Officer Daniel Faulkner Children of Fallen Heroes Scholarship Act of 2008 - Amends the Higher Educaton Act of 1965 to eliminate the expected family contribution used in determining Pell Grant eligibility in the case of a student applicant whose parent or guardian died as a result of performing service as a police officer, firefighter, or other first responder.

Foreign Intelligence Surveillance Act of 1978 Amendments Act of 2008 or FISA Amendments Act of 2008 - Amends the Foreign Intelligence Surveillance Act of 1978 (FISA) to authorize the Attorney General (AG) and Director of National Intelligence (DNI) to jointly authorize, for periods up to one year, the targeting (electronic surveillance) of persons located outside the United States in order to acquire foreign intelligence information, under specified limitations and requirements. Authorizes the AG and DNI to direct an electronic communication service provider to: (1) immediately provide the government with all information, facilities, and assistance necessary to accomplish an acquisition of communications; and (2) maintain under security procedures any records concerning such acquisition. Requires the AG and DNI, at least every six months, to: (1) assess compliance with required targeting and minimization procedures; and (2) submit assessment results to the Foreign Intelligence Surveillance Court (Court) and the congressional intelligence committees. States that FISA and the procedures of chapters 119 (Wire and Electronic Communications Interception and Interception of Oral Communications), 121 (Stored Wire and Electronic Communications and Transactional Records Access), and 206 (Pen Registers and Trap and Trace Devices) of the federal criminal code shall be the exclusive means by which electronic surveillance and the interception of domestic wire, oral, or electronic communications may be conducted. Allows the AG to authorize the emergency employment of electronic surveillance if the AG, among other things: (1) determines that an emergency exists; (2) informs a Court judge of such determination; and (3) applies for a Court order authorizing such surveillance. Requires the AG, after authorizing the installation and use of a pen register or trap and trace device on an emergency basis, to apply to the Court for an authorization order within seven days (current law requires 48 hours) after the emergency installation and use. Authorizes the Court to sit en banc when: (1) necessary to secure or maintain uniformity of Court decisions; or (2) the proceeding involves a question of exceptional importance. Authorizes the acquisition of foreign intelligence information in order to prevent the international proliferation of weapons of mass destruction. Prohibits: (1) civil actions against a communication service provider, or individual other than such a provider, furnishing surveillance assistance requested from an element of the intelligence community; and (2) a state from conducting investigations, imposing sanctions, or commencing or maintaining a civil action or other proceeding against a provider furnishing requested assistance.

Flexibility in Rebuilding American Fisheries Act of 2008 - Amends the Magnuson-Stevens Fishery Conservation and Management Act to require fishery management plans, amendments, or regulations for overfished fisheries to specify a time period for ending overfishing and rebuilding the fishery that is as short as practicable (currently, as short as possible). Modifies the exceptions to the requirement that such period not exceed ten years. Requires consideration, in evaluating progress to end overfishing and rebuild overfished stocks, of factors other than commercial and recreational fishing. Requires, when the Secretary of Commerce extends the period under specified provisions, that the maximum rebuilding time not exceed the sum of the initial ten-year period, the expected time to rebuild the stock absent any fishing mortality and under prevailing environmental conditions, and the mean generation time of the stock.

Paul D. Wellstone Muscular Dystrophy Community Assistance, Research, and Education Amendments of 2008 - Amends the Public Health Service Act to designate centers of excellence for research on various forms of muscular dystrophy as Paul D. Wellstone Muscular Dystrophy Cooperative Research Centers. Requires the Muscular Dystrophy Interagency Coordinating Committee to give special consideration to enhancing the clinical research infrastructure required to test emerging therapies for the various forms of muscular dystrophy. Requires the Secretary of Health and Human Services to ensure that any data on patients that is collected as part of the Muscular Dystrophy Surveillance, Tracking and Research Network (MD STARnet) is regularly updated to reflect changes in patient condition over time. Requires the Director of the Centers for Disease Control and Prevention (CDC) to: (1) report to the appropriate congressional committees on MD STARnet and data collection; and (2) provide prospective health outcome data on the health and survival of people with muscular dystrophy. Requires the Director of CDC, in carrying out a program to provide information and education on muscular dystrophy to health professionals and the general public, to: (1) partner with leaders in the muscular dystrophy patient community; and (2) widely disseminate the Duchenne-Becker muscular dystrophy care considerations. Requires the Director of the Agency for Healthcare Research and Quality to: (1) evaluate the available scientific evidence to develop and issue an initial set of care considerations for Duchenne-Becker muscular dystrophy and provide ongoing review and updates where appropriate; and (2) replicate the same methodology used to develop such care considerations as a model for other muscular dystrophies.

