Amends title XVIII (Medicare) of the Social Security Act with respect to the use of average sales price methodology for calculating payments for drugs and biologicals under Medicare part B (Supplementary Medical Insurance). Excludes from the manufacturer's average sales price when calculating such payments any customary prompt pay discounts extended to wholesalers.

National MS and Parkinson's Disease Registries Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services (HHS), acting through the Director of the Agency for Toxic Substances and Disease Registry, to: (1) develop a system to collect data on multiple sclerosis (MS) and a system to collect data on Parkinson's disease; (2) establish a national surveillance system for the collection and storage of data for each such disease, including population-based registries of U.S. cases of MS and Parkinson's disease; (3) provide analysis regarding expansion of national disease surveillance systems for other neurological diseases and disorders; and (4) establish the Advisory Committee on Neurological Disease Registries. Allows the Secretary, acting through the Director, to provide for the collection, analysis, and reporting of data on MS and Parkinson's disease. Requires the Secretary, acting through the Director, to: (1) identify, build upon, expand, and coordinate existing data and surveillance systems, surveys, registries, and other federal public health and environmental infrastructure wherever possible; and (2) provide for research access to Parkinson's disease and MS data. Requires the Secretary to ensure that epidemiological and other types of information collected are made available to agencies such as the National Institutes of Health (NIH), the Food and Drug Administration (FDA), the Department of Veterans Affairs (VA), and the Department of Defense (DOD).

Clean Water Protection Act - Amends the Federal Water Pollution Control Act (commonly known as the Clean Water Act) to define "fill material" to mean any pollutant that replaces portions of waters of the United States with dry land or that changes the bottom elevation of a water body for any purpose and to exclude any pollutant discharged into the water primarily to dispose of waste.

Dextromethorphan Distribution Act of 2009 - Amends the Federal Food, Drug, and Cosmetic Act to deem to be adulterated any unfinished dextromethorphan that is possessed, received, or distributed in violation of this Act. Prohibits a person from: (1) possessing or receiving unfinished dextromethorphan unless the person is registered with the Secretary of Health and Human Services as a producer of a drug or device or otherwise registered, licensed, or approved pursuant to federal or state law to engage in the practice of pharmacy, pharmaceutical production, or manufacture or distribution of drug ingredients; or (2) distributing unfinished dextromethorphan to any person other than a registered or otherwise authorized person. Excludes from such prohibitions common carriers that possess, receive, or distribute unfinished dextromethorphan for purposes of distributing it between registered, licensed, or approved persons.

Commission on the Foreclosure and Mortgage Lending Crisis Act - Establishes in the legislative branch the Commission on the Foreclosure and Mortgage Lending Crisis to: (1) study and report to Congress on the current legal and regulatory framework governing the housing mortgage lending markets and how it contributed to the increased foreclosure rate; (2) recommend changes to the current framework to prohibit lending practices that have contributed to the mortgage lending crisis; (3) review the impact of subprime abuses and predatory lending practices; (4) assess the role of states in enacting policies to reduce predatory lending practices and abuses in the subprime markets; (5) assess the impact of mortgage-backed securities and the Federal National Mortgage Corporation (Fannie Mae) and the Federal Home Loan Mortgage Corporation (Freddie Mac) upon the mortgage lending crisis; and (6) assess the impact of the Community Reinvestment Act of 1977 on the crisis.

Achieving a Better Life Experience Act of 2009 or the ABLE Act of 2009 - Amends the Internal Revenue Code to establish tax-exempt ABLE accounts for individuals with a disability to pay certain expenses of such individuals, including expenses for education, housing, transportation, employment support, medical care, and certain life necessities. Defines "individual with a disability" as an individual who is eligible to receive certain supplemental security income benefits under the Social Security Act. Allows individual taxpayers a tax deduction, up to $2,000 per year, for contributions to an ABLE account. Requires the Secretary of the Treasury to study and report to Congress on the use of ABLE accounts and the effect of the tax deduction for contributions to such accounts. Requires ABLE accounts to be disregarded in determining eligibility for Medicaid benefits and for purposes of determining eligibility for other means-tested federal programs.

