Currently, schools participating in the program must provide milk that is consistent with the most recent Dietary Guidelines for Americans; USDA regulations require milk to be fat-free or low-fat and allow only fat-free milk to be flavored. The bill removes these restrictions and instead permits schools to offer students whole, reduced-fat, low-fat, and fat-free flavored and unflavored milk.

Speeding Therapy Access Today Act of 2021 This bill requires and authorizes various actions to accelerate the development of therapies for rare diseases. The Food and Drug Administration (FDA) shall establish the Intercenter Institute on Rare Diseases and Conditions. The institute shall (1) coordinate engagement with relevant stakeholders, (2) build the FDA's expertise in the review of medical products to treat rare diseases, (3) coordinate regulatory science initiatives related to rare diseases, (4) establish and implement a program to make recommendations to address challenges associated with developing medical products to treat rare diseases in an individual or in very small populations, (5) convene a stakeholder meeting to consider potential amendments to labels for medical products to treat rare diseases, and (6) establish and carry out a program to facilitate voluntary communication between the sponsors of such medical products and third-party payers (e.g., insurance companies). The bill also authorizes the FDA to make grants to assist in developing practices related to the development and production of individualized therapies or therapies to treat very small populations. The bill also establishes an advisory committee to advise the FDA on issues related to the development of therapies to treat rare diseases.

Knowing the Efficiency and Efficacy of Permanent Telehealth Options Act of 2021 or the KEEP Telehealth Options Act of 2021 This bill requires certain agencies to report on the availability and effects of expanded telehealth services under Medicare, Medicaid, and the Children's Health Insurance Program (CHIP) during the public health emergency relating to COVID-19. Among other information, the Department of Health and Human Services must detail its actions during the emergency to expand access to telehealth services and must analyze telehealth usage by certain demographic groups. The Medicare Payment Advisory Commission and the Medicaid and CHIP Payment and Access Commission must report on the improvements and barriers to telehealth access during the emergency and the risks of fraudulent activity associated with expanded access.

Farm Workforce Modernization Act of 2021

Farm Workforce Modernization Act of 2021 This bill contains provisions related to alien farmworkers, including provisions establishing a certified agricultural worker (CAW) status and changing the H-2A temporary worker program. The Department of Homeland Security (DHS) may grant CAW status to an applying alien who (1) performed at least 1,035 hours of agricultural labor during the two-year period prior to March 8, 2021; (2) on that date was inadmissible, deportable, or under a grant of deferred enforced departure or temporary protected status; and (3) has been continuously present in the United States from that date until receiving CAW status. The bill imposes additional crime-related inadmissibility grounds on CAW applicants and makes some other grounds inapplicable. CAW status shall be valid for 5.5 years and may be extended. DHS may grant dependent status to the spouse or children of a principal alien. An alien with a pending application may not be detained or removed by DHS and shall be authorized for employment until DHS makes a final decision on the application. A CAW alien (and dependents) may apply for lawful permanent resident status after meeting various requirements, including performing a certain amount of agricultural labor for a number of years. DHS shall create an electronic platform for (1) filing H-2A petitions, (2) facilitating the processing of H-2A cases, and (3) providing agencies a single tool for obtaining H-2A-related case information. The bill makes various changes to the H-2A program, such as (1) modifying the method for calculating and making adjustments to the H-2A worker minimum wage, (2) specifying how an employer may satisfy requirements that it attempted to recruit U.S. workers, (3) requiring H-2A employers to guarantee certain minimum work hours, (4) making the program available for agricultural work that is not temporary or seasonal, and (5) reserving a visa allocation for the dairy industry. DHS shall establish a pilot program allowing certain H-2A workers to apply for portable status, which gives the worker 60 days after leaving a position to secure new employment with a registered H-2A employer. DHS shall establish an electronic system patterned on the E-Verify Program for employers to verify an individual's identity and employment authorization. Employers hiring individuals for agricultural employment must use the system. This bill permanently establishes the Housing Preservation and Revitalization Program, which provides financing assistance for rural rental housing and off-farm labor housing and rental assistance for qualified tenants of such housing. It also authorizes the Department of Agriculture to provide various assistance, including funding for insuring loans and grants for new farmworker housing.

Postal Supervisors and Managers Fairness Act of 2021 This bill modifies procedures for negotiating pay and benefits of supervisory and other managerial personnel of the U.S. Postal Service (USPS). At least 60 days before the expiration of a pay decision, the USPS must propose to the supervisors' organization any changes in pay policies, pay schedules, or fringe benefit programs for members of such organization. Not later than 60 days after the USPS agrees to a collective bargaining agreement that affects the pay or benefits of supervisors or managers who are members of the supervisors' organization, the USPS shall provide a proposal regarding such matters to the organization. The bill makes binding the decision of the fact-finding panel appointed by the Federal Mediation and Conciliation Service in the event of an impasse between the USPS and a supervisors' organization over proposed changes in pay and benefits.

