Ulysses S. Grant Bicentennial Recognition Act This joint resolution authorizes the President to posthumously appoint Ulysses S. Grant to the grade of General of the Armies of the United States, effective on April 27, 2022.

Care for Her Act This bill allows an eligible taxpayer to claim the Child Tax Credit for the tax year preceding the year the child is born. It also sets out other activities to support parents and pregnant women. Specifically, the bill establishes the Pregnancy Support Collaborative, which consists of representatives from the Department of Health and Human Services (HHS) and states that elect to participate. The collaborative must maintain a clearinghouse of information on providers of pregnancy and parenting supports and services. States must identify providers in their jurisdictions who meet applicable criteria for inclusion. In addition, the collaborative must share information about education and training opportunities for parents and pregnant women and identify successful programs (including workplace policies) to support them. Furthermore, the collaborative must award grants to states for local programs to improve maternal and infant health outcomes. If a community demonstrates that its program reduces Medicaid costs, it retains a portion of those savings. If approved by the collaborative, HHS must award grants to providers in the clearinghouse for mentoring and training pregnant women and new mothers and addressing gaps in the availability of maternity housing. Additionally, HHS may award grants for pregnancy and parenting supports and services. The Centers for Disease Control and Prevention and the Centers for Medicare & Medicaid Services must jointly maintain a database of de-identified epidemiological and Medicaid claims data to evaluate the effect of maternity homes on maternal and infant health outcomes.

Next Generation Fuels Act of 2021 This bill supports the use of biofuels (e.g., gasoline blended with ethanol) in vehicles, including by establishing a minimum octane standard for gasoline as well as making related biofuel requirements for vehicles, their fuels, and fuel infrastructure.

Havana Syndrome Attacks Response Act This bill requires the President to sanction foreign persons and governments for carrying out clandestine attacks on U.S. personnel that have caused brain injury. Specifically, the President must impose visa- and asset-blocking sanctions on any foreign person that has directed or carried out such an attack. If the President determines a foreign government carried out such an attack, the President must notify Congress and sanction that country by terminating any foreign assistance (except for humanitarian aid or food or agricultural commodities or products) and arms transactions, restricting commercial exports, and denying access to U.S. credit or other financial assistance. The President must remove these sanctions after 12 months, provided that (1) the country's government gives reliable assurances that it will not conduct future attacks, and (2) the executive branch does not have persuasive information indicating an attack occurred in the preceding six months. The bill also requires a congressional briefing and report about suspected clandestine attacks on U.S. personnel that have caused brain injury, including hypotheses concerning the identity of the perpetrators and the technical methods used to carry out the attacks.

National Discovery Trails Act This bill amends the National Trails System Act to include national discovery trails as part of the national trails system. Such trails (1) shall be extended, continuous, interstate trails located to provide for outstanding outdoor recreation and travel and to connect representative examples of America's trails and communities; (2) shall provide for the conservation and enjoyment of significant natural, cultural, and historic resources and be so located as to represent metropolitan, urban, rural, and back country regions of the Nation; and (3) may be designated on federal lands and, with the owner's consent, on nonfederal lands. The 6,000-mile American Discovery Trail extending from Cape Henlopen State Park in Delaware, to Point Reyes National Seashore in California, splitting into northern and southern routes near Cincinnati, Ohio, and rejoining at Denver, Colorado, is designated as a national discovery trail. The bill sets forth requirements for designation of a trail as a national discovery trail. The appropriate federal department for each national discovery trail shall (1) administer the trail in cooperation with at least one competent trailwide volunteer-based organization; and (2) submit a comprehensive plan for the trail's protection, management, development, and use.

Uyghur Policy Act of 2021 This bill addresses human rights issues concerning the Uyghurs and other minority groups in the Xinjiang Uyghur Autonomous Region in China. The bill authorizes the establishment of a Special Coordinator for Uyghur Issues position within the Department of State. The State Department's Bureau of Educational and Cultural Affairs may, subject to appropriations, make certain funds available to human rights advocates working on behalf of Uyghurs and members of other minority groups. The funds, if made available, shall be used to facilitate the presence of such human rights advocates at public diplomacy forums to speak on issues related to the human rights and religious freedoms of minority groups in Xinjiang. The State Department must ensure that Uyghur language training is available to Foreign Service officers. It must also ensure that a Uyghur-speaking member of the Foreign Service is assigned to U.S. diplomatic and consular missions in China.

