Solid Waste Interstate Transportation Act of 2009

Solid Waste Interstate Transportation Act of 2009 - Amends the Solid Waste Disposal Act to prohibit a landfill or incinerator (facility) from receiving out-of-state municipal solid waste (MSW) for disposal or incineration unless the waste is received pursuant to a new or existing host community agreement or an exemption from this prohibition (which may be limited by the state). Establishes conditions for exemptions. Authorizes states to establish limits on the amount of out-of-state MSW received annually for disposal at each facility. Sets the limitation amount for any facility that began receiving documented out-of-state waste before enactment of this Act at the amount received during 1993 (or first subsequent year of documentation). Prohibits state limits from conflicting with permits or host community agreements. Authorizes states to require that a permit for a new or expanded facility include an annual limitation of not less than 20% on the total quantity of out-of-state MSW relative to the total waste received by the facility. Requires percentage limitations to be uniform and not discriminate against out-of-state MSW according to state of origin. Allows states to limit the amount of out-of-state MSW received annually at each facility to the amount received during 1995 if the state has a comprehensive, statewide recycling program. Prohibits discrimination against shipments of such waste on the basis of state of origin. Authorizes states to require inspectors to be onsite during operation of a facility that receives out-of-state MSW.

Requires a participating state to ensure that at least 50% of the resources of the program funded by the grant will be derived from other sources. Requires a state seeking a grant to carry out its activities through a lead entity to be known as a 2-1-1 Collaborative. Requires grant amounts to be used solely to make available to a state 2-1-1 telephone service for community information and referral on human services to all citizens of that state with phone access, including telephone connections between families and individuals seeking services and the service providers. Requires grant recipients to: (1) abide by the Key Standards for 2-1-1 Centers; and (2) collaborate with human service organizations to provide an exhaustive database of services with which to provide information or referral to individuals utilizing the 2-1-1 service.

Exempts from requirements to obtain a license as an animal dealer or exhibitor under such Act any retail pet store or other person who: (1) does not breed or raise more than 50 dogs for use as pets during any one-year period; and (2) derives less than a substantial portion of their income from the breeding and raising of dogs or cats on their own premises and sells such dogs or cats to a dealer or research facility. Requires: (1) a dealer to provide each dog it holds that is 12 weeks or older with a minimum of two exercise periods during each day for a total of no less than one hour of exercise; (2) such exercise to include removing the dog from the dog's primary enclosure and allowing the dog to walk for the entire exercise period; and (3) such exercise to not include use of a treadmill, catmill, jenny mill, slat mill, or similar device, unless prescribed by a doctor of veterinary medicine.

National Conservation, Environment, and Energy Independence Act - Terminates all federal prohibitions on expenditures of funds to conduct natural gas, oil, oil shale, and energy production leasing and preleasing activities for federal lands. Revokes withdrawals of federal submerged lands of the Outer Continental Shelf (OCS) from leasing for natural gas and oil exploration, development, and production. Amends the Tax Relief and Health Care Act of 2006 to repeal the moratorium on oil and gas leasing in certain areas of the Gulf of Mexico. Amends the Department of the Interior, Environment, and Related Agencies Appropriations Act, 2008 to repeal the prohibition on using funds to prepare or publish final regulations regarding a commercial leasing program for oil shale resources on public lands or to conduct an oil shale lease sale pursuant to the Energy Policy Act of 2005. Amends the Outer Continental Shelf Lands Act to prohibit the Secretary of the Interior from issuing any lease authorizing exploration for, or development of, natural gas or oil in any OCS area that is located: (1) within 25 miles of the coastline of a state; or (2) more than 25 miles and less than 50 miles from the coastline of a state that has enacted, within one year, a law disapproving of such a lease. Provides for the allocation of sums collected under qualified leases on submerged land made available for leasing under this Act. Establishes the Conservation Reserve, the Environment Restoration Reserve, the Renewable Energy Reserve, and the Carbon Capture and Sequestration Reserve. Establishes the state seaward boundaries under the Outer Continental Shelf Lands Act. Amends the Clean Air Act to allow the use of woody biomass from federal forest lands for the production of renewable energy. Amends the Energy Independence and Security Act of 2007 to repeal provisions prohibiting federal procurement of an alternative or synthetic fuel for any mobility-related use unless the contract specifies that the lifecycle greenhouse gas emissions associated with the production and combustion of the fuel supplied must be less than or equal to such emissions from the equivalent conventional fuel. Amends the Internal Revenue Code to revise provisions concerning tax credit extensions and deductions for renewable energy, alternative fuel, and energy conservation. Requires the Secretary of Energy to publish a plan for exchanging light grade petroleum from the Strategic Petroleum Reserve (SPR) for heavy grade petroleum. Establishes and provides for the allocation of the Energy Independence and Security Fund, including providing funding for: (1) researching and developing wind, solar, ocean and wave, and geothermal energy; (2) conducting energy efficiency projects; and (3) fostering the development of domestic energy production.