American Dream and Promise Act of 2021

American Dream and Promise Act of 2021 This bill provides certain aliens with a path to receive permanent resident status and contains other immigration-related provisions. The Department of Homeland Security (DHS) or the Department of Justice (DOJ) shall provide conditional permanent resident status for 10 years to a qualifying alien who entered the United States as a minor and (1) is deportable or inadmissible, (2) has deferred enforced departure (DED) status or temporary protected status (TPS), or (3) is the child of certain classes of nonimmigrants. The bill imposes various qualifying requirements, such as the alien being continuously physically present in the United States since January 1, 2021, passing a background check, and being enrolled in or having completed certain educational programs. DHS shall remove the conditions placed on permanent resident status granted under this bill if the alien applies and meets certain requirements, such as completing certain programs at an educational institution, serving in the military, or being employed. Furthermore, DHS and DOJ shall cancel the removal of certain aliens who had TPS, were eligible for TPS, or were eligible for DED status on certain dates. Such an alien shall receive permanent resident status upon meeting certain requirements and applying for such status within three years of this bill's enactment. DHS may not use information from applications filed under this bill or for Deferred Action for Childhood Arrivals status for immigration enforcement purposes. This bill also repeals a restriction that bars a state from providing higher education benefits to undocumented aliens unless those benefits are available to all U.S. nationals without regard to residency in the state.

Build America's Libraries Act This bill establishes and provides funds through FY2024 for the Build America's Libraries Fund, from which the Institute of Museum and Library Services (IMLS) must allocate funding to states and, through them, need-based grants to libraries to make long-term improvements to library facilities. The IMLS must also award grants to Indian tribes and organizations that primarily serve and represent Native Hawaiians. Specifically, the bill requires each state that receives an allocation, and each library that receives a grant, to carry out certain activities to improve library facilities. These activities include constructing and renovating library facilities, investing in infrastructure projects to improve internet access and connectivity, improving indoor air quality, and making facilities accessible to individuals with disabilities. The bill also outlines administrative and oversight provisions, including by requiring library projects to use iron and steel products that are produced in the United States.

Peace Corps Reauthorization Act of 2021 This bill reauthorizes through FY2025 and modifies operations of the Peace Corps. Changes include expanding benefits and services for volunteers by increasing the readjustment allowance paid to volunteers when their service terminates and providing statutory authority for an executive order that grants returned volunteers noncompetitive eligibility for federal civil-service positions. Additionally, the bill entitles returned volunteers to three months of health care benefits (and a three-month extension at the volunteer's expense). The Peace Corps must also provide volunteers with (1) information about enrolling in U.S. health plans no more than 30 days prior to service termination, (2) adequate access to menstrual products, and (3) mental health care during and after service. The bill also includes provisions to address involuntary termination of Peace Corps service in emergencies or otherwise through no fault of the volunteer, including by expediting re-enrollment of involuntarily terminated volunteers. The Peace Corps must also provide adequate support to insure volunteers' safety and must coordinate with the Department of State to periodically update agreements and plans concerning the security of Peace Corps volunteers and staff abroad. The bill also modifies the Peace Corps National Advisory Council's membership and functions, expands whistleblower protections for volunteers, increases the rate of pay that applies to a volunteer's workers compensation claim, and requires a focus on leveraging the internet in Peace Corps programs. Furthermore, the bill requires reporting on (1) Peace Corps operations in the Pacific Islands, and (2) the provision of mental health services to volunteers.

Do No Harm Act

Do No Harm Act This bill prohibits the application of the Religious Freedom Restoration Act of 1993 (RFRA) to specified federal laws or the implementation of such laws. Currently, RFRA prohibits the government from substantially burdening a person's exercise of religion even if the burden results from a rule of general applicability, except in furtherance of a compelling governmental interest when using the least restrictive means. Under the bill, RFRA is inapplicable to laws or the implementation of laws that protect against discrimination or the promotion of equal opportunity (e.g., the Civil Rights Act of 1964); require employers to provide wages, other compensation, or benefits, including leave; protect collective activity in the workplace; protect against child labor, abuse, or exploitation; or provide for access to, information about, referrals for, provision of, or coverage for, any health care item or service. The bill prevents RFRA from being used to deny (1) goods or services the government has contracted, granted, or made an agreement to provide to a beneficiary of or participant in a program or activity funded by such government contract, grant, agreement, or other award; or (2) a person's full and equal enjoyment of a government-provided good, service, benefit, facility, privilege, advantage, or accommodation. In order for a person to assert a RFRA claim or defense in a judicial proceeding, the government must be a party to the proceeding.