Condemns the City Council of Berkeley, California, for impugning the integrity and professionalism of the Marine Corps. Recommends that any special federal projects funding provided under the Consolidated Appropriations Act, 2008, for Berkeley be rescinded. Recognizes: (1) the service and sacrifices of members of the Armed Forces and their families; and (2) the efforts of the United States Marine Corps Recruiting Command. Commends the unique and significant role the Marine Corps has played in upholding U.S. freedom and security. Reaffirms a commitment to ensuring that policy disagreements do not compromise the honor and sacrifice of serving military personnel.

Nursing and Allied Health Education Preservation Act of 2008 - Amends title XVIII (Medicare) of the Social Security Act to prohibit the Secretary of Health and Human Services from denying provider-operated status for a nursing and allied education program that substantially meets certain requirements pertaining to the cost of approved activities for such programs, in effect as of October 1, 2006, on the basis of an organizational structure, contractual arrangements, or legal structure of the program, or a change in such a structure or arrangement, so long as a hospital, hospitals, or health system continues to substantially control the nursing or allied program. Prohibits denial of payments for the costs of approved educational activities for a nursing or allied health education program. Requires restoration to a hospital of any recoupment or denial effected for a previous cost reporting year.

Condemns the ongoing Iranian-enabled rocket attacks on Israeli civilians and places responsibility for launching the attacks on Hamas and other terrorist organizations in Gaza. Supports the government of Israel's right to defend its territory. Recognizes the difficult balance Israel faces with the competing pressures of being the primary supplier of numerous necessities for Palestinian civilians, even while rockets are being fired at Israel from Palestinian areas. Supports Palestinian civilians who reject Hamas and all forms of terrorism. Reaffirms the friendship between the governments and the people of Israel and the United States.

Stealth Tax Relief Extension Act of 2008 - Amends the Internal Revenue Code to: (1) increase the exemption from the alternative minimum tax for individual taxpayers in 2008; and (2) extend through 2008 the allowance of certain nonrefundable tax credits against alternative minimum tax liability.

United States Fire Administration Reauthorization Act of 2007 - Amends the Federal Fire Prevention and Control Act of 1974 to authorize appropriations for the U.S. Fire Administration (USFA) for FY2009-FY2012. Authorizes the Superintendent of the National Academy for Fire Prevention and Control to include within fire service personnel training: (1) response, tactics, and strategies for dealing with non-terrorist-caused national catastrophes; (2) applying new technology and developing strategies and tactics for fighting wildfires; (3) response, tactics, and strategies for fighting large-scale or multiple fires in a general area that cross jurisdictional boundaries, fires occurring at the wildland-urban interface, and fires involving hazardous materials; and (4) advanced emergency medical services training. Requires the Administrator of USFA to include in triennial reports information about changes made to the National Fire Academy curriculum. Authorizes the Administrator to: (1) contract with a nationally recognized organization that meets specified requirements to facilitate the delivery of education and training programs directly to fire service personnel; and (2) assist the nation's fire services to sponsor and encourage research to improve fire prevention and control in the wildland-urban interface. Directs the Administrator to: (1) use specified funds during FY2009-FY2011 to update the National Fire Incident Reporting system to an Internet-based, real-time incident reporting database: (2) make available to the public information about fire-related research through a regularly updated Internet-based database; (3) promote adoption by fire services of voluntary national consensus standards for firefighter health and safety; and (4) provide liaison to assure coordination of fire service-based emergency medical services programs.

