Government Accountability Office Act of 2008 - Requires specified minimum percentage pay increases and lump sum back payments for certain Government Accountability Office (GAO) officers and employees. Establishes an Office of the Inspector General in GAO, who shall report semiannually to the Comptroller General. Requires the Comptroller General's annual report to Congress to assess the overall degree of federal agency cooperation with GAO audits. Requires any executive agency (or component) that prepares an audited financial statement to reimburse GAO the cost of any GAO audit of such statement. Amends the Ethics in Government Act of 1978 to revise the coverage of certain GAO officers and employees under its financial disclosure requirements. Revises the highest basic pay rate for GAO personnel from GS-15 to Executive Level III. Increases from 15 to 20 the number of experts and consultants whose services the Comptroller General may procure for renewable three-year terms at rates up to level IV of the Executive Schedule. Makes funds appropriated to GAO for salaries and expenses also available for recruitment-related meals and entertainment. Revises provisions governing GAO voluntary separation incentive payments.

Protect Our Troops and Our Constitution Act of 2008 - Prohibits funds from being used to: (1) establish or maintain any permanent or long-term U.S. military base or facility in Iraq; or (2) implement any agreement that is consistent with U.S. security commitments to Iraq under the Declaration of Principles or any agreement that provides "authority to fight" for U.S. Armed Forces engaged in combat operations other than for self-defense purposes, unless the agreement is an Article II treaty with respect to which the Senate has given its advice and consent to ratification or the agreement is approved by an Act of Congress enacted after the date of the enactment of this Act. Expresses the sense of Congress that: (1) long-term U.S.-Iraq relations should be determined by the U.S. Administration taking office on January 20, 2009; (2) in determining its policy toward Iraq such Administration should consult with Congress, the government of Iraq, Coalition partners, and Iraq's neighbors; and (3) to maintain international legal authority as well as immunity from Iraqi prosecution for U.S. Armed Forces and other Coalition forces operating in Iraq while such Administration determines policy toward Iraq the current U.S. Administration should encourage the government of Iraq to request renewal of the U.N. mandate for Iraq beyond December 31, 2008.

Protecting the Medicaid Safety Net Act of 2008 - Amends the U.S. Troop Readiness, Veterans' Care, Katrina Recovery, and Iraq Accountability Appropriations Appropriations Act, 2007 to extend until April 1, 2009, the moratorium on implementation of a proposed rule ("Medicaid Program; Cost Limit for Providers Operated by Units of Government and Provisions To Ensure the Integrity of Federal-State Financial Partnership") relating to the federal-state financial partnerships under titles XIX (Medicaid) and XXI (State Children's Health Insurance Program) (SCHIP) of the Social Security Act. Extends until April 1, 2009, the moratorium on any action by the Secretary of Health and Human Services to restrict Medicaid payments for graduate medical education (GME). Amends the Medicare, Medicaid, and SCHIP Extension Act of 2007 to extend until April 1, 2009, the moratorium on certain restrictions relating to Medicaid coverage or payment for rehabilitation services or school-based administration and school-based transportation, including specified proposed regulations, if such restrictions are more restrictive in any aspect than those applied to such areas as of July 1, 2007. Establishes additional moratoria until April 1, 2009, on specified regulatory actions concerning Medicaid: (1) treatment of optional case management services; (2) outpatient hospital services; and (3) allowable provider taxes.

Pathway for Biosimilars Act - Amends the Public Health Service Act to allow a person to submit an application for licensure of a biological product based on its similarity to a licensed biological product (the reference product). Requires the Secretary of Health and Human Services to approve the application if: (1) the biological product is biosimilar to the reference product with respect to each condition of use for which the reference product is approved; and (2) the applicant consents to the inspection of the facility that is the subject of the application. Sets forth requirements for a determination by the Secretary that a biological product is interchangeable with a reference product. Prohibits a biological product from being evaluated against more than one reference product. Prohibits licensure under this Act of a biological product containing specified agents or toxins. Prohibits the Secretary from making approval of an application under this Act effective until 12 yeas after the date on which the reference product was first licensed. Provides for confidentiality of information received pursuant to this Act. Sets forth provisions governing patent infringement actions related to this Act. Deems as patent infringement the submission of a statement under this Act by the applicant setting forth reasons why the making, use, or sale of the biosimilar product would not infringe the patent, or why the patent is invalid or unenforceable, if the purpose of such submission is to obtain approval to engage in the commercial manufacture, use, or sale before the expiration of such patent.

