Justice for Victims of Fraud Act of 2016 This bill amends the Truth in Lending Act and the Electronic Fund Transfer Act to prohibit predispute arbitration agreements with consumers (i.e., agreements to arbitrate any future disputes between parties instead of pursuing the claims in court) from being valid or enforceable in disputes related to credit card accounts or personal bank accounts that are not subject to a final judgment by a court if the credit card or bank account was not issued in response to a request or application for that account. The bill excludes from this prohibition accounts held by a financial institution pursuant to a bona fide trust agreement.

Presidential Accountability Act This bill amends the federal criminal code to make it a crime for the President or Vice President to personally and substantially participate in official matters that affect their financial interests, unless the financial interests are held in a blind trust or the President or Vice President discloses the financial interests and receives an exemption. It imposes criminal penalties—a prison term, a fine, or both—on a President or Vice President who commits the offense. It also authorizes civil penalties and injunctions. Additionally, a violation constitutes a high crime and misdemeanor (i.e., grounds for impeachment) under Article II, Section 4 of the U.S. Constitution. Finally, the bill prohibits the President or Vice President from entering into contracts with the U.S. government.

This bill declares that nothing in the Act shall prohibit federal, state, or local government or other assistance or a preference program designed to assist or benefit domestic violence or sexual assault survivors in seeking, securing, or maintaining dwellings, shelters or any other form of housing. The Civil Rights Act of 1968 is amended to prohibit intimidation in fair housing tranactions regarding survivors of domestic violence or sexual assault.

Partnerships for Progress and Prosperity Act or the P3 Act This bill requires the Department of Education (ED) to award grants to local educational agencies (LEAs) and institutions of higher education for the improvement of students' education in science, technology, engineering, and mathematics (STEM). Each grantee shall partner with an employer in a STEM field to: assist students in obtaining internships or apprenticeships, develop STEM coursework curricula and metrics, carry out dual-credit courses, provide tutoring and mentoring, enable students and teachers to attend STEM events outside of the classroom, provide after-school and summer STEM programs, and purchase educational materials or equipment to facilitate STEM instruction. In awarding grants under the program, ED shall give special consideration to applicants that: promote in-classroom engagement between STEM professionals and students; use technology-based materials and content; pair mentors and tutors with students struggling to meet curriculum benchmarks; in the case of LEA applicants, serve schools in which most students are eligible for free or reduced-price lunch; and propose to use grant funds to target interventions for populations that are traditionally underrepresented in STEM fields. Each grantee shall provide matching funds equal to 50% of the grant amount.

Immigration Courts Bail Reform Act This bill amends the Immigration and Nationality Act to eliminate the minimum bond amount needed to release a detained alien. An immigration judge may review an initial custody determination for an adult alien, subject to specified rules, which include the following: the Department of Homeland Security (DHS) shall, within 72 hours, file the notice to appear or charging document with the appropriate immigration court and serve such notice on the detained alien; except for criminals or suspected terrorists, DHS may continue to detain an alien only if no conditions will reasonably assure the alien's appearance and the safety of any other person and the community; the Department of Justice shall ensure that an alien has the opportunity to promptly appear before an immigration judge for a custody redetermination hearing; except for criminals or suspected terrorists, an immigration judge shall review the custody determination de novo and may continue to detain the alien only if DHS demonstrates that no conditions will reasonably assure the alien's appearance and the community's safety; DHS and an immigration judge shall order an alien's release on personal recognizance or upon an unsecured appearance bond unless such release will not reasonably assure the alien's appearance or the community's safety; if DHS or an immigration judge determines that such release will not reasonably assure the alien's appearance or such safety, DHS or the immigration judge shall order the alien's release under the least restrictive conditions that will assure the alien's appearance and the community's safety; DHS or an immigration judge shall consider the alien's financial ability in determining whether to impose a bond as a condition of release; and DHS or an immigration judge may not impose a financial condition that results in an alien's detention.

