Requires that services be provided in the most appropriate language and cultural context. Authorizes the Secretary to make grants for identifying health needs particular to, and developing model delivery systems for, individuals of such ancestry. Directs the Secretary, in collecting any health-related data on individuals of such ancestry, to ensure that the data is specific to such individuals as a single population, and is specific to each of specified subpopulations.

Earthquake Hazards Reduction Amendments Act

Earthquake Hazards Reduction Amendments Act - Amends the Earthquake Hazards Reduction Act of 1977 to add carrying out the insurance program established by this Act to the list of duties of the Director of the Federal Emergency Management Agency (FEMA). Requires the Director to: (1) publish in the Federal Register and in local newspapers in the applicable area a tentative identification of areas subject to earthquake hazards; (2) notify the chief executive officer of communities in any such areas not already participating in the national earthquake insurance program of the identification, and of loss reduction measures as provided in this Act; (3) on a continuing basis, identify earthquake related factors in any earthquake-prone area; (4) make information available to the public and any agency or official regarding an earthquake hazard, the insurance program, and estimated actuarial premium rates and chargeable premium rates under the insurance program; and (5) encourage local officials to disseminate information widely. Allows communities identified to apply to participate in the insurance program or, within 90 days of notification, submit technical data establishing that the community is not earthquake-prone. Requires the Director to appoint an earthquake insurance advisory committee. Requires the National Institutes of Standards and Technology to develop comprehensive criteria for State and local land use and management ordinances, building codes, and other loss reduction measures, and to periodically update the criteria. Requires the Director to coordinate with and provide technical assistance to State, interstate, and local officials and agencies. Prohibits participation in the insurance program unless the appropriate public body has adopted and is enforcing loss reduction measures in conformance to this Act. Prohibits coverage of any property declared to be in violation of State or local law regulating location or construction in earthquake-prone areas. Requires earthquake insurance coverage in certain amounts in order to get Federal financial assistance for acquisition or construction in an earthquake-prone area. Requires each Federal instrumentality regulating financial institutions to issue regulations requiring earthquake insurance coverage on any loan secured by improved real estate or a mobile home in an earthquake-prone area. Exempts State-owned property that is covered under an adequate State policy of self-insurance from these requirements. Requires each Federal instrumentality regulating financial institutions to issue regulations requiring that, in connection with the making, increasing, extending, or renewing of any loan secured by improved real estate or a mobile home in an earthquake-prone area, the purchaser or lessee be notified that: (1) the area has been identified as earthquake-prone; and (2) Federal earthquake disaster relief may not be available if the community does not participate in the program or if the property is not covered in the required amount. Prohibits Federal financial assistance for acquisition or construction in an earthquake-prone area unless the community in which the area is located is participating in the insurance program. Requires each Federal instrumentality regulating financial institutions to issue regulations prohibiting loans secured by improved real estate or a mobile home located in such an area unless the community is participating. Authorizes the Director to establish and carry out a national program to provide insurance against loss resulting from physical damage to or loss of real property or related personal property, in the United States, arising from any earthquake. Conditions operation of the program on participation by private insurers representing at least 80 percent of the net written premiums for homeowners' multiple peril insurance written in the United States. Requires private insurers participating in the program to reimburse the Director for 15 percent of all costs that exceed the amounts in the Insurance Fund established under this Act. Allows the Director to arrange for participation, on other than a risk-sharing basis, by private insurers, insurance agents and brokers, insurance adjustment organizations, and other persons. Provides for the scope of the program and the terms and limitations of insurance coverage. Requires the Director: (1) to set chargeable premium rates and associated terms and conditions; (2) in establishing rates that are less than actuarial rates, to consider the objective of making the insurance available at reasonable cost. Requires, notwithstanding other provisions of this Act, that the rate with respect to new construction or substantial improvement of property, started after identification of an area as earthquake-prone becomes final, not be less than the actuarial rate. Sets forth special rules for newly eligible construction. Requires the Director to establish in the Treasury a National Earthquake Insurance Fund. Authorizes the Director to borrow from the Treasury to the extent that the assets of the Fund are insufficient to pay claims and expenses. Authorizes appropriations. Requires the Director, upon establishment of the insurance program, to establish a national earthquake excess loss reinsurance program, to be available only to private insurers that are participating in the insurance program. Allows reinsurance coverage to cover not more than 90 percent of the losses of each private insurer that are in excess of ten percent of the insurer's countrywide subject net written premium after the insurance industry has sustained losses in certain lines that exceed ten percent of the industry countrywide subject net written premium. Specifies the covered lines of insurance. Requires any private insurer that purchases reinsurance to purchase coverage for all the lines. Requires the Director to establish premium rates. Prohibits reinsurance liability for property declared in violation of State or local law regulating location or construction in earthquake-prone areas or that is otherwise uninsurable at the time it is insured by the private insurer. Requires the Director to establish in the Treasury a National Earthquake Reinsurance Fund. Authorizes the Director to borrow from the Treasury, with a limit on obligations outstanding at any one time, to the extent that the assets of the Fund are insufficient to pay claims and expenses. Authorizes appropriations.