Matt's Act This bill limits the amount that private health insurance plans may charge plan holders for insulin drugs to a maximum of $20, or $0 for high deductible plans; pharmacies may charge uninsured individuals the average price of such drugs after deducting any rebates and discounts provided by drug manufacturers, plus limited additional charges for distributing and dispensing costs.

COVID-19 American History Project Act This bill directs the American Folklife Center at the Library of Congress to establish a history project to be known as the COVID-19 American History Project to collect and make publicly available individual stories and records of experiences during the COVID-19 pandemic in the United States. The bill includes a requirement to collect video and audio recordings of personal histories and testimonials of those who were affected by the pandemic.

United States Call Center Worker and Consumer Protection Act of 2021 This bill establishes restrictions on businesses that relocate call centers or redirect customer service calls to locations outside the United States. Specifically, a business must notify the Department of Labor that it intends to move its customer service call center overseas and Labor must maintain a publicly available list of such businesses. Subject to narrow exceptions, a business appearing on such list is ineligible to receive federal grants or guaranteed loans for five years after the business is added to the list. Further, agencies must condition the awarding of government contracts on the requirement that any call center activity pursuant to the contract must be performed in the United States. Additionally, the bill requires call center employees to disclose their physical location at the beginning of each call initiated or received, unless all employees of the business participating in the communication are located in the United States, among other exceptions.

Entrepreneurs Need Timely Replenishment (for) Eating Establishments Act or the ENTRÉE Act This bill provides FY2021 supplemental appropriations for the Restaurant Revitalization Fund and modifies requirements related to administration of the fund. The fund was established in response to COVID-19 to make grants to eligible food and beverage purveyors for covering specified costs such as payroll, operational expenses, and paid sick leave. The bill correspondingly rescinds unobligated amounts previously made available for the Economic Injury Disaster Loan Program and coronavirus state and local fiscal recovery funds. Further, the bill requires the Small Business Administration (SBA) to (1) review and process grant applications in the order in which they are received; (2) impose requirements on applicants that reduce waste, fraud, and abuse; and (3) submit and report monthly on an oversight and audit plan outlining the SBA's policies, procedures, and activities with respect to these grants.

Better Empowerment Now to Enhance Framework and Improve Treatments Act of 2021 or the BENEFIT Act of 2021 This bill requires the Food and Drug Administration (FDA) to consider relevant patient-focused drug development data, such as data from patient preference studies and patient-reported outcome data, in the risk-benefit assessment framework used in the process for approving new drugs. After a new drug application has been approved, the FDA's public statement about how it used patient experience data shall include a description of how such data was considered in the risk-benefit assessment framework.

Veterans Entrepreneurship Act of 2021 This bill requires the Small Business Administration to carry out a pilot program assessing the feasibility and advisability of making grants to eligible veterans to start or acquire a small business concern, a franchise business enterprise, or any other appropriate category of business enterprise. Eligible veterans are those veterans or members of the Armed Forces who (1) are currently retiring or separating from the Armed Forces or have been honorably discharged from active duty, (2) have completed a specified minimum period of active duty, and (3) are entitled to certain educational assistance programs. Grant recipients must complete an entrepreneurship readiness program and prepare a business plan, and they may use grant funds for purposes such as purchasing goods or services, funding a project that is directed toward economic development objectives, and acquiring a business enterprise.

Year-Round Fuel Choice Act of 2021 This bill amends the Clean Air Act to address the limitations on Reid vapor pressure (a measure of gasoline's volatility) that are placed on gasoline during the summer ozone season. The bill applies the Reid vapor pressure requirements that are applicable to gasoline blended with 10% ethanol (E10) to gasoline blended with more than 10% ethanol. Thus, the waiver given to E10 gasoline, which allows an increase in the Reid Vapor Pressure volatility, is extended to gasoline blended with more than 10% ethanol.

Veterans in Parks (VIP) Act This bill makes the America the Beautiful-National Parks and Federal Recreational Lands Pass available, without charge, to members of the Armed Forces, veterans, and Gold Star Families. The pass covers the entrance fee and standard amenity recreation fee for all federal recreational lands and waters.

Federal Retirement Fairness Act This bill modifies the federal civilian service that is creditable service under the Federal Employees Retirement System (FERS). Specifically, it expands the nondeduction service that may be creditable under FERS. Nondeduction service is federal service where an employee's pay is not subject to retirement deductions (e.g., service under a temporary appointment). Currently, nondeduction service performed before January 1, 1989, is creditable under FERS so long as a deposit is made into the retirement fund to cover the period of nondeduction service. This bill allows nondeduction service performed on or after January 1, 1989, to be creditable under FERS so long as a deposit is made into the retirement fund.