DISCLOSE Act of 2021

Democracy Is Strengthened by Casting Light On Spending in Elections Act of 2021 or the DISCLOSE Act of 2021 This bill addresses campaign finance, including by expanding the prohibition on campaign spending by foreign nationals, requiring additional disclosures of campaign expenditures, and requiring additional disclosures regarding certain political advertisements. First, the bill prohibits foreign nationals from participating in the decision-making process regarding an election expenditure. Additionally, the bill expands existing foreign money prohibitions to include disbursements for paid web-based or digital communications and federal judicial nomination communications. It also prohibits foreign nationals from contributing to campaigns related to ballot initiatives and referenda. The Federal Election Commission (FEC) must conduct an audit after each federal election cycle to determine the incidence of illicit foreign money. Next, the bill makes it unlawful to establish or use a corporation, company, or other entity with the intent to conceal an election contribution or donation by a foreign national. A violator is subject to criminal penalties—a fine, a prison term of up to five years, or both. Covered organizations (e.g., corporations, labor organizations, and political organizations) must, within 24 hours, file reports with the FEC to disclose campaign expenditures of more than $10,000 during an election cycle. Finally, the bill requires organizations to provide additional disclosures regarding political advertisements, including the donors who contributed the most money to that organization in the last year.

Mainstreaming Addiction Treatment Act of 2021 This bill removes the requirement that a health care practitioner apply for a separate waiver through the Drug Enforcement Administration (DEA) to dispense certain narcotic drugs (e.g., buprenorphine) for maintenance or detoxification treatment (i.e., substance use disorder treatment). Further, a community health aide or community health practitioner may dispense certain narcotic drugs for maintenance or detoxification treatment without registering with the DEA if the drug is prescribed by a health care practitioner through telemedicine. It preempts state laws related to licensure for this activity. The bill also directs the Substance Abuse and Mental Health Services Administration to conduct a national campaign to educate health care practitioners and encourage them to integrate substance use disorder treatment into their practices.

USDA may also award competitive grants to implement the research or other solutions to restore forest tree species native to the United States that have suffered severe levels of mortality caused by non-native plant pests and noxious weeds. The bill also expands the authority of USDA to transfer funds to respond to an emergency involving an outbreak of a plant pest or noxious weed. Further, USDA must enter into an agreement with the National Academy of Sciences or another nongovernmental entity to analyze available resources in federal agencies for research of, and solutions to, non-native forest pests and pathogens.

Telehealth Modernization Act

Telehealth Modernization Act This bill modifies requirements relating to coverage of telehealth services under Medicare. Specifically, the bill extends certain flexibilities that were initially authorized during the public health emergency relating to COVID-19 (i.e., coronavirus disease 2019). Among other things, the bill allows (1) rural health clinics and federally qualified health centers to serve as the distant site (i.e., the location of the health care practitioner); (2) the home of a beneficiary to serve as the originating site (i.e., the location of the beneficiary) for all services (rather than for only certain services); and (3) all types of practitioners to furnish telehealth services, as determined by the Centers for Medicare & Medicaid Services.

National Heritage Area Act of 2021

National Heritage Area Act of 2021 This bill establishes a National Heritage Areas System to recognize certain areas of the United States that tell nationally significant stories and to conserve, enhance, and interpret the areas' natural, historic, scenic, and cultural resources that illustrate significant aspects of U.S. heritage, and authorizes appropriations through FY2034 for each National Heritage Area. Through such system, the Department of the Interior may provide technical and financial assistance to local coordinating entities to support the establishment, development, and continuity of such areas. The bill extends the authority for the Erie Canalway National Heritage Corridor Commission and the Gullah/Geechee Cultural Heritage Corridor Commission until September 30, 2034. The local coordinating entity of a National Heritage Area, not later than three years after the area is included in the National Heritage Area System, shall submit to Interior a management plan for approval. Interior, not later than one year before the authorization for federal funding expires for a National Heritage Area, shall (1) conduct an evaluation of the accomplishments of that area, and (2) submit a report detailing the evaluation to specified congressional committees. Based upon the evaluation, Interior shall prepare a report with recommendations for the National Park Service's continued role, if any, with respect to the area. Interior may carry out or certify a study to assess the suitability and feasibility of designating a specific geographic area as a National Heritage Area to be included in the National Heritage Area System.

