Enterprise Capital Formation Act of 1993 - Amends the Internal Revenue Code to exclude from gross income: (1) 50 percent of the gain from the sale or exchange of qualified small business stock, other than seed capital stock, held for more than five years; plus (2) an applicable percentage (from 50 to 100 percent) from the sale or exchange of such stock which is seed capital stock held for at least five years. Establishes special rules for such investments. Provides for determining the maximum capital gains rate for small business net capital gain or seed capital gain. Treats capital gains on the sale of such stock as a preference item for purposes of the minimum tax.

Small Business Lending Disclosure Act of 1993 - Amends the Federal Deposit Insurance Corporation Improvement Act of 1991 to: (1) mandate that insured depository institutions include in their annual reports of condition their small business lending practices; and (2) prescribe additional guidelines for mandatory information disclosure, including information on minority-owned business.

Ban on Smoking in Federal Buildings Act - Prohibits smoking in Federal buildings and in any other space owned or leased for use by a Federal agency. Directs the Administrator of General Services (with respect to the executive branch), the Administrative Office of the United States Courts (with respect to the judicial branch), and the House Office Building Commission, the Committee on Rules and Administration of the Senate, and the Architect of the Capitol (with respect to the legislative branch) to take such actions as necessary to institute and enforce such prohibition. Requires the Administrator to report to specified congressional committees with information concerning the degree of compliance with this Act and an assessment of the legal status of smoking in public places. Specifies that nothing in this Act is intended to preempt any provision of State or local law that is more restrictive than a provision of this Act.

TABLE OF CONTENTS: Title I: Child Support Enforcement Amendments Title II: Bankruptcy Amendments Relating to Child Support, Alimony, and Property Settlement Agreements Child Support Economic Security Act of 1993 - Title I: Child Support Enforcement Amendments - Amends the Social Security Act to provide that, in order to satisfy Federal grant eligibility criteria, a State plan for child and spousal support must provide for the designation of a single, separate, organizational unit at the State level to administer the plan under uniform State rules. Requires a State to have in effect specified statutory procedures. Mandates that State absent parent locator programs include response deadlines for information requests from other States. Directs the Secretary of Health and Human Services to issue regulations establishing standards and procedures governing the processing by States of cases involving the enforcement of child support obligations against parents in other States, including a deadline by which prosecutions must commence. Increases the amount the Secretary shall pay quarterly to each State for the operation of a State plan for child and spousal support. Repeals the mandate for Federal incentive payments to the States for cost-effective enforcement of child support payments. Makes a prerequisite for approval of any State plan that it have in effect a law identical to the Uniform Interstate Family Support Act. Establishes the Commission on Child Support Guidelines. Title II: Bankruptcy Amendments Relating to Child Support, Alimony, and Property Settlement Agreements - Amends Federal bankruptcy law to declare that the filing of a petition in bankruptcy does not operate as an automatic stay of actions for establishment of paternity or concerning certain debts for child and spousal support and maintenance. Includes among priority claims and expenses those for certain child and spousal support and maintenance. Precludes a trustee in bankruptcy from avoiding a transfer if it was a bona fide payment of a debt for child or spousal support, maintenance, or alimony. Amends the guidelines for what constitutes the property of the bankrupt estate of either a family farmer or an individual with regular annual income. Declares, for such debtors, that the court shall confirm a bankruptcy plan if the debtor has paid all allowable claims arising after the order for relief for debts for child and spousal support, maintenance, or alimony. Permits representatives of child support creditors to appear in court without charge and without meeting any special local court rule requirement for attorney appearances in any judicial bankruptcy proceeding if such representatives file information detailing the child support debt, status, and other characteristics.

Volunteer Protection Act of 1993 - Prescribes circumstances under which volunteers working for nonprofit organizations or government entities shall be immune from personal financial liability for acts on behalf of the organization or entity. Sets forth exceptions and conditions that a State may impose on the granting of such immunity. Requires the Secretary of Health and Human Services to increase by one percent the fiscal year allotment which would otherwise be made to a State to carry out the Social Services Block Grant Program under title XX of the Social Security Act if such State has, within two years, certified to the Secretary that it has enacted a State law which provides such immunity. Provides for the continuation of such increase based on an annual recertification.