Arthritis Prevention, Control, and Cure Act of 2009 - Amends the Public Health Service Act to authorize the Secretary of Health and Human Services to develop and implement a National Arthritis Action Program that may include: (1) research, investigations, demonstrations, training, and studies relating to the control, prevention, and surveillance of arthritis and other rheumatic diseases; (2) additional grant support to encourage the expansion of research related to the prevention and management of arthritis at the Centers for Disease Control and Prevention (CDC); (3) national education and outreach activities for arthritis and other rheumatic diseases; (4) emphasis on prevention, early diagnosis, and appropriate management of arthritis and opportunities for effective patient self-management; and (5) grants to states or Indian tribes for comprehensive arthritis control and prevention programs and public health surveillance, prevention, and control activities related to arthritis and other rheumatic diseases. Authorizes the Secretary to expand and intensify programs of the National Institutes of Health (NIH) with respect to research and related activities concerning various forms of juvenile arthritis and related conditions. Authorizes the Secretary, acting through the Director of CDC, to: (1) provide for the collection, analysis, and reporting of data on juvenile arthritis; and (2) support the development of a national juvenile arthritis population-based database. Requires the Secretary to support activities that provide for: (1) an increase in institutional training grants to support pediatric rheumatology training; and (2) an expansion of public-private partnerships to promote education training and fellowship opportunities for pediatric rheumatologists. Directs the Secretary to establish and carry out a pediatric rheumatology loan repayment program, as needed.

Medal of Honor Commemorative Coin Act of 2009 - Directs the Secretary of the Treasury to mint and issue $5 gold coins and $1 silver coins emblematic of the design selected by the Secretary, after consultation with the Boards of the Congressional Medal of Honor Society and the Congressional Medal of Honor Foundation, in honor of the distinguished service of the American military men and women who have been Medal of Honor recipients. Limits the period for coin issuance to calendar year 2011. Imposes a surcharge of $35 per coin for the $5 coin and $10 per coin for the $1 coin, to be distributed to the Congressional Medal of Honor Foundation to help finance educational, scholarship, and outreach programs of the Foundation.

Federal Reserve Transparency Act of 2009 - Repeals the authority of the Comptroller General to carry out an onsite examination of an open insured bank or bank holding company only if the appropriate federal regulatory agency has consented in writing. (Retains the authority of the Comptroller General to audit a federal agency.) Directs the Comptroller General to complete, before the end of 2010, an audit of the Board of Governors of the Federal Reserve System and of the federal reserve banks, followed by a detailed report to Congress.

Teaching Geography is Fundamental Act - Amends the Higher Education Act of 1965 to establish a geography education grant program under title II, Teacher Quality Enhancement. Authorizes the Secretary of Education to award a grant to a national nonprofit educational organization or consortium, with 75% to be used for subgrants to institutions of higher education associated with state geographic alliances, nonprofit educational organizations, or state or local educational agencies. Requires various grantee and subgrantee activities designed to expand geographic literacy among kindergarten through grade 12 students by improving their teachers' professional development programs offered through institutions of higher education. Includes among such activities state-based conferences to assess geographic literacy and identify improvement strategies.

Fire Sprinkler Incentive Act of 2009 - Amends the Internal Revenue Code to classify automatic fire sprinkler systems as five-year depreciable property. Makes this Act applicable to property placed in service after April 11, 2003.

5-Star Generals Commemorative Coin Act - Requires the Secretary of the Treasury to mint and issue $5 gold coins, $1 silver coins, and half-dollar clad coins in recognition of five United States Army Five-Star Generals: George Marshall, Douglas MacArthur, Dwight Eisenhower, Henry "Hap" Arnold, and Omar Bradley, alumni of the United States Army Command and General Staff College, Fort Leavenworth, Kansas. Requires the design of the coins to include portraits of the generals. Restricts the issuance of such coins to calendar 2013. Requires specified surcharges in the sale of such coins, which shall be paid promptly to the Command and General Staff College Foundation to help finance its support of the College.