National Guardsmen and Reservists Parity for Patriots Act - Amends the National Defense Authorization Act for Fiscal Year 2008 to back-date to September 11, 2001, the period of active duty or performed active service, in support of a contingency operation or in other emergency situations, for which members of Ready Reserve components of the armed forces shall receive credit in determining eligibility for early receipt of non-regular service retired pay.

Code Talkers Recognition Act of 2007 - Directs the Speaker of the House of Representatives and the President pro tempore of the Senate to arrange for the award of gold medals to Native American code talkers of specified Indian tribes. Defines "code talker" as a Native American who served in the Armed Forces during a foreign conflict and who participated in military communications using a native language. Requires the Secretary of the Treasury, in consultation with the Secretary of Defense and Indian tribes, to identify code talkers eligible for a gold medal.

Health Care Choice Act of 2007 - Amends the Public Health Service Act to provide that the laws of the state designated by a health insurance issuer (primary state) shall apply to individual health insurance coverage offered by that issuer in the primary state and in any other state (secondary state), but only if the coverage and issuer comply with the conditions of this Act. Exempts issuers from any secondary state's laws that would prohibit or regulate the operation of the issuer in such state, subject to certain restrictions imposed by such state. Specifies the notice that an issuer must provide in any insurance coverage offered in a secondary state and at renewal of the policy. Requires each issuer issuing individual health insurance coverage in both primary and secondary states to submit to: (1) the insurance commissioners of such states a copy of the plan of operation or feasibility study and written notice of any change in its designation of its primary state and of its compliance with all the laws of the primary state; and (2) the insurance commission of each secondary state a copy of the issuer's quarterly financial statement that was submitted to the primary state. Prohibits an issuer from offering, selling, or issuing individual health insurance coverage in a secondary state if the state insurance commissioner does not use a risk-based capital formula for the determination of capital and surplus requirements for all issuers. Gives sole jurisdiction to the primary state to enforce the primary state's covered laws in the primary state and any secondary state. Requires the Comptroller General to study and report to Congress on the effect of this Act on specified health insurance issues.

Amends the Internal Revenue Code to extend through 2012: (1) the tax deduction for energy efficient commercial buildings; (2) the tax credit for new energy efficient homes; (3) the tax credit for nonbusiness energy property; and (4) the tax credit for residential energy efficient property. Allows a $500 refundable tax credit ($1,000 in the case of a joint tax return) in 2008 for certain low-income individual taxpayers who have a principal place of abode in the United States and who use heating oil as the primary source of energy for heating such abode.

Health Insurance Tax Credit Assistance Act of 2007 - Amends the Internal Revenue Code to allow a tax credit for charitable contributions to tax-exempt charities which subsidize health insurance premiums and pharmacy co-payments of uninsured individuals or individuals who cannot otherwise afford health insurance or drug treatments.