Fairness in Federal Purchases Act of 1993 - Amends the Buy American Act to require Federal agency heads, upon notification in the Federal Register that the unemployment rate was five percent or higher or that the gross national product (GNP) declined during the preceding fiscal quarter, to determine whether: (1) the amount the agency spent on foreign government goods and services exceeded the amount such foreign governments spent on similar domestic goods and services during the preceding fiscal year and, if so, adjust spending on procurement from domestic versus foreign sources to eliminate any imbalance; and (2) less than 35 percent of the agency procurement spending went to small businesses and, if so, increase small business procurement spending to equal or exceed that amount. Provides that the lowest acceptable domestic product prices shall be considered unreasonable if they exceed the lowest acceptable foreign prices by more than specified amounts. Terminates such spending requirements after: (1) three years; or (2) specified shorter periods following publication of an unemployment rate of less than five percent for the preceding quarter or of a stable or increasing GNP for two consecutive quarters.

National Wildlife Refuge System Management and Policy Act of 1993 - Amends the National Wildlife Refuge System Administration Act of 1966 to prohibit the Secretary of the Interior (Secretary) from initiating or permitting a new use of a refuge or expanding, renewing, or extending an existing use unless it is determined that it is compatible with the purposes of the System and the refuge. Allows existing uses of such refuge system lands that have been determined compatible under this Act, or the Refuge Recreation Act, to continue under specified conditions. Terminates such use and revokes permits for it within five years after the enactment of this Act unless the Secretary determines that such use is compatible. Directs the Secretary, acting through the Director of the U.S. Fish and Wildlife Service, to establish a formal process for governing determinations of compatibility of an existing or proposed new use in a refuge with the purposes of the System and the refuge. Requires the head of each Federal agency that has, with respect to a refuge, an equivalent or secondary jurisdiction with the Department of the Interior, or conducts activities within any refuge, to ensure that any actions authorized, funded, or carried out will not impair the resources of the refuge or be incompatible with system or refuge purposes, unless the action is specifically authorized by law or necessary for national security. Directs the Secretary to: (1) prepare (and revise every ten years) a comprehensive plan for the System; and (2) prepare (and revise every 15 years) a comprehensive conservation plan for each refuge or ecologically related complex of refuges in the System, except those in Alaska. Authorizes appropriations. Grants the Secretary emergency power to suspend any activity in any range in the National Wildlife Refuge System that constitutes an imminent danger to the health and safety of any wildlife population, refuge, or to public health and safety.

Regulatory Flexibility Amendments Act of 1993 - Amends Federal law to eliminate provisions respecting judicial review of Federal agency compliance with regulatory flexibility analysis requirements. Requires an agency to consider the direct and indirect effects of a rule in determining whether or not it is likely to have a significant impact on a substantial number of small entities. Sets forth guidelines governing agency transmittal of proposed rules to the Chief Counsel for Advocacy of the Small Business Administration. Authorizes such official to transmit to the agency a statement of opposition to the proposed rule. Requires publication of such statement and the agency's response in the Federal Register. Expresses the sense of the Congress that such official should be permitted to appear as amicus curiae in any action or case brought in a U.S. court for the purpose of reviewing a rule.

National African American Museum Act - Establishes within the Smithsonian Institution the National African American Museum (the Museum) to be operated as a center for scholarship and museum training and a location for education, research, events, and collection and display of items and materials relating to the life, art, history, and culture of African Americans. Authorizes the Board of Regents of the Smithsonian Institution (Board of Regents) to plan, design, reconstruct, and renovate the Arts and Industries Building to house the Museum. Establishes a Board of Trustees of the Museum (Board of Trustees) in the Smithsonian Institution. Sets forth various duties of the Board of Trustees, including: (1) establishing and supporting cooperative programs with other museums and institutions; and (2) reporting annually to the Board of Regents. Directs the Secretary of the Smithsonian Institution to appoint a Director to manage the Museum (as well as appointing five other Museum employees). Authorizes appropriations.