Directs the Comptroller General of the United States to study and report to specified congressional committees on the functions and capabilities of the Civil Air Patrol to support the homeland security missions of state, local, and tribal governments and the Department of Homeland Security (DHS). Requires the Comptroller General to review the process by which the Civil Air Patrol may provide assistance to the Secretary of Homeland Security, other federal agencies, and states to support homeland security missions, including by providing: (1) aerial reconnaissance or communications capabilities for border security; (2) capabilities for collective response to an act of terrorism, natural disaster, or other man-made event by assisting in damage assessment and situational awareness, conducting search and rescue operations, assisting in evacuations, or transporting time-sensitive medical or other materials; or (3) assistance in the exercise and training of departmental resources responsible for the intercept of aviation threats to designated restricted areas. Directs the Comptroller General's report to include assessments of: (1) the feasibility and cost-effectiveness of using Civil Air Patrol assets; and (2) whether current mechanisms for requesting support from the Civil Air Patrol are sufficient. Requires the Secretary to analyze the study and report to the committees any recommendations for action that could affect DHS's organization and administration.

Youth Prison Reduction through Opportunities, Mentoring, Intervention, Support, and Education Act or the Youth PROMISE Act - Amends the Juvenile Justice and Delinquency Prevention Act of 1974 to establish a PROMISE Advisory Panel to assist the Office of Juvenile Justice and Delinquency Prevention in: (1) assessing and developing standards and evidence-based practices to prevent juvenile delinquency and criminal street gang activity; and (2) collecting data in designated geographic areas to assess the needs and existing resources for juvenile delinquency and criminal street gang activity prevention and intervention. Authorizes the Administrator of the Office of Juvenile Justice and Delinquency Prevention to award grants to local governments and Indian tribes to: (1) plan and assess evidence-based and promising practices for juvenile delinquency and criminal street gang activity prevention and intervention, especially for at-risk youth; and (2) implement PROMISE plans, developed by local PROMISE Coordinating Councils (PCCs), for coordinating and supporting the delivery of juvenile delinquency and gang prevention and intervention programs in local communities. Establishes a National Research Center for Proven Juvenile Justice Practices to provide PCCs and the public with current research and other information about evidence-based practices related to juvenile delinquency and criminal street gang prevention and intervention. Directs the Administrator to award grants to: (1) allow institutions of higher education to serve as regional research partners with PCCs; and (2) hire and train law enforcement officers as youth-oriented police to work with PCCs, other community-based organizations, and high-risk youth. Establishes a Center for Youth-Oriented Policing. Mynisha's Law - Authorizes any local government or Indian Tribe with a PCC to submit an application to the Administrator of the Office of Juvenile Justice and Delinquency Prevention for designation as a Comprehensive Gang Prevention and Relief Area. Authorizes the Attorney General to award grants to partnerships comprising state mental health authorities and local or private entities to prevent or alleviate the effects of youth violence in urban communities with a high or increasing incidence of such violence. Prevention Resources for Eliminating Criminal Activity Using Tailored Interventions in Our Neighborhoods Act of 2009 or the PRECAUTION Act - Establishes the National Commission on Public Safety Through Crime and Delinquency Prevention to: (1) carry out a comprehensive study of the effectiveness of certain crime and delinquency prevention and intervention strategies: and (2) make initial and final reports on such strategies to specified federal and state officials. Authorizes the Director of the National Institute of Justice to make three-year grants to public and private entities for the implementation and evaluation of innovative crime or delinquency prevention or intervention strategies. Amends the Violent Crime Control and Law Enforcement Act of 1994 to authorize grants for the creation and expansion of state, local, and tribal juvenile witness and victim protection grants.

Physical Therapist Student Loan Repayment Eligibility Act of 2009 - Amends the Public Health Service Act to include physical therapy within the definition of "primary health services" for purposes of provisions concerning the National Health Service Corps. Makes physical therapists eligible for repayment of their educational loans in order to ensure an adequate supply of physical therapists.

Helicopter Medical Services Patient Safety, Protection, and Coordination Act - Authorizes states to regulate helicopter medical services with respect to: (1) the medical qualifications and training of helicopter medical personnel, except that a state shall not impose new or additional requirements on a pilot; and (2) the obligation of providers of helicopter medical services to comply with a state's health planning, patient safety, and medical service requirements. Authorizes states to regulate the following aspects of helicopter medical services to the extent that state regulations are harmonized with relevant federal operating requirements: (1) the designation of destinations for emergency patient transport; (2) the specification of service requirements with respect to geographic areas within a state or during specified hours and days; (3) the coordination of flight requests for emergency helicopter medical services; and (4) compliance with accreditation requirements. Authorizes states to regulate the following aspects of helicopter medical services to the extent that state regulations are consistent with relevant federal operating requirements: (1) the necessary medical equipment to be carried on board or affixed to the helicopter; (2) the physical attributes of the helicopter necessary for the provision of quality medical care and for the protection of helicopter and ground medical personnel; and (3) specified communication capabilities between helicopter personnel and emergency medical services and public safety personnel and between the flight crew and helicopter medical personnel.