Department of Veterans Affairs Veterans' and Caregivers' COVID-19 Immunizations Now Expanded Act of 2021 or the VA VACCINE Act of 2021 This bill authorizes the Department of Veterans Affairs (VA) to furnish a COVID-19 (i.e., coronavirus disease 2019) vaccine to covered individuals during the COVID-19 public health emergency. Under the bill, covered individuals are veterans who are not eligible to enroll in the VA health care system; specified veterans who are eligible for hospital care, medical services, and nursing home care abroad; family caregivers of veterans participating in the VA's Program of Comprehensive Assistance for Family Caregivers; caregivers of veterans participating in the VA's Program of General Caregiver Support Services; and caregivers of veterans participating in the VA's Medical Foster Home Program, Bowel and Bladder Program, Home Based Primary Care Program, or Veteran Directed Care Program. George Floyd Justice in Policing Act of 2021 This bill addresses a wide range of policies and issues regarding policing practices and law enforcement accountability. It increases accountability for law enforcement misconduct, restricts the use of certain policing practices, enhances transparency and data collection, and establishes best practices and training requirements. The bill enhances existing enforcement mechanisms to remedy violations by law enforcement. Among other things, it does the following: lowers the criminal intent standard—from willful to knowing or reckless—to convict a law enforcement officer for misconduct in a federal prosecution, limits qualified immunity as a defense to liability in a private civil action against a law enforcement officer, and grants administrative subpoena power to the Department of Justice (DOJ) in pattern-or-practice investigations. It establishes a framework to prevent and remedy racial profiling by law enforcement at the federal, state, and local levels. It also limits the unnecessary use of force and restricts the use of no-knock warrants, chokeholds, and carotid holds. The bill creates a national registry—the National Police Misconduct Registry—to compile data on complaints and records of police misconduct. It also establishes new reporting requirements, including on the use of force, officer misconduct, and routine policing practices (e.g., stops and searches). Finally, it directs DOJ to create uniform accreditation standards for law enforcement agencies and requires law enforcement officers to complete training on racial profiling, implicit bias, and the duty to intervene when another officer uses excessive force.

Medicare-X Choice Act of 20 21 This bill establishes and funds the Medicare Exchange health plan, which allows individuals who are not otherwise eligible for Medicare to enroll in a government-administered health insurance plan. The Centers for Medicare & Medicaid Services (CMS) must offer such plan in certain individual health insurance exchanges beginning plan year 2022 and offer it in all individual health insurance exchanges beginning plan year 2025. CMS must offer the plan in the small group market in all geographic areas for plan year 2025. The plan must cover primary care services without cost sharing and meet the same requirements, including essential health benefits, as existing health insurance exchange plans. Unless they opt out, health care providers enrolled under Medicare or under a state Medicaid plan must participate in the plan and are reimbursed at Medicare rates. The bill establishes a grants program for community organizations, educational institutions, and health agencies to create service partnerships and establish interactive data systems for health care providers. Additionally, the bill expands the premium tax credit available for plans purchased through an exchange and eliminates the restriction on the Department of Health and Human Services negotiating prescription drug prices for Medicare.

The bill also expressly specifies that recovery from organ-donation surgery constitutes a serious health condition that entitles eligible employees to job-protected medical leave. In addition, the Department of Health and Human Services must update educational materials on live organ donation to include information about the benefits of live organ donation and about access to insurance for living organ donors.

This disease is caused by damage to or disease affecting any valve that controls blood flow in the heart. The National Institutes of Health must consult with the National Heart, Lung, and Blood Institute to conduct or support research on the disease, including on mitral valve prolapse. This occurs when the valve between the chambers of the left side of the heart seals improperly. The Centers for Disease Control and Prevention (CDC) must develop best practices to treat valvular heart disease. The CDC may also carry out other projects to increase awareness of and reduce deaths from the disease.

The State Department and the U.S. Agency for International Development may provide assistance to prevent and respond to such activities against LGBTQI people. The bill also requires that annual country reports on human rights practices include information on criminalization, discrimination, and violence based on sexual orientation and gender identity.

The bill expands the definition of public accommodations to include places or establishments that provide (1) exhibitions, recreation, exercise, amusement, gatherings, or displays; (2) goods, services, or programs; and (3) transportation services. The bill allows the Department of Justice to intervene in equal protection actions in federal court on account of sexual orientation or gender identity. The bill prohibits an individual from being denied access to a shared facility, including a restroom, a locker room, and a dressing room, that is in accordance with the individual's gender identity.

Following its award, the medal shall be given to the National Museum of American History of the Smithsonian Institution for display and research. The Department of the Treasury must strike duplicate medals in silver for presentation to a hostage (or the personal representative of a deceased hostage), and Treasury may also strike and sell duplicate medals in bronze.