Second Amendment Enforcement Act - Amends specified law prohibiting the killing of wild birds and wild animals in the District of Columbia to declare that nothing in it or any other provision of law shall authorize or be construed to permit the Council, the Mayor, or any governmental or regulatory authority of the District to prohibit, constructively prohibit, or unduly burden the ability of persons otherwise not prohibited from possessing firearms under federal law from acquiring, possessing in their homes or businesses, or using for sporting, self-protection or other lawful purposes, any firearm neither prohibited by federal law nor subject to the National Firearms Act. Denies the District any authority to enact laws or regulations that discourage or eliminate the private ownership or use of firearms. Amends the Firearms Control Regulations Act of 1975 (FCRA) to repeal the definition of a machine gun as any firearm which shoots, is designed to shoot, or can be readily converted or restored to shoot semiautomatically, more than 12 shots without manual reloading. (Thus repeals the ban on semiautomatic weapons.) Redefines "machine gun" as any firearm which shoots, is designed to shoot, or is readily restored to shoot automatically, more than one shot without manual reloading by a single function of the trigger. Includes the frame or receiver of any such weapon, any part designed and intended solely and exclusively, or combination of parts designed and intended, for use in converting a weapon into a machine gun, and any combination of parts from which a machine gun can be assembled if such parts are in the possession or under the control of a person. Repeals the District's: (1) registration requirement for possession of firearms; (2) requirement that licensed firearms dealers keep records of ammunition received into inventory and ammunition sold or transferred; and (3) requirement that, under certain conditions, firearms in the possession of certain individuals must be kept unloaded, disassembled, or with the trigger locked. Maintains the current ban on the possession and control of a sawed-off shotgun, machine gun, or short-barreled rifle. Amends FCRA to allow an individual to possess ammunition in the District if the individual owns (currently, holds the valid registration certificate for) a firearm of the same guage or caliber as such ammunition. Eliminates criminal penalties for possessing an unregistered firearm. Amends federal law to eliminate criminal penalties for carrying a pistol whether loaded or unloaded in one's dwelling house, place of business, or on land possessed by such person. Amends the federal criminal code to make it lawful for any licensed importer, licensed manufacturer, licensed dealer, or licensed collector to sell or deliver a handgun to a District resident if such individual is licensed in Maryland or Virginia to do so.

Pulmonary Fibrosis Research Enhancement Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC), to: (1) develop a system to collect data on pulmonary fibrosis and other interstitial lung diseases; (2) establish the National PF Registry; and (3) establish the National Pulmonary Fibrosis Advisory Board. Allows the Secretary, acting through the Director of the CDC, to provide for the collection, analysis, and reporting of data on pulmonary fibrosis and other interstitial lung diseases that can be confused with, misdiagnosed as, and progress to pulmonary fibrosis. Requires the Secretary, in developing the Registry, to: (1) expand and coordinate existing data and surveillance systems, surveys, registries, and other federal public health and environmental infrastructure; and (2) provide for research access to pulmonary fibrosis data. Directs the Secretary to ensure that epidemiological and other types of information are made available to the National Institutes of Health (NIH) and the Department of Veterans Affairs (VA). Requires the Director of the National Heart, Lung, and Blood Institute to expand, intensify, and coordinate Institute pulmonary fibrosis research activities. Requires the Director of CDC to prepare the National Pulmonary Fibrosis Action Plan. Requires the Secretary to: (1) convene a summit of individuals with expertise in research and care of pulmonary fibrosis to provide a detailed overview of NIH research activities and discuss potential collaborations between NIH and other federal health agencies; and (2) make information about NIH activities relating to pulmonary fibrosis publicly available.