Officer Daniel Faulkner Children of Fallen Heroes Scholarship Act of 2009 - Amends title IV (Student Assistance) of the Higher Education Act of 1965 to eliminate the expected family contribution used in determining Pell Grant eligibility in the case of a student applicant whose parent or guardian died as a result of performing service as a law enforcement officer, firefighter, or member of a rescue squad or ambulance crew. Prohibits any increase in the Pell Grant such students receive by reason of this Act from: (1) factoring into the calculation of their need for other title IV assistance; or (2) reducing the educational assistance some may receive under the Omnibus Crime Control and Safe Streets Act of 1968 as dependents of civilian federal law enforcement officers killed in the line of duty.

Family-Friendly Workplace Act - Amends the Fair Labor Standards Act of 1938 to authorize private employers to provide compensatory time off to private employees at a rate of 1 1/2 hours per hour of employment for which overtime compensation is required. Authorizes an employer to provide compensatory time only if it is in accordance with an applicable collective bargaining agreement or, in the absence of such an agreement, an agreement between the employer and employee. Prohibits an employee from accruing more than 160 hours of compensatory time. Requires an employee's employer to provide monetary compensation, after the end of a calendar year, for any unused compensatory time off accrued during the preceding year. Requires an employer to give employees 30-day notice before discontinuing compensatory time off. Prohibits an employer from intimidating, threatening, or coercing an employee in order to: (1) interfere with the employee's right to request or not to request compensatory time off in lieu of payment of monetary overtime compensation; or (2) require an employee to use such compensatory time. Makes an employer who violates such requirements liable to the affected employee in the amount of the compensation rate for each hour of compensatory time accrued, plus an additional equal amount as liquidated damages, reduced for each hour of compensatory time used.

Prohibits construing this Act to authorize the prosecution of any woman for the death of her unborn child.

Freedom to Travel to Cuba Act - Prohibits the President from regulating or prohibiting travel to or from Cuba by U.S. citizens or legal residents or any of the transactions ordinarily incident to such travel, except in time of war or armed hostilities between the United States and Cuba, or of imminent danger to the public health or the physical safety of U.S. travelers.

American Renewable Energy Act – Amends the Public Utility Regulatory Policies Act of 1978 to require the Secretary of Energy to establish a program to implement and enforce a renewable electricity trading program, including requirements governing the issuance, tracking, and retirement of federal renewable electricity credits. Requires each retail electric supplier to submit to the Secretary, annually, a quantity of federal renewable electricity credits equal to the supplier's base amount (electricity sold) for the calendar year multiplied by a specified annual percentage for 2012 though 2039. Authorizes suppliers to satisfy such requirement by submitting, in lieu of each credit, a payment equal to the lesser of: (1) 200% of the average market value of a credit for the previous compliance year; or (2) five cents, adjusted each year after 2009 based on the Gross Domestic Product Implicit Price Deflator. Requires such payments to be deposited in a Renewable Electricity Deployment Fund, from which payments shall be made to suppliers that have submitted credits in compliance with their obligations for the preceding year. Requires the Secretary to issue to each generator of renewable electricity one federal renewable electricity credit for each kilowatt hour of renewable electricity generated. Provides for the issuance of credits: (1) to suppliers for renewable electricity generated with the support of payments from a supplier pursuant to a state renewable electricity program; (2) to distributed generation facilities; (3) for qualifying hydropower; and (4) to generators that produce electricity using both a renewable energy resource and a non renewable resource. Provides for: (1) the trading and banking of credits; (2) Federal Energy Regulatory Commission (FERC) oversight of the market for such credits; and (3) civil penalties for noncompliance. Requires the Secretary to contract with the National Academy of Sciences to submit periodic comprehensive evaluations of the federal renewable electricity trading program. Terminates this Act on December 31, 2040.

Student Internet Safety Act of 2009 - Amends the Elementary and Secondary Education Act of 1965 to allow local educational agencies to use state subgrants under the Enhancing Education through Technology program and the Safe and Drug-Free Schools and Communities program to develop and implement programs promoting safe internet use by students.