Older Workers' Earnings Protection Act of 1993 - Amends title II (Old Age, Survivors and Disability Insurance) of the Social Security Act to increase the amount of outside income which beneficiaries who have attained retirement age may earn during 1995 through 1999 without incurring a reduction in benefits. Repeals such income limitation in the year 2000. Accelerates the effective dates of increases in the delayed retirement credit rate for individuals who work beyond retirement age.

National Stalker Reduction Act of 1993 - Amends the Omnibus Crime Control and Safe Streets Act of 1968 to: (1) authorize the Director of the Bureau of Justice Assistance to make grants to States which include programs that increase awareness, reporting, and prevention of stalking; and (2) provide for a reduction of formula grants for noncompliance by States with specified requirements. Directs each State which receives drug control and system improvement formula grants under the Act in a fiscal year to allocate not less than five percent of such funds for the development of records regarding stalking and other forms of domestic violence, including: (1) the development or expansion of maintaining records regarding the dispositions of all complaints and arrests for stalking and other forms of domestic violence; (2) the full automation of such records; and (3) the frequency and quality of reports sent to the Bureau of Justice Statistics. Authorizes the Director to waive compliance with such allocation requirement by a State, or to authorize a State to reduce the minimum amount such State is required to allocate, if the Director finds that the quality of the States' records regarding stalking and domestic violence complaints and arrests does not warrant expending the amount allocated. Requires the Bureau of Justice Statistics to: (1) define terms that relate to stalking and make such definitions available to individuals and groups that request such information; and (2) compile a national database regarding stalking and other forms of domestic violence. Requires the Director to submit annual reports to the Congress, evaluating the effectiveness of State anti-stalking efforts and legislation.

Amends the Internal Revenue Code with respect to approval of State unemployment compensation laws to prohibit States from denying or reducing unemployment compensation by reason of certain remuneration for services in the military reserves.

Constitutional Amendment - Prohibits outlays for a fiscal year (except those for repayment of debt principal) from exceeding total receipts (except those derived from borrowing) for that fiscal year unless the Congress, by a three-fifths roll call vote of each House, authorizes a specific excess of outlays over receipts. Requires a three-fifths roll call vote of each House to increase the public debt. Directs the President to submit a balanced budget to the Congress. Requires the approval of a majority of each House by roll call vote before any bill to increase revenue may become law. Waives these provisions when a declaration of war is in effect. Waives these provisions when the United States is engaged in a military conflict which poses a threat to national security as declared by a joint resolution adopted by a majority of each House.

Freedom of Access to Clinic Entrances Act of 1993 - Amends the Federal criminal code to impose civil or criminal penalties upon persons who intentionally prevent other individuals from entering or exiting a medical facility. Permits aggrieved individuals to obtain appropriate relief through civil actions.

Jefferson Commemorative Coin Act of 1993 - Directs the Secretary of the Treasury to issue one-dollar silver coins emblematic of Thomas Jefferson and his home, Monticello. Mandates that all surcharges received from the sale of such coins be paid to the Jefferson Endowment Fund, and to the Corporation for Jefferson's Poplar Forest. Expresses the sense of the Congress that the coin program shall be self-sustaining and that its administration should result in no net cost to the Numismatic Public Enterprise Fund.

