Fiscal Responsibility Act of 2009 - Provides that, if there is a deficit in a fiscal year, then: (1) any pay adjustment (including a cost of living adjustment) for Members of Congress scheduled to take effect in the succeeding calendar year shall be null and void; and (2) rates of pay for Members shall be reduced by a specified percentage, but not below zero. Specifies the mandatory pay rate reduction at: (1) 5%, for the first year; or (2) 10%, for any consecutive subsequent year that expenditures exceed revenues. Specifies conditions for restoration of the original pay rate, together with otherwise scheduled adjustments. Vests authority in the Director of the Congressional Budget Office (CBO) to make determinations of whether or not a deficit exists in any fiscal year. States that, in making any such determination, the Director shall exclude any budget outlays which directly relate to a military conflict that lasts over 30 days or that is in direct response to a terrorist attack on the United States.

Medicaid and SCHIP Beneficiary Choice Improvement Act of 2009 - Amends title XXI (State Children's Health Insurance Program) (SCHIP, also known as CHIP) of the Social Security Act to require an SCHIP plan to describe how it will provide for child health assistance with respect to targeted low-income children who have access to coverage under a group health plan. Requires the Secretary of Health and Human Services (HHS) to pay to each state with an approved SCHIP plan a certain amount for the payment of premiums for coverage under an employer-sponsored group health plan that includes coverage of targeted low-income children and benefits supplemental to such coverage. Revises requirements regarding the purchase of employer-sponsored insurance. Prohibits any minimum benefits requirement or any limitation on beneficiary cost-sharing. Declares that, if the basic coverage of such insurance does not extend to each of certain categories of basic services, the plan shall cover such services as supplemental benefits. Prohibits a plan from requiring a targeted low-income child to enroll in family coverage in order to obtain child health assistance. Requires an annual voluntary enrollment period for switching from one plan to another. Requires the offering of alternative coverage options under SCHIP. Prescribes requirements for federal financial participation for qualified alternative coverage. Declares that the requirements imposed under a state child health plan under this Act shall apply in the same manner to a state plan under title XIX (Medicaid), except that: (1) such requirements shall not apply to individuals whose Medicaid eligibility is based on being aged, blind, or disabled or to individuals in certain categories; and (2) the national per capita expenditures shall be determined based on a specified benchmark coverage but without regard to expenditures for such excluded individuals or for nursing facility services and other long-term care (LTC) services. Amends the Children's Health Insurance Program Reauthorization Act of 2009 to repeal the prohibition against the Secretary's approval of any new health opportunity account demonstration programs. Converts the Health Opportunity Account demonstration program into a permanent program.

Sets forth provisions governing eligible metropolitan areas (EMAs) being considered transitional areas for purposes of emergency relief grants. Limits the maximum amount that a grant to an EMA or a state may decrease from the prior fiscal year. Requires the HIV health services planning council to develop a strategy for identifying individuals with HIV/AIDS who are unaware of their HIV status. Adjusts the number of living cases of HIV/AIDS for areas that moved to names-based reporting systems in FY2007. Increases from 2% to 5% the percentage of unobligated balances permitted from the prior fiscal year for purposes of eligibility for supplemental grants and avoidance of grant reductions. Requires state applications for Care grants (grants to enable states to improve health care and support services for individuals and families with HIV/AIDS) to include a plan related to identifying and making services available to individuals with HIV/AIDS who are not aware of their status. Sets forth provisions related to rebates under the AIDS Drug Assistance Program, including excluding certain rebate amounts from unobligated balances. Requires the Secretary of Health and Human Services (HHS) to establish a national HIV/AIDS testing goal of 5 million tests annually through federally supported HIV/AIDS prevention, treatment, and care programs. Sets forth provisions governing notification of emergency response employees of their exposure to infectious diseases.