War Crimes Rewards Expansion Act This bill expands the Department of State's rewards program to authorize rewards for providing information leading to the arrest, conviction, or transfer of a foreign national accused of war crimes, crimes against humanity, or genocide as such crimes are defined under the law of an international criminal tribunal, the applicable country, or the United States. Currently, rewards are authorized for information leading to the arrest, conviction, or transfer of a foreign national accused of such crimes only as defined under the statutes of the relevant tribunal.

Lymphedema Treatment Act This bill provides for Medicare coverage of lymphedema compression treatment items. Specifically, the bill provides for coverage of (1) standard and custom fitted gradient compression garments that are prescribed by a physician or other specified health care professional to treat lymphedema, and (2) other devices determined to be effective in the prevention or treatment of lymphedema.

Computer Science for All Act of 2021 This bill establishes a program through which the Department of Education must award grants to states, local educational agencies, and eligible tribal schools to serve as models for national replication of computer science education expansion efforts. Grant recipients must use these funds for certain activities, including training teachers to teach computer science and expanding access to high-quality learning materials and online options.

Human-Animal Chimera Prohibition Act of 2021 This bill establishes new federal crimes related to conduct involving certain types of human-animal chimeras. The term human-animal chimera means an organism that, from an early stage of development, contains human and nonhuman parts. This bill makes is unlawful to create or attempt to create a prohibited human-animal chimera, transfer or attempt to transfer a human embryo into a nonhuman womb, transfer or attempt to transfer a nonhuman embryo into a human womb, or transport or receive for any purpose a prohibited human-animal chimera. A violator is subject to civil and criminal penalties.

Accelerating Access to Critical Therapies for ALS Act This bill establishes grant programs to address neurodegenerative diseases, such as amyotrophic lateral sclerosis (also known as ALS or Lou Gehrig's disease), and contains other related provisions. The Department of Health and Human Services (HHS) shall award grants to eligible entities to facilitate patients' access to investigational drugs that diagnose or treat ALS. The Food and Drug Administration (FDA) shall award grants to public and private entities to cover the costs of research and development of drugs that diagnose or treat ALS and other severely debilitating neurodegenerative diseases. HHS shall also establish the Public-Private Partnership for Neurodegenerative Diseases between the National Institutes of Health, the FDA, and at least one eligible entity (generally, an institution of higher education or a nonprofit organization). The partnership shall support the development and regulatory review of drugs that address ALS and other rare neurodegenerative diseases. The FDA shall publish on its website a five-year action plan for fostering the development of drugs that improve or extend the lives of people living with rare neurodegenerative diseases.

Trees for Residential Energy and Economic Savings Act of 2021 or the TREES Act of 2021 This bill directs the Department of Energy (DOE) to establish a grant program for states, local governments, Indian tribes, and other entities to facilitate tree planting projects that reduce residential energy consumption. Under the program, DOE may award grants to facilitate the planting of at least 300,000 trees annually in residential neighborhoods.

Pharmacy DIR Reform To Reduce Senior Drug Costs Act This bill establishes certain requirements for prescription drug plans and the prices of covered drugs under the Medicare prescription drug benefit. Specifically, the bill requires price concessions, payments, and fees that are negotiated with a pharmacy to be included in a drug's negotiated price, excluding incentive payments, and for this price to be provided at the point of sale. Additionally, prescription drug plans must report price concessions or incentive payments that are made after payment for covered drugs at the point of sale, including by contracted intermediaries, to the pharmacy at least annually. The Centers for Medicare & Medicaid Services must establish standardized pharmacy performance measures with respect to incentive payments and price concessions; such measures must account for all pharmacy types, including specialty pharmacies, and focus on patient health outcomes and other targeted areas.

Global Pandemic Prevention and Biosecurity Act This bill establishes a task force and requires the Department of State and the U.S. Agency for International Development (USAID) to take specified measures to respond to and prevent zoonotic (animal-to-human) disease outbreaks. Specifically, the bill establishes the Global Zoonotic Disease Task Force to ensure an integrated approach to preventing, detecting, preparing for, and responding to zoonotic spillover and zoonotic disease outbreaks that may pose a threat to global health security. The bill directs the State Department and the USAID to work with international stakeholders on measures that include (1) preventing zoonotic spillover events, (2) preventing degradation and fragmentation of forests and other ecosystems to minimize interactions between wildlife and human populations, and (3) strengthening global capacity for detection of zoonotic diseases with pandemic potential. Further, the USAID must develop and publish a strategy for food security, global health, and biodiversity protection, including information about zoonotic disease surveillance. To help implement and finance the strategy, the USAID must establish a Conservation Corps to provide Americans eligible for service abroad to deliver technical and strategic assistance. The bill also authorizes a program within the USAID to prevent spillover events, epidemics, and pandemics through specified activities.

