Child Custody Protection Act

Child Custody Protection Act - Amends the Federal criminal code to prohibit transporting a minor across a State line to obtain an abortion and thereby abridging the right of a parent under a law in force in the State where the minor resides requiring parental involvement in a minor's abortion decision. Makes an exception if the abortion was necessary to save the life of the minor. Specifies that neither the minor transported nor her parent may be prosecuted or sued for a violation of this Act. Makes it an affirmative defense to a prosecution for, or to a civil action based on, such a violation that the defendant reasonably believed that before the minor obtained the abortion, the parental consent or notification or judicial authorization that would have been required had the abortion been performed in the State where the minor resides, took place. Authorizes any parent who suffers harm from a violation to obtain appropriate relief in a civil action. Defines "parent" to include a guardian, legal custodian, or person standing in loco parentis who has care and control of the minor, and with whom the minor regularly resides, who is designated by such law as a person to whom notification, or from whom consent, is required.

Sound Science for Endangered Species Act Planning Act of 2003 - Amends the Endangered Species Act of 1973 to direct the Secretary of the Interior to: (1) give greater weight to scientific and commercial data that is empirical or that has been field-tested or peer-reviewed in determining that a species is an endangered or threatened species; and (2) promulgate regulations that establish criteria for data to be used as the basis of such a determination. Prohibits the Secretary from determining that a species is endangered or threatened unless the determination is supported by field data. Requires the Secretary to include in the rule-making record of such a determination data collected by landowners. Requires the Secretary to publish a description of additional scientific and commercial data that would assist in the preparation of a recovery plan. Directs the Secretary to: (1) solicit recommendations from the National Academy of Sciences and develop a list of qualified reviewers to participate in independent scientific review actions; and (2) appoint from such list three individuals who shall report on the scientific information and analyses on which final action is based. Requires the Secretary, when consulting with a Federal agency to determine whether agency action will jeopardize an endangered or threatened species or destroy the critical habitat of such species, to: (1) consider information provided by affected States; and (2) allow any person who has sought agency authorization or funding for an action to participate in related consultations.

Calls on the Latin American and Caribbean group (GRULAC) at the Commission to exclude Cuba from its slate of candidates for the Commission, and urges all member nations to oppose renewing Cuba's membership on the Commission until the Government of Cuba adheres to international human rights standards, such as those delineated in the Universal Declaration of Human Rights.

Local Voices on TV Act of 2003 - Amends the Communications Act of 1934 to prohibit a cable television operator (operator) from carrying the signal of a qualified class A television station (a station that provides local and specialized service and meets certain other requirements) in lieu of a full power analog or digital local commercial station. Requires that, if there are not sufficient signals of full power local commercial stations to fill the channels set aside for local programming, an operator with a system capacity of 35 or fewer channels must carry one qualified low power station (current law) or one qualified class A station. Requires: (1) an operator with a system capacity of more than 35 but less than 72 channels to carry two stations that are either class A or low power stations; and (2) an operator with a system capacity of more than 72 channels to carry three that are either type of stations. Grants carriage rights to all qualified class A stations in a designated market area if there are three or fewer commercial full power stations serving that area that do not substantially retransmit the signal of another broadcast station. Requires the Federal Communications Commission (FCC) to prescribe regulations to implement provisions for the application and granting of new class A television licenses in accordance with the Community Broadcasters Protection Act of 1999. Directs the FCC to consider whether the treatment of a low-power station as a class A station would meet the public interest, convenience, and necessity. Requires prompt FCC review and determination with respect to applications of advanced television services.

Parental Notification and Intervention Act of 2003 - Prohibits any person or organization from performing, permitting facilities to be used to perform, or assisting in the performance of an abortion on an unemancipated minor under age 18, without: (1) clear and convincing evidence of physical abuse of the minor by the parent and the provision of written notification to the parents; (2) compliance with a 96-hour waiting period after notice has been received by the parents; and (3) compliance with judicial intervention procedures. Prescribes penalties of up to ten years' imprisonment and/or a $1 million fine for violating such prohibition. Provides for an exception where a physician without principal responsibility for making the decision to perform the abortion determines that: (1) a medical emergency exists due to a grave, physical disorder or disease that would cause the minor's death if an abortion is not performed; (2) parental notification is not possible as a result of the emergency; and (3) certifications and determinations to that effect have been entered in the minor's medical records. Requires parental notification through certified mail or personal delivery. Authorizes a notified parent to bring an action in Federal district court which shall enjoin the abortion: (1) until the court's judgment is final; or (2) permanently unless the court determines that granting such relief would be unlawful.