(Current law replaced by this provision prohibits payments to colleges where admission distinctions are made on the basis of race or color, but allows payments to separate colleges or educational institutions for white and colored students so long as the payments are equitably divided.)

Amends the Reclamation States Drought Assistance Act of 1988 to extend: (1) through March 1, 1992, the period for completion of studies to augment, make use of, or conserve water supplies available to Federal reclamation projects and Indian water resources development; and (2) through 1991 authorized construction, management, and conservation activities to mitigate damages resulting from drought conditions. Authorizes the Secretary of the Interior to purchase water from willing sellers and to make such water available to reclamation project and nonproject water users at rates sufficient to repay the Secretary for the cost of such water. Extends through 1991 the general and contract authority of the Secretary to make available water or canal capacity at existing Federal reclamation projects to water users and others on a temporary basis to mitigate damages due to drought conditions. Requires that the cost of water made available by the Secretary to protect fish and wildlife resources, even during drought conditions, shall be nonreimbursable. Authorizes the Secretary to store and convey nonproject water utilizing Federal reclamation project facilities for purposes other than irrigation and for use outside the authorized project service area at a rate sufficient to repay the cost of storing and conveying such water. Extends through 1991 the authority of the Secretary to make emergency loans for mitigating drought damages. Authorizes the Secretary to defer without penalty the payment of any charge as the Secretary deems necessary because of financial hardship caused by drought. Provides that actions taken under such Act in response to emergency conditions shall not be subject to provisions of the National Environmental Policy Act and the Federal Paperwork Reduction Act. Extends through 1991 the emergency drought program. Increases the total amount authorized to be appropriated to carry out the Reclamation States Drought Assistance Act of 1988.

Substance Abuse Treatment Corps Act - Amends the Public Health Service Act to establish within the Public Health Service the Substance Abuse Treatment Corps to increase the availability of treatment for alcohol and drug abuse in geographic areas with a significant incidence of abuse and an inadequate availability of services. Allows the Secretary of Health and Human Services to carry out such purpose only through assigning Corps members to provide services for such areas. Allows the Secretary to assign a Corps member to an entity only if the entity, among other requirements, enters into an agreement with the Secretary regarding the allocation, between the Secretary and the entity, of costs relating to the assignment. Directs the Secretary to establish a program of entering into contracts with students in specified fields under which the students agree to serve in the Corps upon obtaining their degree in consideration of the Federal Government agreeing to pay tuition, other expenses, and a stipend. Applies, except as inconsistent, provisions relating to the National Health Service Corps Loan Repayment Program to this program. Directs the Secretary to establish a program of entering into contracts with individuals who have been licensed or certified in certain fields, or who are students in such fields, under which the individuals agree to serve in the Corps in consideration of the Federal Government agreeing to repay up to a specified sum of educational loans of the individuals. Applies, except as inconsistent, provisions relating to the National Health Service Corps Loan Repayment Program to this program. Authorizes appropriations for the scholarship and loan repayment programs established by this Act.