TABLE OF CONTENTS: Title I: Modification of Passive Loss Rules Title II: Provisions Relating to Real Estate Investments By Pension Funds Title III: Discharge of Indebtedness Real Estate Stability and Recovery Amendments Act of 1993 - Title I: Modification of Passive Loss Rules - Amends the Internal Revenue Code to exclude certain rental real estate development activities from treatment as a passive activity for purposes of determining passive activity losses and credits. Title II: Provisions Relating to Real Estate Investments by Pension Funds - Modifies exceptions to the exclusion of real property acquired by a qualified organization from the meaning of acquisition indebtedness. Makes certain exceptions inapplicable to sales out of foreclosure by a financial institution. Applies the meaning of acquisition indebtedness to investments in certain large partnerships where the principal purpose of partnership allocation is not tax avoidance. Repeals the special rule for publicly traded partnerships with respect to the treatment of unrelated business taxable income. Permits a tax-exempt title-holding company to receive unrelated business taxable income of up to ten percent of its gross income, if the income is incidentally derived from the holding of real property. Excludes from unrelated business taxable income: (1) gains from the sale, exchange, or other disposition of real property acquired from financial institutions that are in conservatorship or receivership; (2) amounts received or accrued as consideration for entering into agreements to make loans; and (3) all gains on the lapse or termination of options, written by an organization in connection with its investment activities, to buy or sell real property. Provides for the tax treatment of pension fund investments in real estate investment trusts. Title III: Discharge of Indebtedness - Excludes from gross income, the income from the discharge of qualified real property business indebtedness. Applies the excluded amount to reduce the basis of the depreciable real property. Limits such amount to the amount of outstanding indebtedness over the fair market value of the property, reduced by any other qualified real estate business indebtedness. Excludes qualified farm indebtedness from the definition of "qualified real property business indebtedness."

Drug Free Truck Stop Act of 1993 - Amends the Controlled Substances Act to impose mandatory minimum criminal penalties for the unlawful distribution or possession of controlled substances within 1,000 feet of a truck stop or safety rest area. Prohibits the suspension of a sentence, granting of probation, or eligibility for parole until the individual has served the minimum required sentence under the Federal criminal code for any person who violates this Act after a prior conviction under this Act has become final. Requires the U.S. Sentencing Commission to promulgate specified sentencing guidelines for violations of this Act. Bars multiple enhancements.

Solid Waste Disposal Relief Act of 1993 - Exempts municipal solid waste landfills existing as of October 8, 1993, which meet criteria under the Solid Waste Disposal Act applicable as of January 1, 1993, from any revised criteria (established for facilities which may receive hazardous wastes). Terminates such exemption on October 9, 1995.

TABLE OF CONTENTS: Title I: Shenandoah Valley National Battlefields Title II: Shenandoah Valley National Battlefields Commission Title III: Authorization Of Appropriations Shenandoah Valley National Battlefields Partnership Act of 1993 - Title I: Shenandoah Valley National Battlefields - Establishes the Shenandoah Valley National Battlefields as a unit of the National Park Service (NPS). Sets forth the areas and battlefields included within the Battlefields. Directs the Shenandoah Valley National Battlefields Commission (established in title II) to identify lands in the historic core and the contributing battlefield area in the vicinity that shall comprise the Battlefields. Requires the Secretary and the Commission to: (1) encourage heritage preservation within the regional area of the Battlefields by landowners, local governments, organizations, and businesses; and (2) cooperate to promote heritage tourism in the Shenandoah Valley of Virginia that is compatible with resource protection. Sets forth provisions regarding: (1) restoration of property within the Battlefields; (2) grant awards to property owners and governmental entities and provision of technical assistance to promote and maintain the historic character of the Battlefields; (3) reimbursement of planning costs; and (4) implementation grants to government entities and the private sector. Authorizes the Secretary to acquire lands and interests in lands within the historic core by donation. Directs the Commission to submit to the Congress a Shenandoah Valley Civil War Sites Heritage Plan that describes the appropriate protection, management, uses, and development of the Battlefields consistent with the purposes of this Act. Title II: Shenandoah Valley National Battlefields Commission - Establishes the Shenandoah Valley National Battlefields Commission to: (1) advise and actively participate with the NPS in developing a Heritage Plan; (2) assist in the implementation, coordination, protection, promotion, and management of Battlefield resources; and (3) administer donated funds. Title III: Authorization of Appropriations - Authorizes appropriations.

