Export Administration Amendments

Export Administration Amendments - Title I: Export Administration Improvements and Extension - Amends the Export Administration Act of 1969 to extend the authority granted by such Act to September 30, 1978. Requires that appropriations to carry out the Export Administration Act of 1969 be specifically authorized by Congress for each fiscal year after October 1, 1977. Authorizes the appropriation of $8,000,000 to the Department of Commerce to carry out this Act. Revises the criteria for imposition of export controls for national security purposes. Eliminates the authority of the Secretary of Commerce to assign priority to such controls. Revises the authority of the President to impose export controls for national security purposes without regard to the availability of the controlled articles from sources other than the United States in order to require the President to predicate the imposition of controls on articles available from other sources upon a determination that absence of such a control would be detrimental to the national security of the United States. Revises the policy for control of exports for national security purposes under such Act to redefine "controlled country" as a country to which exports are restricted for national security or foreign policy purposes. Amends such Act to permit agricultural commodities purchased by or for a foreign country to remain in the United States free of quantitative limitations on exports relating to domestic supply and inflationary impact, upon approval by the Secretary of Commerce, in consultation with the Secretary of Agriculture, and under regulations for such export which the Secretary of Commerce is herein authorized to issue. Permits Congressional disapproval of any action by the President under such regulations to prohibit or curtail agricultural exports. Specifies that any export license application under such Act shall be deemed approved within 90 days of its receipt unless disapproved or unless the applicant is notified that additional time is required for the decision. Amends the Export Administration Act of 1969 to require persons agreeing to transfer technical data or other information to any controlled country to furnish information with respect to such agreement to the Secretary of Commerce, under regulations promulgated to monitor the effects of such transfers. Directs the Secretary to study technical data exports and their effects upon the national security or foreign policy of the United States, and to submit a report of such study to Congress. Amends such Act to exclude petroleum products refined in United States foreign-trade zones, or Guam, from foreign crude oil export controls to prevent excessive drain of scarce materials except if the Secretary of Commerce finds that such products are in short supply and issues regulations herein authorized to limit such exports. Prohibits the exportation of horses by sea for slaughter. Directs the Secretary of Commerce to account for technical assistance and technical advisory committees in semiannual reports to Congress under such Act. Requires the Secretary to review regulations under such Act in order to report to Congress on simplification of such regulations. Increases the terms of persons on such committees. Increases the fine for violations of such Act to $25,000 for the first offense and to $50,000 for a subsequent offense. Increases the fine for prohibited exports to Communist-dominated nations to $50,000. Increases the civil penalty for such violation of such Act to $10,000. Permits suspension of the payment of export licensing penalties for a probationary period. Amends the Export Administration Act of 1969 to stipulate that such Act shall not be construed as authority for withholding information from Congress. Requires the President to make every reasonable effort to reduce aid to international terrorists before resorting to export controls for that purpose. Amends the requirements for reports to Congress and to the President under such Act by appropriate departments or agencies to specify information to be included in such reports and to require semiannual rather than quarterly reports. Requires a special report to Congress by the President on multilateral export controls, and a special report to Congress by the Secretary of Commerce with respect to modification of unilateral and multilateral export control lists. Requires any employee of the Department of Commerce performing functions under the Export Administration Act to disclose interests affected by such Act. Imposes civil penalties for violation of this requirement. Title II: Foreign Boycotts - Amends the Export Administration Act of 1969 to direct the President to promulgate regulations: (1) to prohibit any United States person from supporting any boycott by a foreign country against any country friendly to the United States; and (2) to require the reporting of requests for such compliance to the Secretary of Commerce. Permits the suspension or revocation of the authority of any United States person to export as a penalty for violation of such regulations. Title III: Exports of Nuclear Material and Technology - Amends the Export Administration Act of 1969 to regulate the export of nuclear material, equipment, and devices. Requires any agreement for such export to meet specified criteria with respect to reprocessing provisions and inspection by the International Atomic Energy Agency. Directs the Secretary of State to seek inclusion of such requirements in agreements made prior to this Act and to seek periodic reports on the status of inventories of plutonium, U-233, and enriched uranium possessed under such agreements by non-nuclear weapons parties which are not subject to International Atomic Energy Agency safeguards. Prohibits issuance of nuclear export licenses unless the recipient country has agreed that such export will not be used for any nuclear explosive device. Specifies conditions under which nuclear materials, exported under such agreements, may be reprocessed. Declares the sense of Congress that the President should seek international agreements regulating the use and transfer of nuclear materials. Requires the President to study the extent to which United States training of foreign nationals in nuclear engineering and related fields contributes to nuclear proliferation. Prohibits the use of funds authorized under the Foreign Assistance Act of 1961 for the construction, operation, or supply of nuclear powerplants.