TREAT Astronauts Act

To Research, Evaluate, Assess, and Treat Astronauts Act or the TREAT Astronauts Act This bill directs the National Aeronautics and Space Administration (NASA) to establish a program that provides for the medical monitoring, diagnosis, and treatment of crewmembers for space flight-associated medical conditions. The bill defines "crewmember" as an individual certified by NASA to be: a former NASA astronaut or payload specialist who has flown on at least one orbital space mission, or a management NASA astronaut who has flown on at least one such mission and is currently employed by the federal government. Medical monitoring, diagnosis, and treatment shall be provided under the program without any deductibles, copayments, or other cost sharing obligations required of participating crewmembers. NASA shall design the program to facilitate reasonable access of a crewmember to medical monitoring, diagnosis, and treatment under the program, including, at crewmember's option: through NASA; or from a health care provider selected by the crewmember and which enters into an agreement with NASA to provide such services to the crewmember. Participation by a crewmember under the program shall be voluntary and subject to the crewmember's written consent. Under the program, NASA shall provide for the uniform collection of data on space flight-associated medical conditions and the identification of any new space flight-associated conditions. NASA shall arrange with an independent organization to determine an estimate of the cost to NASA and the federal government for the implementation and administration of the program.

America's Call To Improve Opportunities Now for National Service Act or the ACTION for National Service Act This bill amends the National and Community Service Act of 1990 and the Domestic Volunteer Service Act of 1973 to reestablish the Corporation for National and Community Service as an independent executive agency called the National and Community Service Administration. An individual who successfully completes a term of full-time national service shall be entitled to a national service educational award equal to twice the amount of tuition for the institution of higher education where the individual is enrolled, not to exceed twice the average in-state tuition. Current law limits the award's value to the maximum amount of a Federal Pell Grant that an individual is eligible to receive in the aggregate. Within the administration, the bill establishes an interagency working group to evaluate specified issues related to: (1) eligibility for tuition and student loan repayment assistance with regard to participation in certain national or volunteer service programs, (2) the advisability of granting federal hiring preference to certain volunteer program participants, and (3) methods for increasing the participation of seniors in national service programs. The National Service Foundation, a nonprofit corporation established by the bill, shall accept and administer gifts made in connection with the administration. The bill expresses support for the authorization of appropriations sufficient to provide, within 10 years, volunteer service opportunities for at least 1 million volunteers in full-time national service annually. The bill amends the Internal Revenue Code to exclude AmeriCorps educational awards from gross income.

Patsy T. Mink Gender Equity in Education Act of 2016 This bill requires the Department of Education (ED) to establish an Office for Gender Equity to support state and local educational agencies, institutions of higher education, and elementary and secondary schools in fully implementing title IX of the Education Amendments of 1972, which prohibits discrimination on the basis of sex in federally funded education programs or activities. The office may provide grants and perform activities to reduce or prevent discrimination, bias, harassment, or violence based on actual or perceived sex, sexual orientation, gender, gender identity, pregnancy, childbirth, or related medical conditions or stereotypes in all areas of education. The office must: (1) provide technical assistance and annual training to title IX coordinators, and (2) develop a handbook for conducting self-evaluations of title IX compliance. The training must address "compound discrimination" (defined as discrimination based on sex and other characteristics, including race, ethnicity, national origin, disability status, religion, or age). The office may award grants to educational entities and partnerships to: train students, teachers, faculty, and personnel; increase campus resources, facilities, and course offerings; support title IX coordinators in performing outreach, advocacy, and education; identify patterns or systemic problems in title IX compliance; strengthen prevention education and awareness programs; conduct campus climate and victimization surveys; identify gender inequities; and improve data collection and reporting of gender equity indicators from academic assessments, civil rights data, campus data, employment data, attendance and absenteeism data, or title IX coordinator-to-student ratios. ED must coordinate with the Institute of Education Sciences and other federal offices and entities to investigate, identify, and disseminate best practices to: (1) reduce and prevent sex stereotyping, bias, and discrimination in curricula and educational materials; (2) address sex-based harassment and violence on campuses; (3) develop counseling and career guidance training; (4) mitigate implicit bias in teaching and discipline; and (5) address the needs of students who face compound discrimination.

Sexual Assault Survivors' Rights Act This bill amends the federal criminal code to establish statutory rights for sexual assault survivors, including the right to: (1) receive a forensic medical examination at no cost; (2) have a sexual assault evidence collection kit (i.e., rape kit) preserved for the maximum applicable statute of limitations; (3) receive written notification prior to destruction or disposal of a rape kit; and (4) be informed of the rights and policies under this section. Additionally, it makes statutory crime victims' rights applicable to sexual assault survivors. The bill amends the Victims' Rights and Restitution Act of 1990 to include information about sexual assault services, programs, and providers in the description of services provided to victims. The bill amends the Victims of Crime Act of 1984 to authorize the Department of Justice's (DOJ's) Office of Justice Programs to make grants to states to develop sexual assault survivors' rights and policies and to disseminate written notice of such rights and policies to medical centers, hospitals, forensic examiners, sexual assault service providers, law enforcement agencies, and other state entities. DOJ and the Department of Health and Human Services must establish a joint working group to develop, coordinate, and disseminate best practices regarding the care and treatment of sexual assault survivors and the preservation of forensic evidence. For purposes of this bill, the term "sexual assault survivor" includes a legal representative acting on behalf of a deceased victim of sexual assault.