Broad-Based Stock Option Plan Transparency Act of 2003 - Directs the Securities and Exchange Commission (SEC) to require companies to include within certain mandatory reports details regarding stock option plans, stock purchase plans, and other arrangements involving employee acquisition of an equity interest in the company, including: (1) a discussion of the dilutive effect of stock option plans (written in accordance with the Plain English Handbook published by the Office of Investor Education and Assistance of the Commission); (2) expanded disclosure of the dilutive effect of employee stock options on the company's earnings per share number; (3) prominent placement and increased comparability of all stock option related information; and (4) a summary of stock options granted to the five most highly compensated executive officers, including outstanding stock options of those officers. Directs the SEC to examine and report to specified congressional committees on the effectiveness of the enhanced disclosures required by this Act in increasing transparency to current and potential investors. Prohibits the Commission, between enactment of this Act and submission of such report, from recognizing as generally accepted accounting principles any new accounting standards regarding the treatment of stock options. Directs the Secretary of Commerce to analyze and report to specified congressional committees on broad-based employee stock option plans, particularly in the high technology and any other high growth industries.

Declares that such articles include apparel articles that are wholly assembled or knit-to-shape in Haiti exclusively from fabric components and yarns formed in: (1) the United States; (2) a country that is party to a free trade agreement with the United States on January 1, 2003, that enters into a free trade agreement with the United States subject to trade promotion authority, or that has been designated as a beneficiary country; and (4) any country if the fabrics or yarns are designated as not being commercially available in the United States. Specifies the quantity of articles to which such preferential treatment shall extend. Declares that Haiti shall be eligible for such preferential treatment if the President determines and certifies to Congress that Haiti has met specified conditions, including: (1) establishing or making progress toward establishing a market-based economy that protects private property rights, the rule of law, the elimination of barriers to U.S. trade and investment, economic policies to reduce poverty, a system to combat corruption and bribery, and protection of internationally recognized worker rights; (2) not engaging in activities that undermine U.S. national security or foreign policy interests or gross violations of internationally recognized human rights; (3) not providing support for international terrorism; and (4) cooperating in international efforts to eliminate human rights violations and terrorist activities.

Renewing the Dream Tax Credit Act - Amends the Internal Revenue Code to permit a community homeownership tax credit based upon an applicable percentage of each qualified residence's eligible basis. Makes such credit available to residences located: (1) in a census tract with a median gross income not exceeding 80 percent of the greater area or statewide median gross income; (2) in a rural area; (3) on an Indian reservation; or (4) in an area of chronic economic distress. Prohibits a buyer's income from exceeding 80 percent (70 percent for families of less than three) of the area gross median income and requires owner occupancy. Specifies that the aggregate homeownership credit dollar amount which a homeownership credit agency (an "agency") may disburse is the portion of the "State homeownership credit ceiling" (the "ceiling") allocated to such agency. Allows "unused homeownership credit carryovers" to be allocated among qualified States. Small Business and Financial Institutions Tax Relief Act of 2003 - Amends the Internal Revenue Code to make a trust-individual retirement account (IRA) an eligible bank S corporation shareholder. Exempts from prohibited transaction rules any sale of stock in an IRA pursuant to a small business corporation's election to be an S corporation. Excludes from the definition of passive income for purposes of S status termination any interest income earned by or dividends on assets required to be held by a bank, a bank holding company, or a qualified subchapter S subsidiary bank. Increases to 150 the maximum number of shareholders a small business organization may have to be eligible to elect S corporation treatment. States that stock held by a bank director as required by banking regulations (director qualifying stock) shall not be considered a disqualifying second class of S corporation stock. Permits a bank which makes an S corporation election to recapture certain bad debt reserves in the year of election or the preceding year. Limits any special rules regarding corporate income preference items to the three years following S corporation election. Treats a husband and wife as one shareholder. Permits, and sets forth criteria for, an election to treat all members of a family as one shareholder. Permits the issuance of qualified preferred stock, which shall not be treated as second class stock. Makes any distribution (not in payment in exchange for stock) made by an S corporation with respect to qualified preferred stock includible as ordinary income of the holder and deductible to the corporation as an expense. Revises exceptions to the criteria for the treatment of certain wholly owned subchapter S subsidiaries with reference to required information returns. Provides for a charitable contribution basis adjustment of S corporation stock based upon the shareholder's pro rata share of adjusted basis.

Postal Civil Service Retirement System Funding Reform Act of 2003 - Amends Federal law to revise the statutory formula for funding benefits under the Civil Service Retirement System for U.S. Postal Service employees. Mandates that savings accruing to the Postal Service and attributable to specified years: (1) be used to reduce the postal debt as the Secretary of the Treasury shall specify; and (2) be held in escrow until Congress acts following receipt of certain reports. Expresses the sense of the Congress that: (1) the savings accruing to the Postal Service as a result of the enactment of this Act will be sufficient to allow the Postal Service to fulfill its commitment to hold postage rates unchanged until at least 2006; (2) because the Postal Service still faces substantial obligations related to postretirement health benefits for its current and former employees, some portion of those savings should be used to address the unfunded obligations; and (3) none of the savings should be used to pay bonuses to Postal Service executives. Sets a deadline for submission of a mandatory Postal Service report detailing how future savings accruing to the Postal Service as a result of the enactment of this Act should be expended.