Credit Card Fair Fee Act of 2008 - Authorizes providers of a single covered electronic payment system (e.g. Visa or Mastercharge credit cards) and any merchants to jointly negotiate and agree upon rates and terms for access to such a system. Defines covered electronic payment system as any system that has been used for at least 20% of the combined dollar value of U.S. credit, signature-based debit, and PIN-based debit card payments processed in the applicable base year. Grants limited antitrust immunity to such providers and merchants, as well as to those providers who jointly determine among themselves the proportionate division of paid access fees. Sets forth procedures to determine rates and terms for access to a covered electronic payment system. Prohibits any other rates and terms from being imposed upon a merchant for accessing a covered electronic payment system except as specified in a voluntarily negotiated access agreement. Creates a panel of three full-time Electronic Payment System Judges, appointed by the Antitrust Division of the Department of Justice and the Federal Trade Commission Bureau of Competition, to determine the schedule of rates and terms for three-year periods. Subjects any determination of such Judges to judicial review. Authorizes providers and merchants to engage in voluntarily negotiated access agreements. Declares that such voluntarily negotiated access agreements shall be given effect with respect to the signatories in lieu of any determination by the Judges.

Investment in Kids' Instruction, Development and Support Act, or the Invest in KIDS Act - Amends part B of title IV of the Social Security Act to revise requirements for foster care and adoption assistance and for child welfare services. Authorizes a state foster care and adoption assistance plan, at state option, to include a child and family services component. Eliminates certain income eligibility requirements for foster care and adoption assistance. Authorizes: (1) Indian tribes to receive federal funds for such assistance; and (2) separate standards for foster family homes in which a foster parent is a relative of the foster child that protect the child's safety and provide for criminal records checks. Requires application to all children in state custody of state plan standards for foster family homes and child care institutions. Requires the Secretary of Health and Human Services, acting through the Administration of Children and Families, to make child welfare service quality improvement grants to states. Provides for an increased payment rate to states for short-term training of certain child welfare agency staff and court personnel. Allows state coverage of children in foster care after age 18 and up to age 21. Provides for state-optional kinship guardianship assistance payments for children. Authorizes the Secretary to make family connection grants to states. Extends the adoption incentives program for five years, and increases incentives payments for special needs adoptions and older child adoptions. Requires state plans to provide for siblings removed from their homes to be placed in the same foster care placement, unless contrary to their safety or well-being. Requires a state child welfare services plan to provide for development of a plan for the ongoing oversight and coordination of health care services for any child in a foster care placement. Requires case plans to include a plan for ensuring the educational stability of the child in foster care.

Authorizes such grants to be used for reuse planning, site characterization and assessment, or remediation at waterfront brownfields sites, including the integration of activities related to the design and implementation of water quality improvements, low impact development approaches, green infrastructure, remediation and management of sediments, or flood damage prevention associated with brownfields remediation and reuse. Authorizes the Administrator of the Environmental Protection Agency (EPA) to provide training, research, and technical assistance to individuals and organizations to facilitate waterfront brownfields revitalization. Authorizes funding for brownfields revitalization for FY2008-FY2012. Requires the Administrator to establish and serve as chairperson of a task force on waterfront brownfields revitalization that shall identify: (1) funding and technical assistance resources; (2) barriers to and solutions for revitalization; and (3) methods to coordinate interagency efforts.