Preventing Our Kids From Inhaling Deadly Smoke (PRO-KIDS) Act of 1993 - Directs the Administrator of the Environmental Protection Agency to issue guidelines for enforcing a nonsmoking policy at each Federal agency that prohibits, at a minimum, smoking in each portion of a Federal building that is not ventilated separately. Directs the heads of Federal agencies, the Director of the Administrative Office of the U.S. Courts, and specified entities of the legislative branch to adopt nonsmoking policies that meet the guideline requirements. Authorizes Federal agencies to petition for a waiver from the general requirements if extenuating circumstances prevent enforcement and such agencies make a good-faith effort to enforce an alternative policy. Requires Federal agencies in which a labor organization is recognized as a bargaining unit to ensure implementation of the requirements that affect work areas predominantly occupied by employees represented by such organization. Exempts such work areas from the policy if a collective bargaining agreement exists that includes provisions relating to smoking privileges that are in violation of this Act. Terminates such exemption on the earlier of the first expiration date of the agreement or one year after the issuance of the guidelines. Requires the Administrator to establish an outreach program on the dangers of environmental tobacco smoke. Directs the Administrator to establish an Environmental Tobacco Smoke Advisory Office. Requires each person who uses Federal funds to provide children's services to establish and enforce a nonsmoking policy that: (1) prohibits smoking in each portion of the facility used in connection with children's services; and (2) provides for the posting of signs stating that smoking is not permitted. Authorizes persons who make a good-faith effort to enforce a policy that meets such requirements to petition their funding agency for a waiver from the general requirements. Sets forth conditions for granting waivers. Provides for special waivers for persons who provide children's services pursuant to certain collective bargaining agreements. Prescribes civil penalties for violations of this Act. Exempts specified individuals from this Act.

Prison Inmate Training and Rehabilitation Act of 1993 - Directs Federal Prison Industries (FPI) to conduct pilot programs to test the feasibility of providing increased employment for Federal prisoners by producing items for the private market that would otherwise be produced by foreign labor. Permits FPI to enter into agreements with private industry to carry out this Act. Exempts: (1) items produced in such programs from legal restrictions on the sale of items produced by prison labor; (2) decisions in such programs from restrictions under the Federal criminal code on FPI decisions to produce new products or significantly expand the production of existing products; and (3) the business operations of such programs from application of competitive procedures. Directs the board of directors of FPI to include in its annual report to the Congress its findings on the results of such programs and recommendations as to whether to expand this concept within the Federal prison system.

Title II: Federal Emergency Management Agency - Makes emergency supplemental appropriations for FY 1993 for the emergency food and shelter program under such Act. Title III: General Provisions - Declares that the Congress designates all amounts appropriated by this Act as emergency requirements for purposes of the Balanced Budget and Emergency Deficit Control Act of 1985 (Gramm-Rudman-Hollings Act).

Authorizes the American Battle Monuments Commission to establish a memorial on Federal land in the District of Columbia or its environs to honor World War II veterans and to commemorate U.S. participation in that war. Establishes the World War II Memorial Advisory Board to promote the establishment of the memorial, encourage the donation of private contributions for it, and advise the Commission on the site and design for the memorial. Establishes a fund in the Treasury which shall be made available to the Commission for the expenses of establishing the memorial.

United States Mint Bicentennial Coin Act - Directs the Secretary of the Treasury to mint coins in commemoration of the 200th anniversary of the establishment of the United States Mint. Prescribes the designs for the ensuing five-dollar gold coins, one-dollar silver coins, and half-dollar silver coins. Restricts issuance of such coins to 1993. Mandates that all surcharges received from the sale of such coins be paid to the Smithsonian Institution for the National Numismatic Collection. Requires the Executive Director of the National Numismatic Collection to establish specified funds with the surcharge proceeds. Prescribes financial assurances.