Climate Stewardship and Economic Security Act of 2007 - Requires the Administrator of the Environmental Protection Agency (EPA) to establish a National Greenhouse Gas Database consisting of: (1) an inventory of greenhouse gas (GHG) emissions by covered entities (specified entities that own or control a source of GHG emissions in the electric power, industrial, and commercial sectors of the U.S. economy that emit more than 10,000 metric tons of GHGs per year); and (2) a registry of GHG emission reductions and increased sequestration, applicable to all entities. Establishes a program for the market-driven reduction of GHGs by covered entities through the use of tradeable emissions allowances. Requires the Administrator to establish a declining cap on allowances to reduce GHG emissions over time. Requires covered entities, beginning in 2012, to submit to the Administrator one allowance for every metric ton of GHGs emitted. Authorizes the President to establish a program to require importers to pay the value of GHGs emitted during the production of goods or services imported into the United States from specified foreign nations. Allows allowances to be sold, exchanged, purchased, retired, borrowed, offset, or otherwise used as authorized by this Act. Imposes civil penalties on covered entities that fail to submit allowances. Requires: (1) the Administrator to establish a program to assist developing counties and covered entities in reducing GHGs; and (2) the Secretary of Agriculture to establish an outreach initiative on opportunities for agricultural producers to earn revenue. Establishes: (1) the Carbon Market Efficiency Board to analyze information on the GHG emission tradeable allowance market and to carry out cost relief measures if such market poses a significant harm to the US economy; and (2) the Climate Change Credit Corporation (CCCC) to receive, manage, buy, and sell allowances. Directs the Administrator to make allocations of allowances to covered sectors and entities and to the CCCC, providing initial allocations for early action and accelerated participation. Requires the CCCC to establish a program to provide financial support for: (1) technology to assist in compliance with this Act; (2) the restoration of habitat to help fish and wildlife adapt to climate change; and (3) restoration of large-scale aquatic ecosystems. Amends the Coastal Zone Management Act of 1972 to require the Secretary of Commerce to: (1) report to Congress on the oceanic and coastal impacts of climate change; and (2) assist certain coastal states in preparing persons to adapt to climate change. Requires the Director of the Office of Science and Technology Policy to: (1) establish a program on adaptation technologies as part of the Climate Technology Challenge Program; and (2) perform regional infrastructure cost assessments of the impacts of climate change. Requires the Secretary of Commerce to: (1) submit a climate change adaptation plan to Congress; and (2) research the impact of climate change on low-income populations worldwide. Amends the Pittman-Robertson Wildlife Restoration Act to provide funding for the Wildlife Conservation and Restoration Account that may be used by states to develop and implement climate change impact mitigation plans.

Ensuring Medicare Access to Recreational Therapy Act of 2007 - Directs the Secretary of Health and Human Services, acting through the Administrator of the Centers for Medicare and Medicaid Services, to issue a notice of proposed rulemaking, or a transmittal amending the Medicare Benefits Policy Manual, or both, specifying that: (1) recreational therapy is a covered service under title XVIII (Medicare) of the Social Security Act in inpatient rehabilitation facilities, inpatient psychiatric facilities, and skilled nursing facilities (SNFs); (2) recreational therapy is a skilled rehabilitative modality included in the bundle of services as part of the payment rates for such facilities under Medicare's respective prospective payment systems (PPS) for these inpatient settings; and (3) any recreational therapy that is provided to a Medicare beneficiary in such a facility prescribed by a physician as part of the facility's plan of care for the patient must be provided by a qualified recreational therapist.

Justice for the Newark College Students Act - Amends the Immigration and Nationality Act to require: (1) the Secretary of Homeland Security (current law refers to the Attorney General) to make investigative resources available to state and local law enforcement agencies to determine whether an individual arrested for a felony or an aggravated felony (current law refers to only an aggravated felony) is unlawfully in the United States; (2) state and local agencies to use such information to determine whether an arrested individual is unlawfully in the United States and to provide the appropriate court with such information; (3) the court to report such case's disposition to the Department of Homeland Security (DHS); and (4) mandatory federal detention of such individuals pending removal, and release only in furtherance of the felony case for which the arrest was made.

Establishes a Joint Select Committee on Earmark Reform to study and report to the House and the Senate on the practices of the legislative and executive branch regarding earmarks in authorizing, appropriation, tax, and tariff measures. Makes it out of order to consider a bill, joint resolution, or conference report containing a congressional earmark, limited tax benefit, or limited tariff benefit until the filing of such report.

Prevention of Unsafe Licensing Act - Amends the REAL ID Act of 2005 to prohibit a state from issuing a driver's license or identification document to a person unless the state has satisfied certain citizenship or lawful immigration status verification requirements.

Requires the Secretary of Transportation to withhold specified graduated percentages of a state's apportionment of certain federal-aid highways funds for FY2010 and thereafter if driver licenses or personal identification cards issued by the state do not meet with certain minimum federal standards to be accepted by a federal agency.

