This joint resolution proposes a constitutional amendment prohibiting total outlays for a fiscal year from exceeding total receipts for that fiscal year or 18.5% of the economic output of the United States. The amendment also requires a cancellation of budget authority that is equal to the amount by which total outlays exceeded these limits during the preceding fiscal year. The amendment requires a three-fourths roll call vote of each chamber of Congress to increase the public debt limit or increase revenue. The amendment also requires the President to submit an annual budget in which total outlays do not exceed total receipts. Congress may waive these requirements due to a declaration of war or a military conflict that causes an imminent and serious military threat to national security.

To amend the Internal Revenue Code to establish a flat tax, and for other purposes.

This bill imposes a 15% flat tax on the taxable income of each individual taxpayer. It defines taxable income as the excess of the sum of wages, taxable retirement distributions, plus unemployment compensation, over the standard deduction. The bill also imposes a 15% flat tax on business taxable income and on noncash compensation provided to employees not engaged in business activity. The bill repeals various existing tax provisions, including the alternative minimum tax, certain tax credits, and estate and gift taxes.

This bill imposes liability on manufacturers and distributors for claims for losses arising from the administration or use of certain vaccines. The bill also limits the authority of the Department of Health and Human Services (HHS) to incorporate new vaccines into the National Vaccine Injury Compensation Program (VICP), which compensates individuals for injuries or deaths associated with routinely administered vaccines. Current law generally provides liability protections for manufacturers and distributors of pandemic and epidemic products and security countermeasures (which include vaccines). This bill specifies that the liability protections shall not apply to the administration of vaccines that are (1) licensed biological products or approved for use under emergency procedures, and (2) required by federal or state governments (or federally funded entities). The bill also permits individuals to sue manufacturers and distributors in state or federal courts without first seeking compensation through the VICP process for injuries or deaths caused by the administration of such vaccines. Additionally, HHS may not add a vaccine to the Vaccine Injury Table (which lists the vaccines that are covered by the VICP) if the vaccine (1) is required by the federal government or a federally funded entity, and (2) is administered without obtaining informed consent or providing a religious exemption (if requested by the individual receiving the vaccine).

Stop the Sexualization of Children Act This bill prohibits the presentation of sexually oriented materials to children under the age of 10. The bill defines sexually oriented material as any (1) depiction or description of sexual activity; (2) lewd or lascivious depiction or description of human genitals; or (3) topic involving gender identity, gender dysphoria, transgenderism, sexual orientation, or related subjects. Specifically, the bill prohibits (1) the use of federal funds to develop, implement, facilitate, or fund any sexually oriented program, event, or literature for children under the age of 10; and (2) the use of federal facilities or properties to host or promote such programs, events, or literature. The bill grants a parent or guardian a private right of action against a government official, government agency, or private entity that violates this bill. Additionally, the bill prohibits federal agencies from disbursing federal funds to a government agency or private entity for three fiscal years if the agency or entity has received two or more injunctions for violations of the bill in a five-year period.

Endangered Species Transparency and Reasonableness Act of 2022 This bill revises requirements concerning determinations on whether a species is a threatened or endangered species under the Endangered Species Act of 1973 (ESA) and caps attorney's fees to prevailing parties in ESA citizen suits. The U.S. Fish and Wildlife Service (USFWS) and the National Marine Fisheries Service (NMFS) must publish online, subject to privacy or administrative limitations, the best scientific and commercial data available that are the basis for each determination. The bill states that the term best scientific and commercial data available includes all data submitted by a state, tribal, or county government. Thus, the USFWS and NMFS would no longer consider whether data from those sources are the best scientific and commercial data available. Instead, the data would be automatically deemed the best scientific and commercial data available regardless of the quality of the data. Before making a determination on whether a species is an endangered or threatened species, the USFWS and NMFS must provide affected states with all of the data that is the basis of the determination. The Department of the Interior must also publish and maintain an online searchable database that discloses federal expenditures related to litigation under the ESA.

SHORT Act

Stop Harassing Owners of Rifles Today Act or the SHORT Act This bill removes certain short-barreled rifles, short-barreled shotguns, and other weapons from the definition of a firearm for purposes of regulation under the National Firearms Act (NFA). The bill also eliminates certain restrictions that apply to the sale or transportation of such rifles and shotguns in interstate commerce. If a state or local registration or licensing requirement is determined by reference to the NFA, the bill treats persons who acquire or possess a short-barreled rifle, short-barreled shotgun, or other weapon in accordance with the Gun Control Act of 1968 as meeting the registration and licensing requirements. The bill preempts certain state or local laws that tax or regulate these rifles and shotguns. The Bureau of Alcohol, Tobacco, Firearms and Explosives must destroy records relating to the registration, transfer, or manufacture of applicable weapons described by this bill within one year after the enactment of this bill.