TABLE OF CONTENTS: Title I: Sexual Violence Subtitle A: Penalties and Remedies Subtitle B: Rules of Evidence, Practice, and Procedure Subtitle C: Safe Campuses Subtitle D: Assistance to States and Localities Title II: Domestic Violence, Stalking, and Offenses Against the Family Title III: National Task Force on Violence Against Women Sexual Assault Prevention Act of 1993 - Title I: Sexual Violence - Subtitle A: Penalties and Remedies - Amends the Federal criminal code to provide for: (1) pretrial detention in sex offense cases; and (2) the death penalty for murders committed by sex offenders. Increases penalties for: (1) recidivist sex offenders; and (2) sex offenses against victims under age 16. Amends: (1) the Victims' Rights and Restitution Act of 1990 to require a governmental department or agency to pay for up to two tests for a sexual assault victim in the 12 months following the assault and a counseling session; (2) the Controlled Substances Act to provide for increased penalties for distribution of a controlled substance to a woman while she is pregnant; and (3) the Federal criminal code to authorize the restitution of victims of sex offenses. Establishes a civil remedy for victims of sexual violence. Subtitle B: Rules of Evidence, Practice, and Procedure - Amends the Federal Rules of Evidence to allow evidence of similar offenses in criminal or civil sexual assault and child molestation cases. Revises Federal Rule of Evidence 412 (rape victim shield law). Adds a Federal Rule of Evidence that, in a criminal case in which a person is accused of a sex offense, evidence is not admissible to show that the alleged victim invited or provoked the commission of the offense. Enacts rules to be known as the Rules of Professional Conduct for Lawyers in Federal Practice. Subtitle C: Safe Campuses - Requires the Attorney General to provide for a national baseline study on campus sexual assault. Subtitle D: Assistance to States and Localities - Authorizes the Attorney General to make grants to support projects and programs relating to sexual violence. Title II: Domestic Violence, Stalking, and Offenses Against the Family - Amends the Federal criminal code to establish penalties for interstate travel to commit spouse abuse or to violate a protective order. Establishes penalties (including restitution) for noncompliance with child support obligations in interstate cases. Provides for full faith and credit of protective orders among the States. Directs the Attorney General to: (1) prepare a report on the status of battered women's syndrome as a medical and psychological condition and on its effect in criminal trials; (2) conduct a study of the means by which abusive spouses may obtain information concerning the addresses or locations of estranged or former spouses; and (3) complete a study of problems of recordkeeping of criminal complaints involving domestic violence. Authorizes the Attorney General to make grants to support projects and programs relating to domestic violence and other criminal and unlawful acts that particularly affect women. Title III: National Task Force on Violence Against Women - Establishes the National Task Force on Violence Against Women to develop a uniform Federal, State, and local law enforcement strategy aimed at protecting women against violent crimes, punishing persons who commit such crimes, and enhancing the rights of the victims.

Marine Mammal Capture, Export, and Public Display Protection Act of 1993 - Amends the Animal Welfare Act (AWA) to require, instead of the penalty applicable under the AWA for a violation regarding a marine mammal, that a person be liable for a civil or criminal penalty under specified provisions of the Marine Mammal Protection Act of 1972 (MMPA). Mandates review and, if appropriate, modifications to AWA standards regarding the care and habitat of marine mammals in captivity. Amends the MMPA to direct the Secretaries of Commerce and Agriculture to jointly establish a system for tracking marine mammals taken in waters under U.S. jurisdiction or imported. Makes it unlawful to take any marine mammal before establishment of the system. Makes it unlawful to export a marine mammal without a permit under this Act. Requires regulations under the MMPA for exporting as well as for taking and importing marine mammals. Authorizes issuance of export permits under the same requirements as taking and importing permits. Allows issuance of an export permit only: (1) to maintain or improve the health and well-being of the mammal; and (2) if the permit prohibits use of the mammal for any other purpose. Modifies scientific research permit requirements regarding issuance, takings involving surgical procedures, lethal takings, release requirements, permanent marking of released mammals, and permit effective periods.

Community Works Progress Act of 1993 - Directs the Secretary of Labor to award grants to States to establish community works progress programs. Directs the Secretary of Labor to establish an interdepartmental task force to identify and report to the Congress any: (1) Federal funds that may be directed for use in community works progress programs under this Act; and (2) policy or procedural modifications that would help implement such programs. Directs the Secretaries to take necessary actions to carry out task force recommendations.

Amends the National and Community Service Act of 1990 to authorize appropriations for fiscal years after FY 1993 for the Civilian Community Corps Demonstration Program.