Financial Disclosure Act

Financial Disclosure Act - Requires the President, Vice President, Members of Congress and candidates for those offices, justices and judges of the United States, Presidential nominees, officers and employees of the United States compensated at a rate equal to or in excess of the rate prescribed for the grade of GS-15, and members of the uniformed services compensated at a rate equal to or in excess of the monthly rate prescribed for grade O-6 to file in each calendar year, with the Comptroller General and other specified executive or administrative officers, a financial statement for the preceding calendar year if such individual has occupied or been a candidate for the office or position for more than 90 days in such calendar year. Specifies the content of such financial statements. Makes mandatory the inclusion in such report of all items held not only by the individual, but by the spouse, and dependents of such person, and those acting on the individual's behalf. Permits the President to exempt any individual in the Central Intelligence Agency, the Defense Intelligence Agency, and the National Security Agency, or other person engaged exclusively in intelligence activities from the requirement to file a report with the Comptroller General if such disclosure would reveal the identity of an undercover Federal agent. Makes failure to file and falsifying reports punishable by a fine and/or imprisonment. Requires the head of each agency, the Clerk of the House of Representatives, the Secretary of the Senate, and the Director of the Administrative Office of the United States Courts to submit annually to the Comptroller General a complete list of individuals required to file such a report. Requires the Comptroller General to refer to the Attorney General the names of all individuals who the Comptroller General have reasonable cause to believe has failed to file or falsified such report, and that if such an individual is a Member of Congress, that the name be referred to the appropriate Congressional committees. Requires the Comptroller General to make such reports available to the public for all purposes not excluded under this Act. Makes the House of Representatives, the Senate, the Director of the Administrative Office of the United States Courts, the Chairman of the Civil Service Commission and the head of each agency responsible for the review of such reports in accordance with any law or regulation regarding conflicts of interest or confidential financial information. Directs the Comptroller General to conduct audits of each specified group at varying intervals, and gives the Comptroller General subpena power for the purpose of conducting such audits. Requires the Civil Service Commission and the Department of Justice to recommend to Congress such legislation as may be necessary in the area of financial conflicts of interest among Federal employees and officers.

National Agricultural Research Policy Act

National Agricultural Research Policy Act - Directs the Secretary of Agriculture to coordinate and disseminate all agricultural research information affiliated with the Department of Agriculture, to keep abreast of developments in agricultural research and education and to represent the needs for such research and education within the executive branch of the United States Government. Establishes within the Department of Agriculture the National Agricultural Research Policy Advisory Board. States that the Board's responsibilities shall include: (1) establishing means for evaluating the economic, environmental and social impacts of research and extension programs; (2) reviewing programs, policies and goals of agricultural research agencies; (3) providing a forum for research-sponsoring agencies to exchange information on programs related to agriculture, food and nutrition; (4) recommending national policies, priorities and strategies for agricultural research and education; and (5) reviewing and making recommendations to the Secretary with regard to the allocation of funds for all programs of research and extension carried out by the Department. Directs the Department of Agriculture to establish a Clearinghouse for Federal Human Nutrition Research which shall collect from each Federal agency and report to Congress information pertaining to research with regard to human nutrition. Authorizes the Secretary to make grants to land grant colleges and universities eligible for assistance under the First Morrill Act and the State agricultural experiment stations eligible for assistance under the Hatch Act to carry out mission-oriented basic research. Allows the Secretary to make grants on a competitive basis to Federal agencies, research institutions, organizations and individuals for agricultural research. Authorizes appropriations for the competitive grant program of $15,000,000 for fiscal year 1978 and such sums as may be necessary for fiscal year 1979 and fiscal year 1980, the total amount for the three-year period not to exceed $150,000,000. Authorizes appropriations for human nutrition research of $5,000,000 for fiscal year 1978 and such sums as may be necessary for fiscal year 1979 and fiscal year 1980. Authorizes appropriations of $600,000,000 for fiscal year 1978 for those agricultural research programs existing prior to the enactment of this Act.