Authorizes the Secretary of the Army to carry out projects under the program in the Chesapeake Bay watershed, with the goal of carrying out projects in Delaware, New York, Maryland, Pennsylvania, Virginia, West Virginia, and the District of Columbia (currently the Secretary is required to establish at least one project in each of Maryland, Virginia, and Pennsylvania). Directs the Secretary to establish a program, to be administered by the National Fish and Wildlife Foundation, to provide small watershed grants for technical and financial assistance to local governments and nonprofit organizations in the Chesapeake Bay region. Permits the use of grant funds only for implementation of cooperative tributary basin and other Chesapeake Bay-wide strategies that address storm water management or the establishment, restoration, protection, or enhancement of natural habitat associated with the Chesapeake Bay ecosystem. Increases the authorization of appropriations for the Cheasapeake Bay program. Directs the Secretary to develop at federal expense and submit to Congress a comprehensive plan to prioritize projects within the Chesapeake Bay watershed.

Alerting Lives through Effective and Reliable Technological Systems Act of 2008 or ALERTS Act of 2008 - Amends the Homeland Security Act of 2002 to direct the Secretary of Homeland Security to: (1) establish a national integrated public alert and warning system; (2) develop within such system a commercial mobile alert system to provide rapid dissemination of information over commercial mobile devices; and (3) designate an agency within the Department of Homeland Security (DHS) to receive, aggregate, validate, and authenticate homeland security and other information originated by authorized federal, state, local, and tribal governments to facilitate the transmission of such mobile alert system. Requires the Secretary to: (1) establish common alerting and warning protocols, standards of performance, and terminology; (2) include the capability to adapt the dissemination of information and the content of communications on the basis of geographic location, risks, or user preferences and to alert special needs populations; (3) ensure that the national warning system is incorporated into DHS training and exercise programs; and (4) coordinate with other federal agencies, state, local, and tribal governments, and key stakeholders. Directs the Secretary to conduct a pilot program to increase the national warning system's reach. Amends the Implementing Recommendations of the 9/11 Commission Act of 2007 to authorize the use of grant funds to permit state, local, and tribal governments to improve public alert and warning capabilities. Prohibits tampering or interfering with components of the national warning system that are used or designed to deliver alerts and warnings and that were purchased with public funds.

Small Business Health Options Program Act of 2008 or the SHOP Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services to designate an office within the Department of Health and Human Services (HHS) to administer a health insurance program for small businesses and self-employed individuals to purchase health insurance coverage meeting certain requirements. Establishes a Small Business Health Board to monitor the implementation of the program and make recommendations for improvements. Requires the Administrator of the program to: (1) enter into contracts with health insurance issuers to provide health insurance coverage under this Act; and (2) enter into agreements with entities to serve as navigators to provide information about the program and assist in enrollment. Requires a participating employer to ensure that each eligible employee has an opportunity to enroll in a plan. Sets forth requirements for health plans offered under this Act. Requires the Administrator to contract with the National Association of Insurance Commissioners to study the rating requirements, administrative procedures, and standards of external and internal review that apply to such plans and to health insurance purchased in the small group markets in the states and to develop recommendations concerning rating requirements. Sets forth premium-setting rules for plans under this Act. Allows a state to prohibit participation in this program if the state offers alternative health benefit plans. Amends the Internal Revenue Code to allow a tax credit for small employers for qualified employee health insurance expenses under this Act.