SOS: Sustaining Outpatient Services Act This bill allows for payment under the Medicare prospective payment system for hospital outpatient department services of certain items and services that are furnished at off-campus outpatient departments. Specifically, the bill allows for payment of items and services for which payments to physician specialists (under the Medicare physician fee schedule) did not exceed $2 million during the previous year.

Fair and Open Skies Act This bill prohibits the Department of Transportation (DOT) from issuing a foreign air carrier permit or an exemption from certain air carrier certificate requirements under the United States-European Union Air Transport Agreement of April 2007, unless DOT finds that issuing the permit or exemption would be consistent with Article 17 bis of the agreement, which provides that opportunities created by the agreement do not undermine labor standards or the labor-related rights and principles contained in the laws of the respective parties to the agreement; and imposes conditions on the permit or exemption necessary to ensure compliance with Article 17 bis . The bill modifies policy considerations relating to air carrier certificates to require DOT to consider preventing entry into U.S. markets by flag of convenience carriers (i.e., foreign air carriers established in a country other the home country of their majority owner in order to avoid regulations of the home country) and preventing the undermining of labor standards. In carrying out such air carrier certificate requirements, DOT must consider preventing entry of flag of convenience carriers into U.S. markets as being in the public interest and consistent with public convenience and necessity for safety in air transportation and air commerce. In formulating U.S. international air transportation policy relating to the elimination of discrimination and unfair competition, the Department of State and DOT must include in their considerations the undermining of labor standards.

Postal Service Reform Act of 2021 This bill addresses the finances and operations of the U.S. Postal Service (USPS). The bill requires the Office of Personnel Management to establish the Postal Service Health Benefits Program for USPS employees and retirees and provides for coordinated enrollment of retirees under this program and Medicare. The bill repeals the requirement that the USPS annually prepay future retirement health benefits. Additionally, the USPS may establish a program to enter into agreements with an agency of any state government, local government, or tribal government, and with other government agencies, to provide certain nonpostal products and services that reasonably contribute to the costs of the USPS and meet other specified criteria. The USPS must develop and maintain a publicly available dashboard to track service performance and must report regularly on its operations and financial condition. The Postal Regulatory Commission must annually submit to the USPS a budget of its expenses. It must also conduct a study to identify the causes and effects of postal inefficiencies relating to flats (e.g., large envelopes). The USPS Office of Inspector General shall perform oversight of the Postal Regulatory Commission.

Continuous Improvement and Accountability in Organic Standards Act This bill requires the Department of Agriculture (USDA) to undertake rulemaking and other activities to implement certain recommendations of the National Organic Standards Board (a federal advisory board that considers and makes recommendations concerning the production, handling, and processing of organic products). Specifically, USDA must issue within a specified time line final rules for implementing recommendations approved (1) by the board between December 31, 2000, and the date of the bill's enactment; and (2) with at least two-thirds of the votes cast at a meeting where a quorum was present. If USDA determines issuing rules for such recommendations is not practicable, it must identify and report to Congress about the specific constraints that preclude rulemaking. In addition, the bill sets out a process and time line for USDA to implement through rulemaking future recommendations of the board that are approved by at least two-thirds of the votes cast at a meeting where a quorum was present. The bill also requires state officials or entities that certify organic farms or handling operations to report annually concerning the implementation of and compliance with any new rule or guidance.

Kids Eat Local Act This bill modifies Department of Agriculture requirements for the national school food programs relating to the purchases of locally produced food. The bill allows institutions participating in the school food programs to use locally grown, locally raised, or locally caught as a product specification in food procurement requests.

Homecare for Seniors Act This bill allows tax-exempt distributions from health savings accounts (HSAs) to be used for qualified home care. Qualified home care means a contract to provide three or more of the following services in the residence of the service recipient assistance with eating, assistance with toileting, assistance with transferring, assistance with bathing, assistance with dressing, assistance with continence, and medication adherence. The Department of Health and Human Services must carry out a campaign to increase public awareness of the in-home service expenses that are eligible for tax-free distribution from HSAs.