Freestone Peach Research and Education Act

Freestone Peach Research and Education Act - Directs the Secretary of Agriculture to issue orders applicable to handlers of freestone peaches and authorizes the issuance of orders for the collection of assessments on freestone peaches. States that such funds may be used for research and education programs for freestone peaches. Directs the Secretary to issue plans, after notice and opportunity for a hearing, to effectuate the declared policy of this Act. Requires that such a plan provide for the establishment of a National Freestone Peach Research and Education Board comprised of producers and consumer representatives whose powers shall include: (1) the administration of plans; (2) investigating violations of such plans; (3) the development, review, consideration, and approval of research and education projects; and (4) making recommendations to the Secretary for fixing the assessment rate required to meet all obligations incurred in the administration of plans. Authorizes the Board to return up to 50 percent of the assessments collected to the States on a pro-rata basis for freestone peach projects. Allows peach producers to receive a refund of any assessment collected from him if such producer is not in favor of the programs provided under this Act. Makes it the responsibility of each handler, designated by the Board to collect assessments, to make payments to the Board. Sets forth administrative and judicial review procedures for persons objecting to plans issued under this Act. Establishes civil penalties for handlers who violate any provision of an order issued by the Secretary under this Act. Authorizes the Secretary to investigate violations of plans issued pursuant to this Act. Directs the Secretary to conduct a referendum among producers to determine whether the issuance of any plan is approved by such producers. Requires the Secretary to terminate or suspend the operation of any plan which obstructs or does not effectuate the declared policy of this Act, or if producers, by referendum, favor such termination or suspension. Authorizes appropriations in such amounts as may be necessary to carry out the provisions of this Act.

Title II: Development Ceiling Increases - Increases the limitations on appropriations for development of the following units of the National Park System: (1) Andrew Johnson National Historic Site, Tennessee; (2) Arkansas Post National Memorial, Arkansas; (3) Chamizal National Memorial, Texas; (4) Fort Larned National Historic Site, Kansas; (5) Golden Spike National Historic Site, Utah; (6) Jefferson National Expansion Memorial National Historic Site, Missouri; (7) Saint-Gaudens National Historic Site, New Hampshire; and (8) Vicksburg National Military Park, Mississippi. Title III: Miscellaneous Provisions - Repeals provisions relating to beach erosion control, hurrican protection, and purchase of public utility facilities within Assateague Island National Seashore, Maryland and Virginia. Directs the Secretary of the Interior to develop a comprehensive plan for the protection, management, and use of such seashore. Authorizes the Secretary to designate specified areas for addition to the Colorado National Monument, Colorado. Increases the maximum amount authorized to be appropriated for acquisition, development, and rehabilitation of sites of specified events which occurred in Kansas during the decade prior to and during the Civil War. Authorizes the Secretary of the Interior to transfer specified lands to the jurisdiction of the Director of the National Park Service in Montgomery County, Maryland. Authorizes the Secretary of the Army to transfer specified lands in such county to the jurisdiction of the Secretary of the Interior. Authorizes the Secretary of the Interior to acquire up to 64 acres of land for addition to the Saint-Gaudens National Historic Site, New Hampshire.