Sets forth obligations of a person that discloses, uses, or receives an individual's personal health information, including notification if the security of such information is breached. Requires the Secretary of Health and Human Services to develop and disseminate guidelines for the establishment of safeguards and procedures for use under this Act. Prohibits a person from disclosing, accessing, or using personal health information except as authorized under this Act. Requires the Secretary to designate an Office of Health Information Privacy within the Department of Health and Human Services (HHS) to investigate complaints of alleged violations of this Act. Requires the Secretary to establish and implement standards for health information technology products. Provides for whistleblower protection. Establishes: (1) the Office of the National Coordinator of Health Information Technology; (2) the public-private Partnership for Health Care Improvement to make recommendations concerning standards for the electronic exchange of personal health information; and (3) the American Health Information Community to make recommendations concerning policies to support the widespread adoption of health information technology. Provides for health information technology grants. Requires the Secretary to develop and use health care quality measures. Requires the Secretary, acting through the Director of the Agency for Healthcare Research and Quality (AHRQ), to develop a Health Information Technology Resource Center to provide technical assistance and develop best practices for interoperable health information technology. Prohibits the expenditure of federal funds for the purchase of any new health information technology that is not consistent with applicable federal standards.

Provides that, if the federal medical assistance percentage (FMAP) determined under title XIX (Medicaid) of the Social Security Act without regard to this Act for a state for FY2008 is less than the FMAP as so determined for FY2007, the FY2007 FMAP shall be substituted for the FMAP for the third and fourth calendar quarters of FY2008, before the application of this Act. Provides that, if the FMAP determined without regard to this Act for a state for FY2009 is less than the FMAP as so determined for FY2008, the FY2008 FMAP shall be substituted for the FMAP for the first, second, and third calendar quarters of FY2009, before the application of this Act. Provides that, for each eligible state for the third and fourth calendar quarters of FY2008, and for the first, second, and third calendar quarters of FY2009, the FMAP shall be increased by 2.95 percentage points. Provides for an increase in the cap on Medicaid payments to Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa. Declares that, only for FMAP computation purposes, any significant disproportionate employer pension or insurance fund contribution shall be disregarded in computing the per capita income of a state, but not in computing the per capita income for the continental United States (and Alaska) and Hawaii.

Credit Cardholders' Bill of Rights Act of 2008 - Amends the Truth in Lending Act to prohibit a creditor from using certain adverse information, including information in a consumer report or any change in a consumer's credit score, as the basis for increasing any annual percentage rate (APR) of interest on the consumer's outstanding balance under an open end consumer credit plan, except for actions or omissions of the consumer directly related to such account. (Thus eliminates the universal default for credit already outstanding.) Bars a creditor from changing any term of the contract or agreement of an open end consumer credit plan until contract renewal, except for specific material reasons already contained in the contract or agreement. Requires advance notice of credit card account rate increases. Authorizes a consumer who receives such notice to: (1) cancel the credit card without penalty or the imposition of any fee; and (2) pay any outstanding balance that accrued before the effective date of the increase at the APR and in the repayment period in effect before notice was received. Prohibits a creditor from imposing interest on credit repaid within the interest-free repayment time period. (Thus prohibits double cycle billing). Prohibits the imposition of fees on any outstanding balance on a credit card account attributable only to accrued interest on previously repaid credit. Requires each periodic statement of account to provide specified information on obtaining the payoff balance. Prohibits a creditor from furnishing information to a consumer reporting agency concerning a newly opened credit card account until the consumer has used or activated the credit card. Details mandatory pro rata payment allocations by a creditor. Authorizes a consumer to opt-out of creditor authorization of over-the-limit transactions if fees are imposed. Restricts the frequency of over-the-limit fees. Specifies the contents of credit card price and availability information the Board of Governors of the Federal Reserve System must collect and make public semiannually. Prescribes a standard for the initial issuance of subprime or "fee harvester" cards (accounts requiring first-year fee payments in excess of 25% of the total amount of credit authorized).