Expresses strong support for the work of the United States Commission for the Preservation of America's Heritage Abroad and for the European countries that continue to work to preserve sacred historical sites. Expresses strong sentiments to the government of Lithuania that the people of the United States believe the Jewish cemetery located in the Snipiskes area of Vilnius, Lithuania, must not be further desecrated. Declares that if the Government of Lithuania fails to immediately stop construction and protect the cemetery it will jeopardize its important relationship with the United States and its standing in the international community.

Military Construction and Veterans Affairs and Related Agencies Appropriations Act, 2008 - Appropriates funds for FY2008 for the Department of Defense (DOD) for: (1) military construction for the Army, Navy and Marine Corps, and Air Force (military departments), DOD, the Army and Air National Guard, and the Army, Navy, and Air Force reserves; (2) the North Atlantic Treaty Organization (NATO) Security Investment Program; (3) family housing construction and related operation and maintenance for the military departments and DOD; (4) the Department of Defense Family Housing Improvement Fund; (5) DOD chemical demilitarization construction; and (6) the Department of Defense Base Closure Accounts of 1990 and 2005. Appropriates funds for the Department of Veterans Affairs (VA) for: (1) the Veterans Benefits Administration; (2) readjustment benefits; (3) veterans insurance and indemnities; (4) the Veterans Housing Benefit Program Fund; (5) the Vocational Rehabilitation Loans Program; (6) the Native American Veteran Housing Loan Program; (7) guaranteed transitional housing loans for homeless veterans; (8) the Veterans Health Administration; (9) the National Cemetery Administration; (10) the Office of Inspector General; (11) construction for major and minor projects; and (12) grants for the construction of extended care facilities and veterans cemeteries. Appropriates funds for: (1) the American Battle Monuments Commission; (2) the U.S. Court of Appeals for Veterans Claims; (3) cemeterial expenses, Army; and (4) the Armed Forces Retirement Home. Specifies restrictions and authorities regarding the use of funds appropriated in this Act.

Secure America Through Verification and Enforcement Act of 2007 or SAVE Act of 2007 - Sets forth border security and enforcement provisions, including provisions respecting: (1) increases in Border Patrol and investigative personnel; (2) recruitment of former military personnel; (3) use of Department of Defense (DOD) equipment; (4) infrastructure improvements; (5) aerial and other surveillance; (5) a national strategy to secure the borders; (6) emergency deployment of Border Patrol agents; and (7) expansion of the Customs-Trade Partnership Against Terrorism along the northern and southern borders. Amends the Immigration and Nationality Act and specified maritime law sections to revise alien smuggling provisions. Sets forth provisions respecting border security on certain federal lands under the jurisdiction of the Secretary of Agriculture or the Secretary of the Interior. Border Law Enforcement Act - Authorizes a border relief grant program for a tribal, state, or local law enforcement agency in a county within 25 miles of the southern border of the United States. Amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to make the basic employment eligibility confirmation pilot program permanent. Sets forth conditions for the mandatory use of the E-verify system. Requires: (1) employer/employee notification of social security number mismatches and multiple uses, and related information sharing with the Department of Homeland Security (DHS); and (2) establishment of electronic birth and death registration systems. Amends the Internal Revenue Code to: (1) penalize specified employers for failure to correct information returns; and (2) prohibit employers from deducting from gross income wages paid to unauthorized aliens, with an exception for an employer participating in the basic employment eligibility confirmation program. Increases criminal alien program (CAP) personnel. Establishes within DHS a rewards program to assist in the elimination of commercial operations to produce or sell fraudulent immigration-related documents and to assist in the investigation, prosecution, or disruption of commercial alien smuggling operations. Provides for: (1) increased alien detention facilities; (2) additional district court judgeships; and (3) a media campaign to inform the public of changes made by this Act including a multilingual media campaign explaining noncompliance penalties.