National Food Stamp Reform Act - Redefines the meaning of the term "food" as used in the Food Stamp Act of 1964 to include seeds and plants for garden use. Redefines the term "household" to delete the requirement that individuals sharing common living quarters be related in order to qualify as a household. Defines the term "nutritionally adequate diet. Directs the Secretary of Agriculture to establish uniform national standards of eligibility for participation by households in the Food Stamp program. States that no household shall be eligible if its income exceeds the income poverty guideline for a household of its size as prescribed by the Office of Management and Budget. Stes forth standards by which the income of a household shall be determined. Excludes from gross income Federal, State, and local taxes, and necessary expenses incurred in self-employment. Establishes limits on the value of liquid and nonliquid assets owned or being purchased by a household for purposes of determining eligibility. Specifies types of holdings which are to be included in determining the value of the household's assets. Authorizes the Secretary to establish temporary emergency eligibility standards for households which are victims of a disaster. States that no household shall be eligible for participation in the Food Stamp program which includes an able-bodied adult between the ages of 18 and 65 who: (1) incurs a reduction of income as a result of voluntarily reducing his or her number of hours of employment without good cause; (2) fails to register for employment at a State or Federal employment office; (3) has refused to accept employment or public work within 30 miles of the person's principal residence; or (4) fails to actively seek employment. Excludes from this class of ineligible individuals mothers with dependent children, primary or secondary school students, postsecondary level students or trainees' employed part-time, enrollees in a drug addiction or alcoholic treatment program, and persons working at least 30 hours per week. States that refusel to work at a plant site because of a strike or other labor dispute shall be deemed to be a refusal to accept employment. Declares that no person shall be eligible who is not a citizen or an alien lawfully admitted for permanent residence. States that no individual shall be considered a household member for food stamp program purposes who: (1) has reached his eighteenth birthday; (2) is enrolled in an institution of higher education; and (3) is properly claimed or could be claimed as a dependent by a taxpayer who is not a member of an eligible household. Declares that no household that knowingly transfers liquid or nonliquid assets for the purpose of qualifying or attempting to qualify for the food stamp program shall be eligible to participate in the program for a minimum of 90 days. States that no individual shall be eligible for participation in the Food Stamp program who resides in a State in which the Supplemental Security Income benefit has been increased specifically to include the bonus value of food coupon allotments. Requires food coupons to be designed with spaces for the user to sign upon receipt and redemption. Requires coupon users to present suitable identification; including signature and photograph, when redeeming coupons at approved food stores. States that the value of the food coupon allotment to which eligible households will be entitled shall be an amount sufficient to allow a household to purchase a nutritionally adequate diet. Requires the semi-annual adjustment of the value of an allotment based on changes in the cost of living. Sets the charge for a household coupon allotment at 30 percent of the household's monthly income. Requires State agencies administering the food stamp program to conduct nutrition education programs for food coupon recipients. Establishes a plan whereby the States will pay two and one-half percent of the bonus value of the food coupon allotments made to State residents each month of fiscal year 1977, with an additional two and one-half percent added annually until the States pay ten percent of such bonus value each year.

Alaskan Natural Gas Pipeline Authorization Act - Expresses the intent of Congress that the Alaskan natural gas pipeline be constructed promptly, without further administrative or judicial delay or impediment. Declares that the most efficient and economical method available for the transportation of Alaskan natural gas is a pipeline system from northern Alaska, across Canada, to the lower forty-eight States. Directs the Federal Power Commission to issue all necessary permits and authorizations in order to expedite the construction and operation of such pipeline within 60 days of the date of enactment of this Act. Grants the holders of such permits the powers of eminent domain under the Natural Gas Act. Directs the Secretary of the Interior and other appropriate Federal officials to issue all necessary permits and take appropriate action within 60 days to expedite the enforcement of all rights-of-way related to the construction and operation of such pipeline. Authorizes the Secretary to modify the pipeline route through the States to provide greater environmental protection during the construction period. Requires compliance with requirements of the Mineral Leasing Act of 1920 relating to the rights-of-way for pipelines through Federal lands. Exempts such pipeline from requirements regarding (1) environmental protection, (2) technical and financial capacity of applicants, (3) public hearings, (4) licensing requirements for crude oil under the Export Administration Act of 1969, and (5) furnishing of specified information and reports. Authorizes the Secretary and the Commission to waive procedural requirements of Federal law where desirable to accomplish the purposes of this Act. Declares that (1) the actions of Federal officers and agencies under this Act and (2) the legal or factual sufficiency of any environmental statement relative to such pipeline under provisions of the National Environmental Policy Act of 1969 shall not be subject to judicial review of the courts. Allows the claims that (1) this Act is unconstitutional, (2) actions under this Act will deny Constitutional rights, and (3) actions taken are beyond the scope of authority conferred by this Act, provided that such claims are filed within 60 days following the date of the challenged action. Declares that exclusive jurisdiction shall be vested in the United States District Courts, and that review of any final order shall be had only upon direct appeal to the United States Supreme Court. Declares that the power to issue injunctive relief against the issuance of any certificate, except in cases where a final judgment is entered. Declares that authorizations issued pursuant to this Act shall grant no immunity from Federal antitrust laws.