Amends the Federal Election Campaign Act of 1971 to permit candidates for election to federal office to: (1) designate an individual for each of a candiate's authorized campaign committees who will be authorized to disburse funds of the committee in the event of the candidate's death; and (2) designate another individual to carry out the responsibilities of the designated individual in the event of the death or incapacity of the designated individual or the designated individual's unwillingness to carry out the responsibilities. Prescribes procedures for filing and revoking such a designation. Permits the filing of a designation to contain the candidate's instructions regarding the disbursement of funds.

National STEM Education Tax Incentive for Teachers Act of 2009 - Amends the Internal Revenue Code to allow certain full-time elementary and secondary school teachers of math, science, engineering, or technology courses a refundable tax credit for 10% of their undergraduate tuition up to $1,000 in any taxable year. Increases such credit amount to $1,500 for teachers in schools serving disadvantaged children.

Amends the Foreign Assistance Act of 1961 to prohibit the availability of appropriated funds for population activities to any private, nongovernmental, or multilateral organization until it certifies that it will not during the period for which funds are made available: (1) directly or through a subcontractor or subgrantee perform abortions in any foreign country except if the life of the mother would be endangered if the fetus were carried to term or in cases of forcible rape or incest; or (2) violate the laws of a foreign country regarding the circumstances under which abortion is permitted, regulated, or prohibited, or engage in lobbying activities in an effort to alter its laws with respect to abortion (except lobbying in opposition to coercive abortion or involuntary sterilization).

Providing Resources Early for Kids Act of 2009 or the PRE-K Act - Amends the Elementary and Secondary Education Act of 1965 to direct the Secretary of Education to award matching grants to states to enhance or improve state-funded preschool programs. Sets forth a grant formula favoring states that: (1) have curricula aligned with state early learning standards; (2) use nationally-established, or better, best practices for class size and teacher-to-student ratios; (3) require each teacher to have at least an associate degree in early childhood education or a related field; (4) require such programs to operate for at least a full academic year; and (5) have a plan for meeting the requirement, within five years of receiving such grant, that teachers have at least a baccalaureate degree in early childhood education or have such degree in a related field, but have also completed specialized training in early childhood education. Directs the Secretary to establish a competitive process for awarding grants to other states that demonstrate that they will meet such requirements within two fiscal years. Prohibits state grantees from reducing their preschool or child care expenditures. Requires states to give priority, in using grant funds, to preschool programs in communities with high concentrations of impoverished children. Includes among grant uses: (1) increasing the qualifications of, and benefits provided to, teachers, teacher aides, and program directors; (2) decreasing class size and improving teacher-to-student ratios; (3) providing certain comprehensive services that support healthy child development; (4) extending program duration; and (5) improving program monitoring and learning environments. Reserves funds for competitive grants to Indians for their preschool programs.

Child Interstate Abortion Notification Act - Amends the federal criminal code to prohibit transporting a minor child across a state line to obtain an abortion (deems such transporting to be a de facto abridgment of the right of a parent under any law in the minor’s state of residence that requires parental involvement in the minor’s abortion decision). Makes an exception for an abortion necessary to safe the life of the minor. Makes it an affirmative defense to a prosecution or civil action under this Act that a defendant: (1) reasonably believed that before the minor obtained the abortion, the required parental consent or notification or judicial authorization took place; or (2) was presented with documentation showing that a court waived parental notification requirements or authorized the minor's abortion. Defines "abortion" as the termination of a pregnancy with an intention other than to increase the probability of a live birth, preserve the life or health of the child after live birth, remove a dead unborn child who died as the result of a spontaneous abortion, accidental trauma, or a criminal assault on the pregnant female or her unborn child. Imposes a fine and/or prison term of up to one year on a physician who performs or induces an abortion on an out-of-state minor in violation of parental notification requirements. Requires such physician to give 24-hour actual or constructive notice to a parent of the minor seeking an abortion, subject to certain exceptions.

Assessment Accuracy and Improvement Act - Amends the Elementary and Secondary Education Act of 1965 to allow states to require the use of adaptive assessments of student progress toward state academic performance standards that accurately assess student achievement above and below grade level while also measuring grade-level performance. Defines an "adaptive assessment" as one that changes in difficulty in accordance with a student's performance, but reports its outcome on a scale common to all students.