Amends Rule XXI (Restrictions on Certain Bills) of the Rules of the House of Representatives to make it out of order to consider any bill, joint resolution, or conference report, containing appropriations within the jurisdiction of the Subcommittee on Military Quality of Life and Veterans Affairs, and Related Agencies of the Committee on Appropriations if such measure also contains appropriations within the jurisdiction of any other subcommittee of that Committee. (Thus requires that general appropriations for military construction and veterans' affairs be considered as stand-alone measures.) Exempts from such requirement any measure making supplemental appropriations or continuing appropriations for up to 60 days.

Credit and Debit Card Receipt Clarification Act of 2007 - Amends the Fair Credit Reporting Act (FCRA) to declare that any person who printed an expiration date on any receipt provided to a consumer cardholder at a point of sale (POS) or transaction between December 4, 2004, and the enactment of this Act, but otherwise complied with FCRA requirements for such receipt, shall not be in willful noncompliance by reason of printing such expiration date on it.

Expresses the sense of the House of Representatives that Department of Veterans Affairs National Cemetery Administration employees, volunteers, and veteran's service organizations that perform funeral honors and memorial honor details should be permitted to recite the 13 steps to fold an American flag (known as the "13-fold recital") at any national cemetery if requested to do so by the family of the deceased.

Commends all U.S. Post Offices that display photographs of local community members who are serving in the Armed Forces and are deployed overseas. Reaffirms the authority of the U.S. Postal Service to display in post offices official photographs of members of the Armed Forces at the request of the community or the servicemembers' families. Urges U.S. Post Offices to reserve or designate space in their public areas for the purpose of displaying photographs of servicemembers.

Science Museum and National Laboratory Partnership Demonstration Act - Authorizes the award of up to five grants only to partnerships that include science museums, or consortia thereof serving at least 1,000,000 visitors annually and with an existing partnership with one or more national laboratories, for the purposes of : (1) increasing public understanding of scientific work occurring at the national laboratories; (2) developing exhibits and informal education programs featuring advances in the physical sciences; and (3) increasing public understanding of science, technology, engineering, and mathematics disciplines. Disallows such science museums or consortia from receiving more than 60% of a grant award for any fiscal year, with the remaining funds allocated to National Laboratory partners.

Affordable Footwear Act of 2007 - Expresses the sense of Congress that the elimination of duty on certain imported footwear would provide significant benefit to U.S. consumers, particularly lower-income families. Amends the Harmonized Tariff Schedule of the United States to provide for the duty-free treatment of certain footwear (including children's shoes) made of rubber or plastics that are imported into the United States. Amends the Caribbean Basic Economic Recovery Act to provide footwear imported directly from Haiti into the United States with the same preferential treatment that is provided to certain imported footwear under the Dominican Republic-Central American-United States Free Trade Agreement.

National Hepatitis B Act - Amends the Public Health Service Act to require the Secretary of Health and Human Services to develop a plan for hepatitis B prevention, control, and medical management. Requires the Secretary, acting through the Director of the Centers for Disease Control and Prevention (CDC), to: (1) support the integration of testing, counseling, immunization, and medical referral activities into existing clinical and public health programs at state, local, and tribal levels; and (2) provide hepatitis B coordinators to health departments in order to ensure the success of such integration. Requires the Secretary, acting through the Director of CDC, the Administrator of the Health Resources and Services Administration (HRSA), and the Administrator of the Substance Abuse and Mental Health Services Administration, to implement programs to increase awareness and enhance knowledge and understanding of hepatitis B. Requires the Secretary, acting through the Director of CDC, to: (1) support the establishment of a national hepatitis B surveillance program; and (2) report on population-based seroprevalence studies and hepatitis B's economic and clinical impact and its impact on quality of life. Requires the Secretary, acting through the Directors of CDC, the National Cancer Institute, and the National Institutes of Health (NIH), to conduct research on hepatitis B. Requires the Secretary to give priority in carrying out this Act to individuals with limited access to health education, testing, and health care services and groups that may be disproportionately affected by hepatitis B.

Brownfields Redevelopment Promotion Act - Amends the Internal Revenue Code to make permanent the taxpayer election to expense (deduct in the current taxable year) expenditures made for environmental remediation (i.e., abatement or control of hazardous substances at contaminated sites).