Medigap Fraud and Abuse Prevention Act of 1990

Medigap Fraud and Abuse Prevention Act of 1990 - Amends title XVIII (Medicare) of the Social Security Act to penalize individuals who issue, sell, or renew Medicare supplemental policies which are in violation of this Act's standards or offer to sell a policy in a State that has not approved such policy. Requires that Medicare supplemental policy issuers: (1) cover a core group of basic benefits and, if they offer other benefits, issue a policy covering only such basic benefits; (2) provide prospective purchasers of a policy with a summary information sheet describing policy benefits and the amount of any premiums attributable to optional benefits; (3) guarantee the renewability of policies; (4) offer each group policyholder terminating their coverage or group membership the right to continued coverage under an individual policy (the policyholder ending his or her group membership may also opt for continued coverage under the group policy) or, if the old group policy is replaced by a new group policy, the right to coverage under a new group policy without exclusion for preexisting conditions; and (5) suspend policy benefits and premiums upon the policyholder's indication that he or she is entitled to Medicaid (title XIX of the Social Security Act) benefits. Requires the National Association of Insurance Commissioners (NAIC) or, upon the NAIC's default, the Secretary of Health and Human Services to promulgate simplification standards which set the core group of basic benefits policies must provide, limit the additional benefit packages that may be provided, and establish a uniform language and format to be used with respect to policy benefits. Prohibits the sale of policies which do not meet such standards, though permits approved waivers of such standards to test new or innovative benefits. Directs the Secretary to request the NAIC to educate Medicare beneficiaries on the simplification standards. Increases the civil monetary penalty for knowingly selling a policy which duplicates health benefits to which an individual is already entitled. Permits persons aggrieved by duplicative coverage to recover triple damages in a civil suit. Prohibits a policy issuer from selling a policy without: (1) obtaining a written statement of the buyer indicating any health policies of the same type or Medicaid coverage the buyer may have; and (2) notifying the buyer of the possibility and effect of their coverage under the Medicaid program and the address and telephone number of any State Medicare supplemental policy counseling program and the State Medicaid office. Prohibits the issuer from selling a policy to a person who indicates that he or she is covered by the Medicaid program or has duplicative health benefits. Penalizes individuals who sell a policy in violation of such requirements. Increases the percentage of premiums which must be returned to policyholders as benefits. Establishes a process whereby States must approve premium increases prior to their implementation. Requires public hearings for any premium increase request exceeding twice the percentage increase in the medical care component of the consumer price index. Limits Medicare supplemental policy sales commissions. Authorizes appropriations for a matching grant program to assist States in establishing counseling programs to aid Medicare-eligible individuals in choosing Medicare supplemental policies. Prohibits such policies from denying a claim for losses incurred more than six months from the effective date of coverage for a preexisting condition.

Aviation Noise Abatement Policy Act of 1990 - Amends the Federal Aviation Act of 1958 to direct the Administrator of the Federal Aviation Administration (the Administrator) to consider as being in the public interest aircraft noise reduction in communities near an airport (or under an aircraft flight path associated with an airport). Directs the Administrator to: (1) transmit to the Congress a comprehensive aircraft abatement noise plan for airports in the State of Washington; (2) make periodic progress reports to the Congress regarding implementation; and (3) submit biennial reports to certain congressional committees regarding noise level reductions. Directs the Administrator to enter into an agreement with the Secretary of Defense regarding increased use by air carriers of special-use air space over the Pacific Ocean which is being used by military aircraft. Requires the Administrator to issue an environmental impact statement and hold hearings in certain cases of air route changes to altitudes of 15,000 feet or below in order to mitigate aircraft delays and congestion. Directs the Secretary of Transportation to establish advisory committees in the Department of Transportation to develop a national policy on reducing noise resulting from airport operations. Requires the Secretary to transmit such committees' recommendations to the Congress. Requires the Secretary to submit to the Congress recommendations for the reduction of the commercial fleet of Stage II aircraft.

SSI Independence Act for Disabled Americans - Amends title XVI (Supplemental Security Income) (SSI) of the Social Security Act to exclude from an SSI recipient's income in SSI eligibility and benefit determinations, contributions of clothing and other contributions, other than cash paid directly to the recipient, which are for the purchase of social services, vocational rehabilitation services, medical care, transportation, educational services, personal assistance or attendant care services, and certain services or equipment related to the quality and livability of his or her shelter. Excludes a trust created for an SSI recipient's benefit from such recipient's resources if such recipient does not have access to the trust's assets. Excludes funds or property placed in a trust for an SSI recipient's benefit from such recipient's income. Directs the Secretary of Health and Human Services to provide notices and pamphlets to SSI applicants and recipients informing them of the consequences various actions affecting their income and resources will have on their SSI and Medicaid (title XIX of the Social Security Act) eligibility. Deems SSI applicants who lost disability benefits under title II (Old Age, Survivors and Disability Insurance) (OASDI) of the Social Security Act after their trial work period to have received SSI benefits while still eligible for OASDI disability benefits and therefore qualify for participation in the SSI work incentive program (providing Medicaid and special SSI cash benefits to disabled individuals whose earnings otherwise make them ineligible for SSI and Medicaid benefits) if they meet SSI income, resource, and disability tests. Provides that reviews to determine the continuing disability of participants in the SSI work incentive program need to be conducted no more frequently than once every 12 months. Excludes spousal income in determining a disabled and working individual's eligibility for participation in the SSI work incentive program. Precludes the attainment of age 65 from serving as a basis for the termination of Medicaid eligibility under the SSI work incentive program. Requires that State supplementary cash payments to the needy include participants in the SSI work incentive program. Excludes impairment-related work expenses from the income of an individual who is eligible for SSI and OASDI disability benefits but receives only State supplementary payments. Treats royalties from the publication of an individual's work and scholarships which have not been used for education expenses as earned income.

