Securing Agriculture's Workforce Act of 2026 This bill expands the H-2A agricultural visa program; creates online platforms for H-2A employers, workers, and agencies; and codifies certain wage calculations. Under current law, workers on H-2A visas are only allowed to perform agricultural work of a seasonal or temporary nature. Under the bill, the seasonal work requirement is removed, thus allowing H-2A workers to qualify for agricultural work that occurs year-round. The bill also expands the type of agricultural work that qualifies, including reforestation, aquaculture, and livestock work. The Department of Agriculture must issue rules to define agricultural labor or services for purposes of the H-2A program. The bill also establishes an H-2A visa pathway for current unauthorized agricultural workers who otherwise meet requirements. The Department of Labor must maintain a national, publicly accessible online job registry and database of all job offers submitted by employers seeking a labor certification required to employ H-2A workers. The Department of Homeland Security must establish an online platform for employers to submit information and documentation for review by federal agencies in the course of admitting H-2A workers. The H-2A program requires employers to provide workers with wage rates at or above those set in regulations and such wages must not adversely affect the wages and working conditions of workers similarly employed in the United States. The bill codifies the current calculation method for the adverse effect wage rate as set in regulation.

Rural Community Hospital Demonstration Program Reauthorization This bill extends the Rural Community Hospital Demonstration Program for an additional five years. The program tests the feasibility of cost-based reimbursement under Medicare for small rural hospitals that are too large to qualify for special payment as critical access hospitals. The bill specifies that hospitals that participate in the program between December 30, 2024, and January 1, 2027, may continue to participate during the five-year extension period.

Preventing Waste, Fraud, and Abuse in TANF Act This bill limits how and when states may use Temporary Assistance for Needy Families (TANF) funds and establishes an eligibility threshold for all TANF-funded assistance and services. Currently, each state sets its own eligibility threshold for TANF-funded cash assistance. The bill establishes an upper limit on eligibility applicable to all assistance and services (including non-cash benefits) funded by TANF family assistance grants. Under this provision, only families with income under 200% of the federal poverty guidelines may receive TANF-funded assistance and services. Further, the bill generally requires states to obligate TANF funds by the end of the fiscal year after they are paid and to spend funds by the end of the second fiscal year after they are paid. However, states may reserve a specified portion of their TANF funds for future use. (There is currently no requirement to use TANF funds within a specified period.) The bill also explicitly requires states to use federal TANF funds to supplement, not replace, state and local funding for TANF-supported programs. (Current law requires states to spend a specified minimum amount on TANF-eligible activities and populations, known as the maintenance of effort requirement.) States must also take specified steps to track and report on improper payments of federal funds (e.g., overpayments, underpayments, payments to ineligible recipients). Within one year of enactment, HHS must submit to Congress a plan to reduce or eliminate improper payments made by states under the TANF program within 10 years.

Recover COVID Unemployment Fraud in Banks Act This bill extends to 10 years the statute of limitations for federal criminal charges or civil enforcement actions for fraud related to several unemployment insurance programs that were established during the COVID-19 pandemic. The bill also establishes a task force to locate fraudulent payments and develop strategies to recover such payments. The extension applies to Pandemic Unemployment Assistance, Federal Pandemic Unemployment Compensation, Mixed Earners Unemployment Compensation, and Pandemic Emergency Unemployment Compensation. The bill extends the statute of limitations for (1) criminal charges related to fraud, including aggravated identity theft, wire fraud, and conspiracy to commit fraud (currently subject to a 5-year statute of limitations); and (2) civil actions involving false claims (currently subject to a 6-year statute of limitations). However, the bill does not apply to a criminal prosecution or civil enforcement action if the applicable statute of limitations expired before the date of the bill's enactment. The task force established by this bill must coordinate with state agencies to identify federal pandemic unemployment compensation payments held by financial institutions and other entities or held by state agencies responsible for unclaimed property, coordinate with federal agencies to develop model processes that result in the cost-effective recovery of such payments, issue guidance to financial institutions on legal pathways for returning such payments, and issue guidance to state unclaimed property agencies on their obligation to review and return such payments.
