain criminal aliens after the completion of their prison sentences to effectuate their transfer to federal custody. Authorizes appropriations for the training of state and local government officers or employees to perform certain functions of a federal immigration officer.

Internet Radio Equality Act - Declares to be ineffective: (1) the March 2, 2007, Determination of Rates and Terms of the U.S. Copyright Royalty Judges regarding rates and terms for the digital performance of sound recordings and ephemeral recordings; (2) the April 17, 2007, modification of that determination by an order denying motions for rehearing; and (3) any subsequent modification by the Copyright Royalty Judges published in the Federal Register. Replaces standards for determining reasonable rates and terms of royalty payments for public performances of sound recordings by means of eligible nonsubscription transmission services and new subscription services with a requirement that such rates and terms be established in accordance with stated objectives of the Copyright Royalty Judges. (Currently, rates and terms are required to distinguish among different types of eligible nonsubscription transmission services and include a minimum fee for each type.) Allows a minimum annual royalty for each provider subject to such rates and terms. Provides a transition rule for payment of royalties by providers of digital audio transmissions that would have been subject to the rates and terms nullified by this Act. Revises royalty payment provisions concerning the use of certain works in noncommercial broadcasting to include: (1) sound recordings; and (2) performance or display by nonprofit organizations and public broadcasting entities. Provides a transition rule for the payment by a public broadcasting entity to owners of copyrights in sound recordings. Requires a report to the Copyright Royalty Judges by the Assistant Secretary of Commerce for Communications and Information on the competitiveness of the Internet radio marketplace and the effect on Internet radio providers of proposed rate determinations in proceedings concerning: (1) public performances of sound recordings by means of the services described above; or (2) the use of certain works in noncommercial broadcasting. Requires the Federal Communications Commission (FCC), upon publication of the commencement of proceedings of the Copyright Royalty Judges to determine rates and terms under the statutory license described in this Act, to report on the effect of such proposals on localism, diversity, and competition in the Internet radio marketplace (including in rural areas). Requires a report to Congress and the Copyright Royalty Judges by the Corporation for Public Broadcasting (CPB) on the effect of such proposals upon public broadcasting licensees and permittees.

Defines "biogas" as a gas that is derived by processing qualified energy feedstock (i.e., manure of agricultural livestock and other waste material) in an anaerobic digester and which contains at least 60% methane and carbon dioxide and trace gases. Amends the Farm Security and Rural Investment Act of 2002 to direct the Secretary of Agriculture to: (1) use Commodity Credit Corporation funds for making countercyclical payments to qualified biogas producers for biogas production facilities placed in service before December 31, 2013; and (2) make loans, loan guarantees, and grants to providers of qualified energy feedstock for collecting and transporting such feedstock to a biogas facility or for the purchase or construction of equipment of facilities for such collection and transportation activities.