Fifth Amendment Integrity Restoration Act of 2021 or the FAIR Act This bill revises federal laws governing civil asset forfeiture. Specifically, the bill makes various changes to the general rules governing civil forfeiture proceedings. Among the changes, the bill requires counsel for an indigent property owner regardless of whether the owner requests counsel, raises the evidentiary standard from preponderance of the evidence to clear and convincing evidence, and sets forth factors courts must consider in determining whether a forfeiture of facilitating property is excessive. Additionally, the bill eliminates statutory authority for equitable sharing and directs forfeiture proceeds to be deposited into the general fund of the Treasury instead of the Department of Justice Assets Forfeiture Fund. Finally, the bill makes changes with respect to the civil forfeiture of money involved in structuring offenses (i.e., structuring currency transactions to evade currency reporting requirements). Among the changes, the bill specifies an evidentiary standard of knowingly for structuring offenses, and requires a prompt probable cause hearing following the seizure of money involved in a structuring offense.

Growing Climate Solutions Act of 2021 This bill authorizes the Department of Agriculture (USDA) to establish a voluntary Greenhouse Gas Technical Assistance Provider and Third-Party Verifier Certification Program to help reduce entry barriers into voluntary environmental credit markets for farmers, ranchers, and private forest landowners. A voluntary environmental credit market is a market through which agriculture and forestry credits may be bought or sold. Entities eligible to participate in the program are (1) providers of technical assistance to farmers, ranchers, or private forest landowners in carrying out sustainable land use management practices that prevent, reduce, or mitigate greenhouse gas emissions, or sequester carbon; or (2) third-party verifiers that conduct the verification of the processes described in the protocols for voluntary environmental credit markets. Among other requirements, USDA must publish (1) a list of protocols and qualifications for eligible entities; (2) information describing how entities may self-certify under the program; (3) information describing how entities may obtain the expertise to meet the protocols and qualifications; and (4) instructions and suggestions to assist farmers, ranchers, and private forest landowners in facilitating the development of agriculture or forestry credits and accessing voluntary environmental credit markets. USDA must also establish an advisory council to make recommendations regarding the list of protocols and qualifications, best practices, and voluntary environmental credit markets. The bill also rescinds certain funds provided in the American Rescue Plan Act of 2021 and makes the funds available for the certification program.

Recovering America’s Wildlife Act of 2021 This bill provides funding for (1) the conservation or restoration of wildlife and plant species of greatest conservation need; (2) the wildlife conservation strategies of states, territories, or the District of Columbia; and (3) wildlife conservation education and recreation projects. The Department of the Interior must use a portion of the funding for a grant program. The grants must be used for innovative recovery efforts for species of greatest conservation need, species listed as endangered or threatened species, or the habitats of such species.

Shark Fin Sales Elimination Act of 20 21 This bill addresses the sale of shark fins and the inclusion of rays and skates in the Seafood Traceability Program. The Seafood Traceability Program has data reporting and recordkeeping requirements at the time of entry for imported fish or fish products entered into U.S. commerce. The bill makes it illegal to possess, buy, or sell shark fins or any product containing shark fins, except for certain dogfish fins. A person may possess a shark fin that was lawfully taken consistent with a license or permit under certain circumstances. Penalties are imposed for violations under the Magnuson-Stevens Fishery Conservation and Management Act. The Department of Commerce must revise its regulations to include rays and skates as species that are subject to the Seafood Traceability Program.

Trillion Trees Act This bills establishes a variety of requirements and incentives to plant trees and conduct other land management practices for the purposes of capturing and storing carbon in domestic and international trees and forests. Additionally, the bill provides incentives to research or develop other carbon sequestration tools. Specifically, the bill directs the Department of Agriculture (USDA) to set targets to increase forest carbon stock through January 1, 2100, for the purposes of sequestering and storing carbon in U.S. forests. It also establishes and provides funding for the Trillion Trees Challenge Fund to provide grants to nonfederal entities for activities related to reforestation efforts on public or private lands. In addition, it raises the cap on the Reforestation Trust Fund to enhance forest health in the National Forest System and requires the USDA to establish a Tree City USA Grant Program. The bill also allows the U.S. Agency for International Development to enter into an agreement with a nonprofit organization to establish an International Forest Foundation to promote reforestation and prevent deforestation. Additionally, it establishes requirements and incentives to address seedling shortages and support nurseries. Finally, the bill provides market incentives to research or develop other carbon sequestration tools relating to biochar, sustainable building practices, biochemical and bioplastic products, and biomass energy.