Amends those Acts and the Rehabilitation Act of 1973 to set forth requirements regarding a right of recovery for harassment. Amends the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA), the Age Discrimination in Employment Act of 1967 (ADEA), and the Fair Labor Standards Act of 1938 (FLSA) to provide that a state's receipt or use of federal financial assistance for a state program or activity constitutes a waiver of sovereign immunity for a suit by a program employee. Amends the Air Carrier Access Act of 1986 to authorize civil actions in federal court for discrimination based on disability. Settlement Encouragement and Fairness Act - Modifies the definition of "prevailing party" for purposes of provisions governing the recovery of attorney's fees to include a party whose pursuit of a non-frivolous claim or defense was a catalyst for a voluntary or unilateral change in position by the opposing party that provides any significant part of the relief sought. Preservation of Civil Rights Protections Act of 2008 - Makes arbitration clauses in employment contracts unenforceable, with exceptions. Authorizes recovery of expert fees by prevailing parties in civil rights actions. Equal Remedies Act of 2008 - Repeals provisions limiting the amount of compensatory and punitive damages that may be awarded in cases of intentional discrimination in employment. Amends the FLSA to revise provisions governing discrimination in the payment of wages, including equal pay requirements. Amends the Immigration and Nationality Act to prohibit denying back-pay or other monetary relief for unlawful employment practices against undocumented immigrant workers. Applies specified provisions of this act to violations pending as of enactment or occurring prior to enactment.

Calls on the two leading presidential candidates to accept offers of external and internal assistance to help find a solution to the current crisis which has the support of the people of Kenya. Calls on Kenyan security forces to refrain from using excessive force and to respect the human rights of Kenyan citizens. Calls for an immediate end to the restrictions on the media, and on the rights of peaceful assembly and association. Condemns threats to civil society groups, journalists, religious leaders, and human rights activists making every effort towards a peaceful, just, and equitable political solution to the current electoral crisis. Calls on the international community, United Nations aid organizations, and all neighboring countries to: (1) assist those affected by violence; and (2) use all the diplomatic means to persuade relevant political actors to commit to a peaceful resolution to the crisis. Urges the President to: (1) support diplomatic efforts to facilitate a dialogue between leaders of the Party of National Unity, the Orange Democratic Movement, and other relevant actors; (2) consider the imposition of targeted sanctions on such leaders who refuse to engage in meaningful dialogue to end the current crisis; and (3) review current U.S. aid to Kenya to restrict all non-humanitarian assistance to Kenya unless the parties are able to establish a peaceful political resolution to the crisis which is credible to the Kenyan people.

Emergency Assistance for Secure Elections Act of 2008 - Directs the Administrator of General Services to reimburse certain jurisdictions for the costs of: (1) converting from electronic or other voting systems to paper ballot voting systems for the general elections for federal office to be held in November 2008; and (2) providing emergency paper ballots if the jurisdiction uses a direct recording electronic voting system which happens to fail. Directs the Administrator to reimburse any state, county, or equivalent location for the documented reasonable costs it incurs in conducting manual audits or hand recounts of the results of any of the regularly scheduled elections for federal office in November 2008 (including, at state or local option, manual audits of state and local elections, ballot initiatives, and referenda). Requires the Director of the National Institute of Standards and Technology (NIST) to study, test, and develop products and practices that ensure the accessibility of paper ballot verification and casting for individuals with disabilities, for voters whose primary language is not English, and for voters with difficulties in literacy.

Domestic Partnership Benefits and Obligations Act of 2007 - Provides that a federal employee and his or her domestic partner shall be entitled to benefits available to, and shall be subject to obligations imposed upon, a married federal employee and his or her spouse. Defines "domestic partner" to mean an adult unmarried person living with another adult unmarried person of the same sex in a committed, intimate relationship. Defines "benefits" to include federal health insurance and enhanced dental and vision benefits, retirement and disability benefits, family, medical, and emergency leave, group life insurance, long-term care insurance, compensation for work injuries, and benefits for disability, death, or captivity. Excludes members of the uniformed services from the definition of "employee." Sets forth requirements for filing: (1) an affidavit of eligibility as such a domestic partner, which shall include a certification that the employee and the domestic partner are each other's sole domestic partners and intend to remain so indefinitely; and (2) a statement upon dissolution of such a domestic partnership.

Requires SEA- or LEA-provided transportation to the school of origin for such a child or youth only in certain circumstances, and only if the SEA or LEA is reimbursed by the responsible child welfare agency or other entity.