This bill amends the federal criminal code to require a licensed gun dealer to notify the national instant criminal background check system (i.e., the NICS database) of an explosive materials sale and the purchaser's identity. Additionally, it requires the Department of Justice (DOJ) to include in the NICS database information about an individual who is or has been under a federal terrorism investigation. A federal department or agency must submit to DOJ information about such individual. If a licensed gun dealer request a background check on a prospective gun buyer or provides notice of an explosive materials purchaser who is or has been under a federal terrorism investigation, then the NICS database must notify the appropriate division of the Federal Bureau of Investigation.

Coal Cleanup Taxpayer Protection Act This bill amends the Surface Mining Control and Reclamation Act to prohibit the Office of Surface Mining and Reclamation Enforcement (OSMRE) and state regulatory authorities from accepting new self-bonds for coal reclamation. Additionally, any existing self-bonds or corporate bonds utilized for coal reclamation must be converted to surety or collateral bonds. The OSMRE may approve state or federal alternative coal mining bond programs that result in no greater risk of financial liability to the federal government than a surety or collateral bond program. The bill also requires the OSMRE to issue rules establishing limitations on surety bonds to minimize the financial liability to the federal or state government.

LGBT Data Inclusion Act This bill requires federal agencies that collect information through a survey that includes demographic data (where subjects self-report information or a proxy provides information about the subject or responds for all persons in a household) to establish data standards that require: a determination of which existing data sets exclude information about sexual orientation and gender identity; an identification, and a use, of appropriate methods to include questions on sexual orientation and gender identity in surveys that facilitate categorization and voluntary participation and that preserve privacy and confidentiality; and a routine assessment of needed changes in survey methods related to asking such questions. Agencies that publish reports relying on survey demographic data must include information on sexual orientation and gender identity. Individuals shall not be: (1) required by this bill to disclose their sexual orientation or gender identity to an agency; or (2) subjected to fines or penalties for refusing to answer, or providing a false answer to, any survey question regarding gender identity or sexual orientation. Nothing in this bill shall be construed to permit the use of such collected information in a manner that would adversely affect an individual.

Women, Peace, and Security Act of 2016 This bill expresses the sense of Congress that the United States should be a global leader in promoting the meaningful participation of women in conflict prevention, management, and resolution and post-conflict relief and recovery efforts. The President, not later than October 1 of 2017, 2022, and 2027, shall submit to Congress and make public a Women, Peace, and Security Strategy, which shall: be aligned with other nations' plans to improve the participation of women in peace and security processes, conflict prevention, peace building, and decision-making institutions in conflict-affected environments; and include goals and evaluation plans to ensure strategy effectiveness. The Foreign Service Act of 1980 is amended to direct the Department of State to ensure that personnel responsible for, or deploying to, countries or regions considered to be at risk of undergoing, or emerging from, violent conflict obtain training in the following areas, each of which shall include a focus on ensuring participation by women: conflict prevention, mitigation, and resolution; protecting civilians from violence, exploitation, and trafficking in persons; and international human rights law. The Department of Defense shall ensure that personnel responsible for, or deploying to, countries or regions considered to be at risk of undergoing, or emerging from, violent conflict obtain training in: conflict prevention, peace processes, mitigation, resolution, and security initiatives that addresses the importance of participation by women; and gender considerations and meaningful participation by women, including training regarding international human rights law and protecting civilians from violence, exploitation, and trafficking in persons. The State Department and the U.S. Agency for International Development shall establish guidelines for overseas U.S. personnel to consult with stakeholders regarding U.S. efforts to: prevent, mitigate, or resolve violent conflict; and enhance the success of mediation and negotiation processes by ensuring the meaningful participation of women.