Comprehensive Alzheimer's Assistance, Research, and Education Act of 1990 (CARE) - Title I: Amendments to the Public Health Service Act - Replaces provisions of the Public Health Service Act authorizing the establishment and operation of Alzheimer's Disease centers with provisions requiring the Director of the National Institute on Aging to make grants and enter into cooperative agreements for planning, establishing, or strengthening at least 15 Alzheimer's Disease Research Centers to support any part of the full range of research and development from very basic to clinical. Requires the Director to award center core grants or enter into cooperative agreements to support shared resources for categorical research. Requires the Director to award grants or enter into cooperative agreements with entities receiving assistance under the Research Centers and center core provisions of this Act to assist in providing high-quality research and services at locations other than the Research Centers. Requires the Director to make grants or enter into cooperative agreements to: (1) attract new or young investigators to careers involving research on biomedical, behavioral, and social aspects of Alzheimer's disease; and (2) develop institutional training programs emphasizing postdoctoral training and training of women and groups underrepresented in such research. Authorizes appropriations for: (1) the grants and cooperative agreements above in this Act; and (2) under existing provisions, awards for leadership and excellence, research on services to individuals with Alzheimer's disease and related dementias and their families, preparation and revision of a plan for certain research related to Alzheimer's disease, and dissemination of research results. Authorizes the Secretary of Health and Human Services, through the Commissioner on Aging, to make grants and enter into contracts for family support demonstration projects. Authorizes the Director to make grants and enter into contracts for long-term care research with regard to Alzheimer's disease and related disorders. Authorizes the Secretary, through the Director of the National Institute of Mental Health, the Administration on Aging, and the National Center for Nursing Research, to make grants and enter into contracts for research on methods for improving the delivery of supportive services to individuals with Alzheimer's disease or related disorders. Authorizes appropriations for family support demonstration projects, long-term care research, and supportive services delivery research. Directs the Secretary to make competitive grants to States for State Alzheimer's disease programs, including medical, legal, educational, health care financing, and other aspects. Requires that 25 to 50 percent of a grant be used in any fiscal year for respite care. Limits grants to: (1) a minimum dollar amount; and (2) one-half of the costs of the research for which the grant is made. Authorizes appropriations. Authorizes the Secretary, through the Director of the National Institutes of Health and the Director of the National Institute of Mental Health (NIMH), to make grants and enter into contracts for basic and clinical research with respect to Alzheimer's disease and related disorders. Authorizes appropriations. Title II: Amendments to the Alzheimer's Disease and Related Dementias Services Research Act of 1986 - Amends the Alzheimer's Disease and Related Dementias Services Research Act of 1986 to require the Council on Alzheimer's Disease to make certain annual reports to the Congress and the public regarding matters related to Alzheimer's disease. Authorizes appropriations for the establishment and operation, under existing provisions, of the Advisory Panel on Alzheimer's Disease. Requires grants under specified existing provisions for Alzheimer's research to focus on specialized care as well as on services. Requires the Director of the NIMH to submit a research plan to the Council annually. Modifies the research to be provided for in the plan. Authorizes appropriations to carry out the responsibilities of the NIMH relating to Alzheimer's disease under the Act. Requires the Administrator of the Agency for Health Care Policy and Research to submit a research plan to the Chairman of the Council annually. Authorizes appropriations to carry out the responsibilities of the Agency under the Act. Replaces provisions requiring education programs for providers of care for individuals with Alzheimer's disease with provisions authorizing the Director of the National Institute on Aging to make grants: (1) on the basis of merit, for training programs and continuing education programs with respect to health care for individuals with Alzheimer's disease or related disorders; and (2) for the development of curricula for the training programs and continuing education programs. Requires the Director to establish the National Alzheimer's Education Program to: (1) provide coordination and leadership in the Federal education and promotion effort; (2) develop and distribute educational materials; (3) encourage and work with the media to provide information; (4) encourage and work with public and private efforts to develop models for education, training, and assistance programs; and (5) provide technical assistance. Authorizes the Director to make grants for programs to educate health care providers and the families of individuals with Alzheimer's disease or related disorders on caring for such individuals, and on the availability of public and private sources of assistance. Authorizes appropriations to carry out educational activities provisions of the Act.