Prohibits anything in the Employee Retirement Income Security Act of 1974, the Internal Revenue Code, or the Public Health Service Act from being interpreted to prevent any health insurance provider from establishing premium discounts or rebates, or modifying copayments or deductibles, for individuals who participate in a health promotion or disease prevention (wellness) program which meets this Act's requirements. States that if none of the conditions for obtaining a premium discount, rebate, or other reward for participation in a wellness program is based on an individual satisfying a standard related to a health status factor, such program shall not violate this Act if participation is made available to all similarly situated individuals with respect to a program: (1) that reimburses the cost for memberships in a fitness center; (2) of diagnostic testing that provides a reward for participation not based on outcomes; (3) that encourages preventive care related to a health condition through the waiver of the copayment or deductible requirement under a health plan for costs related to a health condition (such as prenatal care or well-baby visits); (4) that reimburses individuals for the costs of smoking cessation programs without regard to whether the individual quits smoking; and (5) that rewards individuals for attending a periodic health education seminar. Provides that if any of the conditions for obtaining a premium discount, rebate, or other reward for participation in a wellness program is based on an individual satisfying a standard related to a health status factor, the program shall not violate this Act if specified conditions are met, including that: (1) the reward for the program, together with the reward for other wellness programs regarding the plan that requires satisfaction of a standard related to a health status factor, does not exceed 30% of the cost of employee-only coverage under the plan; (2) the program is reasonably designed to promote health or prevent disease; (3) the plan gives individuals eligible for the program the opportunity to qualify for the reward at least annually; and (4) the full reward under the program is made available to all similarly situated individuals.

Ensuring the Future Physician Workforce Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act (SSA) with respect to the formula for calculating payments for physicians' services. Resets to 2009 the base year for application of the sustainable growth rate formula, which shall be eliminated in 2011. Amends SSA title XVIII to extend the current transitional bonus payments through 2011 at 3%. Directs the Secretary of Health and Human Services to establish a reporting system for quality measures relating to physicians' services that focus on disease-specific high cost conditions. Amends SSA title XI to create safe harbors to antikickback and civil and criminal penalties for provision of health information technology (HIT) and training services. Directs the Secretary to study and report to Congress on the impact of such safe harbors. Amends SSA title XVIII to create an exception to the limitation on certain physician referrals for the provision of HIT and training services to health care professionals. Directs the Secretary to report annually to: (1) each physician information on the physician's total Medicare billings; and (2) each individual entitled to benefits under Medicare part A (Hospital Insurance) and part B (Supplementary Medical Insurance) on the amount of Medicare payments made to or on behalf of the individual during the year involved. Directs the Secretary to collect data on annual savings in expenditures in the Medicare program due to physicians' services that resulted in hospital or in-patient diversion. Requires the Board of Trustees of the Federal Hospital Insurance Trust Fund and of the Federal Supplementary Medical Insurance Trust Fund to monitor and examine the extent to which the different funding mechanisms under Medicare parts A, B, and D (Voluntary Prescription Drug Benefit Program) provide an appropriate alignment with the program goals of the respective parts. Requires the Secretary to provide for a study of, and report to Congress on, health care disparities in high-risk health condition areas and minority communities with respect to the impact reporting requirements may have on physician penetration in such communities.

Secure America Through Verification and Enforcement Act of 2009 or SAVE Act of 2009 - Sets forth border security and enforcement provisions, including provisions respecting: (1) increases in Border Patrol and investigative personnel; (2) recruitment of former military personnel; (3) use of Department of Defense (DOD) equipment; (4) infrastructure improvements; (5) aerial and other surveillance; (5) a national strategy to secure the borders; (6) accountable financing under the Secure Border Initiative; (7) emergency deployment of Border Patrol agents; and (8) expansion of the Customs-Trade Partnership Against Terrorism along the northern and southern borders. Directs the Secretary of Homeland Security (DHS) to check against terrorist watchlists those persons suspected of alien smuggling and smuggled individuals who are interdicted at U.S. borders. Amends the Immigration and Nationality Act and specified maritime law sections to revise alien smuggling provisions. Sets forth provisions respecting border security on certain federal lands under the jurisdiction of the Secretary of Agriculture or the Secretary of the Interior. Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to make the basic employment eligibility confirmation pilot program permanent. Sets forth conditions for the mandatory use of the E-verify system. Requires: (1) employer/employee notification of social security number mismatches and multiple uses, and related information sharing with DHS; and (2) establishment of electronic birth and death registration systems. Amends the Internal Revenue Code to: (1) penalize specified employers for failure to correct information returns; and (2) prohibit employers from deducting from gross income wages paid to unauthorized aliens, with an exception for an employer participating in the basic employment eligibility confirmation program. Increases criminal alien program (CAP) personnel. Authorizes border relief grants for local law enforcement agencies within 25 miles of the southern U.S. border. Establishes within DHS a rewards program to assist in the elimination of commercial operations to produce or sell fraudulent immigration-related documents and to assist in the investigation, prosecution, or disruption of commercial alien smuggling operations. Provides for: (1) increased alien detention facilities; (2) additional immigration court judgeships; and (3) a media campaign to inform the public of changes made by this Act including a multilingual media campaign explaining noncompliance penalties.