Middle Class CHANCE Act

Creating Higher Education Affordability Necessary to Compete Economically Act or the Middle Class CHANCE Act This bill amends title IV (Student Assistance) of the Higher Education Act of 1965 to modify provisions related to the Federal Pell Grant program. Specifically, it increases the maximum Federal Pell Grant award for academic year 2017-2018 and adjusts it in subsequent award years to account for changes in the Consumer Price Index. Additionally, the bill increases from one to two the number of Pell Grants an eligible student may receive in a single award year (i.e., it restores year-round Pell Grants). An eligible student is a student who: (1) has already received one Pell Grant for an award year, (2) is enrolled in an eligible program for an additional payment period (e.g., a summer term) during the same award year, (3) is enrolled on at least a part-time basis, and (4) has completed a full-time course load prior to receiving an additional Pell Grant. Opioid and Heroin Abuse Crisis Investment Act of 2016 This bill appropriates funding for the activities in the bill. This bill amends the Public Health Service Act to require the Department of Health and Human Services to enter into cooperative agreements with states to expand opioid treatment capacity, make services more affordable to those who cannot afford them, and help individuals seek treatment, successfully complete treatment, and sustain recovery. (Opioids are drugs with effects similar to opium, such as heroin and certain pain medications.) Funding must be allocated to states based on the severity of the opioid epidemic in the state and the strength of the state's strategy to respond. The Office of the National Coordinator for Health Information Technology must expand efforts to support prescription drug monitoring programs and health information technology interoperability. The Bureau of Prisons must support drug treatment programs. The bill amends the Second Chance Act to require the Department of Justice (DOJ) to help justice-involved individuals successfully reintegrate into the community. The bill amends the Controlled Substances Act to permit DOJ to support the development of residential and aftercare services for substance-involved inmates. DOJ must establish new heroin enforcement groups within the Drug Enforcement Administration to target, disrupt, and dismantle heroin trafficking organizations.

The Department of Justice (DOJ) may reduce by up to 20% the JAG allocation of a state or local government that fails to comply. DOJ must collect data on the efforts of state and local governments to enhance de-escalation training for law enforcement officers. Additionally, a state or local government that receives JAG program funding must enact a law, policy, or procedure that establishes an affirmative duty on a law enforcement officer to use de-escalation techniques. DOJ must reduce by 15% the JAG allocation of a state or local government that fails to enact such law, policy, or procedure. DOJ must issue guidance on compliance with these requirements.

Medical Leave for Disabled Veterans Act This bill amends the Family and Medical Leave Act of 1993 (FMLA) to provide eligibility for specified medical/hospital care for an employee who: (1) has a Department of Veterans Affairs (VA) disability rating of between 30% and 50% and at least 833 hours of service with the employer (from whom leave is requested) during the previous eight-month period, or (2) has a VA disability rating of 60% or higher and at least 625 hours of service with such employer during the previous 6-month period. Medical/hospital leave shall also be provided to an employee who is not covered by the above provision but who retired from the Armed Forces by reason of a service-connected disability: (1) rated at between 30% and 50% at retirement and who has at least 833 hours of service with such employer during the previous eight-month period, or (2) rated at 60% or higher at retirement and who has at least 625 hours of service with such employer during the previous 6-month period. (Under current law, employees of an FMLA-covered employer become eligible for medical leave after 12 months on the job and at least 1,250 hours of service with such employer during the previous 12-month period.) A employee must submit a certification to the employer from the VA or the Department of Defense, as appropriate, to be eligible for such adjustment.

Emmett Till Unsolved Civil Rights Crimes Reauthorization Act of 2016 This bill permanently reauthorizes the Emmett Till Unsolved Civil Rights Crime Act of 2007 (Emmett Till Act) and expands the responsibilities of the Department of Justice (DOJ) and the Federal Bureau of Investigation (FBI) to include the investigation and prosecution of criminal civil rights statutes violations that resulted in a death, regardless of when the violations occurred. (Currently, the Emmett Till Act is scheduled to expire at the end of FY2017 and such investigations are limited to violations that occurred before 1970.) The bill expresses the sense of Congress that all authorities with jurisdiction should: (1) coordinate information sharing; (2) hold accountable individuals who were perpetrators of, or accomplices in, unsolved civil rights murders; and (3) comply with Freedom of Information Act requests. In investigating a complaint, DOJ may coordinate activities with entities that DOJ determines to be appropriate. DOJ shall reopen and review cases closed without an in-person investigation conducted by DOJ or the FBI. DOJ must establish a task force to conduct a thorough investigation of Emmett Till Act cases. In an annual report to Congress, DOJ must indicate: (1) the number of cases referred by a civil rights organization, an institution of higher education, or a state or local law enforcement agency; (2) the number of such cases that resulted in federal charges; (3) the date any such charges were filed; (4) whether DOJ has declined to prosecute or participate in an investigation of a referred case; and (5) any activity on reopened cases. DOJ may award grants to civil rights organizations, institutions of higher education, and other eligible entities for expenses associated with investigating offenses under the Emmett Till Act.