Prohibits consideration in the House of a general appropriation bill reported by the Committee on Appropriations until 72 hours (excluding Saturdays, Sundays, and legal holidays unless the House is in session on such a day) after printed hearings of the Committee have been available to Members. Prohibits the Committee on Rules from reporting a rule or order proposing a waiver of this resolution or of Rule XXII (House and Senate Relations) unless a question of consideration of the rule is adopted by a vote of two-thirds of the Members voting, a quorum being present. Amends Rule XXII (House and Senate Relations) to make it out of order in the House to consider a conference report, the accompanying signed joint explanatory statement, or a motion to dispose of a Senate amendment reported in disagreement by a conference committee until after: (1) the 72-hour availability requirement has been met; and (2) posting on the Internet. Declares that nothing in this resolution or any amendment made by it shall be interpreted to require or permit the declassification or posting on the Internet of classified information in the custody of the House. Requires such classified information to be made available to Members in a timely manner as appropriate under existing laws and rules. NATO First Act - Expresses U.S. policy on the current force structure in Europe. Prohibits any action to effect or implement the closure of any military installation in a European member nation of the North Atlantic Treaty Organization (NATO) at which a unit of U.S. Armed Forces is based, or to alter the permanent basing arrangement of such a unit, unless: (1) the closure is requested by the government of the host nation; or (2) the Secretary of Defense makes a certification to the congressional defense committees regarding the necessity of such closure or alteration. Authorizes the Secretary to: (1) conduct or support programs to build the capacity of the national military forces of certain foreign countries to support the theater priorities of the Commander of the United States European Command; and (2) provide assistance to the NATO Special Operations Coordination Center to support NATO special operations forces and activities. Expresses U.S. policy on the extended deterrence commitment to Europe. Prohibits any action to effect or implement the reduction of U.S. nuclear forces in Europe unless: (1) the reduction is requested by the government of the host nation; or (2) the Secretary makes certain certifications regarding the necessity of such reduction. Earmarks specified funds appropriated for FY2011-FY2012 for the Missile Defense Agency for a long-range missile defense system in Europe. Directs the Secretary to deploy a system providing a short-range air and missile defense capability, and the personnel required to operate and maintain the system, to Poland. Allows Department of Defense (DOD) funds to be used to implement reductions in the strategic nuclear forces of the United States pursuant to a treaty or other agreement entered into between the United States and the Russian Federation after the date of enactment of this Act only if the President makes certain certifications to Congress concerning the efficacy of such reductions. Authorizes the Secretary to expand the United States-Russian Federation joint center for the exchange of data from early warning systems to include the exchange of data on missile defense-related activities.

Automobile Dealer Economic Rights Restoration Act of 2009 - Prohibits an automobile manufacturer (manufacturer) in which the federal government has an ownership interest, or which receives loans from the federal government, from depriving an automobile dealer (dealer) of its economic rights. Requires the manufacturer to honor those rights as they existed for Chrysler LLC and General Motors Corporation dealers prior to the commencement of the bankruptcy cases of each corporation, including dealer rights to recourse under state law. Requires the appropriate manufacturer to restore the franchise agreement between the dealers and Chrysler LLC or General Motors that was in effect prior to the commencement of their respective bankruptcy cases, and to take assignment of such agreements. States that nothing in this Act is intended to make null and void the transfer of substantially all the assets of such corporations.
